signed a three year contract for a fixed rate plan with Family
Energy. I changed addresses and no longer
need gas service as I have oil now. In addition I no longer want their
electric supply service, my primary
utility Central Hudson Gas and Electric has better rates and service
than this ESCO. Family Energy's fixed
rate isn't any cheaper for me now and there is no benefit as far as
I'm concerned. In addition, I just moved
on 10/**/15 and within a few days of the address change, Family Energy
started calling constantly and left
no voicemails. I called back and requested service in all areas,
electric and gas be discontinued
immediately. Request has not been fulfilled. I have reached out a
couple more times via email form for
customer
service to no avail. This all started from aggressive, rude and pushy door to
door sales.
Desired
Settlement:
I would like the immediate
cancellation and discontinuance of all services I currently have with Family
Energy,
electric and gas as well as no further contact from them in any way.

Family Energy received notification from the customer’s utility that the contract
is cancelled, as the customer has moved. The contract was cancelled on October **,

does not wish to continue with the contract. The

Problem:
A sales representative for Family Energy came to my door asking to see
a copy of my utility bill. The representative was unclear about who he was. The
representative explained that he was "making sure I was not being
overcharged" and was holding himself out as a third party, inferring that
Family Energy is a regulator of sort. This person asked to come into my house
and was aggressive when I said that I didn't understand what the particular
situation was about and didn't want to show my utility bill. I did not give this
person any information or access to my house. The representative never stated
that Family Energy is an energy supply company and rather tried to mislead me
to get me to show my utility bill.
Desired Settlement:
I would appreciate
if the sales representatives for Family Energy would not come to my
neighborhood.

they came to my home. All they told me was they will save me money on my energy bill. Did not tell me that there was a cancelation fee. I recently moved and turned my energy services off in my name. My final bill was only 25 dollars for electric and gas together. Now I got a bill from family energy saying I have to pay them 100 dollars for a canceling. Or I get reported to credit bureau. I refuse to pay this money to them. And now my credit will b hurt. From them not specifying that there is a early termination fee. With that said what can I do. About this. They were pushy and did not take the answer I'm not interested. For an answer so I only just went with it. Did not want it

I want my last bill from them to b no more. I do not want to pay them for their effort to save me money I did not save any money while I was using their services

·         “Savings are not guaranteed under either the natural gas and/or electricity supply Agreement, and are dependent upon market conditions”.
·         “An early cancellation fee of $25.00 plus applicable taxes for each year or partial year remaining on the natural gas and/or electric supply Agreement(s) Term will apply if the Agreement(s) is/are terminated prior to the end of the Term selected above.
 
On the Third Party Verification call conducted after the contract was signed, [redacted] provided a positive response to the following questions:
·         Did the Sales Representative leave you with the Family Energy agreement(s) you just signed and do you have it in front of you?
·         "You also have the right to rescind the agreement if you choose within three business days and may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction. If you terminate the agreement(s) early, a fee of $25 per commodity, for each year or partial year remaining on the Agreement(s) will apply. See the notice of cancellation form for an explanation of this right. Do you understand?"
 
On July *, 2015, Family Energy cancelled contract number [redacted], as per the notification received from the customer’s utility that the customer has moved.

On May **, 2014, [redacted] signed contract number [redacted] with Family Energy for the supply of Natural Gas at a fixed rate of 69 cents per therm for 3 years with a 2 month introductory rate of 63 cents per therm and the supply of Electricity at a fixed rate of 8.99 cents per kWh for 3 years with a 2 month introductory rate of 7.99 cents per kWh.
 
For the period from July **, 2014 to September **, 2014, the customer was billed the Family Energy introductory rates (63 cents per therm for the natural gas and 7.99 cents per kWh for the electricity) and from the period from September **, 2014 to effective drop date, the customer was billed the Family Energy fixed rates (69 cents per therm for the natural gas and 8.99 cents per kWh for the electricity), as per the contract.
 
The contract signed by [redacted], under the “Customer Disclosure Statement Information” section it states, “Savings are not guaranteed under this agreement and are dependent upon Market conditions”.
 
Customers are required to read the statement on the back of the Family Energy business card to a third party verification (TPV) representative on the TPV call.  [redacted] read “Family Energy is not the utility” on the TPV call.
On January **, 2015, [redacted] contacted Family Energy to request cancellation of contract number [redacted]. Family Energy cancelled contract number [redacted] as per the customer’s request. The utility set the effective drop date as March *, 2015.

sent the customer an early cancellation fees letter via mail.

opinion that the customer entered into a valid, binding contract and early
cancellation fees are applicable.

Family Energy has offered NO resolution.  They won't even return e-mails and when you call there to talk to someone you get hung up on after being on hold.  Now, after receiving an e-mail from the company, I find out that this applies to our gas bill as well...which is actually in my wife's name.  I do not even have authorization to make changes to the gas company.  My wife called the company a total of 3 times yesterday.  She left 1 voice mail.  The 2 other times she was on hold for close to 30 minutes a piece and then got hung up on.  Our gas company can not cancel this.  We have to speak to Family Energy to cancel and they are obviously unreachable.  My wife wasted an entire day yesterday dealing with this and trying to get through to someone.  NOW....because of this.....we are going to have to pay AT LEAST 3 months of the over charges of the supply on the gas bill as well as the electric.  I figured up the total that we will have paid due to this.  From November 2015 - January 2016 it will be over $800.00.  In 3 months that is how much this company has scammed out of us.  And, if we don't get resolution with my gas soon that total will go up!  My wife called the gas company and as they are not authorized to make any changes, they instructed her to call the Public Service Commissioner and file a formal complaint which she has done.  She has also been in contact with a class action claims attorney.  This company has not only ripped me and my family off, but they have done it to so many others with their pushy door to door salesmen that pretty much force their way into peoples houses and have them sign things that they don't even understand.

Problem:
Family energy came to my door a couple months ago, right around when
many college students in my
neighborhood started to move in. I had just moved into an apartment where
it was the first time that the utility was in my name. The man who came told me
he was with the energy supplier that works with RG&E (making me think that
he was some type of official representative). He told me there was a problem
with my bill, and that there was a charge on it (the merchant function charge)
that would go away if I signed his contract and thus would save me money.
Thinking that he was with the utility and this was a normal part of getting the
utility setup in my name, he worked me into signing the contract, although it all
seemed more sketchy to me as the transaction continued on. The first bill I
received after signing didn't seem out of sorts, about the same as I'd been
paying before. The second bill was significantly higher, so that's when I began
to do an investigation as to why my bill was so high. That's when I found out
that the contract I had signed a couple months prior was costing me far more
than it was saving me. The man took advantage of my limited knowledge of paying
for utilities, and led me to believe I was signing a contract that would simply
make the merchant transaction charges go away, and thus save me money. He
failed to tell me that my energy rate would be significantly higher than it
currently was (it was 0.03913216 per kwh at the time and now it is 0.0997 per
kwh). The way in which I was convinced to sign the contract constitutes fraud,
and so I should be able to exit the contract with no penalties. I spoke to a
man on the phone explaining my situation. He was very rude and did not seem to
understand that the practices of his business are illegal and morally wrong.

Cancellation of contract with
no cancellation fees, since I believe this company scammed (committed fraud) against
me.

Problem:
Two complaints
- 1. when I signed up for the service I was promised that if my bills went up
Family Energy would send be a check for $50-75 if I was unhappy with the
service. Every bill I received after signing was higher than any bill had
gotten prior to joining the company. Bills from $60. - $105. went to $96. -
$171. 2. The company continues to call me every single evening, offering these
outrageous deals. I have asked then to stop calling but they continue to
pressure me to re-join the company. I want the calls to stop. Deregulation has
created a monster and the consumers are suffering because of it.

On July **, 2014, the customer entered into a contract with
Family Energy via telephone for the supply of electricity for term of 2 years.

On July **, 2014, Family Energy sent the
customer a welcome
package via mail that confirms the Family Energy Program Agreement Details, theTerms
and Conditions of the Program, and the ESCO Consumers Bill of Rights. In the
welcome package it states the following:

“If
the total commodity charge on the above chosen program(s) equals an amount
greater than the total commodity charge of the Customer’s Utility for the same
term, then the Customer shall receive up to $75.00 cash-back at the end of the Term
On October **, 2015, the customer sent Family Energy an email
requesting cancellation of contract number [redacted]. Family Energy cancelled the customer’s
contract, without penalty, as per the customer’s request.
The customer did not complete the entire 2
year term of the contract, as the cancelled the contract early. Therefore, the
customer is not eligible for the “Cash Back” feature with Family Energy.
Family Energy has also placed the customer on
out internal do not call list, as requested.
