Mr [redacted] , in Bankruptcy Loans the customer is responsible to contact their trustee to request an approval to incur debt Once the request is approved from the Trustee they will send the forms to the finance department that states the terms of the loan Keep in mind that the amount and monthly payments are approved by your Trustee when the loan is within the guidelines set by the trustee This loan was in the guidelines set by the trustee The length of the process is all depending on the customers ability to provide the required documents request by the lender On the issue of the copies of the contract Epic Auto Sales has no problem providing you with additional copies for your records with warranty informationWe have all the text message/email screen shots of conversation in regards to the letter from the trustee and a request to change a payment due to Epic Auto Sales Everything was communicated by both parties and everything was clearIf you wish to see these screen shots of communication, we are more than happy to provide them Sincerely, [redacted] Epic Auto SalesGeneral Manager281-955-Office281-955-Faxwww.epicautosalestx.com

On January ***, [redacted] *** and his wife visited Epic Auto Sales for a vehicle On that day [redacted] *** found two vehicles for his wife and himselfThey both selected vehicles which were a Dodge Journey and a BMW 750Li [redacted] was attempting to trade of his vehicles in for the vehicles owned by Epic Auto [redacted] trade ins were a Lincoln Town car a Chevrolet CapriceThe Lincoln could not be used as a trade since [redacted] had a title loan on it and the lien was significantly larger than what the vehicle was worthThe Lincoln could not be used towards the Journey which resulted in them keeping the LincolnThe Dodge Journey required a $down payment for them to take delivery of the vehicleAn agreement was made and both parties have singed off on the contract on the vehicle in question with the exception of the Lincoln The BMW 750Li included a trade value of $for the Caprice plus an additional $down payment was neededThis deal on the BMW 750Li was returned/concelled by both parties and is null and void [redacted] has possesion of both trade ins, the Lincoln and the CapriceThe only money [redacted] has paid is the $down payment which is listed on the contract which is the amount required by the lender All monies collected were applied to the JourneyInspections and any items owed have been honored to [redacted] by Epic Auto Sales All details in regards to his loan is listed in the Retail Purchase Contract Any questions regarding this matter can be direct to Epic Auto Sales Management Sincerely, [redacted] Epic Auto Sales [redacted]

On Feb 25, [redacted] came to the dealership to purchase a Cadillac Cts vin# [redacted] with approximately 77kMr [redacted] and our sales representative went for a test drive approximate to minutes long to check the vehicle outAfter the test drive, Mr [redacted] proceeded with the purchaseAfter ½ hours of negotiating, Mr [redacted] received a $dollars discount off the advertised price for the vehicleThe discount was to compensate for some wear and tear on the vehicleMr [redacted] also asked that we replace his front brake pads and we agreed to do so at a later time set by appointmentThat day Mr [redacted] took delivery of the vehicleThe next day Mr [redacted] called and said the vehicle would not start and the check engine light came onMr [redacted] brought the vehicle in and we observed that the battery went bad and Epic Auto Sales replaced the battery with a new one on the spot, free of no charge to Mr ***The dead battery was also the reason for the check engine light to come onLooking at the documentations and the whole contract, Mr [redacted] never once mentioned any other items, defects or promised work that Epic Auto needed to performMr [redacted] did ask for tires but we clearly advised him that after his discount, we had no more room to negotiate and he understoodAny copies pertaining to the purchase agreement can be provided to Mr [redacted] where it shows very clear that there was no additional work promised to himAny questions or documentations regarding this matter, please contact Epic Auto Sales

First of all, epic auto did not send the required information to my chapter trusteeI can provide a sworn document from t he case worker and all the email communications that point to epic being at fault for not submitting all the required documentation.
*** ensured me that they work with backruptcy every day but it sure doesn't seem like it since they failed to do what was necessary the first timealso is it me or did they not address at all my issue with not receiving any of the contract paperwork, tags and plates, and warranty informayionI contacted the aftermarket warranty provider Tuesday of this week and they have no knowledge of me, my wife, our car, or the dollar warranty that was pushed on us by ***

Epic Auto was very clear with Mr *** that his vehicle purchase was as is and he also declined to purchase an extended warrantyThe only items promised to Mr *** were front brake pads and they were already installed on his appointment dateMr *** did complain about his check engine light being on the day after his purchaseEpic Auto asked Mr *** to come in so we could inspect why his light was on and we found it to be from the hard freeze and it drained his batteryAt no cost to Mr *** we replaced his battery on the spot with a brand new batteryWe explained to Mr*** why his check engine light was on and it was not a safety issueThe computer from the car did not have enough voltage from the drained battery to read its components correctly which caused the engine light to come onAt the time of purchase no issues were addressed about the vehicles except the engine which we fixed and the brake pads which were also fixedThe other items Mr *** are questioning are wear and tear items that is his responsibilityWe offered to Mr*** our customer loyalty discount on all his service and repairs work to his car but he declinedOur offer still stands to do all repairs at a discounted price at any time Mr *** would like to do soPlease contact us if you have any further questions regarding this matterThanks you Epic Auto Sales

Mrs*** *** *** originally came to the purchase the vehicle on 8/6/The vehicle she selected was a black *** *** *** touring suvThe vehicle had miles on the odometer when she took delivery for the vehicleMrs***'s claim's of
fraudulent actions on behalf of Epic Auto Sales has no merit and is invalidEpic Auto Sales has copies of the contract which she signed and a government issued ID she provided on fileLoan was returned by the lender for inconsistent information by the customerMrs*** was asked to return the vehicle back to the dealership immediatelyThe vehicle was in Mrs*** possession from 8/6/until 8/23/Mrs*** arrived with vehicle on Saturday 8/23/to return the vehicleOnce on the premises she would not release the keys to the vehicle until a refund was madeManagement explained to Mrs*** that miles and restocking fees would be charged for the vehicle useAt that point Mrs*** contacted the Sheriff's DepartmentOnce the Sheriffs department arrived, they investigated the complaint and determined that Mrs*** should release the keys to the vehicle and leave the premisesA complaint was filed against Mrs ***Epic Auto Sales has all documentation and case filing to support it's statementThe following charges for Mrs*** is as following:

Mr*** came to Epic Auto Sales originally on 9/19/to purchase a vehicle. On that day Mr*** & *** *** selected the 2009 DODGE CHALLENGER. Mr*** applied for a vehicle and was paired with a lender that
works Chapter Bankruptcy's which they neededDuring the loan process he was explained that a letter to incur debt from his trustee was required to complete their loan. The customer agreed to the terms and payment structure that was presented to themAn outstanding balance was owed to Epic Auto Sales that still to this day has not been fulfilled by the ***s. During this time, the *** were not able to obtain the letter and was unable to meet the lenders requirements by the set deadlineEpic Auto Sales had to recontract the deal due to the missed deadline on the ***'s endThe customer still had the same agreed terms from original contract dated 9/19/that is on the new contract on 10/11/2014. The warranty was included on the deal as agreed on the previous contractExtended warranty was included in the deal as part of the original agreementThe only free warranty that is provided by Epic Auto Sales is the complementary 3,miles/month limited power trainAny charges they incurred is due to the agreed payments set by them. Signatures authorizing the charged amounts are on fileAll charges incurred by the customer are due to customer agreements and scheduled pay structure. Ripped us off and took advantage of us so bad even with excellent credit. Sold us an $11,000 truck (KBB value) for $29,000 Then they put cheap oil in the vehicle and blew the turbo causing it to dump oil and coolant then refused to fix it. Said they replaced the brakes when I went to pick it up I drove it and the brakes didn't work causing me to almost crash. I guess they didn't realize we would take it to our personal mechanic. Then they said they fixed multiple things on the vehicle when honestly they never fixed nor replaced anything, put dirt cheap Chinese tires that couldn't be balanced after they said they did balance and rotated them and kept it on and off for longer then we ever drove it. They offered to get me into another vehicle but told me there was no way I could get a truck and they were only going to buy the current vehicle back at KBB value causing me to have so much negative equity/2 ($18,000). The kicker is I only owned the vehicle for 2 1/2 months. STAY AWAY!!!!!

We have tried to contact [redacted] several times about this issue. The person who referred [redacted] to the dealership was allotted 150.00 dollar referral fee for sending a customer to us who purchased, which was the amount of our referral fee at the time. The 150.00 dollar...

check has still never been picked up. Mr. [redacted] bought his car back in January and as stated earlier we did not offer a 500 referral fee at that time. No customer has ever mentioned that Mr. [redacted] referred them to our dealership that has purchased a vehicle. Despite numerous attempts to find out who Mr. [redacted] referred and what they purchased from us, we have not been able to do so. We are more than glad to pay referrals to our customers, in fact, it is a large part of our business, all we ask is that the customer mention who referred them at the time of purchase. According to when the customer was referred will also determine the amount of referral. Mr. [redacted] is more than welcome to contact us via phone, email, or visit us in person so we can work this matter out. Thank you

As for the warranty, [redacted] from [redacted] explained to you that it can take up to 90 days for the warranty to be processed in the system. I doubt it will take that long but its a possibility. If you have an issue before it is processed, we would be able to do a warranty claim for you since we have the original docs on file. The warranty is accepted nationwide at ASE certified service centers. If you do use another service center, you will have to pay the deductible and for rental fees if applied.  [redacted] we do apologize for any inconvenience this may have caused. so where are my Tags and license plate? where is my sales contract? where is my warranty contract? Additionally, [redacted] also stated that I can take my car to any service center that recognizes the service contact for warranty work. There is absolutely NO WAY that I would take my car back to your dealership at this point, so can you confirm that to be true or was that another lie?
