owner of Eastman's Landscaping was hired to remove a hill a long side of property.
after removing 3/4 of hill, the town Code enforcement officer came and shut him down because Mr. didn't retain the proper permits. After speaking with the Code enforcer officer he stated he has had many problems with Mr. in the past and he should have known he needed a permit. Mr *** stated he was really upset because the company removing the dirt was starting to bring it to his house so he could use it for fill to build his garage. He said he would come back with his 14 year old son and finish spreading dirt. Mr. came back with his 14 year old son. Mr. ran an excavator while his son ran a Bobcat Skid steer, a heavy piece of machinery. I was concerned about his son and Mr. said he uses it all the time.
Mr. stated he had a big job coming up and was running out of time. He would bring some loam across my 4 week old driveway and grade the area around garden.
The day I got back from hospital after having a total knee replacement, he was packing up his gear and said he was done. I was in deep pain from my knee and took his word that all work was done. I noticed alot of dirt on driveway and only a small pile of loam. after I cleaned dirt, I noticed drivway all chewed up. I read his invoice he handed me the day I get back from hospital. I was different from original and only included work he had done. it was not the one I signed. No finished work was done. He left it a Mess. I put a stop payment on his $5000.00 check. He said he was done and not coming back.
Mr *** has not read the contract that he signed. He did not even retain a copy, even after I have sent him one via text. We use progressive invoicing, meaning that what is typed on the estimate is carried over to the invoice. The contract clearly states that no finish grading will be done as Mr *** did not want the added expense. He stated that he was capable to finish off the work. Also, we are not responsible for permits, clearly stated on the original contract. The work that was shut down was due to the home owner not obtaining the work. I find it unreasonable that a CEO that is new to town has had many complaints for a company that does not typically do work in town. We may live in ***, but we only do 1-2% of our work in ***.Mr *** complains about work our son did. However, this is his third year working with his father and has been running equipment for at least 5 years, and none of the 100's of customers we have dealt with in that time has had a complaint with this child that is driven to work. He is very capable of the spreading work, and was always under the eye of his father. He did not come close to tipping the equipment over, or else he would not be running it. Mr. was insistent that the loam, that was not a fine loam be spread in May. The piles were still frozen, and if you have any experience spreading frozen materials you know it does not spread well. I do not believe we are responsible for the gouging of the driveway, but I also ask, who has a new driveway installed prior to lawn areas on either side of it being completed. I did offer him $1000 to cover the repair of the driveway, that he declined wanting us to fix it. I do not trust this man that put a stop payment on a final check that he wrote after, stating that he was "too impaired", How do I know that he is not "impaired" at this time? We will not be returning to his work site. His accusing us of doing so at night is one of the most ridiculous thing I have heard as we have better things to do in life than "stalk and steal" from Mr *** in the middle of the night. As if he would not hear equipment in his yard?

He adds to contract to cover his butt. The contract keeps getting bigger and bigger to include other stuff that wasn't in original. The one he attached can't even be read. I have tried on numerous times to get a copy. He always had an excuse, he has Never texted me a copy. he never sent me one because he wasn't done adding to it.Progressive invoice? another way for *** to keep changing and adding to contract. He is a Flat Out Lier. obtaining permits was Never on Original contract. More proof that he changed it. *** also did some foundation drainage work for me. relocating the foundration drain. I asked *** if we need a permit, he said don't worry about it, if you ask the town they wont let you do anything, He said he would take care of it. we agreed on a location of the drain. when I got home from work, it was in a totally different spot. He did the cheapest way around it, it took it upon himself to do it. Now I have a big reen cover sticking out of my lawn. I let him slide on that, but should have been a flag, he is a crook. I went to the CEO and he said *** never contacted him about a permit and one was needed. *** will only do anything to benefit himself and not care about his customers.Any honest person would not have started any work before he had permits in hand or was cleared one was not needed.Eastman bought a business in *** where he kept illegally stripping land. The CEO had to keep going over and shutting him down because he couldn't get permits.He later sold the business because he couldn't handle it.Mrs *** was not present to see if her son had any problems controlling heavy equipment. I will be looking further into child labor laws about running heavy equipment. I will be notifying the proper authorities.I understood about the loam being frozen and was all for *** coming back and finish the spreading of the loam. when *** came back he said he only had a short time to finish because he just got a big job and didn't have time.He ran out of time, waited until I got out of hospital after having a total knee replacement. He loaded his equipment and said he was done. he handed me an invoice full of lies.I kept telling *** work needed to be done because I had a company coming over to Tar driveway. he kept telling me he would get it done. He never came over and other company showed up. and did the regrading work. I explained the landscaping work wasn't finished yet. they said they can hold off taring for another two weeks. I kept calling *** and telling him about the paving. He said he would be over. Never called of showed up until paving was completed.That is the kind of person he is.Eastman was going to come at night to take sand so the town wouldn't see him not me. I wish Mrs *** would talk to her husband to see what unlawful things he is up toTo show you the kind of people they are. When the ***s were here going over all the uncompleted things. Mrs *** out of the blue said, oh your 13 year son is a cyber bully, I read all my sons cyber emails in all his account could find no traces of his cyber bully. My wife called the *** and ask where they got that info to accuse my son, they said they would email it and they never did. I think They are the Bullies.My wife has been a paralegal for 30 years. We have lawyer friends in 3 states if I was the kind of person the ***'s are I could sew them and put them out of business.I am old fashion, If I mess up work, I will inform the person and get it fixed. I tried to give the ***'s that chance to be respectful and do the right think. Alls they did was deny responsibility.I could keep going on about what I have learned about the ***s but I want this closed and over with.Not only do I not want them to return, I will have them arrested if I see them close to my property.With that being said, I will mail out a check for $4000.00 to make it all go away.I will take the loss to move on. I had anywhere between $15,000.00 - $20,000.00 in landscaping I WAS going to give to *** so in the long run, it his his lost. My son wanted his friend to do it but I picked *** because I thought re was more reliable. Glad I learned my lesson before it was to late.
