Review: I own a skincare business Sensational Skin. My merchant services are with Cynergy Data and every year I have to be in PCI compliance or I am subjected to pay a fee of $185.00. I did my compliance through a 3rd party and emailed Cynergy when I had completed the compliance on 05/**/15. I verified through an email they received everything they needed not to charge me the $185.00. I received a letter in the mail about the PCI Fee. When I called them on 07/**/15 I was told by [redacted] a rep that I was in compliance and that I would not be charged. I explained to her they did the samething last year and I don't have the extra funds in my account to cover it. On 07/**/15 I was charged $185.00 which then in return caused me NSF fees of $216.00. I have called and emailed for the last week with not one return call or email on if they were going to refund me these charges back. Finally today the customer service rep told me they would refund me the $185.00 but not until 07/**/15 almost 3 weeks after they took it out in error. They also said they wouldn't refund me the NSF fees of $216.00 even though it was there error which caused by checks to bounce. I sent an email to the supervisor today [redacted] and asked for a return call. But again no email or call. I should not have to fight this hard to get me money back when I followed everything they asked me to do to keep the fee from being charged. This is the 2nd year in a row this has happened. this company thinks because they are so big they can make up the rules as they go. I want my $401.00 refunded to me immediately. No one should be subject to this type of behavior. They are providing a service. I have also asked for a complete copy of my contract and have not received that either.Desired Settlement: For the company to refund me $401.00 bank into my bank account immediately.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.

Sincerely,

Review: I have been billed a total of $453 in inactivity fees from November, 2015 to February, 2016 by Cynergy.

This is a multi-use machine with 3-4 other practitioners on the terminal, so I am assuming that they have all been paying inactivity fees also.

Unbeknownst to me our old merchant was never cancelled through Elavon/Costco and all of our credit card charges were still going through that system, hence the “no activity” on Cynergy.

Apparently, one of the practitioners never filled out the Cynergy paperwork, so although Cynergy was “activated” the old merchant was never closed down.

This was an unfortunate error and completely out of my control, as far as I knew we were using Cynergy but I got concerned when these increasingly high bank fees were charged to my bank account. I phoned and found out they were inactivity fees from Cynergy.

I faxed Cynergy my cancellation and asked for the inactivity fees to be refunded. I have heard nothing.Desired Settlement: Refund of inactivity fees by Cynergy to the total of $453

Review: My company uses a credit card processing company known as Lucy Gateway by Cynergy Data, Lucy/Cynergy processes our customer credit card transactions through CTS Holdings who is also known as First Data and Priority Payments. On 12/*/15 we contacted Cynergy regarding our funds not being deposited into our business bank account totaling $6,389.43. We were told that the deposits were missing but after 1 hour of holding, no one returned to the phone line. On 12/**/15, we again contacted Cynergy to find out where our money was and was told we need to speak to the business support center but no one was available at that time. A ticket was issued and we were told we should get a call back within one week but no call was ever received. On 12/**/15 we received a statement from CTS Holdings showing very large fees. We called CTS for an explanation and was told we need to speak to Cynergy Data. Called Cynergy and was told that First Data flagged our account for security risks and the funds were being held "somewhere in the backend." The Cynergy CSR said the director was going to review it but the money was being held for a "vague 2013 collection matter." We have used this company for several years and there are no 2013 collections. On 12/**/15 we made another call to Cynergy and was told that our account was transferred to the risk department so I was forwarded to someone's voicemail where I left 3 messages with no return call. Called Cynergy back the same day and this time was told that we need to speak to the collections department bc they could release funds, not the risk department. The CSR said it was in the process of being resolved and to check back in 2 hours or the money should be in our account the following Monday. Later that day we received a call saying that our bank needed to fax them a letter, saying there were no holds on the account, then they would be able to begin putting the money into our account. My banker said this was absurd since the bank does not require anyone to be authorized to deposit money and he did not want to write such letter. On 12/**/15 called Cynergy again and was told that the "HOLD" was being accessed through First Data. Received a call on 12/**/15 from an investigator with Priority Payments who does the processing for First Data who said our info needs to be updated with customer service with a bank letter. She also said a ticket was entered and someone should call me to explain the large fees on CTS Holdings statement. We filed a complaint with the NC Dept of Justice on 12/**/15 when they sent a letter to CTS Holdings. To date CTS has not responded to our complaint. On 2/*/16 we attempted to contact client services at Priority Payments who placed me on hold and attempted to conference in First Data but came back to the line saying our account experienced a Federal Clearing House violation and the violation was due to rejections from trying to debit funds on 11/**/15. The CSR said the account is now closed. I further discussed this matter with the representative and emailed her copies of the statements for explanation. She said she would review and call me on Monday, but no call. On 2/**/16 we called the CTS number provided by Priority Payments and was told they show rejections for deposits being made into our account on Nov [redacted], 2015. Said they cannot discuss fees with us that only Cynergy can. Call to Cynergy who said the account was open but First Data put a hold on it and they were the only ones who could release the funds. Asked Cynergy CSR for explanation of fees, placed me on hold then hung up on me. Called back, Cynergy CSR said First Data is holding the funds so they cannot see the fees. I explained that I have been told since Cynergy is our account manager that they are the only ones who can explain fees. To date, we have not received a reasonable explanation of the fees as shown on the statement and First Data is not attempting to release our funds of $6,389.43 to us.

** This same complaint was also filed against First Data Merchant ServicesDesired Settlement: That the money owed to our company in the amount of $6,389.43 be paid to us and deposited into our account or a check sent to our address.

Response:

At this time, my complaint, ID [redacted] regarding Cynergy Data, LLC has been resolved.

(By clicking "OK", your complaint will be closed as Resolved.)

Yes, they have contacted us and the matter is resolved. The company still cannot provide an adequate accounting of their charges and an explanation as to why they kept our money for over 90 days, however. The amount that they claimed were “service fees” during the period of 90 days (in spite of telling us that our account had been closed”) is not enough to go to court. I am just happy to have them out of our lives. Thanks for your help. Just your involvement gave us a name and phone number of someone who had the ability to do something about it finally.[redacted]Sincerely,[redacted]

Review: This company sent us to collections without ever attempting to contact us to let us know that we had an outstanding balance. We were never contacted with an invoice. We were never informed that we were about to be sent to collections.Desired Settlement: Cynergy Data needs to tell me what my balance is prior to any late payment penalties, close my account, and stop the collections process.

Response:

I don't agree with the charges and need explanation from company on their attempts and pass charges to my account.

Review: I signed a contract with [redacted] Services (over four years ago) who then contracted with Cynergy Data to process the credit card payments we receive from our patrons. I was issued a "lifetime guarantee" regarding the rates I am charged, but Cynergy has been charging me almost double that rate. I contacted them on March **, 2015 and asked them to explain the situation. This was the start of over TEN weeks of them ignoring my phone calls, ignoring my emails, and refusing to talk to me on the phone. (I have this all documented.) They provided me with a bogus mailing address (the same one at least six different times) and my letters were returned undeliverable. My contract says that I have to provide them notice in writing that I wish to cancel my contract - how can I do that if my letter is returned undeliverable? So I stopped doing business with them on 05/**/15 by closing my account. On 06/**/15 they sent me an email bill for $84.08. They asked me to send the payment to the same bogus address. I agreed that I owed them $59.08 and mailed it to the address they provided - and it was returned to me undeliverable on 06/**/15. I mailed it again with a certified mail receipt and it took 24 days for the letter/payment to be signed for in Georgia (07/**/15) and they neglected to complete the portion indicating the address it was received at. Now they have turned me over to a collection agency who says I owe Cynergy hundreds of dollars - with no explanation for why and still no attempt to contact me. This is a disreputable company - why is the address on their website/the address they say to mail payments to invalid? Why would they never return my phone calls/ticket numbers/emails, etc - but instead turn me over to a collection agency. I don't owe them anything.Desired Settlement: I I want this company to acknowledge that they provided me with a bogus address and that I had no way of postal mailing them a request to cancel my contract if they were unable to receive it. I want them to cancel my contract with no penalties or cancellation fees and cancel the collection process they have begun. I want them to admit that I owe them nothing further, admit that they have received the letter of explanation & payment on what I truly owed them, and that payment was dated the day after I received the first bill from them.

Review: I have been trying to cancel this merchant account since Jan 2013. The company will not stop debiting the business bank account and has refused to cancel he account and stop the monthly charges. The debits appear each month as CTS Holdings. The merchant account was initially set up with Pipeline Data processing and I am assuming either the company has changed names or sold the account. I initially called Pipeline data processing in Jan 2013 and requested to cancel. The company continued to debit $20.95 each month. I called again in April 2013 and was told to fax in a cancellation form, which states the business name is Cynergy Data. The cancellation form required the principals signature and a copy of his drivers license. This was faxed on 4/**/13, again on 7/**/13 and emailed on 1/3/14. I have called in numerous times and am placed on hold and transferred around. Finally on 1/**/14 I called again and continued calling until I reached someone that indicated she could help. This was Whitney Adams. The email she gave me was for Calpian Commerce [redacted]. The company may have changed names again or again sold the account.Regardless all debits have continued each month from CTS Holdings all during this time at $20.95. On 1/**/14 I also emailed Whitney Adams all of the documentation I had. She acknowledge having received the faxed cancellation request 5/**/13,yet the charges continued.I requested a refund . She told me that the account would be reviewed and someone would call me back. I told her I would give her one week to issue the refund and after that time a complaint would be made to the Revdex.com and the division of consumer protection. She said the company would ACH the refund to the account. I checked the account one week later and their has been no credit issued. Instead there was one additional ACH debit for $10.00 on 1/**/14. I emailed the company again today and again requested another refund plus the additional $10 and an explanation of the new chargeDesired Settlement: I am seeking a full refund of charges made after the cancellation request in Jan 2013. I am also requesting the account be cancelled and all future debits to the associated account be stopped. I have also requested for the company to delete and bank routing and account information that they have one file for this bank account.Total Refund requested. 12 months at $20.95 $251.40 (Jan -Dec 2013) plus $10 for Jan 2014. Total refund requested $261.40.

January **, 2014

Review: We changed credit card processing companies in July 2013. We notified synergy data that we were canceling with them on July **. After auditing our account we found they had been withdrawing fees from our account for 4 months after canceling their services. We contacted them on December **about the improper charges. They disputed the fact we had canceled even though they had a record of the call, which I believe was recorded. There had been no activity on our account in the disputed time. We had a lot of activity before we called and cancelled. After reviewing the case they refunded us for 3 months of charges, October through December We were then charges again January for 89.00 after they confirmed cancellation and refunded 3 of the 5 months since we had originally cancelled. As of January [redacted]we have not been refunded for the improper charges in JanuaryDesired Settlement: We want the $89.00 improperly charge in January refunded. We also believed they owe 2 months of back charges withdrawn that we're not refunded in our original complaint after we had canceled in July. I.e. August and September

Dear [redacted],

Please see the attached response for the following complaint:

Re: Revdex.com Complaint filed by [redacted]d/b/a Allen Heating and Air Conditioning

Case No.: [redacted] Thank you,

Review: I had an account with this organization several years ago to support the taking of credit cards for the business that I had at that time. Shortly there after I closed the business and followed the process outlined with this organization including mailing a notice of cancellation services and received a letter in the mail acknowledging that the account was closed by Cynergy. So here I am several years later and I now recieve a piece of mail from a collection company (Transworld Systems Inc account number [redacted]) telling me that I owe this organization $100 and that my credit has also been affected by this obvious mistake. So the big question here is if I followed all the processes outlined at the time of closing this account and recieved a letter telling me this, why do I now see this several years later. It is absolutely unacceptable from my perspective and I really have to question if this was such a problem why is this the first time we are hearing about this. They had all of my information to contact me, but did and wouldn't this have been part of the conversation for closing the account? One would think so, but it sounds like someone dropped the ball here and this needs to be corrected immediately. There is nothing worse than following someone inflated process on how close an account every step of the way and still dealing with the reprocussions of someones obvious mistake.Desired Settlement: The expectation here is that someone needs to remove this account from collections immediately and also provide a letter clearly outlining this mistake to me so that I have additional proof that this has been addressed. Additionally it is my expectation that Cynergy will also reach out to the three different credit bureaus and acknowledge this mistake and have any negative comments or information removed from my credit report immediately. If I do not see this happen I will continue to file Revdex.com complaints against this organization on a weekly basis until I have clearly seen this being removed from my credit report.

Response:

We apologize for any inconvenience this situation may have caused consumer. We have waived the $100.00 owed, and have removed consumer from collections.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved. I will however be checking my credit report in the near future to determine that this has been removed from my credit report along with any derogatory comments. If something still exists I will need to re-open another case until that has been resolved.

Sincerely,

Review: In September 2012, Cynergy Data enrolled my company into a Merchant Benefits Club (I was told by the CSR. [redacted], on 9-**-13 that the club covered the terminal customer equipment repairs and the necessary supplies. She told me "all customers were enrolled into it".) Our company only does credit card sales through the internet using OUR personal computer--with no equipment supplied by Cynergy. We didn't understand the new charge until 9-**-13, so I requested the charges stop and I wanted a refund for the $14.95 our bank account was debited for the past 12 months--$179.40. [redacted] put me on hold for five minutes, then told me Cynergy Data would cancel our membership in the club, and Cynergy Data could only refund three months worth of fees--$44.85. She said I would get the refund in approximately two weeks. I said I wanted the full amount, and she told me the contract I signed in 2008 stated we had to notify Cynergy within 90 days to dispute any billing errors. Cynergy Data added a $14.95 per month charge to all of their customers' bills (even though it did not apply to all of their customers)--how can they do something like that without written or electronic permission? It was for a membership required for terminals, that we do NOT even use. Shouldn't they be liable for ensuring they enrolled the correct customers into a $179.40 per year club? The Cynergy Data bill is so confusing, and the charge is lumped into the fees section with all of the compliance, network acquirer, and VISA, MC, AMEX transaction fees. It was just lumped into the fees section with the other 15 miscellaneous fees. Please do something about this, because we can't be the only online store in the United States, that Cynergy Data swindled this extra $14.95 per month charge from. Cynergy Data also made it mandatory this year that merchants have to download their electronic statements from their website--no more paper--but they still charge a $9.95 per month fee for generating the statement.Desired Settlement: My company should receive a refund for the full amount of $179.40, since we were erroneously enrolled in their Merchant Benefits Club--especially since they enrolled all of their customers. The fact that we can call and get un-enrolled from the club is proof enough that it was a mistake on Cynergy's part.

Response:

We are refunding all MMBC fees that were charged to consumer, total of $179.40, please allow up to 3 business days for refund to post into consumer's bank account. We sincerely apologize for any inconvenience this situation may have caused consumer.

Thank you,

Review: A sales rep for Cynergy Data approached me several times and insisted he could lower my cc rate substantially. He told me I was overpaying but he could lower the rates. I had been approached many times, but he was wit the same company I was with so I believed him. I explained that I had a POS system and that the man I got the POS system also had the CC processing (Cynergy Data ). I PLEADED with [redacted] that I had a very BIG problem changing processing servers In the past. I was trapped. [redacted] INSISTED it was no problem!!!!! Contingent upon my POS system, he would have no problem. HE PROMISED ME that if I was unable to easily switch me over, he would VOID our contract (of course) . He now has me under a lease agreement for something I never wanted and he acknowledges he could not get me out from under my POS agreement( even though they are the same company). I believed in him and now he is not answering meDesired Settlement: I would like Cynergy Data to either give me the rates they promised me for my CC processing or stop charging me for for a lease that I have to pay for 48 moths for something I NEVER WANTED OR NEEDED. Vend LEASE is aware of this situation and they don't care.

Review: Cynergy is charging me fees that are not allowed in the agreement. Cynergy admits the fees should not have been charged but refuses to refund all the fees. Cynergy blames [redacted] even though the fees are clearly not allowed in the agreement. Additionally, Cynergy says the signed agreement forces me to stay with them for 3 years or be penalized for an early termination. When Cynergy sent a copy of the signed agreement, it appears my initials were forged on the documents. Again they blame [redacted].Desired Settlement: Because Cynergy does not wish to abide by the agreement, it would seem to me we never had an agreement. I request Cynergy terminate the relationship without charging an early termination fee and refund all fees paid to Cynergy since inception.

Review: I signed up for a credit card processing service through Merchant Services. Was informed that the only charges that would made to my account were with customer use, and would be a very small percentage of the total charge. There was no mention of any minimum monthly fees. So far my account has been debited for $25.00 and an attempt made to take an additional $70.00 from my account. I have attempted to contact the business on several occasional, only to be transferred from office to office. They claim no matter the time I call the office I need to reach is not open. I need to speak to the sales department and keep being transferred to what they call Tech Support. On one attempt I was transferred to someone who claimed they could address the problem. When I ask for an accounting of the charges to me, they were not able to answer that question, and I was again transferred multiple times, and after a 20 min on hold with the last office that was the one that could assist me they hung up on me. I called back and was told they would e-mail me a form to discontinue their services, It has been over a week and the form has never arrived. Once again an attempt was made to withdraw from my account and this time, only one week later, the amount was $139.00. The only thing I know to do at this point is to open a new account at my bank and close the account that the business is attempting to steal from. And yes I consider it stealing. I have tried to solve this problem, however not only are they not able to tell me what the charges are for, the charges have almost doubled in the weeks time between their attempts to take money from my account. The total amount of customer charges processed on this Merchant account are less than $40.00, but somehow I owe them almost four times that amount. I wish I had done my research better and know that there have been over 214 recent complaints on this business, and they actually have a D rating, when they boasted of an A rating.Desired Settlement: Wish to have the charges reversed and to no longer have to deal with this company. Will be only to glad to return the credit card processor to the company, and never have to deal with this highly unethical business again.

Review: Cynergy Data deception on annual and processing fees. A 3rd party representative(Everest Merchant Services) oral agreement did not match to the monthly statements received.

In addition no return service request or answering my phone calls or emails. Unknown charges without knowledge.Desired Settlement: Refund on PCI Compliance fee(185.00 )when I have a certificate of validation. Refund of Annual fee(200.00) when already cancel in December **, 2014. Refund of Merchant Benefit club fee of 14.95 monthly for 9 months (134.55) with out knowledge. Termination fee( 495.00 )when verbally agreed that I was not signing a contract, no where in the contract does it state the years of contract I was signing.
