Mr [redacted] 's appraisal was produced and sent to his email ( [redacted] ) on the 25th of January and then again on the 31st then again on February the 2ndI spoke to Mr [redacted] on the 25th and he requested me to produce the appraisal as soon as possibleI sent the appraisal out that evening As to our written agreement, we completed the appraisal, sent it multiple times to his email address and have received no response from himHe called my cell phone yesterday but hung upI immediately responded and received a voice mailI have tried to speak with him, but he is not returning my callsMr [redacted] provided his work email address to us and many work emails have firewalls to prevent large files from coming throughWe have not received any bounce responses stating that the emails were returned for any given reasonI believe this is just a misunderstanding and if Mr [redacted] will take the time to speak with me for just a few minutes, we'll be able to hopefully resolve his complaint.We have clearly stated protocols on the invoice that Mr [redacted] paid and agreed to, in the chance that it takes longer than expected to complete the appraisalsMr [redacted] did file a dispute with Paypal and they did not issue a refund because we provided them documentation showing we completed the appraisal, evidence of emailing the appraisal to Mr [redacted] at his email address and evidence that we fulfilled the agreed upon terms stated in the invoiceI am a licensed appraiser which I have provided in the attached documentation, as well as Mr [redacted] 's appraisal, and the paypal invoice he paid and agreed to terms (please not red outlined verbiage)Even though Mr [redacted] stated in his email he would hire someone else, that does not resolve him from our agreementWe try to provide the best service possible to our clientsI produce approximately 2-appraisals per yearSeldom do we have problems producing the appraisalAs stated both on our website and invoiceI am not an attorney, we provide no legal advice, and have no attorneys working for usI can however refer an attorney who is willing to send a client's appraisal and demand to the at-fault insurance company on their behalfAs to the bad weather, our office was closed for nearly weeks during the month of January due to snow and ice, just as many other local businesses wereNot only was our office closed, but local businesses we work with in order to gather research data were also closedI apologize to Mr [redacted] for any inconvenience and would like an opportunity to help him collect his diminished value

The vehicle is a VERY unique Luxury Vehicle and I was having a VERY hard time locating comparables with over 100,miles on themComparing the vehicle to similar vehicles under 100,miles was grossly devaluating the vehicleThe client was aware of this and was in agreement and stated he was more interested in us finding comps with similar miles, in order to prove a higher valueIt appears I spoke to the client the same day he filed a complaint, which under his request we closed the valuation with the comps we had, which we did and had the appraisal to him the very next dayThe client made the request directed to my cell phone, of providing a complete appraisal or his money backI was in court at the time of the request (which requires I turn my phone off during court)I answered in a timely manner and provided the report within hours of the request

We are working with the Clients ( [redacted] ) on thisThe problem lies with the their vehicle having multiple prior claims against it dating back to Normally, once we determine there were multiple prior claims, we stop, and there is no appraisal completed and a refund is only issued if the combined outlay of our hourly rate and the cost of supporting documentation at that point is less than the cost of the appraisalThis is the norm, unless the client purchases additional appraisals and supplies documentation for the prior damage so we can determine the residual diminution in value from the prior claimsThis is an industry standardI am a licensed appraiser and expert witness, unlike most of the online Diminished Value "experts" online, who are not licensedI have to follow rules and as an officer of the court, I cannot produce a or incomplete appraisalI produce each appraisal in compliance with USPAP (Uniform Standards of Professional Appraisal Practice) standardsBefore I can complete the appraisal that the client purchased, I have to determine the residual diminution of value related to PRIOR LOSSES12/12/GEICO, 10/29/ALLSTATE (VAND) $1131, 8/15/ALLSTATE (FRT/ RF) $ Normally, in these instances, I inform the client that I have done as much as possible and can not complete the appraisal based on the unknown prior damageOccassionally If I feel I may be able to still produce the appraisal, as in this instance, I continue to investigate and collect information to try to put the appraisal together for clients when I have timeSince acquiring this type of information can literally take months, I normally just keep working on it until we've either found a way to produce the appraisal or exhausted all possiblitiesWith this Client's vehicle, I have found the most significant prior damage was in August of where the vehicle was in a collision with a Honda Pilot in FloridaBased on the information we have collected up until this time, I believe I need only a small amount of additional information and I will be able to depreciate the prior damage and complete the appraisalIn accordance to our terms of service, if we are unable to complete the appraisal, a charge of $per hour (which is half our hourly rate of $per hour)plus any costs for history reports, etcare levied against the cost of the appraisalIn this case, we have over billable hours related to this appraisal and approximately $for additional historic damage reports, and other documentation purchasedWhich just considering labor, would be over $1,in hourly services they have received against their flat fee of $they paid for the appraisalI feel our service is a great valueWe provide a flat fee appraisal so clients know how much their total cost is before hand, and the clients are not changed one penny more, even if we have to work on the appraisal months longer to try to determine the loss of valueI even provide a money back guarantee on completed appraisalsIn most cases, we would have determined that we could not complete the appraisal due to prior damage, and would have charged our hourly rate against itBut I found enough information on the prior claims, that I was feeling we would be able to produce a valuationThe problem was that during our investigation, we found more prior claims against the subject vehicleWe are working with the client and hope to have the appraisal completed for them soon based on the information on the previous collisions we've been able to acquire

The appraisal was emailed to Mr*** on May 19, This is a legal document and in such, I had to do due diligence in the research of the structural damage to the vehicleThis did take longer than due to some new rulings that occurred at the first part of the year, as we had to modify
methodologies, narrative verbiage and consult with attorneys and other appraisers in order to produce a credible appraisalAs is spelled out in our terms and conditions, once an assignment has been accepted, there is no refund, unless the client fails to receive a settlement after going to court and receives less than the cost of the appraisal as an awardAlthough in most instances most appraisals are completed in to business days, appraisals where the subject vehicle has severe structural damage such as this can take months to complete. thank you, *** ***

Our ultimate goal is to produce an appraisal that will provide sufficient evidence that will lead to a quick and reasonable settlement of the client's diminished value claimA local opposing appraisal company, who works primarily for the insurance company involved in the claim this appraisal
relates to, has come up with multiple new claims over the past few monthsThese claims, are that a vehicle suffers little to no loss of value after an accidentMany of these claims reference Oregon laws and case lawIn order to provide due diligence for my client, which is the reasonable steps taken by an appraiser in order to satisfy a legal requirement, I've had to take additional time to investigate and research these laws and case law and how it relates to this specific appraisal
Even though I am an independent auto appraiser and I am not bound to answer these additional claims and objections, I feel it is my duty to provide my clients with a solid appraisal that answers the questions that may be asked in arbitration or courtI feel a duty to produce a credible appraisal that provides explanations of possible objections which may arise, and clarity of verbiage as it is used in the appraisalSometimes that takes much more time than expected, especially when we're being barraged by sometimes frivolous and unfounded claims by opposing appraisers who work for billion dollar companies
Many of these claims, I feel, are designed to "muddy the waters" and confuse end users (such as arbitrators, magistrates, or juries) and prevent a claimant from receiving what they are dueCall me old fashion, but if I'm hired to produce an appraisal, and I don't feel that the appraisal answers the questions that may be asked of it, I continued to strive to produce an appraisal that willSometimes I end up making literally less than a few dollars an hour, when I could just have just wrapped up the appraisal and completed my contractual obligation to the buyerBut I don't feel that is fair to the buyer, and is not my definition of a flat fee.I apologize for the delays, but it seems that over the past few months, the Appraisers who will probably be the appraiser for the Insurance company related to this claim, have come up with new ways to try to disprove diminished value, at least weekly and sometimes dailyI'm just trying my best to provide a quality service to my clientI'll work diligently to complete the appraisal within the time period they are requesting, which is November 15, If I don't have the appraisal completed by then, I'll happily issue a refund

I am rejecting this response because:My experience with MrN** has been nothing but smoke and mirrors from the beginningI did finally receive the so called appraisal, but it is inaccurate as MrN** would know if he had kept his word. He was supposed to contact Kendall Collision and keep up to date on the required repairs which he never didI picked up the vehicle on Friday, February 3, from Kendall Collision and was told that MrN** never contacted themThe repair price escalated $6,to $7,which again he would have known if he had kept his wordMrN** also told me he had spoken with the other insurance company about our vehicle, which according to them is also not trueI have read numerous reviews of MrN** with very similar complaintsI attempted to contact MrN** multiple times after I paid the invoice and he would not return phone calls or e-mailsI think I made myself clear in my e-mail at 9:AM on January 27, that if the situation wasn't handled by the end of that day I was finished with his firmMrN** did not contact me until the following week, after I had already filed disputes with Paypal, my credit card company and Revdex.comI refuse to do business with someone who will not be honest with me

I have already sufficiently responded to this complaintThe client does not qualify for the money back guarantee as they claim to have settled for more than the cost of the appraisalWe are refunding their money, once they provide all documentation requested, only due to their CRM record being accidentally merged with another record for a few weeks during a migrationWe are not refunding their money due to their qualifying for the money back guarantee as THEY DO NOT QUALIFYI will issue the refund as soon as possible, but they continue to refuse to provide the documentation regarding their claimUntil I am provided documentation so I am satisfied that I'm not being used as an accessory to any type of insurance fraud or crime, no refund will be paid.( e.gif they have already been reimbursed by the insurance company I would have to refund the insurance company, not them)We're not talking about them purchasing a tv or bicycle, this is an appraisalTypically there are no refund on most appraisalsI provide a refund if certain criteria such as them normally pursuing the claim, which they did not and being awarded less than the cost of the appraisalVery few times have we had a legitimate complaintI have very few clients who do not settle very quickly and for a significant award above the cost of the appraisal as I provide an appraisal with a solid methodology and supporting evidenceThe problem is that the client had an obligation to provide certain documentation and to pursue the claim and they failed to provide that documentation or to pursue the claimAll clients are informed they are responsible of providing these documents at the time they purchase the appraisalThe *** filed no lawsuit against the insurance company and was willing to settle for the lowball amount offered by the insurance companyThat is their prerogative, but that does not qualify them for a the money back guarantee

The appraisal for Mrs*** was sent out on September 10, I've only received a few responses from Mrs*** since it was assigned to me, and I didn't find any mail from her from November 25, The appraisal did take much longer than normal, due to circumstances that the Revdex.com should be
well aware of at this pointAs a licensed appraiser, Ihave to follow due diligence in the determination of a valueI can notshort cut the research just because a client requests an appraisal quickerIf I did, that would be insurance fraudWhen new, significant arguments arise, I am bound to address those arguments and to do my bestto determine if those argument are legitimate, or if they are not and to prepare appraisal assignments in kind.Per Mrs***'s complaint, "I paid Ken $USD for HIS PROMISE to complete and deliver the appraisal WITHIN three weeks." I never made such a promiseI may have said I would try, but I would have never promisedI never make promises when there are variables in the m**Per our terms of service on the invoice that Mrs*** agreed to when she purchased the appraisal, "Most appraisals are completed within to business days after all information is received, but may take longer if extra researchor repairs are needed."
Mrs***'s vehicle also had a prior loss associated with it and that took time to determine how it related to the current lossDue to new arguments that had arose due to prior damage, determination of fair market value, and other rebuttals, I detemined that additional research was needed to determine the loss of value.Since is has been over months since the appraisal was completed and mailed, and we received no bounce backs or reasonable reason to believe the appraisal was not received through email, there will be no refund issuedI have attached the appraisal to this complaint.PLEASE UNDERSTANDThis is Legal DocumentNot a simple "product" that can be produced without significant amount of research and due diligenceIf Mrs*** will take the time to review the appraisal, I'm confident she will find the appraisal more than satisfactory

I have no record of any correspondence related to the vehicle year being incorrectThis is normally propagated from Black BookAfter reviewing the appraisal, it appears that there was an error to the year, but that would not make a difference as all the criteria was based on the Vehicle
Identification Number, not just the yearSo this would not only be a easy fix, but is only a typo in the yearPer the terms on the appraisal:
Ken N** assumes no liability for any errors or omissions in this report, or latent or manufacturing defects which may affect the performance, safety or value of the vehicle
Ken N** reserves the right to recall his report and amend for any reason
The report was requested by *** *** and *** *** and the estimate of record from the insurance company and body shop they supplied to me, states that the owner of the vehicle is *** ***I have no record of any reference in writing where it is stated that *** *** should be identified on the report as the owner instead of the identified owner on the estimate of record(see snapshot of estimate of record that I have added to the attached invoice)

The complainant was initially referred to me by their attorney. A few days ago the complainant requested a refund based on our money back guarantee. Our guarantee explicitly states specific terms including receiving less than the cost of the appraisal to qualify and/or actively pursuing the claim...

including filing a law suit against the at fault driver or their insurance company. During the inquiry of whether they qualified, they kept insisting that I had a 100% satisfaction guarantee, which we do not. This is mainly due to the nature of this product being an appraisal and we can not guarantee above the cost of the appraisal the results, as every claim is different and the settlements are normally negotiated. Although we can offer legal information, we can not offer legal advice, which the client repeatedly demanded and became angry when I explained that I am only an appraiser, and can not give them legal advice.Even though the complainants do not qualify for our money back guarantee, after reviewing their case. I decided to issue a refund due to a situation last year where we migrated from one CRM to another and the technician inadvertently merged their record with another client record which caused a delay in producing their appraisal. Please understand, this isn't a product you can just return, and we can resell. It is an appraisal specific to their vehicle. I have agreed to refund their money, not because they qualify for our money back guarantee, but due to the CRM migration incident. The client will still have to produce documentation from the insurance company stating the amount of the appraisal so we can be sure the appraisal was not altered when it was filed with them. This is a reasonable request as I do have to provide documentation in the event there is an insurance fraud investigation related to this claim.
