Again I was not told I was entering a contract. I was told this was the paperwork to start the process, if agreed I wanted to start the program when  upon talking with my husband. Ms Besty I had a hard time to get a hold of on the phone and when I did, never told me of such information. She only told me she would see what she could do for me and I never again heard from her.  This company mislead me from the very beginning.  I should not be charged for something I felt I was blindly led into to and unable to resolve through the company due to them not returning my calls, emails or text messages.  I stated the reason for my fault of not returning a voicemail. What was theirs for all of mine to them? This is a service I did not use from them nor plan to use.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  Distance Learning Center Employee Aaron C[redacted] never gave me a welcoming packet with any of this information in it and further more he stated in the conferance that Distance Learning Systems was affiliated with Excelsior College not once did he say that they was a Turtoring service and he also said that the first half was to be financed with there affiliated company and the second half could be paid for by fafsa gov assistance grant and even scolarships Instead everything was financed over 7000 dollars. I would like to be with drawn from the program it is Fraudulant and false advertisement on there part mr C[redacted] did not even allow me to see the written contract all was on his computer and all my information was not filled out in the contract there is a portion of the contract that was supposed to be initialed by me and was not I am asking that all payments are stopped immediately and I will no longer access the program I have not used but two classes and was charged ahead of all being used for 12 courses I have email from Excelsior College admission stating they are not affiliated with any outside source and also email from Mr C[redacted] giving me the school code for Excelsior College for me to apply for fafsa assistance to pay for my schooling and I am now told by Daniel that I can not use FAFSA to pay for anything I have text messages with this information from him also All I would like from this if they are unwilling to refund me my money paid is to unenroll me and stop all payments owed to benfranklin financial I do not want to be any part of this frauntulant company and the associated lies with them They withing the seminar should say bluntly they are a tutoring company not any kind of school associated with another school I have also read many complaints from other clients with the same complaints of false advertising I was also never told about having to pay over $500 dollars for tests after each class When I am already paying over $7000 for classes I was never told about the 72 hour cancellation period or given a formal written paper contract from Aaron C[redacted] Please look over this and contract or not a lie is a lie and taking advantage of people is wrong and not morrally right to do.

When reading Distance Learning Systems response, I do not understand how one could tell the tone of my attitude when writing. I was not calm or in a calm manner when contacting Distance Learning Systems. Also, there is not any mention of the text messages to Josh G[redacted], in which I was told to contact from Academics who could not answer any of my questions. Josh G[redacted] would not answer my calls and would any communicate via test message, which I found highly unprofessional. Also, there is not any mention of how the material on the exam did NOT mirror anything from the "course" I took. As to regards with my emails to Manal, it is very shady when a test is taken that doesn't have any material, then you contact the instructor and there is an error message. I sent every email to the address provided from Manal and from academics. Furthermore, I became dissatisfied with the program before taking the assessment when contacting the academic department. They could not answer what my course schedule would be, only referring me to the website. I questioned academics multiple times regarding this, still getting the runaround. It was after I took the assessment and from the poor feedback I received that I knew something was not right with Distance Learning Systems. A final note: there was never any mention of Josh G[redacted] from Distance Learning Systems. He sold this company as a school (as noted in the prior response and attachment photo) and he did not respond to me in a professional manner. Again, I want this contract terminated. If I can not be reimbursed the money I spent, I want the bills from [redacted] to stop. Why should money be spent if the end result was not what I was promised. Mr. G[redacted] promised a degree AND credits. This corporation seems to be scamming innocent people and it needs to end. I will rather spend my hard earned finances toward a real education at a quality, accredited institution.

I am not 100% what the original complaint was as it was sent to [redacted] Finance and I cannot respond to anything related to them. What I can add to this is that Ms. [redacted] did email academic support on 1/8 upset that she was pulled from class. Ruthy in our academic department explained that if you are not logging in weekly, we will pull you from class for attendance. She was placed back into the class on 1/9 and then removed again on 1/25 for inactivitiy. From February through May 2016 her personal coach called and left messages for her to contact us. On June 7, 2016 we received a text message from Ms. [redacted] stating that she was no longer interested in attending our program and to please remove her. Ms. [redacted] signed a contract with a 72-hour cancellation period. This cancellation period is clearly documented on 4 different pages throughout the contract. This policy was also explained to her over the telephone on 12/15/2015 by Jack W[redacted], our National Sales Manager. I have attached a copy of her contract for your review.  I have also included a copy of the addendums that were signed by Ms. [redacted] to add a course to her contract.

Ms. [redacted] states that she was having issues learning on her own and wants to cancel her contract. Ms. [redacted] signed a retail installment contract on 4/29/2015. This contract very clearly documents a 72-hour cancellation policy on pages 4, 10, 13, and 17 of the contract. (see attached) Ms. [redacted]...

has been placed in one Microbiology class and she did not week 7 of the videos and did not complete all of her quizzes for the course. She has since been placed in an open Microbiology class and has not really done anything in the open class. There has been no complaint or contact regarding her dissatisfaction of our program until 7/29/2015. We cannot cancel the contract, but we will continue to provide the classes and materials as agreed in the contract. All of our clients have an academic advisor that is available to help with study tips and helpful test taking information, there is supplemental information available within the online classroom, and the instructor is available to answer any questions. Sometimes, all of these tools must be utilized along with every video and each quiz in order to be successful in this program.

[redacted]. I want to first apologize for the delay in my response to this complaint. In regards to Ms. [redacted]'s complaint regarding a failed exam score, we do not have any documentation on this failed exam. We do however have two passing exam scores (one is for Microbiology and one is for Ethics). We also do not have any documentation of her wishes to cancel at any time. The only thing we do have documented regarding any frustration is that Excelsior College informed her that she needed to add a course. We have had otherwise positive correspondence with this client. In regards to our pass rate, we do track that information. Yes, our clients take Excelsior College exams, but they utilize our material and take our classes to prepare for those exams. Our pass rates fluctuate monthly and by class. The advertising material Ms. [redacted] received may have very well been accurate of a current pass rate at that time of 99%. In 2014, our overall pass rate for the entire year was 98%. We had a total of 1064 test scores reported, and of those reported scores, only 26 were failing grades. We are committed to our clients and take the feedback we receive on failed scores to improve our program. I am the one that spoke to Ms. [redacted] regarding her request to have her contract and receipts mailed to her and I did mail those out the day after she called. I am not sure why she did not receive the envelope. A copy of this letter and all attachments has been mailed to her today. There is a 72-hour cancellation period, and beyond that there is no cancellation. We will continue to provide a high level of service and assist Ms. [redacted] in the completion of her program. On 4/13/2017, Ms. [redacted] attended an information session regarding our program. At that time, she received an enrollment agreement sent to her email. 72-hour cancellation period on this agreement that is clearly documented in the contract. She requested a post-dated down payment date of 4/24/2017. On 4/17/2017 Andrew M[redacted] reached out to get the remaining digits on her credit card (she only provided us with 12 digits).  She did not respond to him until 4/24 and at that time was the first she mentioned of not wanting to enroll in the program.Her contract history, and enrollment agreement are both attached. Ms. [redacted] enrolled in our program on 10/15/2014. Her contract was very clear on all the fees, monthly payments, and enrollment costs with Excelsior College. The 72-hour cancellation is also very clearly documented on four different pages throughout the contract. Ms. [redacted] has passed a total of 5...

exams. The only "issue" we have documented aside from her not wanting to pay, is an issue with logging in. On June 185, 2015 she called in because she could no longer log in to her Developmental Psychology course. This was because the class was over, and it was closed. The resolution was to place her into an "open" class so she could continue her studies.On 1/15/2016 Ms. [redacted] called in and was extremely upset that we do not provide any tax documents. We are not the degree granting institution and cannot provide any type of 1098-T form. We did advise Ms. [redacted] to contact her tax professional to discuss the matter when she files her income tax return. She stated that if we did not cancel her contract and issue a full refund she will file a complaint with the Revdex.com. She was again told that we cannot cancel her contract, and she ended the call.We will continue to provide Ms. [redacted] with the coursework needed to continue to pass her exams, but we will not cancel her contract.

Our Microbiology class is taught by a Biologist with amazing reviews (see testimonials attached). We will not cancel her contract, but we will refund the cost of this one course once we have both failing grades per the guarantee in our contract. I have attached a copy of her contract as well.

As I stated in my first complaint I only agreed to submit my initial application for my transcript to be evaluated and sent back to me. I never paid any down payment as claimed by the business. I also didn't sign any document. The document shown is not having my valid signature nor did I signed it. It is a fraudulent document. The company should be sued for forging document in my name. I want this company to forget my name for good by releasing me from all the financial responsibility and refund my application fee which is $95.  Regards,[redacted]

Ms. [redacted] first contacted our office regarding her wishes to cancel on 9/19/16 stating reason of lack of communication (again - there had contact between Ms. [redacted] and our academic department on multiple occasions regarding her transcripts and removing one class from her plan that she already received credit for). The cancellation period was explained to her at that time (and is clearly documented in the contract that she signed on 3 different pages).Our program works, we have clients successfully completing our program on a regular basis. We have a pass rate that is higher than most colleges and universities. While we will not cancel Ms. [redacted]'s contract outside the cancellation period, we will provide her the service and materials she enrolled for. It is our goal, just as it is hers, for her to complete our program successfully to obtain her Associates Degree from Excelsior College, pass her state boards, and earn her RN license.

The testing fees are covered during the seminar or webinar each client attends/watches. The testing fees are also covered in detail in the welcome pack that each client receives. Ms. [redacted]'s welcome pack was sent to her email on 2/10/2015 (the day she signed her contract) at 3:19 pm. We will not...

Ms. [redacted] was pulled from her A&P class on 4/11/2016 due to inactivity. She had not logged in for 20 days so she was pulled. She called in and spoke to someone in academics on 4/12/2016 and stated that since she was removed she was just going to focus on her Microbiology review for her exam...

right now. On 5/11/2016 she contacted our academic department and said that she wanted to stop and take a breather. At that time she was informed of the 72-hour cancellation policy and that her payments would still be due, but that she could put her classes on hold at any time. Since that time she has stopped making payments on her account, and has been sent to collections.

I have attached a copy of Ms. [redacted]'s enrollment agreement for your review. The information regarding the TEAS testing is very clearly documented on her enrollment agreement. In addition to that documentation - the TEAS testing is covered in the online orientation class (which is required for all...

clients). Ms. [redacted] never attended that orientation class, and I have also attached that documentation for your review. We were clear up front regarding Excelsior's change to include the TEAS testing and we have even created an online class to assist our clients in passing. We are not cancelling this contract, but we will continue to provide and exceptional level of service and support that she is contract for.If you have any questions or require any additional documentation, please let me know.

Making changes now does not correct what has happened. I have had to rely on other sources to continue my studies because I have lost all faith in your company. You continue to speak of your pass rates... Well prior to you kicking me off your Facebook page I myself saw many many students posting that they failed exams or are retesting for this or that exam. How in the world could I trust your material when these exams cost hundreds of dollars? As far as accents being something we need to adjust to, yes I agree, but only when you are actually being taught and not simply being read to. 
And as far as your company not being required to have a relationship with the degree granting institution, it is not I that stated you did, it was stated in the webinar "we partnered with excelsior to provide classrooms for their courses" I am very well aware of the fact that your company is not affiliated in any way shape or form with my degree granting institution.

Thank you for your feedback. All courses, regardless of revision dates are constantly updated, which explains why our pass rate is always between 98% and 100%. We have spoken to the instructors regarding your request for more discussion on power point topics and that is being addressed. Regarding an instructors accent, this instructor has an amazing pass rate. There are instructors in pretty much every college who have accents. That is just something as students we need to adjust to. When possible we will attempt to place you in other instructors classes, but our instructors are all chosen for their grasp of the subject matter, and they ALL have amazing student feedback and pass rates. During the sales presentation, there was a slide that displayed 3 aspects of the program: Distance Learning Systems, the tutoring company and the degree granting institution, which for this degree is Excelsior College. The role of each is discussed along with interaction between the three. We are not required to have a formal relationship with any college, as CLEP, DSST and ECE test scores are accepted by this college (and most colleges) for credit, regardless of how the student prepared for the examination. Compared to traditional nursing courses this program is very fast as long as the customer stays active. There is typically a wait to start the very short clinical as this program is very popular. Different clinical locations have different wait times, so you might research where you want...

When we contacted the state board, they gave us no reason to believe otherwise. This is a scheduled review of the program.
