I moved in as a roommate at*** last year 2019. at the time,*** was the guarantor on the lease and I was just there as a roomate renting a room. In my time there I had witnessed flooding in the home several times leaving*** to have to replace certain personal items and live in a house that smelled like mold which could possibly have been a health hazard. Every time occurred, the Landlord blamed Jeff and actually fined him to the pont where Jeff moved out. He took Jeff's whole security deposit for several things that he blamed Jeff for and was supposed to fix after Jeff moved out and I took over as the guarantor I was told his construction guys had fixed the problem that persisted to happen every time it rained heavy. they never fix the problem, causing more flooding while I was there after paying the security deposit and the first months rent I literally found myself having to move out to no fault of my own. I could not afford to move and it was very unfair for me to have to move at that point so I made a deal with the landlord should be out within 30 days rent free and get my security deposit back which would help me move. this would help me not only secure a new apartment but help me with the cost incurred of moving out of that apartment such as movers, truck, storage and what not. The landlord told me the second I moved out that I would have the security deposit turned over to me immediately, I received an invoice, very inflated charging me for things that he only charging the previous tenant for never fixing and on top of that literally taking every dollar he could from me and trying to charge me money for things and sending me a bill. I wasn't even able to live out my lease term at the residence and had to move out because of the living conditions being unsafe. All I asked for was my seurity deposit back and he's trying to keep it. My next step is to file a civil lawsuit with Union County but I'm hopeful, this will be rectified

Unfortunately there are more details to this situation that I can not disclose. The security deposit was used to repair and clean the home as the it was left in bad shape beyond normal wear and tear. The tenant was not charged for any items due to the water damage.
The tenant was given the option of a hotel or stay in the home for 1 month rent free. Tenant opted to stay in the home for free for 1 month. The tenant was given ample time to clean and fix items per lease agreement, which were never done. He was told that we would work with him on the security but needed to at minimum see the backyard addressed and cleaned up, which never was done. This tenant was only charged for a fraction of repairs due to damage and cleaning of the home from how he left it, as the cost well exceeded the security deposit amount. This tenant was not charged for items that the previous tenant was charged for. The previous tenant was charged for items the unapproved dogs damaged in the home and damaged front door.

I do not accept his response. HE shook my hand and told me he would give me the security deposit back. he told me I had nothing to worry about. Micheal D charged me for things that was already done to the house. I was only on the lease for 4 months before the house flooded for the 5th time. I have text messages of him even saying that he was going to give me the security deposit back. This is not only sick because he lied to my face and others, but during a time of this pandemic he has done harm to me finical and emotional, I could not get another place because of him. Even the 3 way phone call with his contractor Ken he promised me the security deposit. if this dose not get settled *** and myself will see you in court Micheal D. The attached files are text messages between me and Micheal. There is plenty more of messages where he promises me the security deposit. not only that I have tons of pictures of all the floods that has happens to that house.
