We are responding to the above referenced complaint...

made by [redacted]. I[redacted] received a complementary treatment at our facility, after which, she saw the results and the need to address her skin issues.,At that point, she decided to start the treatment , which included an individually tailored program and a set of products that were to be used at home along with a Twinrey Device. The date of purchase as outlined in the attached invoice was August **, 2015. Furthermore, as outlined in the invoice, there is a 7 day return policy on all UNOPENED merchandise, should a customer change her mind. [redacted] decided to return the merchandise on September **, 2015, which was almost a month after she had purchased it. The product was used and [redacted] implied that it caused her skin to breakout. Upon the Esthetician's examination of [redacted]'s skin, it was determined that she used the product incorrectly and was experiencing an escalated version of the normal Detox effect. We as a company who always tries to appease the client's requests and concerns, tried to convince [redacted] that the effect was temporary and that we would do everything in our power to help her through it. However, [redacted] refused to accept our help in the situation and insisted on returning and reversing the transaction.  We attempted to rectify the situation and provide as much comfort as we could have, however, the only solution to ease [redacted]'s concerns was to allow her to terminate her agreement. For that to occur, as stated in the invoice, a 15% restocking fee had to be paid for opened merchandise. [redacted] adamantly refused to pay the restocking fee, although she was warned that the contractual obligations would not be terminated unless the restocking fee was paid. Her statement in the complaint is valid, she did leave the opened and used merchandise in our facility, however, the penalties that were imposed on her for using and opening the merchandise were never collected form her, thus the billing institution continues to bill her and will eventually place her in collections. We at Desheli have over 1500 happy clients, some of whom left video testimonials on our website [redacted]   Therefore, [redacted]'s accusations are not justified and we as a company have rules that apply to everyone who wants to return and they are clearly outlined in the invoice upon purchase.  Awaiting for your reply Thank you.   Reginald C[redacted]Vice President, Chief Operating Officer Desheli USA, Inc. Revdex.com:At this time, I have not been contacted by DeSheli Beauty Center regarding complaint ID [redacted]. Though I have called them at [redacted]. They referred me to [redacted].  According to my search and communications with...

Broadway Rejuvenation,  they informed me that Desheli has been closed as of Jan. 2016. So, where did my payments go? As of Jan 2016 they were going to Universal at [redacted] or [redacted] MO for $300 but no servicesSincerely,[redacted]

This place offers a wonderful experience at no cost. I received a great facial and was under no obligation to buy anything. Beautiful offices and friendly staff.

this business called me 3 times in one hour with marketing information. I asked them to stop calling me, they said they would remove me from their marketing call list and then they called me the next day. i'm considering this harassment, at this point.

Review: Company has an automated dialer that will call my private cell number 1-3 times a day, every day. I have called and spoke to multiple managers and requested numerous times over the last 2 years for them to STOP calling. I have been treated on the phone with as much respect as one would give a pile of dung. I have been yelled at, I have been told not to worry, I have been told that they will stop calling on "GODS TIME".

I have NEVER been to this business, I have never been interested in this business, I have never purchased anything from this business. I have had my cell phone number for almost 8 years now, I have been on the national DNC list as well for about the same amount of time.Desired Settlement: I WANT this business to STOP harassing me ASAP, I would also like their to be some form of punishment as this has been going on for almost 2 years now. I have been more than patient.

Response:

[redacted] alleges that we have continuously called him to offer our services for the past two years. Given the fact that we have been open for one year, [redacted]'s exaggeration is duly noted in other instances of his complaint as well. Our marketing team purchases phone lists from reputable sources that provide us with phone numbers that have been "scrubbed" against the National Do No Not Call List. If [redacted]'s number would have been on that list, we would never had received it in the first place. Secondly, during my conversation with [redacted] I informed him that the best solution to this problem would be to "block" our number on his telephone. This would alleviate all concerns and we would never be able to contact him again. However, this suggestion was taken offensively, hence the filed complaint. I personally informed him that I would delete his number from our database, but that would not ensure that his number would not come up in future purchased databases. Therefore the best solution for him would be to block our number. I have done all that I can do to ensure that we do not call [redacted].

Review: On Sunday, August [redacted]. I went to Desheli for a facial, I agreed to purchase the product, I didn't put any money down, but we set up a payment arrangement to begin Friday, October *, 2015. After a week of use, my skin began to breakout, so I returned the product to them on Tuesday, September [redacted] 2015. I met with a manager, he asked me to consider trying the product out for some more time so that it can work for me and I can be a satisfied customer. I told him that I did not want to continue with the product and left it in his office. The company contacted me and said that I have to pay a $450.00 restocking fee, I contacted the company and ask where on my contract did it state that I have to pay a restocking fee, they said it was on there. I reached out to the billing company on September [redacted] and [redacted] to inform them of the situation. Then I received a letter in the mail yesterday, September [redacted], stating that they received my complaint, but they were still going to take the $177.00 out of my account on Friday, October [redacted]. I am making a complaint because I have not had the product since September [redacted], and I don't want to pay for a product that is no longer in my possession. I returned it in ample to have this situation resolved and they have contacted me, to pay a restocking fee for a product that they have in their possession.Desired Settlement: I would like no further contact from the business and I do not want to pay for a product that I have not had in my possession since September [redacted], 2015. They have the product now, I want Desheli to contact the billing company to terminate my contract, because I do not want to pay for a product I no longer have in my possession. Thank you.

Review: At the beginning of July, a friend of mine told me his friend’s company was giving out free facials. He asked me if I was interested because he thought it would be a great birthday treat for me. He told his friend I was interested and she gave me a call. Days later, his friend gave me a call about a “free” facial promotion at her company. I decided to give it a try and set up an appointment with her.

When I arrived to "my" time slot, at least 10 - 15 other women were there. After waiting about 45 minutes, someone came out to bring me surgical booties and a cap to begin the facial screening. After she asked me to tell her my regimen, she told me my regimen was causing even more damage to my skin, everything I was doing and suggested I try their products. She used the products she suggested on my face. When I told her I liked how my face felt and looked after the mini-facial, she asked me if I was interested in purchasing the product. I told her I wasn’t sure. She kept telling me reasons why I should buy it such as , “You should start taking care of your skin now, before you start aging”, “You only live once, it’s okay to treat yourself.” I told her I would be interested in hearing about the prices.

As soon as I told her that, a young man comes into the room, and tells me “ Wow, I see the before and after difference, you should definitely think about purchasing the product.” At this point, I knew he was a one of the sales representatives for the company. He told me the price of the product, and I told him I was not interested. He then tells me I can lower the price of the facial case.” I told him I was not interested again. He mentioned prices that seem fairly decent when he discussed how much I would pay monthly. So I agreed to sign up for it. The young lady who gave me the facial, walked me up to a room where the down payment was made. The sales representative came up to me again to watch the transaction being made and said “You won’t regret it. You have made a great decision.”

On July 31st,2015, I put a down payment of $200 on a $3,1990 Deshelli face case. This left me with a balance of $2,990. The Desheli face case contained a Diamond Treasures Face Case ( FC1001), a Twinrey Skin Care Massage Device ( TR1002) at Desheli USA, [redacted].

After trying out two of the products, reflecting on the financial burden the payments may become, and reading bad Yelp reviews on how the company has coerced numerous women of color into purchasing products they can barely afford, I decided to return the product within the 7 day money back guarantee period.

I returned the case on August [redacted] , 2015 . I was told by a manager as a result of opening two products , that I will have to pay an additional $250 to cover their restocking fee by August [redacted], 2015.

I returned to Desheli USA on August [redacted] , 2015 to get a better understanding of why I had to put down 250 on top of the $200 down payment when I did not use their products or services for more than one week. Two men sat me down in room. One of the individuals was the young man who originally sold the product to me. He was so nice to me when I purchased the product. But as soon as I mentioned I decided I would possibly get a lawyer to handle the situation, they both became talking to me in a condescending tone. When I mentioned taking this situation to court, they brought in a third person, they claimed was an attorney for the company. Now there were three men in the office with me. I complained numerous times that I was uncomfortable and did not understand why there were three men in a closed office with me because of this situation. All three men were talking at me. I asked the attorney for his full name, and for proof that he was an attorney. He told me he did not have to show me anything. His hesitation when asked to show proof, his mannerisms, informal tone towards me, and belligerent tone towards his colleagues lead me to realize that he was a fake attorney. The fake attorney kept trying to pressure me into paying the $250. During my encounter with their fake attorney, I expressed that I was not going to say anything with my own attorney present.

I contacted a friend of mine for advice regarding the situation. When my friend arrived at Desheli USA, she insisted on asking the manager for the attorneys name so that we can verify he was an actual attorney. The manager suddenly changed his tone and said that he never said the man I encountered was an attorney. He told my friend that he told me he was a paralegal. This was a lie. And it wouldn’t make sense for them to have a paralegal discuss consumer affairs with a customer. At this point, I was certain that this company was filled with manipulators and scam artist. The behavior of the staff I encountered truly reflected the bad reviews on yelp.

The fake attorney and the manager told me if I did not put the $250 down that they will continue billing me as if I have the products in my possession. They told me refusing to pay the $250, would result in my $2,990.00 balance being sent to a collection agency

On December [redacted], Omega RMS, a third party bill collector representative told me my credit would be affected by January [redacted] if I did not make a payment towards a Desheli $2,998.31 balance.

I refuse to pay off a balance for a product I returned months ago, and would appreciate the $2,998.31 balance being removed from the collection agency. Because I put down $200, I believe I should only have to pay an additional $50 to cover the restocking fee. To resolve the problem, I would appreciate you contacting Desheli USA to notify them about this arrangement.Desired Settlement: I will agree to paying $250 in total

Response:

[redacted] returned the product that she purchased within the 7 day grace period, however, upon return, the products inside the case were used. The invoice that [redacted] received, specifically stated that a 15% restocking fee will applied towards all opened merchandise. The entire cost of the package that [redacted] purchased was $3,190. [redacted] left a $200 deposit. Therefore, [redacted] was informed by our Manager that if she returned the entire package, she would have to pay a restocking Fee of 15% from the total remainder .. which is $2,990.. hence $450 Fee. [redacted] was warned that if she did not pay the fee then we would continue billing her and if she did not close the account in good standing, she would be sent to collections. [redacted] was very adamant about paying the remainder of the Restocking Fee which was $250 ($200 left over from down payment). She stated that she did not care about collection activity.. and that we were free to do what what w e wanted. Apparently, upon receipt of the collection letter, [redacted] decided to complain to the Revdex.com. However, everything that was stated to her was actually written in her invoice and made apparent to her upon her purchase. She did not take her delinquency seriously enough. We will allow her to pay us $250 and remove her from collections.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

I filed a complaint with Omega RMS( collection agency they sent me to). They contacted me telling me Only have a $50 balance after filing the complaint. I won my case , and desheli agreed to have me pay $50 as my final balance. I have documentation from the company as proof. I already paid off the $50, so I no longer owe Desheli any money. The case has been closed

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Sincerely,

Review: This company has been calling me for years trying to get me to come in and try their product. Every time I tell them I do not live in NY to remove my number from their calling list and nothing. They even have an automated system that calls me and there is a long pause and then the computer says goodbye. I get these calls multiple times a month. Every time I talk to them they say my name has been removed. I am starting to feel harassed by this company.Desired Settlement: I want this company to delete my contact information from their system and never contact me again.

Business

Response:

There is obviously some misunderstanding in this entire matter. First of all, [redacted] claims that our company has been calling her for years.. we in fact have been actively calling people for only one year.. since we opened in the United States. Furthermore, [redacted] alleges that we use an automated system to call people, we in essence do not. Our calls are not made through an automated system, but are dialed individually by a caller. Therefore, I believe [redacted]'s complaints are related towards a different company. However, we have removed her from our calling lists and any other calls that she may receive will not be from us.

Consumer

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here] I have been living in Florida for almost a year. I have been getting these calls since I lived in Massachusetts so no these calls did not start a year ago. Also, the automated calls came from your number because when I looked it up online your salon came up.

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Sincerely,

Business

Response:

Since my initial response was contested by the complaint issuer, I felt that I should respond again to the complaint. As I explained to [redacted], we have been open a little over a year, and thus have been calling and inviting women during that time frame. Nevertheless, as I stated earlier, I will instruct for the removal of [redacted]'s number off of our database. And once, again I apologize if we caused any inconvenience.

Consumer

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved. I do not want to go back and forth with this I wanted the calls to stop and my pbone number removed and that has been done.
