Initial Business Response /* (1000, 6, 2015/07/30) */
This is a monthly parking lot only and requires a hangtag to be displayed and clearly visible from the front of the vehicle while parked on the premises. The tag was not visible when the citation was issued.
Initial Consumer Rebuttal /*...

(The consumer indicated he/she DID NOT accept the response from the business.)
I don't accept this response as it is inaccurate. I was a monthly parker (pre-paid for the whole month) and my tag was displayed properly. This company in no way was able to show me that my hangtag wasn't visible. They sent me a picture of the back of my car. What does that prove? Besides the fact, as I said I had already paid to park there for the month. I feel as if this is a scam.

Paying the ticket in no way is an acknowledgement of fault. I do not want my credit affected or to be involved with collection agencies, which I'm sure is this companies intent. No less than 3 people that I work with have had this happen and are cancelling their business with them. This is a scam and a dishonest company.
Final Business Response /* (4000, 14, 2015/08/07) */
Each citation was administered when the vehicle parked did not display a proper hang tag. Appellant agrees to display proper hang tag when they sign the contract at inception. If they choose not to follow these rules they are issued a citation. Should the choice be made to take your business elsewhere because you are unable or unwilling to follow these rules you have the freedom to do so, however in no way does that make our diligence to enforce the posted rules anything but a proper operation.

Initial Business Response /* (1000, 6, 2015/09/18) */
Most parking lots in the metro area charge a minimum $75 for parking violations. This is charged in order to cover the cost of enforcement in addition to the penalty for the parking violation. This penalty amount is typical for the parking...

industry. Most citations reduce the total amount by $20 if paid within 14 days.
When parking on private property you must adhere to all posted rules or be penalized. The city of Denver charges 12-25 times the cost of parking for their penalties.

Initial Business Response /* (1000, 6, 2015/12/14) */
Me [redacted] was sent the following email late last week.
Mr. [redacted],

Your email was not ignored, it is just a busy time of year and we have not had time to give your email an adequate response given your level of frustration. We do...

understand your frustration and since you may not understand the logic behind the expensive Lost Ticket price I will take the time to explain it to you.

We have the Lost Ticket button so patrons can exit the facility without needing further assistance when they lose their ticket. The Help line is there to assist patrons who are not following the signs and may need further instructions. The attendant who answers the Help line would not have been able to discount the Lost Ticket cost, they would have only been able to instruct you to pay using the LOST Ticket function. There is no way to discount the transaction over the Help Line nor does the attendant on the Help line know how long you have been in the garage whether you had been in the garage for a week or an hour. If he were to just let you out of the garage the facility loses out on the parking fee that is owed.

In addition and most important to the Lost Ticket Fee amount is that it is common at this garage and garages near a transportation hub for vehicles to be left for multiple days at a time while the owner is traveling on the train or other means and for the vehicle owner to attempt to exit without paying for parking fees using various methods, including the Lost Ticket button, when their charge exceeds the Lost Ticket charge. There is no way for us to monitor each car that enters and exits the garage with it being an unattended, automated facility so to prevent this from happening we charge an expensive Lost Ticket fee and the problem for the most part resolves itself.

Many patrons feel like they should be treated as the exception because their story is unique to them. Unfortunately we do not have the resources to handle each case and research and study it out. We have no way to gauge the truth of each story. Therefore we must treat them each the same. We understand we will lose some business.

So you are also aware in your future parking, this is not unique to this garage. There are garages in the Downtown Denver area who experience similar theft of parking fees and have Lost Ticket Fees that exceed the cost of a day's parking. As it sits our Lost Ticket Fee is equivalent to just over 72 hours parking at this garage.

Obviously this explanation is more than we can give every vehicle who enters our garage but since you took the time to email us we took the time to give you a more thorough explanation. We will use your feedback and attempt to improve the parking experience here for future patrons.

-Management
Complainant admitted to losing his ticket and the penalty for this error was paid through the Lost Ticket button. No refund is owed and our business practices should not be called into question when the complainant created the problem by his inability to keep possession of his ticket. We will take his feedback constructively and add additional signage at the garage entry so there is no question what the Lost Ticket Fee is upon exiting without a ticket.
We consider the matter closed for all of the reasons listed in our thorough email response to him.

Complaint: [redacted]
I am rejecting this response because: I entered the lot at 0:45am on Sunday morning...

and left at 7:25pm, parked for 18:40 total time, a day is 24 hrs. A regular day starts at 12:01 in the morning and ends at 12pm at night. The sign reads BIG letters ALL DAY Saturday and Sunday $5.00. The company claims the day starts at 5am in the morning but that is not what is announced it reads all day.  therefore it is a deceit, fraudulent advertisement. See attachment of the sign. It is not about the $5.00 is about principle and customer service. The sign is just deceitful. I was not parked for two day I parked only on Sunday and for 18 hours and 40 minutes which do not equal two days as they claim.
Sincerely,
[redacted]

Complaint: [redacted]
I am rejecting this response because: I agree that is it not your responsibility to define where [redacted] Parks lot is but it is your responsibility to define and label your locations.  There are many other people who have submitted a very similar complaint to you.  I think you as the business are required to at lease check that you have proper signage because what you currently have is inaccurate and does not do a proper job defining your lots start and ending locations.  I am sure we can come to some sort of compromise.  I called your business the other day and found out that I could get an entire months parking pass for $75 which is the exact same as what you ticketed me.  Your lack of signage is to blame for my "mistake" and I use that very lightly because I am not in the wrong here.  If the company is willing to come to a compromise such as I will pay $7 USD to you (which is the exact same as I paid to [redacted] park for the day in question) to help with the 1 day parking that I did in your lot.  I would hate for this to have to end up in small claims court over a very simple issue.  Please look at the documents that I have provided and see how your lack of signage made me make an "incorrect" assumption on where I should park.  I do agree with you that [redacted] park should have better signage to define their boundaries but the exact same goes for you.  Please let me know if you accept my offer to pay you $7 USD for my one day parking on your lot.Sincerely,
[redacted]

Appellant concedes she did not enter the correct license plate when making payment which is required for parking on the lot. This the vehicle parked on the premises was not paid for and a citation was correctly issued. Enforcement can only go...

off of the information provided. No apology is warranted by enforcement when the error was admitted by the appellant and the citation was warranted.
Enforcement has already reduced the citation amount by over 90% and the remaining amount does not even cover our overhead cost of issuing the citation and dealing with the appeal. If appellant pays the reduced amount by 10/12/15 at 5pm we will honor the reduced citation amount. If payment is received by this time and date the original citation will stand. If left unpaid it will proceed through the collections process after 30 days.
Initial Consumer Rebuttal /* (3000, 8, 2015/10/12) */
(The consumer indicated he/she DID NOT accept the response from the business.)
No, I did not concede that I entered the incorrect license plate!!!! As a matter of fact, I entered the correct plate number. When the system read back to me on my phone the license plate it was read back to me correctly. If the system recorded the incorrect plate number in the system I would have had no way to know this. THE SYSETM DID READ BACK TO ME THE CORRECT LICENSE PLATE ON MY CAR. AS I HAVE TOLD YOU AND PROVIDED PROOF, I HAVE PAID YOU MONEY. YOU WILL NOT GET ONE MORE PENNY FROM ME BECAUSE I HAVE ALRAEDY PAID YOU MONEY. THIS IS SO INCREDIBLY DISHONEST I AM AMAZED AND APPAULED!!! YOU WERE PAID THIS MONEY ON THE NIGHT WHEN I USED THE PARKING LOT. YOU ARE NOT ENTITLED TO MORE MONEY. IF THIS GOES TO COLLECTIONS I WILL FILE A LAWSUIT ALEDGING HARRASSMENT! If this is not resolved by 10/13/15 at 5 pm I will be calling the channel 9 news trouble shooter. As a matter of fact, in light of the fact I don't owe you anything because the person who owes you the money is the person who owns the car with the license plate you have on record and I don't own that vehicle.

After a more detailed review we confirmed thru the payment company that no payment was made for this vehicle at this location on 9/21/15. A photo listing all vehicles paid in real time on the attendant's cell phone when the citation was issued is attached.
As per 2 of the attached photographs, appellant was driving a red Toyota Tundra with CO plate [redacted] Furthermore we have verified through DMV records that [redacted] is the registered owner of this vehicle. According our notes on this notice, [redacted] is disputing the notice which is also confirmed on this Revdex.com complaint.
We re-confirmed that no payment was received by our payment system for this vehicle on this date. Additionally, this lot charges $7.35, so $6.34 was an incorrect amount and should have been noticed when the payment sign at the entrance clearly shows $7.00 + $0.35 service charge. Had a payment actually had been made successfully using the Paybyphone system, when appellant made payment she either 1. entered the wrong location code AND/OR 2. entered the wrong license plate. We do not know for sure what appellant did and cannot speak to that, but we do know with 100% certainty that we did not receive payment. As further evidence attached is a report using her license plate as a search confirming she did not make payment using that license plate number on 9/21/15.
All things considered, since we received no payment for that vehicle on that day the ticket stands. If we do not receive the discounted payment of $7.35 by Friday, October 16 at 5pm the original amount the citation was written for will stand. If left unpaid after 30 days it will be forwarded to our attorney's office for collection.
Final Consumer Response /* (4200, 13, 2015/10/16) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I received this message at 6 am from Revdex.com and was not able to see it until 6 pm this evening. I have now made the payment receipt number is XXXXXXX in the total amount of $10.82 as there was a $3.50 processing fee . Payment of this money in no way shape or form admits any wrong doing or that I owe the money. I was not given adequate time to make payment per latest deadline as should be given to someone who is working.
As it pertains to this event, I followed the instructions exactly as was directed at the parking lot in question per the billboard to the right of my car. There was nothing that would have indicated to me that I ever did anything wrong when my payment was confirmed. The amount actually read back to me on the phone (from my memory here) was actually 8 dollars and some cents had been paid. I remember going into the building a bit unhappy that the amount was more than posted but since I had followed the instructions exactly as posted I didn't see that there was anything else I could have done. I am 100 percent certain that when the system read back to me the license plate on my car it read it back to me correctly which tells me that there was an error in your system. If the system made an error in the license plate which is evidenced in the fact that the license plate was different on the ticket than it was on the car (when it was applied that evening) which you didn't know about until I told you then it most likely made error also in location.
So, I have made the payment demanded. To the Revdex.com, I have not clicked on the accepted button because I do not want in any way admit that they are correct in this situation. I would imagine that the file can be closed. They have now admitted to previously receiving 6.34 cents from me.
1. I did not enter an incorrect location code. I followed the instructions on the posted billboard above my car to the letter.
2. The system read back to me my car license plate exactly as it was on my car but recorded it in the system incorrectly.
Please forward to me a finalized closed copy of this report.

Appellant chose to park in a private lot not open for public parking. Our lot requires a hang tag to park, as explained on the large signs located at the 2 main entrances. Our only legal recourse is to issue the citation, which we did. It is not our responsibility to define the borders of the lot...

you paid to park in, it is the responsibility of the operator of that lot. Any further complaints should be issued to [redacted] Park. You need to voice your complaint to them for allowing their lot to be oversold.

Hello,Douglas Parking does not do enforcement at this parking lot during business hours, only after hours 5pm - 6am.  Therefore, this ticket was not written by Douglas Parking, it was written by building management.  Douglas Parking does contract with [redacted] at numerous locations...

throughout the nation, including this one.  Their payment information is updated instantly and we have never had a problem with a lag in their system.  We don't feel that we are the responsible party in this dispute. Thank you
