I am attaching the contract that has been signed for your reviewIf you read on the contracts 6th signature down it states "There is no cooling off period unless you obtain a contract cancellation option" and it states under it in writing he cannot cancel this contractWe also offer the customer a contract cancellation option agreement which was also declinedSee attached This sales agreements denies the customers claim that they never purchased a truckThere claim that we "made them sign a contract" and came to "strictly look at inventory" is because they put money down towards their truck purchase and sign a sales contractThere is also a Due Bill/Work order made that states to "replace super singles" that alone costs our company for than $2000. We are at a loss with this customer by his work orders and taking his truck off the market for so longWe should be coming after him for losses, But instead we settled out differences which is why he ended up coming to us for the 2nd time

We would like to make a few things clear before hand: The customer information in this complaint states "*** ***" however this is not our customer and we are not aware of whom he isSecondly, from the clients complaint log he is stating he purchased a Freightliner from us however it is a KenworthThere was nothing attached from the customers complaint, he mentioned there were paperwork attached from the Kenworth dealer in his complaint message however there is nothing attached
The customer name is *** *** located in Lankershire Drive Tracy, CA He purchased a Kenworth TModel from us which he had taken possession of on 04/30/Customer stated he had a check engine light after miles of his first load but continued to drive and did not stop to diagnose the issueWhile he was on route to deliver a load and driving on a check engine light his truck began to overheatInstead of fixing the issue with his coolant, he had continued to add water in his radiator, after his engine overheated due to insufficient supply of waterCustomer had continued to do so for over 7,milesHe had reached high temperatures of Degrees per the report logThis is not and will damage any motor being put through that much stress and abuseThis is clear sign of negligence from his part, he has stated he has had a Class A commercial drivers license for over years so one would assume he would know how to take care of his truck
After driving over 7,miles, customer took his truck to the *** *** in Lathrop, CA and after diagnoses, truck had a bad head gasket and needed repairs. He contacted his warranty provider thereafter and the warranty advised him they did not cover head gaskets
Client stated in his complaint "I had notified Diamond Truck Sales of the issue and they have told me to take the truck in for repairs and do not worry, we will take care of the repairs." This statement is false, client took the truck in for repairs/diagnoses on his own and he had called us after the diagnoses and his truck had been sitting in the shopwe had not made any agreement with him to pay for any repairsHe bought the truck AS-IS with no warranty from the dealer however, after we had investigated how his truck had a bad head gasket, the computer log showed that *** *** OVERHEATED the ENGINE over TIMES within the past HOUR PERIODThis has been on the negligent report from the *** *** in Lathrop, CA (we have also attached documents please see enclosed) these document support the overheating of times,
Customer has also claimed that this truck had a heating issue before he purchased the truck but according to the K*** *** the truck has overheated when it had 3,hours on it and the customer had overheated it at 7,hours so the previous overheat has been irrelevant to his current issueHe complained we gave him bad customer service but we had seen him on numerous occasions before he took delivery and completed nearly all of his requests he had made until he was satisfied with his truck and took delivery
Customer is requesting we pay $3,towards his repair invoice however we have agreed to only help him with the Diagnostic fees incurred totaling out to $

We would be more then happy to show you the sales contract that you signed it states "There is no cooling off period unless you obtained a contract cancellation option agreement."You cannot cancel this contract simply because you changed your mind or though the vehicle costs too much or if you found a vehicle somewhere else." The odometer states "EXEMPT" because it is a commercial vehicle and they are exempt from odometer disclosureAll we ask is to complete your part of the agreementWe do not like to keep your deposit, we would like to use it for our services rendered but we cannot accommodate you if you are no longer willing to complete you part of the agreement

The customer stated the following. 1. Claims he purchased the wrong truckBusiness Response, Customer knew exactly which truck he was purchasing after the sales person and him agreed and accepted terms, said customer signed contracts and later came back to sign loan contracts with the dealership...

and even chosen to have tires changed on the truck he wanted and purchased. If this was the wrong truck he would have never done above mentioned. This is false accusation made from anger and stand no ground. If knew it was the wrong truck we would gladly have him pick out the truck of his choice. 2. Customer claimed dealer claimed during the sale "if anything happens to this truck he is going to take care of it and is also under warranty" Business response, the customer was offered a warranty at the time of sale and which the customer denied to purchase and assumed responsibility by signing a buyers guide of AS IS, If the customer would have agreed to purchase a warranty he would have not have had these issues stated in his complaint. This truck may have had some warranty that was not applicable to his breakdowns. Since we are not the manufacturer we do not stand behind manufacture warranty.  3. Customer stated he heard some sound coming from the engine upon deliveryBusiness response, customer took possession, and shortly after he calls us stating he heard a noise in his transmission he never mentioned anything about an Engine. The truck was left in our facility and we found that the leveling Rod for suspension was broken by the rear axle was needing replacement. When that was repaired the sound went away. Customer came back and inspected the equipment with his satisfaction he took possession of it. He agreed the sound went away and took possession. After this repair the customer is on his own for he did not purchase any warranty.  4. Customer complained after purchase he fixed his clutch, injector, fuel pump then finally the engine going out. Business response, we offered him warranty on above components (except his clutch) if he were to purchase the warranty he would have not have to deal with these costs. On the side not, the truck did not leave with any issues for he had put over 23000 miles on it. If the truck left our dealership it would not make it 23000 miles.

As soon as we receive a contract from the client our shop is told to complete their work order in a timely manner. Their contract was valid based on the information they had given us about their company. We have a written agreement from the customer to perform work that has been completed and it has been completed, I can send a copy of it if you wish. We feel it would be in best interest for both parties to complete this transaction, we are willing to cooperate with some requests/concerns the client may have and that has to do with moving forward with the purchase . Please advise what you would like for us to do from here thank you

I am rejecting this response because: Diamond Truck Sales are scanners. If they chose to perform work after it was made clear to them that the deal was no going through, it is a cost they have to eat. I have proof that no work was done Pryor to me stating I wanted to back out. And they should not have performed any work before final documents were signed. This is a crooked tactic and I reject it.

I received a call from the acting agent saying Diamond Truck Sales was trying to go out of State to register the truck so when it was registered back in California it would not have a Salvage Title. Therefore they would've had full knowledge of the Title.
