payments are maintained on a specified schedule and, among other items, that a signed agreement is returned to usThe complainant largely kept to the payment aspect of the program but we did not receive the signed agreement that was requiredDelta spoke with the complainant three times in July and August of to remind him that this document was missing and essential to the ProgramOn each occasion, the complainant committed to returning it but it was never received by usDelta was unable to reach the complainant for more than months, despite having left him multiple voicemail messagesFurther, Delta sent him the agreement that needed to be signed on five separate occasions between July and November At this point, too much time has elapsed since the complainant's last payment and, in order to participate, he would need to begin the process all over againIt is important to note that Delta was very active in our attempts to have the complainant complete the ProgramThe current status of the complainant's account is not one that is advantageous to him or DeltaDelta does, however, remain committed to assisting the complainant as best we can

Delta Management Associates, Inc. (Delta) stands by our initial response. Our inbound/outbound calls are recorded, and a review of the call in question indicates that the purpose of it was to speak with Human Resources/Payroll to verify the complainant's employment for legitimate business purposes. It was the representative of the employer who stated that they would get the complainant and bring him to the phone. This communication with the complainant was not requested by Delta and did not serve us at all in the completion of the task at hand. Delta can assure the complainant and the Revdex.com that Delta is far from a "nefarious operation", and further, that we have and will continue to honor the complainant's request that we cease placing calls to him at his workplace.

Delta Management Associates, Inc. (Delta) did place one call to the complainant's place of business on 12/15/15. Delta spoke with the complainant that day, at which time he indicated he was not the same [redacted] we were trying to reach. The account was appropriately noted and the proper 'Do...

Not Call' alerts were placed. It is important to point out that Delta placed no other calls whatsoever to the complainant at his place of employment, as we have only had the file in question since 12/14/15. Delta is not contradicting what the complaint contended, in that he has received calls for a different [redacted] for years...rather, we are stating that the entity calling him was not Delta Management Associates, Inc. That said, Delta has honored, and will continue to honor, the 'Do Not Call' request made by the complainant. Further, we apologize to the complainant for any inconvenience our call to him may have caused.

Delta Management Associates, Inc. (Delta) did place one call to a relative of the complainant's as a means of procuring location information. Delta had tried for over a year to reach the complainant at the number she provided in her complaint, but we had made no contact and our messages were...

not returned. We therefore questioned whether or not the number we had was valid or if the phone was even operational. Under such conditions, Delta is allowed to place calls to third parties to obtain the location information we sought from her relative when calling 2/22/17. It is important to note that no personal or private information whatsoever was disclosed to anyone during this call. That stated, Delta will honor the complainant's wishes that we cease all efforts to contact third parties and, to that end, conspicuous 'Do Not Call' alerts have been entered. All future attempts to reach the complainant will be through mail, at the number she provided, or at an alternate number we believe is valid to reach her directly. If the complainant wishes for us to cease all efforts to reach her by phone and/or mail, we ask that she so directs us so that we can further update our records.

Delta Management Associates, Inc. (Delta) did initiate an Administrative Wage Garnishment (AWG) on behalf of our client as indicated by the complainant. Prior to the commencement of this action, Delta sent letters and attempted phone contact as means of avoiding it. Delta believes that we did...

speak with the complainant in April but, because the person with whom we spoke declined to provide the identifying information Delta requires before disclosing the purpose of our call, we were unable to go into any detail. As to the address to which letters were sent, including the Notice Prior to Wage Withholding, Delta mailed all correspondence to the address provided us by our client. The responsibility for furnishing his creditors with updated addresses and/or telephone numbers lies with the complainant. Delta received no mail returns on any of the letters sent. It is important to note that Delta would have certainly preferred to have spoken with the complainant prior to the commencement of AWG and to have provided him voluntary alternatives. As it is, the complainant still has options. He may file for an untimely hearing if the validity of the debt is in question, if he feels he may be eligible for a discharge of his loans, or if the amount being taken through garnishment presents a hardship to him and/or his dependents. The other options, to which the complainant already alluded, would be for him to either pay in full or settle his account, or to make five qualifying voluntary payments in addition to the amount being garnished at which point the AWG action would be suspended. All of these options can be discussed in greater detail, and the complainant is encouraged to contact Delta directly toll-free at [redacted]. Delta would be happy to assist the complainant in any manner possible.

Delta Management Associates, Inc. (Delta) did place a handful of calls to the complainant. Because Delta has not spoken with the complainant as yet, we are uncertain as to whether or not she is actually the person with whom we wish to speak. Delta did initiate a mailing to the party with...

whom we seek to communicate, but the address to which it was sent was in Ohio. All of this notwithstanding, Delta will happily honor the complainant's wishes to not be contacted by us by phone and has placed conspicuous Do Not Call alerts to the two numbers we believe the complainant to be referencing. No calls will be initiated to the complainant at these numbers until or unless the prohibition on our calling them has been rescinded by the complainant.

In an effort to best address the complainant's concerns, I'll answer each item individually. 1) Again, Delta was provided an address by our client, and that was the one to which all mail had been directed. Delta would have had no reason to change an address on which we had no indication of its inaccuracy. We presume the address we were furnished is good until we receive indications to the contrary. 2) Delta not receiving returned mail or a forwarding address from the Post Office is among the few ways we can validate an address' validity. It is admittedly not foolproof, but it was all the information by which we had to go. 3) As to Delta's policies of requiring a person's name, date of birth, and (at least the last 4 digits of) their social security number, this is done to ensure that the sensitive information with which we're entrusted remain secure and that it is not disclosed to anyone other than its intended recipient. Delta does recognize that some are uncomfortable providing it, but it is a necessary safeguard put in place to protect the privacy of the consumers whose information we possess. As to the complainant's request to stop the garnishment, it cannot be done until or unless certain prerequisites have been met. These were described in Delta's initial response. Despite the complainant's skepticism, Delta does wish to assist him in the process of stopping the AWG action. Further, Delta would have absolutely preferred that something was done prior to its commencement that would have avoided it altogether. Now that it has begun, there are procedural steps that must be taken. Again, the complainant is encouraged to contact Delta to explore those options. As stated previously, Delta remains committed to doing everything possible to work with the complainant.

Delta Management Associates, Inc. (Delta) sent the complainant four separate mailings since March 2015. Further, Delta made multiple attempts to contact her by phone (at the same telephone number referenced by her in her complaint) to assist her in working toward a mutually beneficial resolution....

Until the receipt of this complaint, Delta has only had one other contact from the complainant, which was on 3/10/15 when she called our office after having received our initial notice. But the complainant hung up while being transferred to a representative who could assist her. None of our subsequent voicemail messages were responded to. In searching our inbound/outbound call database, Delta could find no other contact or messages left for us by the complainant. That said, the complainant has asked that Delta cease our attempts to contact her by phone. As of 10/20/15, Delta has duly noted this request and will not place any calls to the complainant. Should the complainant wish to discuss this matter with Delta, we remain very willing to assist in whatever ways possible. She may call us at [redacted], extension [redacted]. This will connect her with [redacted], our Unit Manager.

Delta Management Associates, Inc. (Delta) did place calls to the complainant's phone as stated. Our objective was to reach a different person and we were provided information which linked that person and the complainant as possibly being acquainted. As the complainant has now clearly indicated,...

there is no knowledge of the person with whom we were trying to reach. That stated, Delta has removed the complainant's phone number from any association with that third party, and no further calls shall be placed by Delta to the complainant. Further, Delta genuinely apologizes to the complainant for any inconvenience our calls may have caused. Lastly, Delta believes that the last call referenced by the complainant was the result of a poor line connection. In our review of that call, Delta's rep was trying to access information and, after about 60 seconds of silence, the line goes dead. Until that point, the conversation was quite friendly and productive.

It is now, and has been, Delta's policy to ensure that we only disclose the specifics of the purposes of our calls to individuals whose identities have been confirmed and who are authorized parties to receive...

the information. While we certainly understand that the complainant may not feel comfortable disclosing this information, it is Delta's policy nonetheless, and no substantial conversation can take place without it taking place. Again, Delta takes very seriously our responsibility to safeguard the sensitive information with which we are entrusted...both from the standpoint of consumers in general and our clients. As the complainant pointed out, we have since received from her the information we required in order to proceed and, at this point in time, nothing else is needed of her. Delta does apologize for any inconvenience our policies may have unintentionally caused the complainant. We do thank her for her cooperation and for having voiced her concerns.

Firstly the agreement was made over the phone and there absolutely was not a letter sent out by delta pertaining to this agreement. Also the check was not mailed out by me , check your records again!  Most importantly your statement about making several attempts to contact us is ridiculous. This was already discussed between myself and a delta supervisor that absolutely no attempts were made for seven months , either by letter or phone call by delta , in fact he expressed to me that it concerned him that no contact was attempted for so many months. I finally received a letter in August. To me this is a sure way to collect more interest, and why leave a 600.00 dollar balance on the account ? Why not take the whole amount from her taxes ? I would still to this day not know about this balance had I not contacted delta. Again there was no attempt by mail or phone to advise us of any balance.So most of your response is untrue . Before you were paid 14,400 we were contacted by delta several times a week . Then you say the account sat unmanned for several months ? What does that mean? And why? I feel delta dropped the ball on this and it has cost my family a lot of money in penalties and interest. I have to ask , when were you going to advise me of any balance due? Next year at tax time?

Delta Management Associates, Inc. (Delta) was assigned a defaulted federal loan in the complainant's name for collection from [redacted] ([redacted]) on 1/22/18 (seven days ago). While attempts were made to reach the complainant by phone and mail, Delta never attempted any calls to the...

number provided by her in the complaint. All calls that were placed were done within permissible timeframes and in accordance with both law and Delta policies. It is worth noting that the latest time of day that a call was ever placed by Delta was just after 4:00PM (on 1/22/18). The address Delta was provided by [redacted] does not match the one furnished by the complainant so we have updated the address and initiated another mailing to the complainant that will explain the account better, as well as explain rights afforded her under the FDCPA. Delta has also never had any communication whatsoever with the complainant until this filing, including any receipt (verbally or in writing) of her wish to not be contacted by phone about this matter -or- her request that we send her a copy of her agreement. This fact notwithstanding, Delta has placed conspicuous 'Do Not Call' alerts on the complainant's file and will honor her wishes henceforth and will also forward her (to the address she provided) a copy of the promissory note that binds her to this account. As stated earlier, Delta will place no future calls to the complainant, but remains happy to try to help her resolve this matter as best we can. Should she wish to contact Delta, she is welcome to call us at ([redacted].

Delta Management Associates, Inc. (Delta) did place calls to the complainant's home. We were attempting to speak with a person whose first and last name is the same as his wife's. Only twice did anyone answer our calls and, on the first occasion, we asked for the first and last name of the...

person with whom we wished to speak. We were told (presumably by the complainant) that she was not there. The next time someone answered the phone (8/30/16), we spoke with the complainant who, upon further questioning, indicated that the middle initial of the person with whom we wished to speak was not the same as his wife's. At this point, our representative apologized for the inconvenience, stated that he would place a note on our internal file to cease placing calls to the complainant. This note remains, the complainant's phone number has been added to our 'Do Not Call' list, and the request has been honored since 8/30/16. It will further be honored going forward.
