To Whom it Concerns:
We have talked with the above homeowner several times. He has paid $2500.00 of a $7348.00 contract. The homeowner states that the insurance company must pay his deductible 2647.09. This constitutes Insurance fraud. We...

Initial Consumer Rebuttal /* (3000, 13, 2016/01/05) */
I disagree with Elder 1's response. As I mentioned earlier, as per contract, Elder 1 should install Drip Edge/ Ice & Water Shield along with roof. Since Elder 1 have not completed this job, insurance company is withholding this payment. Elder 1 also wrongfully claimed to my insurance company that they have completed Drip Edge/ Ice & Water Shield installed to my roof.

I recently had my roof replaced with poor workmanship. I called Elder1 to inspect and determine if I needed a new roof. I worked with Kyle; out of all the contractors I had come take a look, he was the best, most professional person. He gave me his honest opinion, and also gave me limited advice on how to proceed. He had been very, very helpful, and I greatly appreciate his and Elder1's help!

On May 18, 2017, customer signed a contract for roof only in the amount of $5,481.32. This contract dated May 18, 2017, and job performed were the result of an insurance claim.  In an attempt to help with the financial burden, we found and reported additional damage to the insurance company.  As a result, we got a small amount of money added to claim, through additional items not covered originally and not done as part of our roof only contract. This, if not for the rotted wood, would have ensured no money out of pocket to customer, as was told to customer from beginning.  Unfortunately, due to this rotten wood, the remaining balance is $1,022.00. Our contracts have a highlighted red line, just above the total which reads verbatim, “[redacted] To install new wood or decking is an additional charge of $4.00 per linear foot for 1-inch solid decking or $50 per 4ft x 8ft plywood sheet above the stated price.”  Nowhere on this contract dated May 18, 2017 is there any statement showing that no decking is needed, which is attached to prove.  Also, nowhere on this contract does it state Elder 1 to do deck service (stain) or any siding.  Unfortunately, when working in any home improvement field, there can be circumstances that are outside of both our control and a homeowners’.  This is why we have conditions spelled out on our contract for unfortunate changes should they arise, which includes the decking on the roof.  The red line on our contract wholly exists on our contract because we have to tear the roof off to expose bare decking for proper installation, and we cannot always predict if there will be bad wood that requires replacement. On Friday, July 28, 2017, we attempted to self-resolve this situation with the customer to the best of our ability by showing on paper the very specifics and explain the process by which this job proceeded.  Unfortunately, we were not able to reach resolution, despite approximately 2 hours of conversation and relatively plain explanation. As always, we at Elder 1 will follow any resolution as determined by the Revdex.com as the appropriate action.  And we look forward to successful resolution of this situation.

Initial Business Response /* (1000, 5, 2014/09/20) */
We signed a contract with [redacted] on 4-26-14 to install GAF Timberline shingles to the [redacted] home & a small shed roof, and to install 5' seamless gutters with over-sized 3 x 4 downspouts to home only. Contract stated to start any...

time after May 18th, 2014. We received $6,540.70 from [redacted] Insurance Company. We charged $780.00 to upgrade from 3- tab 25 yr. shingles to limited lifetime Architectural shingles, and $400.00 to upgrade the 2X3 downspouts to 3X4. The roof was started and completed on May 19th 2014. The gutters and downspouts where completed on June 3rd, 2014. Ms. [redacted] called on June 4th 2014 and stated that the downspouts were wrong, and that the gutters were not pitched to her satisfaction. I told Ms. [redacted] that we would be there the following day to fix the problem. Ms. [redacted] stated that her son would do the downspouts and I could just credit the $400.00 off her balance.
On June 5th 2014, Ms. [redacted] paid the balance of $4,808.08 and signed a completion stating that she was satisfied with her job. The week of June 15th 2014 Ms. [redacted] called the office and reported that she had a leak in the kitchen, and the drywall had fell down during the night. I assured the home owner that we would fix it. I sent a second roofing crew out to find and fix the leak. Ruben, a GAF Certified Roofer, came back and told me that the shingles had been pulled-up through the nails. The following day I went out to the damages. Ms. [redacted] stated that the drywall had, "fell from ceiling". There was a spot on the drywall that was smaller than a 3" circle. I was handed a piece of paper stating that they wanted $2,000.00 to repair those damages. Her son would fix the drywall himself. To stay in good graces, I paid her the exact amount, (to fix the area that her son tore up) as the Insurance Company would have paid a company being sent to do the repairs. That amount came to a payment of $591.00. Ms. [redacted] is very short tempered and has cussed at me several times. I have been to her home 5 times, and have never seen a leak. She has told my office that another "roofer" said that her siding should come down. We have done everything possible to make this customer understand. Ms. [redacted] doesn't listen, she screams over the top of you. Ms. [redacted] has been given back almost a $1,000.00 off her contract amount, simply because I couldn't prove that her and her son had made the roof leak.
I have pictures that show no water stains on the plywood, trusses, or the drywall that her son tore out. The step flashing that she wants replaced has never leaked. When I asked her why the roof didn't leak from the time it was finished, and the 3 1/2 weeks before the final payment, she told me it had not rained. We had substantial rain during that period. This is documented by NOAA.GOV. I will not go back to Ms. [redacted] home without a B.B.B Arbitrator. I will make myself available to with the arbitrator at their convenience. Thank you for your help with this matter.
Sincerely,
[redacted]
