Ticket Prices may exceed face value.”Our customer has expressed concerns regarding their order, to which we would like to address. Our customer confirmed their purchase on 8/2/2018 for four tickets to Wicked that took place on 1/28/2018. They were then notified via email that their tickets were expected to be emailed to them on 1/21/2018. We were later notified that the tickets our customer purchased were no longer available by the seller. We immediately contacted our customer on 1/24/2018, to which they accepted replacement tickets with a courtesy resolution to the matter as well.Prior to our customer’s event taking place on 1/28/2018, the seller notified us that our customer’s tickets were not able to be shipped or left at will call. This information was relayed to our customer; a sufficient resolution was also offered for the inconvenience. We are pleased to have reached an amicable resolution with our customer at this time. As we have thoroughly addressed all of our customers concerns, we consider this matter closed. transactions between ticket buyers and ticket sellers. Ms. [redacted] placed an order on 5/19 for a [redacted] event on 11/15. Ms. [redacted] valid and authentic tickets were delivered on 5/20. Noted clearly in our Terms it states, “Please keep your tickets in a safe place. We are not responsible for lost, stolen, damaged or destroyed tickets and are under no obligation, and, in many instances, are not able, to replace the tickets.” When Ms. [redacted] contacted us on 11/14 explaining she had misplaced her tickets, as a courtesy, we reached out to the seller to request a reissue. We informed Ms. [redacted] that we could not guarantee that a reissue was possible. The cost of $82 would be the cost it would take to reissue her tickets. However, as the seller was unable to honor this request, Ms. [redacted] was never charged this amount. Since our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry. Box Office Tickets carefully screens each seller to ensure the listing of valid and authentic tickets. We have attached an image of the Order Summary Ms. [redacted] stated she brought to the [redacted] to gain entry. It should be noted that Box Office Tickets did not recommend Ms. [redacted] to use her Order Summary in an attempt to gain entry into her event. As the Order Summary does not contain tickets, it therefore would not gain Ms. [redacted] entry into her event. As Ms. [redacted] Order Summary did not contain seat numbers, the [redacted] had no way of knowing which seats Ms. [redacted] purchased on our site. Though Ms. [redacted] indicated her tickets were fraudulent; we cannot validate her claim as the tickets were lost by Ms. [redacted] and a reissue was not possible. As Ms. [redacted] received her valid tickets on 5/20 prior to her event on 11/20, we consider this matter closed. Box Office Tickets maintains that our checkout process--throughout which all prices, fees, an interactive map, and the total for Mr[redacted] order were shown--was sufficient opportunity for him to review this information. After being shown this information, Mr. [redacted] proceeded to enter his payment information, checked the box to accept our Sales Terms and Conditions and agree that all sales are final, and then submitted his order. The order summary email Mr. [redacted] received after placing his order reconfirms the selected row was AA. As Mr. [redacted] received the valid tickets which he selected, and they provided him entry into his event, we consider this closed and have fully adhered to our Sales Terms. are intentionally different from those of any other site. Directly on our website it states “We are a resale marketplace. This site is not owned by any venue. Ticket Prices may exceed face value.” Since customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry. Mr. [redacted] mentioned that his tickets differed in price from their primary-market, or "face," value, it should be noted that this is a common occurrence in our industry. Box Office Tickets operates on the secondary market, meaning that all tickets available for purchase on our site are owned and priced by individual ticket sellers, rather than by our company. These prices are set at the discretion of the individual ticket sellers—not by Box Office Tickets—based on their assessments of various market factors such as customer demand. This information is presented at the top of every ticket listing page on our website, as well as during checkout stating “Prices set by sellers, may be over face-value. Box Office Tickets not owned by any venue. All seats together unless otherwise noted.”On 6/27 Mr. [redacted] viewed tickets for a [redacted] event on 11/11. The specific tickets Mr. [redacted] selected were listed at $180 each. When Mr. [redacted] selected his tickets, he navigated to our checkout page. From there, he was directed to review the itemized order breakdown, which clearly displayed the price per ticket, all fees, and the total price of $928.55, not $1,500 as Mr. [redacted] stated, in bold text. Mr. [redacted] was required to agree to our terms and conditions—visible in a text box—and presented with the message in bold, “All sales are final.” At this point, Mr. [redacted] was also presented with the message “I agree to the sales terms and conditions above,” and a check box that needed to be selected in order to continue with checkout. As Mr. [redacted] mentions, in addition to this current claim, he has also filed a dispute with his credit card company regarding this order. We have addressed this, and the dispute was ultimately ruled in our favor. Prior to receiving any dispute we did offer a resolution to Mr. McClure, stepping outside of out Terms and Conditions agreed upon at checkout, however Mr. [redacted] declined this offer. I am rejecting this response because:  This event was NOT sold out  There is no acceptable reason for a huge successful company like Box-Office Tickets to let this happen   I believe that this was a human error, not because there were no tickets available   I purchased these tickets 5 months in advance, paid over $1000 for them   The woman who called me 2 hours before the event was supposed to start was very apologetic and she had no idea how this could have happened.  All I want is for the company to turn the $250 store credit that Box-Office Tickets gave me as an a apology into cash

Thank you for your response. Though Ms. [redacted] continues to press forward with this matter, Box Office Tickets maintains that all pertinent order details are shown to customers prior to checkout.  As we have previously clarified, the venue did not deem the seats Ms. [redacted] purchased as obstructed view, thus did not print this on the tickets that were provided to our customer by the seller. Since these were not deemed obstructed view, such inaccurate disclosure was not provided. Though Ms. [redacted] has indicated that she spoke to a customer service agent who misrepresented themselves as a manager, this should be noted as inaccurate. Our records indicate that a customer service manager reached out to our customer to provide clarity to her concerns and to offer a resolution to her matter, to which Ms. [redacted] declined. As it presently stands, we consider this matter closed. Since we operate on the secondary market and are not owned by the venue, all tickets available for purchase on our site are owned and priced by individual sellers. These prices are set based on the assessments of various market factors such as customer demand. Directly on our homepage it states, “We are a resale marketplace. This site is not owned by any venue. Ticket Prices may exceed face value.” Upon selecting the tickets she was interested in, Ms. [redacted] was directed to a checkout page where our complete terms and conditions are listed. At the point of purchase, it is stated in bold letters, “All sales are final. All prices are listed in US Dollars (USD)” to which she selected a check box agreeing to the terms and conditions, and placed her order. Ms. [redacted] also stated that she thought she was purchasing through the venue directly. However, our web address Box-OfficeTickets.com and branding are intentionally different from those of any other site. Box Office Tickets has no affiliation with the venue as we are simply a marketplace for tickets. At the top of every ticket listing page it states, "Prices set by sellers, may be over face-value. Box Office Tickets not owned by any venue.” Additionally, the checkout screen Ms. [redacted] viewed reiterated the same information for her to review at the time of purchase.  As this information was provided to Ms. [redacted] prior to placing her order and we have adequately addressed her concerns, we consider this matter closed.
