This account was enrolled with Con Edison Solutions as part of a municipal opt-out aggregation with the City of New Bedford This program was authorized by the City of New Bedford as well as the Massachusetts Department of Public Utilities. Con Edison Solution was selected as a result
of a Request for Proposal Process to provide electricity supply to residents of the City of New Bedford who were still taking electricity supply on Basic Service from their utility, Eversource.Since we have been selected to be the electric supplier for New Bedford, we are now the default supplier This means that when a new account is opened, the electric supply portion will automatically come from Con Edison Solutions Our charges will appear on your utility bill in addition to the delivery charges from Eversource There have always been two sets of charges (supply and delivery), but you may not have noticed it because they both came from the utility (Eversource) Our charges replace the supply charges previously charged by Eversource For the months of January, February, and March, our charges for electricity supply were less than what Eversource would have charged. If you believe that both ConEdison Solutions AND Eversource charged you for electricity supply (as opposed to ConEdison Solutions charging you for electricity supply and Eversource charging you for delivery), you should contact Eversource since they administer the monthly bills. It is extremely unlikely, however, that this occurred. Enclosed is a copy of a letter with more details about the program that was sent when we did the initial enrollment in DecemberOur records indicate that your account with us has been terminated. We are sorry you were not happy with having us as your supplier.

We are sorry that *** *** felt as though he was caught in the middle between his utility company and ConEdison Solutions *** *** has been a customer of ConEdison Solutions since 2008. He elected to purchase our Wind Power product, through which he purchases wind-generated
power at a variable price to offset the electricity he is using in his home. The cost of his electricity supply appears on his monthly Con Edison (utility) bill, but is identified as being supplied by his electricity supplier, ConEdison Solutions, and shows the current price of the Wind Power product We are also sorry for the confusion that the mailing of the certificate of *** ***’s annual usage caused. Each year, as a courtesy to our Wind Power customers, ConEdison Solutions mails out certificates indicating the total amount of “green” energy that was supplied to the customer in the previous year. The certificate is meant to summarize the positive environmental impact of the customer’s decision to purchase Wind Power and many customers look forward to receiving this visible evidence of their commitment to renewable energy. There are no fees associated with the usage summary as *** *** already paid for that electricity as he used it during the prior year. However, because it is electricity that he has already used, *** *** is also not entitled to any bill credit. If *** *** is not happy with his purchase of Wind Power, he can choose to purchase standard electricity from ConEdison Solutions as an alternative. Also, if *** *** is not happy with the service ConEdison Solutions provides, he can at any time choose to switch to another electricity supplier or have the utility provide his electricity supply. While we would prefer that he remain our customer, he can always contact us about these options

*** *** was part of the Sustainable Westchester community choice aggregation program. *** ***’s community is participating in the Sustainable Westchester program, and ConEdison Solutions was engaged by Sustainable Westchester to supply electricity to residents of her municipality
As part of the Sustainable Westchester program, *** *** was mailed literature regarding the program and was given the opportunity to opt out of participating in it. We understand that there was also a notice about the program on her utility bill. Since ConEdison Solutions did not receive an opt out notification from *** ***, she was enrolled in the program *** *** contacted ConEdison Solutions about this matter on 8/*/and she requested to de-enroll in the Sustainable Westchester program. ConEdison Solutions processed her de-enrollment request and sent that request to her utility on the day she called. It may take a few weeks before her utility completes the termination of her participation in the Sustainable Westchester program The charges referenced in the complaint were for the electricity *** *** used during her time as part of the Sustainable Westchester program so the charges are not refundable.

In 2016, Con Edison Solutions’ electricity supply business was purchased by Constellation. According to our records, *** *** enrolled with Con Edison Solution on 1/**/which was prior to the sale of the business to Constellation. Constellation does engage in door-to-door sales in
some markets but would never market under the Con Edison Solutions name. In May of 2017, *** *** would have already been a customer of Con Edison Solutions/Constellation and that may have been why he associated the sales call with our companyConstellation has assured me that *** ***’s account is now terminated and he was not charged a cancellation feeShould he have any additional questions, please have him contact the Constellation customer service department at ###-###-####
