Contractor installed Marmiline in shower, 7 weeks after completion it has white spots in the gray material.
Contractor blames Calcium in water for white spots, however he didn't test water but I did and my water has 0% of Calcium in water. Material was suppose to be sealed before and after installation. I was present when all Marmiline was delivered and the day it was installed in still had plastic around it. I watched them cut and install the Marmiline so I know it never was sealed. Due to that the product has developed white spots. Contractor gave me the information on how to clean and seal the product myself after he saw the defective material. I feel that's his responsibility after being paid $33,000.00 for this remodel. The contractor told us last day of project he is responsible for 1 year after completion however he isn't living up to that.

Desired Outcome

I would like for the contractor to replace and seal the damaged Marmiline as well as seal all the rest oof the Marmiline in the shower.

Custom Kitchen & Bath installed the product (Marmiline by Anatolia Tile of Canada) per the customers request.
I purchased and sealed the product twice with *Fila MP90 as was approved and suggested by Louisville Tile of Evansville. The Customer was not present when the product was sealed or installed. My son was the one who sealed it per our discussion about the suggested installation procedures of the material.
When the customer texted me about the complications with the product, I promptly replied and scheduled a time to inspect it. After looking at the product, I asked the customer if any cleaner was used and her reply was "I only use water to clean with".
I explained to her that the product was sealed twice and she had a receipt for the sealer; Fila MP90 used. She again continued to say that I didnt seal it. I informed the Customer that I would contact the manufacturers of the sealer and product and I would forward that information to her.
While waiting for the manufacturers to respond after several emails and calls, she text me and said; "if something isnt done in a short period she would seek legal advice". Obviously that doesnt speed up the time it takes the manufacturers to respond. I met the Fila rep at a Tile seminar and explained how long I had been waiting and he offered to take the Marmiline back to their lab and test it. After testing it, they established that it was from calcium in the water and provided a cleaning method of which I forwarded to the customer. I also contacted the water company about the conclusion related to the calcium. The reports attached indicates the level of hardness and calcium in the water.
With the information provided by the manufacturers of the products used and the water company, it is not a problem associated with the installation.
I feel that I have been very diligent in my pursuit to resolve her problem with the product.
The customer should use the suggested cleaning method supplied by the manufacturer and sealer company.

(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept response. I do not work outside the home and I was absolutely home when material was delivered and installed. It's a family business and of course his son is going to say he sealed the Marmiline, but it wasn't sealed. If he sealed it twice, why would one more time make a difference. According to the manager at Louisville Tile they sell a lot of this product and this is the first time having trouble with it. No consumer would install a product that had to be sealed every 7 weeks nor would a business sell it. I have every text and email from the first day I reported the problem to the contractor and in a text contractor stated he would come look at it and make an appointment to come clean and seal again hoping that would resolve problem so he wouldn't have to rip out the shower. When I told him I would not be out any more money he changed his approach and told me how to clean and seal the Marmiline. I base the Calcium levels in my water by a printed test result, not on what someone figures we all have in our water. I have a new water softener that removes Calcium from my water. I did have a consultation with an attorney and this was the recommended step to take however if we can't resolve this problem there is a second suggestion which I will take if necessary.

In resonse, The product was sealed and tested by the company that makes the sealer, the minerals/calcium in the water are reacting with the stone and the sealer per the info forwarded to the customer. the cleaning procedure was supplied to the customer as well as the water quality report.
Therefore my last response still stands.

I want to re-iterate this first.
1.) I installed the "Marmaline" stone product according to the Mfg specifications. The product was used for wall caps, curb, seat, and a shelf in the shower.
2.) I obtained info from the product mfg. as to proper cleaning & sealing and passed that along to Mrs..
3.) I met with the sealer ( FILA ) mfg. and they took a piece of the product to their plant and tested it in their lab and determined that it due to mineral/calcium
from the water and gave instructions for cleaning and sealer which I passed on to Mrs.
4.) During the search for info, Mrs. threatened legal action because it was taking too long. My attorney stated it was not my problem and I should not
contact Mrs.. She said I did more than I needed to by obtaining the info and requested testing.
5.) I even contacted the water company and submitted a report of the chemicals and minerals/calcium in the water which was significant.
6.) Mrs. claimed she tested and had no calcium in her water........We both know that isnt possible.
7.) I even purchased a piece of Marmaline, sealed it and a week later sprinkled a little water on it and 4 days later it showed spotting just like Mrs.
8.) She claims to have a new water softener which she didnt have when we were working there because they were talking about possibly installing a filter and softener at a later date. When I tested the product at home, I have a filter and softener.

It is unfortunate that she is having this problem and even though if it were cleaned and resealed, it would do the same thing, however, I spoke with my Attorney after you called yesterday and let her know that I would like to try and help Mrs. with her problem even though I am not obligated to do so. I would only provide labor to remove the Marmaline and replace with a different stone or tile that doesnt have to be sealed.
My Attorney outlined a process:
A.) Mrs. would have to sign an agreement stating that I was doing so as a "Good faith gesture" to help with her problem. and I would not be held liable for any future problems associated with the shower or the materials used.
B.) She would have to pay to remove and re-install the glass from Service Glass Co.
C.) She would have to pay for any new materials needed for removing & re-installing.
D.) It would be done according to my schedule since there is only two of us and I already have jobs scheduled.

If Mrs. agrees to this then I would like to help her with her problem. If Mrs. is interested in fixing her problem, even though I am under no obligation to do so, this is what I am willing to agree to and with no deviation from the outlined process stated above.

failed to provided Architectural rendering of kitchen remodel project as agreed, then refused to refund the paid full price of $500.00.
Paid *** $500.00 by personal check on 3/9/19, for a full architectural design/rendering of kitchen remodel. Even after several contacts *** still has never provided the design drawings and has refused to refund the $500.00. He came by my home one day on or about April 6,2019, claiming to want to show progress on the design/rendering but was unable to operate the software program he had. Has never returned as promised and still has not delivered drawings after several emails and text contacts. Finally, I have requested a full refund and he has not provided a refund and still no rendering.

Desired Outcome

Full refund of $500.00

The *** were living in Tennessee and have a house in Newburgh their children live in. I met with them on a few occasions. Once to discuss design, another to review the design, which we reviewed the design. She arranged a meeting with a HVAC contractor to establish the possibility of moving duct work to accommodate the design they wanted. They contacted her. The HVAC contr. proposed having a plumber assess the problem. The HVAC contr. also stated he wouldnt be able to do the work until the end of summer. *** of *** Plumbing was going to contact her to set up a meeting. I did charge them $500 for a kitchen design & detailed estimate for which I offered to refund if I received the job. I did design the kitchen, and the 3-dimensional rendering program wasnt performing correctly but the actual floor plan was shown to the *** and we discussed each cabinet.
I agreed to meet with them again to supply them with all of the designs and renderings they paid for and I was awaiting their call to arrange a time when they were coming back to Indiana.
She didnt. Apparently she thought I was going to contact her. She text me on June 6th and said she wanted her money back. I contacted her and let her know the communication problem and I would be happy to drop off their designs and estimate but she only wanted her money back.
I spent 4 to 5 hours meeting with them and about 10 hours on their designs. I offered to supply her the designs she paid for but she didnt want them. As far as I know, their isnt any returns for labor acquired. However, I would be willing to either offer her the designs she paid for or $300 which doesnt even cover a 1/4th of my time. Please let me know what she would like to do. Thank you.
