initiated the mailing of a letter to the complainant in February at the same address she lists within her complaintIt was not returned to Delta as undeliverable and was not responded to by her at that timeThat stated, Delta does recognize that the complainant is now disputing the claimAttached to this response is a statement of account provided to Delta by *** Education GroupIt outlines aspects of the liability to the degree that, hopefully, will allow the complainant to understand the nature of the balance claimed as owedDelta has also asked *** to forward any other documents that would assist the complainant in understanding her alleged liabilityIn the interim, Delta has placed the claim in a dispute status with the applicable credit reporting agency(s)Should the complainant wish to discuss this in further detail, Delta would be most pleased to speak with her and ask that she contact our office toll-free at (*** ***." Delta understands that the complainant has indicated her dissatisfaction with our response to her complaint, but does not see any specific information from her relative to why she is not satisfiedAgain, Delta remains committed to assisting the complainant and/or her daughter to contact our Special Assistance Unit as a means of being provided a summary and breakdown of all payments made, as well as information that would prove beneficial to the resolution of the remaining balance

Delta Management Associates, Inc(Delta) affirms that it never made the comments attributed to us by the complainantSpecifically, in review of all calls placed to her, no threats were ever made against her child supportThe only mention of child support was by the complainant when it was cited
as a source of income when Delta was trying to qualify her for as low a payment as possible toward the Student Loan Rehabilitation ProgramWhile it is true that Delta has placed calls to the complainant, these calls were made with nowhere near the frequency alleged by the complainantThe calls placed have been once daily (with the exception of Saturday and Sunday) for the past weekThese were made as followups to our conversation with the complainant on 10/6/wherein she stated that she would forward us the documentation needed for her eligibility to make very modest monthly payments toward the Student Loan Rehabilitation ProgramThe required documents were initially promised 9/8/15, prior to the complainant's short term disabilityFurther, since the conversation we had with the complainant 9/8/15, no demands for the full balance have ever been voiced by DeltaIt is important to note that Delta's objective is to assist the complainant as best as possible in setting up reasonable and affordable payments in a program designed to remove her loans from their default statusOur objective has not changed, and we are willing and anxious to do our partBut, the complainant must realize that the program to which she agreed has requirements and that, if this program is still one in which she wishes to enroll, we need to receive the needed paperwork and maintain an open line of communicationBecause the complainant has stated that Delta has called her too often, we will enter 'Do Not Call' alerts on her account, and will place no more calls to her at any number until or unless directed otherwise by the complainantThat said, the complainant is welcome to contact Delta toll free at *** *** ***, extension *** and speak with *** ***He is one of our Operations Directors and will be happy to see the complainant through the programBecause of the 'Do Not Call' alert, if the complainant is interested in participating in the Student Loan Rehabilitation Program, it is vital that she reach out to us without delay

Delta Management Associates, Inc(Delta) initially spoke with the complainant on 3/20/During that conversation, Delta informed the complainant that her federal student loan was in default and further explained that there were means by which to resolve the matterIn a review of the recorded
call, the complainant was told on 3/20/that collection charges had not yet been assessed against her account but that, unless she was fully enrolled in an eligible payment plan, these charges would be addedThe complainant agreed to the terms of the Loan Rehabilitation Program and the first $installment was received on 4/22/It was also explained to the complainant that an executed Rehabilitation Agreement Letter (RAL) must be returned to Delta in order to be enrolledThis RAL has still not been received and the complainant, although making monthly payments, is not enrolled in an approved payment arrangementAs explained during the 3/20/call, collection charges were assessed on 6/6/for $2,When the complainant later questioned this addition, it was explained to her againShe then asked to speak with a supervisor but was unable to remain on the phoneMany subsequent attempts were made by Delta to reach the complainant and explain the assessment to her, but contact was never fully established again until 8/5/when she spoke with *** *** and *** ***Again, the processes and timelines were explained to the complainant this dayFurther, on 8/14/17, Delta forwarded a copy of the Promissory Note and a payment history to the complainantThe Promissory Note explains the circumstances under which the collection fees are assessedDelta remains happy to assist the complainant in any way possible, but cannot reverse the fee that has been addedAs stated earlier, it is important that the complainant realizes that she still needs to return an executed RAL to us in order to participate in the Loan Rehabilitation ProgramDelta welcomes the complainant to contact Delta directly and toll-free at (*** ***

Delta Management Associates, Inc(Delta) did place one (1) call (not three calls, as the verbiage of the complaint would imply) to the complainant 6/2/and advised her we were trying to reach an individual we believed to be her husbandThe complainant stated that she was neither married to (nor
even familiar with) the individual we mentioned, and asked that we call her no moreOur representative immediately entered notes to that effect and no future calls have been (or will be) placed to the complainantIn our review of the recorded call, Delta believes that we acted professionally, cordially, and appropriatelyThat notwithstanding, we do extend our apologies to the complainant for any inconvenience our call may have caused her

While I appreciate that they will no longer contact me, the rest of their statement is a total lie. I spoke to *** in February and the female caller on 3/22. The only time they would have gotten my voicemail was today just prior to my filing this complaint. I will proceed with filing complaints at the state and federal level against this fraudulent company

Delta Management Associates, Inc(Delta) has been in contact with the complainant and her husband for the past weeks or so in an effort to assist her in remedying her defaulted federal student loan serviced through *** *** *** ***While Delta does not believe that the number
of calls to them was excessive, we do apologize to the complainant for any inconvenience our calls may have causedDelta will also specifically review the call(s) between the complainant and our representatives with regard to the lack of professionalism that was cited by her, and will take the appropriate disciplinary action if any violations of Delta policy are uncoveredAs to the complainant's desired resolution to this, Delta will reissue the Rehabilitation Agreement Letter with a due date of the 23rd for her to review, sign, and return to us, along with other forms that were previously sentDelta will also credit $from the amount paid earlier this month toward her June payment (a payment of $will be taken 6/23/and then payments of $from July 23, through February 23, 2018)Lastly, as requested, Delta will cease the placement of all calls to the complainant from this date forwardDelta does recommend that the complainant touch base with Delta periodically to ensure there are no outstanding issues that would delay or prevent her loan from rehabilitating

ever mention trying to reach *** ***'s motherDelta's agent advised the woman answering the phone that he was trying to reach *** *** and asked her if she had a good contact phone number for himThe woman stated that Mr*** was her uncle and asked if everything was okayOur agent replied yes and that he was merely trying to reach himThe woman asked for, and was provided, our company's name and phone numberAgain, our representative's tone and words were friendly and imparted no sense of immediacyHe did not mischaracterize the purpose of his callWhile Delta can certainly understand how and why the complainant might have felt a sense of alarm based on past events involving family members, we are confident that our representative was professional and forthright throughoutThat stated, Delta does apologize for any confusion or undue anxiety experienced as a result of our callDelta will place no future calls to the complainant

I am rejecting your response because when we where making payments with *** *** we where able to log on to the account and make paymentsThen a new company took overWe were only able to make about two payments back to back and then we where never able to access the account againWe never received any letters, up until now, over years later, that we still owed money on the accountWhat happened to the settlement that *** *** was involved in with over charging students for their loansWe thought the account was closed due to this, and had received a letter, years later about the account being closedDue to lack of communication from said companies, and the lack of information to try and get in contact with them, I feel as though I should not be penalized for the communication issues from both companies

Delta Management Associates, Inc(Delta) did place a call to the complainant's place of employment on 2/1/The call was transferred to a man who did not identify himself at all, but who told us to stop calling himDelta added the number to our internal 'Do Not Call' listIn an effort to
formally verify employment, Delta called back on 2/13/for the sole purpose of determining through Payroll or Human Resources whether or not the workplace was the employer of the same *** *** with whom we had personal business to conductUpon Delta's representative mentioning the complainant's name to the person answering the phone, they mistakenly believed we wished to speak with the complainant and sent someone to get himWhen the complainant came to the phone, he identified himself and instructed us to cease calling him at workAgain, this second 'contact' with the complainant was completely inadvertentDelta has since verified employment through other means and will honor the complainant's request to not be contacted at his workplaceDelta apologizes for any inconvenience our call may have caused the complainant, however unintentional

Since December 2014, Delta Management Associates, Inc(Delta) has had multiple conversations with Ms*** relative to her defaulted Federal student loansFurther, Delta has attempted to work out a voluntary payment arrangement with Ms*** as a means of avoiding Administrative Wage Garnishment
(AWG)Unfortunately, Delta did not receive the completed forms back from Ms*** which were needed to calculate a reasonable and affordable payment in time to prevent the commencement of the AWG actionDelta is still not in receipt of the completed paperworkCalls were placed to Ms***'s place of employment, but nowhere near to the degree she describesIt is important to note that many of the recent calls placed by Delta to Ms***'s employer were to effect the Order of Wage Withholding that was sent to them on 3/6/This is standard procedure to ensure that the demand made of them to withhold a portion of Ms***'s earnings take effect in the manner prescribed by lawDelta received the first payment from the employer today (5/7/15)The other calls placed to Ms***'s place of employment were for the purpose of speaking with her directly so as to avoid the AWG action altogetherIn response to Ms***'s claim that Delta is calling family members, and harassing her and her staff at her job, Delta vehemently denies these allegationsFor the past many months, calls have been placed by Delta exclusively to Ms*** and her employer (following up on the AWG Order)Delta has, nonetheless, placed a 'Do Not Call' alert for calls placed to Ms*** at her workplaceCalls to her employer's payroll department may still occur for the purpose of assuring that the AWG Order remain honoredAs to the resolution Ms*** seeks, Delta was, and remains, very willing to assist her in the resolution of her liabilityShe is encouraged to contact our office to discuss the steps she must take, and the forms that must still be completed, for this to occur

Delta Management Associates, Inc(Delta) had just spoken with the complainant's husband who had called in from the same phone number we called back a few moments later, as it was discovered that we needed an item of unfinished businessThe complainant answered and was asked to provide her DOB/SS#
in accordance with Delta’s ID procedures but she declined and stated she’d file a complaint with the Revdex.comWe told her that her husband had called us from the same number just minutes earlier (to try to put her suspicions at bay), but she still would not ID herselfDelta extends our apologies to the complainant for any inconvenience this call may have caused her and hopes that she understands that Delta's policies were adopted in an effort to safeguard the sensitive information with which we are entrusted

Delta Management Associates, Inc(Delta) was forwarded four defaulted federal student loans in the complainant’s name for collection in September from *** *** *** (***)It is vital to note that Delta did not commence any Administrative Wage Garnishment (AWG) action against the
complainantRather, the complainant’s account has been in active AWG since 2014…an action begun by ***Delta was assigned this file for the purpose of contacting the complainant about options that may be available to him that may eliminate or suspend the AWG presently in placeIt is true that Delta contacted the complainant’s employer, but only to ask that they forward future AWG payments to us, as opposed to ***Delta never directed the complainant’s employer to begin withholding any of his wagesAll of the foregoing information should be verifiable to the complainant through his employer’s payroll recordsIn closing, Delta remains very willing to discuss various options of resolving the liability in questionMany of these options were overviewed with the complainant when he called our office less than two weeks agoSince that date, however, the complainant has notified Delta that he would prefer we communicate with him in writing only, making a productive dialog difficultDelta has honored this request, and will continue to do soThat stated, in order to accomplish a voluntary resolution to this matter, the complainant is encouraged to contact Delta back toll-free at (*** ***

Delta Management Associates, Inc(Delta) did initiate the mailing to which the complainant refersDelta was operating with the good faith belief that the complainant was the person with whom we wished to speakDelta is now confident that the complainant is not the person with whom we wished to
communicate or whose wages were intended to be garnishedIt is important to note that safeguards do exist to prevent the inadvertent garnishment of the wrong party's wagesThis is why identifying information is included in the Order of Wage Withholding letterThat stated, Delta does certainly offer our apologies to the complainant for any inconveniences the sending of this letter may have causedFurther, Delta will honor the complainant's wishes to not be called at her place of employment or on the cell phone number she provided

As previously stated, Delta has communicated with the complainant and his wife on many occasionsUnfortunately, the timelines (that needed to be met in order for the collection charges to not be added) were not metThis was not a mistake for which Delta bears responsibilityAs it presently stands, the account in question is being managed by Delta's loan rehabilitation departmentThe agent to whom the complainant refers does not work in this department, and this is the reason he is now speaking with agents other than herDelta remains happy to assist the complainant and his wife through the loan rehabilitation process and will continue to answer all questions posed to us in the fastest and most accurate manner possible

The logic of this business is flawed in several areas:All my known creditors have my valid address - when I spoke with *** *** he indicated that the address you sent mail to appeared on my credit report for some reasonThat being the case - if you'd pulled my report you'd have access to my last known or current address in which I've resided for years approxDid you send your notices to every address you pulled or did you randomly select one and because no mail was returned determined that was a good address for meFailure to get returned mail indicates its a valid address? This isn't logical as most people would destroy mail that arrives to their house that doesn't belong to themYou're garnishing someone's wages - why did you not send a certified letter - in which case you'd have received some real confirmationYou indicated that you spoke with me and that I refused to identify myself by giving you what is considered by most people to be personal information? There are million victims of identity theft every year (***)Do you think any normal, rational person is going to give you their birth date and/or social security number to someone that just called them? The truth is that you do notThis allows you to behave as you have as some collection's company pirateYou take advantage of a situation you create. I'm asking that the garnishment be stopped - and that you provide me with the details of the student loan in questionI have a history of paying my student loans, I'm not sure why this one is different and was not consolidated with my other student loansIf it is a valid debt - I'm happy to make arrangements to pay it - as I am with all of my student loansThis company creates problems and exploits those who fall into their trapHad they sent a certified letter, had they reviewed my tax information for the prior few years, had they done some of the simple things any skip tracer would do - they could have avoided this - yet they did not and now hold a 15% garnishment on a debt that isn't verified or had a chance to be disputed. *** ***

[I was working with Delta Mgmt Rep (***) since August But, *** failed to mention that the bi-weekly payments must be made on time initially before the customer is allowed the day grace period from the due dateThis went on for a few months which is why *** changed the agreement forms.Worst customer care support: Delta supervisor did not allow us to discuss or speak to *** on this matterHe basically told me the agreement was not met and the 25K fee was added to the existing debtNo contact or phone calls to the customer to respond to the additional charges
