Review: My husband and I signed a contract with CVA Builders, LLC under Lockridge Homes on February 17, 2013 to build us our new home in Louisa, VA. We paid cash for the house and were told that the house would be built within 4 months. Work on our driveway didn't even start until June 2013, four months later, and a culvert pipe was installed incorrectly across the creek along our driveway. The pipe was not properly installed with rip-rap around the pipe to prevent erosion. The pipe was also damaged in the process of putting it in, as a large rock dented the pipe when a heavy truck ran over it while being installed. The dent has gotten worse since last June, with the damaged area sinking in by a few more inches in the last few months. I have been going back and forth with Lockridge Homes/CVA builders since the pipe was installed and I have been given every excuse in the book as to why they will not replace the damaged pipe. As per my builders instructions to have someone official go out and deem the pipe needing to be replaced, he said that the company would replace said pipe. I had the [redacted] to go out and take calculations of the pipe, as well as an inspector from[redacted] to inspect the pipe. Both officials stated that the pipe is not only damaged, but it was not installed properly, and is only half the size that it needs to be for a creek as large as the one we have. I did what my builder said to do, sent them all of the information, and now they are refusing to replace the damaged pipe. When I signed my contract with Lockridge Homes/CVA Builders, I paid for a new, un-damaged pipe that I thought would have been properly installed. Now they won't even rectify their mistake in correctly placing a new, un-damaged pipe in at the creek. Lockridge Homes/CVA Builders did all of our site work, and they damaged the pipe themselves, so they should have to hold up on their end to install a new pipe that is large enough to accommodate the water flow, and install it properly.Desired Settlement: I did what I was told by the builder to do in order for them to replace the damaged, incorrectly installed pipe, and Lockridge Homes/CVA Builders should have to honor their word and install a new, un-damaged culvert pipe across the creek that is up to code with the water flow. As it is now, the culvert installed is dangerous and could wash out at any time because it cannot accommodate the water flow underneath, and the erosion has already deteriorated the driveway at the culvert.

Response:

In doing some research on Complaint [redacted], I have attached the contract with the [redacted] and highlighted here what the signed contract states in regards to all site work items – like installation of a drainage culvert pipe.

Per our contract this complaint should be directed to the installer of the pipe. “Contractor does not warrant any of the Schedule “B” items as warranty would be the direct responsibility of the vendor of such service.”

As mentioned in Section 1 (b) of the contract (attached) Owner shall complete all necessary pre-construction site work to Contractor’s satisfaction, obtain all necessary municipal construction permits… within ninety (90) days of execution of this Agreement.

Section 1 (c ) discusses that contractor shall complete construction of the Improvements (house) within 180 business days from commencement of construction, which commencement shall occur within 30 business days following Contractor’s receipt of written notice of completion of all required site work.
