My question is, if their company does not quot a price without weighing the goods, why would they quote a price against their policy. Is their focus only on the non-refundable deposit?  How many times have they done this to other victims, and is this why they shut down in the city of Hurst and reopened in Arlington?Our company bases estimate off weight.  When you spoke to Alicia and she took your list of items she estimate the weight of your shipment based on that list given to her.  When the foreman showed up the items you wanted moved were different than the list given to Alicia.   The based on the walk through the foreman estimated an approximation of what the difference would be.   The truck could have been taken a certified scale to be weight after your items were loaded for an exact weight.  According to the foreman you chose not to have Condor pick up your items therefore we did not.   Our clients are not victims....we are not in the business to scam customers our we were upfront with you from the beginning regarding the additional charges as well as the non-refundable deposit.     Condor has never been shut down we moved from Hurst, TX to Arlington less than 5 miles away to a new facility.    I need more answers from your business associate, in fact I need my money refunded.Mr. Kingsley our contract was clear regarding the deposit Im sorry you feel otherwise but we will not be refunding the deposit.  Thanks,Kingsley Otaluka From: Nisrine Gal <[email protected]>Sent: Monday, August 29, 2016 1:24 PMTo: kingsleyCc: Sweetie; Alicia Beamon; Jesse Valdez; Dorothy BrooksSubject: Re: The nightmare of my move  Dear Mr. Kingsley, That you for your feedback regarding your experience with Condor.    The 10% deposit is non-refundable because we reserved space on the truck,  had crews come out to your home to pack and load your household goods as well as and incurred fuel and transportation cost to dispatch a truck from our Arlington, TX warehouse to your home.  Our crews are required to let you know pre-loading of any additional charges so we are not packing and loading  the truck to find out that you cannot afford to pay the additional charges.   Im sorry that you feel that we were not being upfront with you but the foreman saw a significant difference from the estimate Alicia gave you versus what was at your home.   In the transportation industry sometimes we have unforeseen things that can happened that can cause driver delays as in your situation and again Im very sorry that happened it was defiantly not intentional.   In regards to the cubic feet our company does not charge by cubic feet all charges are based on weight.   The driver may have told you preloading that he used the cubic foot method to get the weight which is common because he can scale the goods off while in your home.   I hope I have addressed your question in regards to the weighing.  Condor received a chargeback from our merchant processor and which we responded to in regards to the disputed deposit.  Your bank initially refunded you until they received our response.  We cannot charge you again as we do not have your credit card information on file.  Our system is encrypted once its taken we can not access it again.    Your bank more than likely denied your dispute because our paperwork is very clear that the deposit is non-refundable.    I have attached the estimate you signed as well as the credit card receipt for your review.  Please look at number 9 on the terms and conditions and the description on the receipt that was emailed to you.    Again Im very sorry that you were not pleased with our service; if you have any further questions or concerns please do not hesitate to email me at your convenience.   Best Regards,Nisrine Gal Director of Accounting/SalesCondor Moving SystemsTelephone: 817-701-1580 ext. 203Fax: 817-701-1585   From: kingsley <[email protected]>Sent: Friday, August 26, 2016 10:23 AMTo: movers; Alicia BeamonCc: SweetieSubject: The nightmare of my move   To whom it may concern,In the month of June 2016 I contacted your company to move my household goods from Texas to New York and agreed to pay $4099.61 for the service, after we have completely detailed every single item to be moved for me. I paid $409.96 which is ten percent (10%) of the service upfront. On the day of the move, June 27th 2016 your company did not show up, and called a few of hours before to say that their truck was in an accident. This alone caused me so much inconvenience and money because of the re-arrangement of move related travel I had to go through.  Dispatcher rescheduled for the next day June 28th. The driver came and decided that he will load my goods in the truck and then weigh it to tell me how much I will have to pay, because he said the quote was not right and that it is against their company policy to quote price without weighing the goods, which I previously asked the sales agent Alicia Beamon about during my negotiation with her, and she repeatedly said that they go by cubic feet and that was the reason we have to inventory my goods in details. Because I have no idea if the move will still be affordable to me after is been weighed, I asked the driver to not load the goods, so he left. A few days after, I contacted Condor Moving Systems to refund my $409.96 and the agent said okay, that will take 48 hours. A week later when I didn't see any refund, I called my credit card bank to help with the refund, and the bank gave me the money back until Condor Moving Systems started to file claim that it is a non refundable fee earned without providing the service. So the bank now charged the amount to my account again.  Condor Moving Systems declined to provide the service they agreed to at the said price without any discrepancy to the itemized goods to be moved, and therefore did not earn the $409.96 fee I paid. I am ready to file a claim with TXDMV  and beyond soon unless this is resolved by your company within reasonable time. Please would you acknowledge the receipt of this email, and forward to every responsible party accordingly.  Thank you for you assistance in this matter. Regards, Kingsley Otaluka

I have attached your agreement with some highlighted sections pertinent to your inquiries and concerns. Included in the attachment are your delivery documents containing your signature that the shipment was received in apparent good condition.   There are no notations on the inventory list at the time of delivery (attached) as to any missing or damaged items. Your signed agreement (also attached) does specify further- any and all -exclusions with regard to your claim- I have highlighted some specific areas for reference.  All claims are final however out of good will we did offer $950 towards your repairs, less your deductible of $500 totaling $450 of which you have not accepted as of yet.  Your signed agreement details the service we provide, exclusions, etc.  Please refer specifically to number 11 & 12 regarding rescheduling and pick up/delivery times.  With regard to the shuttle (number 8 in the agreement) there are different size cabs and trailers on 18 wheelers- a few feet difference can make the difference between a driver being able to access a street or not.  $750 is not worth the additional labor and time it takes to perform a shuttle for it to be an unnecessary service; hence we would not have required a shuttle if it were not absolutely necessary. If the plastic bin containing your items broke and the crew placed them in a box for safe transport and did not charge you it was out of courtesy as some of those plastic bins are not durable enough to take the weight of other boxes stacked on them as they would be during an interstate relocation. [redacted] has hauling agreements with owner operators, it is not “brokering” as they uphold our terms and conditions and represent [redacted] when transporting our customers belongings.  This is a very common practice and carries no violation with any organization. Signing the release to receive the $450 is in no way silencing you, again, we would never request that and have no way to control your actions online or otherwise.  It is a generous offer for the damage you claim was sustained during your relocation.  The release is to protect [redacted] from further financial obligation in this regard.  I have attached the release again to reference.  [redacted] has been in business for 15 years, we offer a good service and are a good company.  I regret that was not your experience and hope you will accept the $450 resolution and sincere apology for any inconvenience.    Tell us why here...

I am rejecting this response because: no shuttle was used. Photo was sent to [redacted] showing other 18 wheeler in lot at an apartment beside mine unloading. Lame excuse for bad driver skills. I had already filed claim as requested on 08/02/2016. Now filing additional claim form requested by [redacted] that will arrive Friday, 03/31/2017

I am rejecting this response because: the invoice I just received by email still includes a storage fee when my contract and initial quote offered free storage. No dates are included nor was I notified on the days the storage rates would start and stop. My freight bill also states I already paid for my items being overweight by 300 pounds so the amounts still don't match and today is the first. My VA legal aid rep will be contacting Condor today to record and forward the conversation.
