MsLatoya, StarTex Power's representative contacted meShe confirmed that she fully understood that I did not cause the early terminationHowever, since StarTex cannot pursue their charge to Mr*** ***, she suggested that I should pursue with Mr*** and StarTex ETF is still valid on me.As my point of view, I signed the contract to buy electricity from StarTex, then the company should be single point of contact to solve any issue with my accountAs a consumer, I should be protected from any wrong doing and the party who has responsibility to protect me is the party who I signed contract withTherefore, it is not fair for me that I have to pay ETF just because they cannot charge the guy who took the service away

StarTex Power sent *** a Contract Expiration Notice which provided him with clear and precise instructions as to how to renew his existing StarTex Power account. (Notice available for review) *** failed to follow the instructions and instead attempted to enroll an already active address to get a promotional rate available to customers enrolling for the first time, as advised on the Power to Choose website. StarTex Power is in no way trying to get around this matter and has confirmed that our actions are consistent with the rules and regulations set by the Public Utility Commission of Texas, the governing commodity for all Retail Electric Providers (“REP”) operating within the State of Texas. As such, ***’s account does not warrant any adjustments at this time.

Fix the your system then the whole situation will be avoided but for now it a valid compliantYour email was mid leading stating if the account was not to be set up you would be contacted within day Never revived a call or a emailI can also upload the email if needed that states the fact from star tex "A StarTex Power representative will contact you within one business day if there is an issue with your order." Copy and pasted from emailSo startex how about you resolve the problem instead of trying to get around the problem with fancy emails that you have to use spell check with and fix something for a change.Only if you were to put this much effort into your business I would not have to complain about the situation

Door to door agents are not direct employees of StarTex Power and are contracted through a third party vendor.  Upon...

receipt of Revdex.com Case # [redacted], StarTex Power immediately began an investigation with the agent’s vendor regarding Mrs. [redacted]’ concerns.  High pressure sales tactics and misrepresentation is never tolerated and is against all principles to which we demand our third party vendor contractors adhere to.  Matters such as this warrant disciplinary action leading up to termination.    
StarTex Power has returned Mrs. [redacted]’ service to her previous provider as of 1/22/2015.  Mrs. [redacted] will receive a $50.00 for her recent experience. 
StarTex Power apologizes for any frustration this matter has caused.

Power received a request from [redacted] on behalf of [redacted] asking StarTex Power to regain [redacted] service from the date of loss. As such, StarTex Power agreed to regain [redacted] service from the date of loss. • On [redacted]2014, [redacted] contacted StarTex Power to advise that he switched his service to [redacted] Energy and that his account should not be active.  StarTex Power advised [redacted] that his service was switched to [redacted] on */20/2014; however [redacted] asked StarTex Power to regain his service from the date of loss.
In conclusion, StarTex Power was asked to regain [redacted] service from the date of loss and agreed to do so.  As a result, [redacted] StarTex Power account became active again as of */21/2014 and there are no adjustmetns warranted at this time.

Mr. [redacted] has also reached out to our regulatory commission and StarTex Power has been advised that we have acted in good faith and the disputed variable rate charges were correct and in accordance with stage and local laws. While we are sorry we could not reach a mutual agreement, the Public Utility Commission of Texas has made a final ruling on the decision.  As this falls under our governing regulators decision, we must adhere and comply with their laws.  Any questions or appeals of this decision would need to be directed to the PUCT.

StarTex Power issued a Contract Expiration Notice on 8/13/2014.  (Notice available for review)  This letter advises that Mr....

[redacted]’s contract is scheduled to expire as of 9/15/2014 and that in order to keep the account from transitioning to a month to month variable rate plan, a renewal would be needed.
 On 9/16/2014, Mr. [redacted]’s account transitioned to a month to month variable rate plan because a renewal was not completed on or before 9/15/2014.
StarTex Power confirms that Mr. [redacted] contacted StarTex Power on 12/10/2014 to request an account adjustment because he was not advised of his contract expiring.  StarTex Power advised Mr. [redacted] that a Contract Expiration Notice was issued on 8/13/2014 and that as a courtesy, upon the completion of a renewal, his latest invoice would be adjusted to reflect his previous contract rate.  He was also advised that the adjustment would be applied in 1-2 billing cycles.  Mr. [redacted] found this offer unacceptable and requested to speak with a supervisor as he wanted an immediate adjustment applied to his account.  He was advised that a supervisor would contact him within 24-48 business hours.    
StarTex Power’s records indicate that a Customer Care Supervisor contacted Mr. [redacted] on 12/12/2014; however he was unavailable and a voicemail message was left. 
Upon receipt of Revdex.com Complaint No [redacted], StarTex Power contacted Mr. [redacted] in an effort to bring this matter to a satisfactory resolution.  Mr. [redacted] has asked that StarTex Power no longer contact him as he has been harassed and abused as a customer.
Although StarTex Power has acted within the guidelines set forth by the State of Texas regulatory body and provided Mr. [redacted] with proper notification of his contract coming to an end, a credit has been applied to his account as a good faith gesture. Additionally, per Mr. [redacted]’s request, StarTex Power will no longer contact him and respectfully request that the Revdex.com administratively close this complaint.

[redacted] Power’s initial response advised that the first contract **. [redacted] agreed to on [redacted] did not take effect.  As such, **. [redacted] contacted [redacted] Power to advise of the error and a $[redacted] bill credit was applied to his account for the inconvenience.  [redacted] Power also adjusted **. [redacted]’s invoice that billed at the incorrect rate and applied a credit in the amount of $[redacted]  **. [redacted] also agreed to an additional fixed price plan so that he would no longer be billed at the higher month to month variable rate.  **. [redacted] did ask for paperwork pertaining to the fixed price plan he agreed to on [redacted] and was advised by the [redacted] Power representative that he would receive the details of his contract in writing via standard mail and email.    
 
In regards to the outstanding balance due, **. [redacted]’s account was final invoiced in the amount of $[redacted] on [redacted] after service dropped due to a switch on [redacted].  This invoice includes an Early Termination Fee in the amount of $350.00 and bill credits totaling $[redacted].  (Invoice available for review)  [redacted] Power received a payment in the amount of $[redacted] on [redacted], leaving a balance due in the amount of $[redacted].  [redacted] Power referred **. [redacted]’s account to third party collections after several failed attempts to collect the outstanding balance. 
 
[redacted] Power reiterates that no adjustments are warranted at this time as **. [redacted] agreed via a recorded telephonic renewal to allow [redacted] Power to remain as his Retail Electric Provider for an additional 36 months.
