TheBank is still conducting its investigation which is due to expire in 90 days (11/17/2015) from your initial notification. Asecond checking account was opened for you at your request on 10/14/2015 as a courtesy so you would have access to fundsthat were being deposited.On 11/02/2015, the initial disputed account had been overdrawn for 49 days. Regardless of situation, the Bank’s policy is to“charge off ’ an account that has been continuously overdrawn for 49 days. At the time of the charge off, the bank reservesthe right to “use the money from any other account in which you hold an interest to pay the debt” . This is found in theDeposit Account Agreement. When the original, disputed account was charged off, funds were collected from the newaccount that was opened to off-set the amount owed to the bank. The charge off was not sent to Collections and will not besent until the disputes that were filed are resolved.The case will be resolved on 11/17/2015, at which time the action taken will depend on the outcome o f the disputes. If thedisputes are valid, the temporary provisional credit will become permanent and any fees assessed as a result o f the disputeditems will be refunded. All transactions posted to your account and all fees assessed to your account were assessed in accordance with the deposit account agreement and personal fee schedule provided to you at the time of account opening (enclosed for reference).On February 20,2018, the ending balance for your checking account was $126.89. To determine your available balance for February 21, 2018, we take your ending balance from the prior business day plus or minus any pre-authorized debits or available credits. Your available balance to pay items on February 21, 2018, was $126.89. Pursuant to the deposit account agreement and personal fee schedule, your checking account was assessed one, $12.00 continuous overdraft fee (COD Fee) on February 28,2018, as the account maintained a negative balance for three business days.On March 1,2018, I spoke with you via telephone regarding your checking account. We discussed overdraft services. I advised you that your account was opted-out of overdraft services for your debit card purchases and ATM withdrawals, which would cause any debit card purchases and ATM withdrawals to be declined and not paid in to overdraft for your checking account if funds were not available. I further explained that recurring automatic clearing house (ACH) transactions would be paid into overdraft for your checking account. We discussed the transactions that caused your account to go in to a negative balance, which included the recurring student loan ACH payment of $141.32 and transfers to PayPal (current statement enclosed for reference). During this conversation, you advised me that you do not keep an accurate checking account ledger, instead utilizing FNB's mobile and online banking features to track your balance information. We discussed options to help you avoid OD Fees in the future, including opening a personal line of credit attached to your checking account as overdraft protection and keeping an accurate checking account ledger. I advised you that Ellen S[redacted], Branch Manager of the Lewistown Office, would follow-up with you via telephone to discuss how your account went in to a negative balance and how the OD Fees were assessed.On March 6, 2017, you spoke with Ms. S[redacted] via telephone. Ms. S[redacted] advised you that the recurring payment for your student loan and the transfers to PayPal were ACH transactions and therefore not covered under the overdraft services opt-out. The two of you discussed that your account was brought to a positive balance on February 23, 2018, with a deposit of $1,022.17, and that you had not accounted for the OD Fees totaling $370.00 assessed on February 22, 2018. This caused your account to become negative, as listed above. The negative balance of your checking account on February 27, 2018, as listed above, was also discussed including the OD and COD Fees. During this conversation, you advised Ms. S[redacted] that you used FNB's mobile and online banking to monitor your account. Ms. S[redacted] reminded you that the fees are calculated in both the online and mobile banking ledgers and you responded that you had made a mistake and did not wish to pay the OD and COD Fees.On March 15,2018, as a one-time courtesy, OD Fees in the amount of $370.00 were refunded to your account. FNB processes transactions on your account in order from highest dollar amount to lowest dollar amount. We’ve included an additional, full copy of this agreement for your review and to hopefully clarify any misunderstanding. The Deposit Account Agreement Disclosure section pertinent to your concern is also copied below: OVERDRAFTS/RETURNED ITEMS In connection with overdrafts, our determination of the account balance may be made at any time between presentment and our applicable deadline, and will only be made once each day Monday through Friday, except federal holidays. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Mr. H[redacted] certainly play fast and loose with the truth about this issue. He fails to mention that the Corporate Office stated that the problem was created by the manager of the Macedonia OH branch.  He also failed to share that the complainant has advised him that his particular manager lied to him about the previous manager who he stated had been fired and called her a "[redacted]."  Neither is true.  Mr. H[redacted] also failed to mention that the current manager, while the complainant was doing a transaction at a branch teller's window was forced to come to his office even grabbing the complainant by the arm of his jacket and literally THREW him into his office so hard that the complainant who is diabetic and falls easily landed "spread eagle" on the manager's desk.  Mr. H[redacted] also failed to mention that First National Bank is retaliating against the [redacted] family for reporting the manager's actions by announcing that the bank is closing our account on June 30, 2018.  This man needs to be exposed and First National Bank needs to be exposed for their actions by allowing this complaint to be posted openly on the Revdex.com website to warn other elderly and disabled persons of the terrorism by this company which they had started.  The complainant is yet not able to access their account online consistently, i.e. each and every day, as they had been able to since the account was opened and the branch managed by a fantastic non-threatening non-foul mouthed person who is believed to have prior service as a felon in a state prison.

account, she told me she opted out when we merged so that her debit card would be declined if the funds were not available in her account. I tried to explain how the fees ended up on her account, when the card was swiped the funds were in the account some transactions take longer to clear then others, so when the transactions tried to post the account the funds were no longer there. For example there were checks that had cleared after the card was swiped. Mrs. [redacted] then told me she was closing all of her accounts because this was fraud. I apologized for this happening to her, again trying to explain why this had happened.I tried to explain to her that FNB does not clear on uncollected items like BCSB use to. I tried to explain options that FNB offers.Mrs. [redacted] came in on Monday about her NSF's fees. I have attached her statements for the last few months, to show her account history. I explained to Mrs. [redacted] that when deposits are made at the ATM the funds are not available immediately, it can take up to 48 hours from when the deposit is made. I told her if she ever needed to make a deposit when we were closed to use the night drop, those funds are processed differently. The agent advised that you could dispute the transaction, if you feltthe transaction was unauthorized, but your response was that you authorized the transaction andthere was nothing to dispute. In your complaint, you indicated that the $7.56 PayPal transactionwas unauthorized, action was taken, and our Uniontown Branch has been trying to reach you togather additional information.Our records indicate that your account does have overdraft services but is opted out of RegulationE, which does not authorize FNB to pay overdrafts on ATM transactions and everyday debit cardtransactions. However, checks and automated clearing house debit transactions made using yourchecking account number while your account is in an opt-out status can overdraw your accountand cause OD Fees. We have received a copy of your communication from the Revdex.com regarding the statusof your account ending in 5133.Upon reviewing your account, we have found the following:August 15, 2015 - [redacted] and [redacted] came into the branch to discuss overdraftcharges/unauthorized...

items from [redacted]. [redacted] requested statements to show [redacted]that it was their debit transactions that overdrew their account. The account was first overdrawn onAugust 10. The transactions in question are time stamped August 11 and posted to their account August13. During this conversation, the Assistant Manager explained that credits will post before debits, andthat items post largest to smallest regardless of the time of day the transaction took place. She also toldher that any business transacted over a weekend is on the following Monday's business. The AssistantManager was unable to comply with [redacted]'s request to create a statement proving [redacted]transactions were the first overdraft on the account since the account history shows the account at anegative balance on August 10. The Assistant Manager offered to file dispute claims, but [redacted] chose totry to get in contact with [redacted] in order for the refund to be handled on their side. This was due tothe fact that it was explained to [redacted] that the Business Debit Card that was used must be closed whenfiling the disputes through FNB. [redacted] did not want the Debit Card closed. We agreed to waive thecontinuous OD fee until the hotel refunded the charges or disputes were filed with FNB. [redacted] alsostated that she had in her words "a large deposit" for the account, but was not going to deposit thisbecause she felt that the hotel and bank would be less apt to refund anything if the deposit was made.August 28, 2015 - disputes filed with FNB - debit card was closed.September 8, 2015 - provisional credit issued.September 17, 2015 - [redacted] called to speak with the Manager regarding some of the overdraft fees onthe account. Branch Manager explained that the time stamp on the transactions validated that theaccount was overdrawn prior to the [redacted] transactions. When requesting NSF fees, the Managerstated that only a total of 4 - $37.00 NSF fees could be refunded as those were attached to the disputedtransactions. [redacted] requested an exception refund for all of the fees accumulated over this time. TheManager stated that since there was no bank error, no additional fees would be refunded.September 21, 2015 - Manager contacted the customer to inform them that he had checked with hissupervisor and that the decision was that the four (4) NSF fees would be refunded as a result of the 4disputes/provisional credit items, but no additional NSF fees would be refunded, again, because this wasnot a bank error. During the conversation, [redacted] stated her intentions were to close the account.September 23, 2015 - [redacted] and [redacted] came in to close the account. The Assistant Manager wasworking a teller window and waited on them. Since the account was at a negative balance, [redacted] and[redacted] were told that we were unable to comply with their request to close the account until andunless the account was at a zero balance. The Assistant Manager advised them that after 49 days theaccount would be charged off and sent to collections.
