I am rejecting this response because:The main reason diamond truck sales never inspected the truck before you guys sell the warranty by law you guys need to inspection on it which you guys said that you did but that was false statement. I Actully got lucky that I bought warranty on that truck what if I never had warranty .if that's such small amount just simply pay for it .

This client signed a sales contract agreeing to sales price and terms. We provided financing for her since she could not provide her own. She stopped the financing process halfway through the process complaining the process took too long although she ignored our requests to come in a close out...

the loan. Her sales contract states "There is no cooling off period unless a contract cancellation option has been purchased" She is not allowed to back out of a binding agreement once she signs it. We are willing to continue the purchase, we do not like to hold customers money. We sell many trucks and a lot of our business is through word of mouth where customers buy from us due to good experiences they have had. We would like to extend that hand to this client and move forward with our initial agreement in the sale of the vehicle to her. Please, do reach out to me at your earliest convenience.

I am rejecting this response because: As stated in my first complaint, I never purchased any truck from Diamond Truck Sales. The purpose of my first and second visit was strictly to look at their inventory, inquire about prices, and receive a quote to present to my own bank. [redacted], the sales representative from Diamond Truck Sales that I met with on my first visit on May 6, 2015, made me sign a contract both times I visited, and stated that customers needed to do so while waiting for the bank to approve the offer so the truck remains off the market. [redacted] also told me that singing the contract was necessary, because if I did want to move forward with the buying process, that it would be faster if the contract was also signed ahead of time. According to [redacted], I was also told not to worry; that I wouldn't be forced to purchase anything, and that my $2000 deposit would be returned back to me if there were any sales disagreements, such as the Annual Percentage Rate being too high, the amount to be financed wasn't enough, etc. The purpose of the deposit was to put a "hold" on the vehicle, to prevent anyone else from trying to purchase the same vehicle during the application process. [redacted] reaffirmed with me, that if for whatever reason I did not agree to purchase the vehicle, that my deposit of $2000 would be returned back to me. I want to state again, and make it very clear, that I did not purchase any truck or vehicle from Diamond Truck Sales. I never received, nor do I have, any documentation stating my ownership of the vehicle. Both times I visited, I never drove the car off of the lot, and I was told that signing the contract was required both times during the application process. Never was I told that signing the contracts was a finalization of the sale. Also, I never used the Diamond Truck Sales shop for any repairs or inspections, nor did I even purchase any truck from Diamond Truck Sales. I also don't have any statements or documents stating that I used their shop for any kinds of services; it's impossible for me to do so, since I don't own any truck from Diamond Truck Sales.

You are claiming that we have sold you a junk truck and that you have had to fix the alternator the next morning after delivery. But according to our records you had brought the truck back into our shop around 3 days later and we have paid for the parts and labor...

for the repair of the Alternator. You claim is completely false and we have an invoice to back up repairs on your Alternator.
Secondly, your complaint consists of having a bad Cam Shaft and you calling our salesmen [redacted] and "told him of your situation." According to us you had demanded we pay your invoice from the mechanic shop because you are afraid the warranty company would not cover your repairs. Reason being [redacted] said he would get back to you is because of verification of your warranty coverage.  After he had gotten back to you, you were told that your warranty does cover the issues you were having with the Cam Shaft. Your initial response to us was that the warranty company did not cover the full amount associated with the repairs. This morning on 05/08/14 we have spoken to the mechanic working on your truck and he stated that your warranty will cover $110 an hour for labor and your mechanic shop charges $121 an hour so you are responsible for the difference.
Now tying this in with your complaint/demand, you are requesting us to pay you $3,000 for the costs out of pocket expense you have to pay for.  We are still puzzled on where you have acquired this number. For we have spoken to the mechanic and you are required to pay $11 an hour of difference for your labor (Parts are covered in full) and a $100 deductible. We are including an invoice from your mechanic shop backing up our facts but according to your accusation and overestimated demands we have a good reason to believe you are being dishonest and using this complaint to deceive us.  Your desired settlement is that you want us to pay for the rest of the costs that the warranty will not cover and you came up with a figure of $3,000 however this is very inaccurate.
 
Enclosed invoice tells us you have to pay approx. $297 out of pocket plus $100 deductible for your warranty deductible, however you are still demanding $3,000. Your claim is inaccurate and improper.

Once again, the truck was supposed to be part in and repaired by our shop but it was not so therefore we cannot reimburse customer for services done without our approval.

I am rejecting this response because: the truck broke down the same day we took it out of the yard. towing the truck to their yard will cost a lot of money that Diamond truck sales will not pay. I asked for their help to pay for the parts and they said no. They sold us a truck that had problems and now they don't want to help us.

Customer is claiming the truck was promised to be in good running condition by us. Customer has driven the truck almost 10,000 miles as he has stated therefore the truck left our yard in good condition. Driving 10,000 miles is equivalent to driving to New York and back and forth 2 times. Truck was...

inspected by the customer prior to delivering and it met his all of his expectations before he took possession. We have provided the customer with a 90 day/25,000  warranty on his Engine, Turbo, Injector and water pump and he is claiming the warranty does not cover much of his repair issues. He stated we gave him a cold shoulder when he came in to ask on assisting with repairs, He had not even had his truck properly diagnosed at the time of his breakdown so we referred him to his warranty company for assistance. As for the Rust issue it is used truck and the rust on his frame is not sever....  his frame is still in good shape and there are no holes and or loose bolts in his frame therefore it is still in good working condition.  Truck Frames get painted and sandblasted over to give the truck a better presentation. Customer viewed this truck and test drove it more than once before he took delivery. Therefore he was aware of the rust  before he took possession.

This dispute has been officially settled, we have assisted the customer with repairs for you can see the enclosed document. The customer ([redacted]) has signed the letter and no longer holds a dispute against. This letter can be found attached to this email/message.
Please close this file for there is no longer a complaint against us from this customer.

From March 13th 2015 to starting of April. and ever since that its been in the shop its April 29th today I just spoke with the guy who's fixing the truck after putting the injectors in it still has the same problem.It's great that they are funding for all the repairs but this is already the 5th or the 6th problem they'd fixed still more to come. Don't they suppose to have all the problems and issues resolved before selling anything? Without even driving this truck we've already made 2 insurance payments all dmv fees our truck payment is due on may 1st. We're making all these payments without making a single dollar on this truck.This repair need to stop at some point. It can't just keep on going. Dealer doesn't even bother to call us I have to all them and find out even then I have to all few times before I get hold of right person. Either he's dealing with customer or on lunch. Everytime I call they tell me it's going to be fixed end of the day, next day or day after.Just get me my refund for this truck then they will have all the time in the world to fix this truck.

I faxed the parts receipt I want diamond truck sales to pay for it

I am attaching the contract that has been signed for your review. If you read on the 553 contracts  6th signature down it states "There is no cooling off period unless you obtain a contract cancellation option" and it states under it in writing he cannot cancel this contract. We also offer the customer a contract cancellation option agreement which was also declined. See attached 
This sales agreements denies the customers claim that they never purchased a truck. There claim that we "made them sign a contract" and came to "strictly look at inventory" is false because they put money down towards their truck purchase and sign a sales contract. There is also a Due Bill/Work order made that states to "replace super singles" that alone costs our company for than $2000. 
We are at a loss with this customer by his work orders and taking his truck off the market for so long. We should be coming after him for losses, But instead we settled out differences which is why he ended up coming to us for the 2nd time.

this customer took possession of their vehicle and was offered a warranty at the time of sale but they did not purchase a warranty and bought the vehicle as is however we are still trying to help the customer. They were advised to bring the vehicle back into our yard and we would assist them in...

Review: On June 3, 2014 I [redacted] went to Diamond Truck Sales in Turlock to inquire about a 2005 Peterbilt Semi-Truck they had for sale. Because I only keep my Trucks for 4 to 5 years, then I sale the Truck it's important that it not have a Salvage Title. I asked Oscar several times if the truck had been wrecked he assured me that it had not been wrecked and the Title was clean. I paid cash for the Truck so the pink slip was to be sent to me when the DMV paperwork was complete. I called the lot inquiring about Pink Slip, I always have my trucks gone through before I put them on the road: Tires, engine, paint etc. and I seemed to be investing a lot of money in this truck, Approximately $15,000.00. Five weeks later I received a call saying the Truck did have a Salvage Title, after reminding them I was guaranteed it did not Soloman one of the Men from Diamond Trucks offered to purchase the Truck back for the sales price. I'm out an additional $15,000.00 they should also be responsible for this amount.Desired Settlement: I would like the purchase price plus what I have invested in the truck to make it a safe reliable Semi-Truck.

auctioneers ([redacted]) has claimed complete responsibility of the

salvage title. The DMV had failed and/or delayed the report of the title being

a total loss during the consignment process from the original owner at auction.

The auction had not disclosed to any parties the vehicle was a salvage for they did not have knowledge of it being salvaged. Now that they are aware they are willing to pay [redacted] the sales price of what he had paid as long as he returns his truck.

We have

the title in our possession (please see attached) TITLE DOES NOT STATE IT IS A

SALVAGE therefore we had been giving Mr. [redacted] the information we had been

aware of at the time of sale.

There was

Review: On Feb. 5th 2015 we paid $2000 deposit on [redacted] ([redacted]). On Feb 26th we paid them rest of down payment $16721 total $18721. On March 11th 2015 we got them the insurance for truck after paying $3550 as a down payment to insurance company. Diamond Truck Sales got the payment from the bank on March 12th 2015. Ever since that day myself and Corminder been waiting for our truck. From March 13th 2015 to March 28th truck was in repair shop. On March 29th 2015 they told us do come get the truck delivery in Reno, NV. But truck broke down halfway. After fixing the truck they told us to come get the delivery in Reno, NV on April 2nd 2015 this time we got the delivery but truck broke down next day. They towed the truck back into their repair shop and ever since that day it's been sitting their whenever we call and ask they don't tell us anything. Every single time new person new story. Desired Settlement: Give my money for down payment, Insurance payments, time lost, DMV fees or any other money we had to spend.

Starting off, we have been helping this client since hisbreakdown. We are funding all of the repair(s) neccesary to get his truck backon the road. Review: I went to Diamond Truck Sales to check their trucks. I like one truck. They have told me I needed to give $2000 deposit to hold the truck while they check my credit and see if I qualified. After a week or so they call me and said I was approve. But I didn't agree with the APR & payments. So therefore, I didn't buy any truck and ask for my deposit. As they have told me that my deposit will be return to me if for any reason's I didn't agree with any of the sales agreement. Now they are refusing to return my deposit due to I didn't buy any truck.They told me that the only way my deposit can be credit back to me is if I buy a truck from them. So therefore, I try a second time. But until this time I don't agree with any of the sales agreement. Diamond Truck Sales said as long as I don't buy a truck from them I'm not getting my $2000 back.Desired Settlement: I just want them to give me my $2000. deposit back. Customer came in and purchased a truck from us as of May of this year. He signed a sales contract and later backed out. We held the truck for him and kept it off the market to others. He wanted his money back but since he signed a sales contract for his purchase this was not possible since there is no cooling off period. He told us he wanted to hold off on his purchase until the end of the year Customer came back to us later in the year and wanted to use the deposit he left with us and decided to do the same thing by conducting another truck purchase. He subsequently backed out again for the 2nd time and he was in contract for the 2nd time. He has used up our shop time for repairs and inspection twice and has cost our company money. He has signed a contract stating he is not allowed to change his mind after the truck purchase. There is nothing we can for him at this time. If he ever does return to purchase another truck now or in the future we will gladly credit him

Review: I bought commercial truck at diamond truck sales in turlock ca . It is commercial truck they sold me premium2000 warranty for $4500 .They sold me a junk truck after my delivery date I brought my truck to the yard next morning I find out alternater was bad on the truck. So got that fixed and 3rd day truck start making weired noises I took it to cummins in Stockton ca for tune up and found out from them that truck com shaft is bad . So I called diamond truck sales & talk to [redacted] their his sales man told him my situation . He replied give me a day I'll see what I could do 2nd day I called him again and he told me call your warranty they will cover it . I said [redacted] they won't cover the whole thing so he replied you will pay out of your pocket.Desired Settlement: I want them to pay rest of the cost that warranty will not covered . Review: When purchasing my truck I was assured by their sales team and mechanics. the truck I bought was in good running order. Just weeks and under 10,000 miles my truck gave problems that caused breakdowns and out service dates, which caused me to lose days of work and thousands of dollars in repairs. The warranty that was given to me only covered barely nothing of the repairs. I contacted Diamond truck sales but they gave me the cold shoulder and said " That's why they gave me the warranty". Finally not to mention the rust issue that were discovered underneath the chasiss by my head mechanics, that diamond trucks covered by spray paint.Desired Settlement: To acknowledge the problems and reimburse me for my repair bills so early in the purchase.

Review: I am complaining about the purchase of my 2010 Freightliner I purchased from Diamond Truck Sales in Turlock, CA.At the time of this purchase it was made clear by the salesman that the truck is in excellent working condition. I still wanted to get an extended warranty on the engine, being it is probably the most expensive part of the truck. The salesman at Diamond Truck Sales ([redacted]) stated that there was no warranty on their end and recommended that I purchase an extended warranty so there would be coverage on the engine and other components. All of the paperwork was done and I drove the truck off the lot. On my first trip to the East, The engine light turned on within 100 miles. I was concerned that there must be some mechanical problem, that is why the engine light went on. I was on route to deliver a load as scheduled and I determined it may overheat. So I continued to put water as needed so the truck would not overheat. I came back from my trip I had notified Diamond Truck Sales of the issue. They told me to take the truck in for repairs and do not worry, we will take care of the repairs. I went to the [redacted] in Lathrop, CA. As the mechanic diagnosed the issue. It was clearly stated the head gasket was damaged to overheating. I called the warranty that I purchased at the time of sale. They said the head gasket was not covered. I ended up paying $3,800.00 for the repairs and labor costs. The Kenworth dealership in Lathrop, CA printed out the history of the truck and before Diamond Truck Sales sold it to me, It had a severe heating issue in the past. That document is attached for your review. You may contact Kenworth dealership in Lathrop, Ca. I informed the Diamond Truck Sales, that this truck had a history of overheating , before I purchased the truck. This is very poor customer service, and I believe the truck was sold defective. I have enclosed copies of the repairs bills that I have paid, Diamond Truck Sales advised me that they will only pay the labor.Desired Settlement: I would like to get a reimbursement on all of the repairs that I have paid for. Receipts are enclosed for the departments review.

We would like to make a few things clear before hand: The customer information in this complaint states "[redacted]" however this is not our customer and we are not aware of whom he is. Secondly, from the clients complaint log he is stating he purchased a 2010 Freightliner from us however it is a 2010 [redacted]. There was nothing attached from the customers complaint, he mentioned there were paperwork attached from the [redacted] dealer in his complaint message however there is nothing attached.

The customer name is [redacted] located in [redacted]. He purchased a 2010 [redacted] T2000 Model from us which he had taken possession of on 04/30/14. Customer stated he had a check engine light after 100 miles of his first load but continued to drive and did not stop to diagnose the issue. While he was on route to deliver a load and driving on a check engine light his truck began to overheat. Instead of fixing the issue with his coolant, he had continued to add water in his radiator, after his engine overheated due to insufficient supply of water. Customer had continued to do so for over 7,200 miles. He had reached high temperatures of 275 Degrees per the report log. This is not normal and will damage any motor being put through that much stress and abuse. This is clear sign of negligence from his part, he has stated he has had a Class A commercial drivers license for over 10 years so one would assume he would know how to take care of his truck.

After driving over 7,200 miles, customer took his truck to the [redacted] Dealer in Lathrop, CA and after diagnoses, truck had a bad head gasket and needed repairs. He contacted his warranty provider thereafter and the warranty advised him they did not cover head gaskets.

Client stated in his complaint "I had notified Diamond Truck Sales of the issue and they have told me to take the truck in for repairs and do not worry, we will take care of the repairs." This statement is false, client took the truck in for repairs/diagnoses on his own and he had called us after the diagnoses and his truck had been sitting in the shop. we had not made any agreement with him to pay for any repairs. He bought the truck AS-IS with no warranty from the dealer however, after we had investigated how his truck had a bad head gasket, the computer log showed that [redacted] OVERHEATED the ENGINE over 14 TIMES within the past 68 HOUR PERIOD. This has been on the negligent report from the [redacted] dealer in Lathrop, CA (we have also attached documents please see enclosed) these document support the overheating of 14 times,

He complained we gave him bad customer service but we had seen him on numerous occasions before he took delivery and completed nearly all of his requests he had made until he was satisfied with his truck and took delivery.

Customer is requesting we pay $3,800 towards his repair invoice however we have agreed to only help him with the Diagnostic fees incurred totaling out to $417.

We would like to make a few things clear before hand: The customer information in this complaint states "[redacted]" however this is not our customer and we are not aware of whom he is. Secondly, from the clients complaint log he is stating he purchased a 2010 Freightliner from us however it is a 2010 Kenworth. There was nothing attached from the customers complaint, he mentioned there were paperwork attached from the Kenworth dealer in his complaint message however there is nothing attached.

The customer name is [redacted] located in 1475 Lankershire Drive Tracy, CA 95377. He purchased a 2010 Kenworth T2000 Model from us which he had taken possession of on 04/30/14. Customer stated he had a check engine light after 100 miles of his first load but continued to drive and did not stop to diagnose the issue. While he was on route to deliver a load and driving on a check engine light his truck began to overheat. Instead of fixing the issue with his coolant, he had continued to add water in his radiator, after his engine overheated due to insufficient supply of water. Customer had continued to do so for over 7,200 miles. He had reached high temperatures of 275 Degrees per the report log. This is not normal and will damage any motor being put through that much stress and abuse. This is clear sign of negligence from his part, he has stated he has had a Class A commercial drivers license for over 10 years so one would assume he would know how to take care of his truck.

After driving over 7,200 miles, customer took his truck to the [redacted] in Lathrop, CA and after diagnoses, truck had a bad head gasket and needed repairs. He contacted his warranty provider thereafter and the warranty advised him they did not cover head gaskets.

Client stated in his complaint "I had notified Diamond Truck Sales of the issue and they have told me to take the truck in for repairs and do not worry, we will take care of the repairs." This statement is false, client took the truck in for repairs/diagnoses on his own and he had called us after the diagnoses and his truck had been sitting in the shop. we had not made any agreement with him to pay for any repairs. He bought the truck AS-IS with no warranty from the dealer however, after we had investigated how his truck had a bad head gasket, the computer log showed that [redacted] OVERHEATED the ENGINE over 14 TIMES within the past 68 HOUR PERIOD. This has been on the negligent report from the [redacted] in Lathrop, CA (we have also attached documents please see enclosed) these document support the overheating of 14 times,
