I am very sorry he feels this wayThe gap policy is a 3rd party company it is not an earnhardt companyI went back and cancelled the gap policy based on the first time we recieved word that the customer wanted the gap cancelledThe amount of the refund is based on when we first were notifiedWe did send out a check right away but for some reason it was returnedThe check was returned to one of our other eanhardt stores so we had no idea until the customer said he did not recieve paymentAt that time I issued another checkAgain we are very sorry for any confusionIf customer is ever in town here I will gladly fill their tank and do an oil change for free once they are out of coverage on their maintenceAgain if they would like to contact me my number is ###-###-####

There was a mis communication on the lease returnEarnhardt's will make good on paying off lease turn in for *** ***

Yes customer came in a recieved and oil change on the the date he providedHowever we have no record of him ever calling *** the service advisor that there was a problem? Also this work was done 6months ago? If a problem was an oil filter not being tight is would of shown up
6months agoWe would gladly take a look at it for him to determine what happenHe can contract me or *** to bring the car in to find out what the issue is with the carIn the notes that we have we reconmended several services and they were declinedA loose oil filter would of leaked right away not 6months from the serviceThanks *** *** ###-###-####

I think this is just a mis understanding, the 300 or the 700 dollars is a [redacted] program if you belong to [redacted]. Fred and his wife do belong to [redacted] and we gave them the [redacted] pricing so the 300 or 700 dollar card comes from [redacted] not from Earnhardts. I will follow up with [redacted] to see...

which membership they have so I can confirm which dollar amount they qualify for. The [redacted] program usually takes 60 days to receive they gift card from [redacted]. I am sorry for any mis understanding but if you belong to [redacted] they will for sure receive a card in the amount of 300 or 700 depending on the level of membership. This letter was mailed to you on June 13, 2016, not July 21, 2016.  I have a hard time believing that it took from June 13 to July 21 for you to receive this letter.
This makes it sound like I made my complaint to you more than a month AFTER I received a refund from them.  We did not receive the $490.60 from Earnhardt
until June 17, 2016.  That was more than two months after we notified them that the loan had been paid off.  Meanwhile, they continued to use more of the
Gap Insurance premium that we pre-paid them.  We purchased the auto on October 16,2016 and the loan was paid off on April 11, 2016 (178 days into
a 5 year contract).  As you can see they charged me $108 for having that policy for 178 days, which is excessive but not surprising because Earnhardt 
does not have the best reputation for fair practices.  I am reasonably sure that we are not the first customer who has complained to the RevDex.com about them.  Or, maybe they just warn off other people from dealing with them.  Unfortunately we HAD been warned but gave them the benefit
of the doubt.
Anyway we do not expect you to do anything more.  We know when we have been beaten.  [redacted]

[redacted] came into the store on or around 11/23/2013. He was in a hurry and just wanted the amount printed on the check. However, we had a disclaimer here at the dealership that I...

was trying to go through with him and he didn’t want to take the time. The mailer is based on black book which states 10,000 miles a year max and mileage over that is 30 cents a mile. Also it states it is the price on the mailer minus the reconditioning that would need to be done by the dealer. I would be happy to send him a copy of the discloser or to meet and go through it. 6months ago. We would gladly take a look at it for him to determine what happen. He can contract me or [redacted] to bring the car in to find out what the issue is with the car. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I have been in sales and sales management for many years and based upon my experience, it was obvious to me based upon a very short conversation with Mr. [redacted] that he had no intentions of honoring the price stated in the letter.  Consequently, I did not want to waste my time "haggling" over the price.  

His written reply to this complaint referred to a disclaimer at the dealership; but this was not in the letter.  The letter stated, "We've checked the Black Book Appraisal Guide and it stated that your vehicle in clean condition, could be worth up to $25,275.  HOWEVER, WE FEEL THAT YOUR VEHICLE COULD BE WORTH UP TO $1,00 MORE!"

Additionally, the letter stated, "[redacted], I'll give you $27,675* for your SRX!"  The "*" disclaimer stated "Estimated Black Book market value is based off of clean and average vehicle condition and mileage, equipment and condition of vehicle may affect vehicle value."  (see attached letter)

The SRX was exceptionally clean, excellent condition, and has the the Premium level of options (highest level).  At that time, the mileage was approximately 47,000 miles.  

I believe that this letter and the unwillingness of Mr. [redacted] to pay the stated amount represent false and misleading advertising.
