The amount that they claimed were “service fees” during the period of 90 days (in spite of telling us that our account had been closed”) is not enough to go to court. Review: Credit card processing charges after transfer. The business was sold the buyer wanted to keep the credit card company, They call to transfer the account . Everthing went fine I thought until I started getting charges on my account with no services. When I called the last rep I spoke to said basicly that I didn't take care of it 3 months ago. It has been 3 months that I shouldn't get back my money.Desired Settlement: Refund the charges they made for no services

We are closing consumer's merchant account, consumer will no longer be billed, and we are refunding total of $309.34 for May and June statement fes. Consumer did process transactions in the month of April, April statement fees cannot be refunded.

Review: The company charges an annual "PCI Compliance Fee" of $185 at the end of June/beginning of July. On June **, 2013, well in advance of this charge date, I contacted Cynergy Data at their Customer Cr, ###-###-####. Their Cancellation Dept. is at Prompt No. 5. That prompt takes you to a voicemail system--I tried several times, and each time was immediately dumped into voicemail. I left a detailed message, including our full Merchant ID Number, [redacted], and asked for immediate cancellation of our merchant account. I also left my cellphone number for confirmation. No one ever returned the call, no cancellation was provided, and our bank account has now been debited both the usual monthly charge and the $185 PCI Compliance Fee, for a total of $231.90. We seek a full and immediate refund of this amount, please confirmation that the merchant account has been cancelled.Desired Settlement: Full refund of $231.90, representing the monthly merchant fee and the $185.00 PCI Compliance Fee.

Review: I got charged 199.00 from Merch Svc on July [redacted], 2013. It was for PCI, and my business doesn't require PCI. I got charged the same fee a year ago, and called them so many times, and got the money back a year later. And I got charged the same fee again. I called them, and was told that they would reverse the fee. I do have all the text messages from the sales person from the company. I am extremely mad, and really want my money back.Desired Settlement: Please refund the fee as soon as possible.

This business SUCKS! They are expensive, arbitrary and unfair in their practices. I have been a customer for over 5 years yet, (long story), when THEY mistakenly charged my checking account for a charge reversal instead of freeing up the money they were holding in escrow, they refused to take any steps to make good on the mistake. Their contract contains numerous "hidden" clauses that they use to pummel a small business into submission. How would YOU like to have 9,000 dollars in charges held for "additional verification" in less than 4 months??

Review: I originally contracted credit card services with [redacted], who apparently sold my account to Cynergy Data in May or June 2013. I was charged a PCI compliance fee without notification and my other fees change dramatically. After numerous phone calls and emails I was able to cancel my account and they sent a check for $90 to offset higher fees. They have not refunded my PCI compliance fee and have refused to do so - $129. And, they have not picked up the terminal that was loaned to me during its use. They referred me to a salesman who no longer works for them because they did the same thing to him.Desired Settlement: Refund $129 PCI fee and pick up the terminal asap.

Review: In August-Sept. of 2012, I was called numerous times by [redacted] from EMS (Everett Merchant Services) taking alot of time out of my day promising better credit card processing rates. After many many calls by [redacted], I finally agreed to change over. I was told by [redacted], that it would be a seamless conversion and she would be with us every step of the way. It would all be "behind the scenes." The new processor had no "junk Fees"( such as PCI Assure) like the processor we were using was charging us. I signed the contract and that was almost the last phone call she ever made to us. As I was helping my son, balance our check statement, there was a charge of $10 (GCF-Govenrment Compliance FEE) from BKCRD FEES MERCHANT SERVICES Alias Cynergy, I called and left many messages before I finally got in touch with [redacted] and was told that we shouldn't have any fees and she would take care of getting it credited back. In speaking with her I had also asked once again about a letter we recieved from PCI Assure about a quarterly fee. I faxed the paper to her on 10/**/12, Once again she reiterated that it was industry standard and there were no such fees from Everett Merchant Services. On Oct. **, 2012, our account was credited the $10. I thought the problem was over and she would be taking care of the rest of the process. My son continued to balance the bank statements but didn't mention to me that we continued to be getting charges from BKCRD FEES MERCHANT SERVICES (Cynergy) On 11/*/12, there was an EFT of 159.00, 12/*/12-EFT 60.00, 1/*/13 an EFT 60.00, 2/*/13 an EFT $60.00, 3/*/13 an EFT $60.00, then on 4/*/13 an EFT $99.00 totalling 498.00. Some of the charges had been called to my attention and I would call to speak with [redacted] but she never called me back. I called and called but to no avail. I called in Sept. Oct., Nov. 2012, I also sent a FAX on 3/**/13 for her to call me since I was unable to get thru to her by phone. There were no return calls. I had once gotten thru to a guy with a # [redacted] who was very rude and hung up on me. At one point, I had talked to someone from Cynergy who sent me a form to cancel their service. I had been assured by [redacted] that she would make sure everything was taken care of so I didn't send it in, this was when I had just gotten to speak with her. I finally got to speak to someone called [redacted] at Cynergy Data in March of 2013. She actually listened to the issues and put in a request to refund all charges at that time. She couldn't promise that is would happen but was sending confirmation # [redacted] for review and to call back the next week. . She thought that since the very first charge was credited by them and no credit card was ever processed by them that the charges would be returned to us. Once again the phone calls with no returned calls started. I called on 4/*/13 and 4/**/13 leaving messages to please return my call. I called once again on 5/**/13. I had also spoke with a [redacted] who stated, there should be no charges since we were unable to process at all. She sent in a confirmation #[redacted]. When I was finally able to get ahold of [redacted] again, she transferred my call to [redacted]. [redacted] informed me that my claim was denied because I had not sent the paperwork in to cancel the service when I had spoken with the guy earlier. Once again, I didn't send it because I was being told it would all be straightened out in the end. Let me reiterate, THEY NEVER PROCESSED A SINGLE CREDIT CARD FOR US, the charges were only their fees. I finally decided it was time to send the form to stop the charges! Thinking it was done, the very next month I get another $99 EFT charge from them. This time when I called to ask about it, I am told that this one was for the previous month from the time I had sent the cancellation notice. OH boy, they don't ever give up ! After not getting anywhere with [redacted] by pleading my case. She told me they no longer work with EMS. I decided to take the issue up with EMS. I hung up, dialed the EMS number, went through all the press this number for, press that number for..., and lo and behold, who answers the phone???? [redacted]! The same [redacted] that I had just spoken to. What a small world. After many excuses and to no avail, I hung up, very upset that they were not going to refund their charges. I really didn't know where to turn. So, on July **, 2013 I receive a collection letter from NCO, Cynergy has turned us in for collection for $124.00 from a February **, 2013 charge. I have no idea of what we might owe them for since they had no problem taking money by EFT out of our checking account since October 2012. I called the collection company to dispute the charges and they were going back to Cynergy for the detail of what the charges were for. I cannot believe a company is allowed to stay in business when they do business like this. We have been in business for almost 60 years and sure wouldn't have our doors still opened had we run into companies like this. They never provided us with any type of service. It would be like getting a car payment book and never receiving the car.Desired Settlement: I want my $498 dollars returned to our account and to be taken off their collection list for a $124.00 charge that I have no idea what it is.

We have waived the -$124.00 owed, and we are refunding all charges that were successfully debited from consumer's bank account. Total refund due of $409.00, from all fees charged from September of 2012 to February of 2013. March fees of $99.00 rejected, this $99.00 fee that rejected caused the balance owed of -$124.00, which includes a $25.00 reject fee. Refund is being mailed to address in complaint which is the same address that we have on file, unfortunately we cannot refund to consumer's bank account due the merchant account being closed. Please allow 10-14 days for refund check of $409.00 to be received.

The check for $409.00 is correct due to the following which was explained in our first response:

Date of 4/*/13 shows charge of $99.00, this is the negative balance of -$124.00. The $99.00 fee rejected from consumer's bank account, and includes a $25.00 reject fee. Total comes to -$124.00, which has been removed from collections. Attachment is showing $0.00 balance owed.

Total refund requested in original complaint is $498.00 minus the $99.00 which rejected, (we cannot refund a fee that was never deducted). The reason we did not refund $399.00 (and did refund $409.00) which is the original amount of $498.00 minus the $99.00 rejected fee is due to consumer was also charged $10.00 on October [redacted], consumer did not state this amount, but it was deducted from consumer's bank account. We added the $10.00 to refund. We have refunded every fee that was successfully debited from consumer's bank account. Consumer can verify their bank statement that the $99.00 was not successfully deducted, bank rejected this fee.

Review: Joe W[redacted], the rep from Cynergy, presented the Cynergy proposal for credit card processing. He explained the basic fees and payments. [redacted] signed a hand written, preliminary contract on 1-**-15 with a written stipulation that the agreement would not go into effect until 2-*-15 at 11:59pm. [redacted] requested a full, detailed contract with all items printed completely. Upon receiving this contract and reading it thoroughly, [redacted] decided not to enroll with Cynergy. An email was sent to Joe W[redacted] on 2-*-15 at 3:31pm advising him that [redacted] declined the service from Cynergy and to destroy all information given to him regarding [redacted] Unlimited. On 2-*-15, Joe emailed and asked why. On 2-*-15, [redacted] emailed a list of 25 reasons that the contract was unacceptable.

On 2-*-15 Cynergy took $40.00 from [redacted] Unlimited checking account. On 3-*-15 Cynergy took $22.00., on 4-*-15 Cynergy took $22.00 and on 5-*-15 Cynergy took $207.00. The first amounts went unnoticed because they were small but the $207.00 on the May ** bank statement was a red flag. [redacted] spoke to the bank and was told he has to deal directly with Cynergy.

[redacted] emailed Joe on 6-**-15, called both his phone numbers on 6-**-15, called the main office number on 6-**-15, called Joe on 6-**-15, called the main office on 6-**-15 and sent Joe an email on 6-**-15. There has been no response at all.

The formal agreement was never signed by [redacted] and was declined before the agreed upon date.Desired Settlement: [redacted] Unlimited, [redacted] Gunther, wants a refund of $291.00 which is the total amount that Cynergy took from the checking account.
