Review: TWENTY MINUTE PHONE CONSULTATION ON HOW THEY WILL MAXIMIZE MY EARNINGS. MATCH UP ALL MY ACTION FIGURES WITH THEIR ACCESSORIES THAT WERE GIVEN TO THEM. INSTEAD THEY DUMP ALL TWENTY FIVE POUNDS OF COLLECTABLE ACTION FIGURES INTO A FEW PILES AND LIST THEM ON EBAY. COULDN'T EVEN SEE HALF THE ITEMS. RESULT= SOLD FOR A FRACTION OF WHAT THEY COULD HAVE. TWO MONTHS FROM THE DATE OF SELL AND I HAVEN'T GOTTEN A PENNY.Desired Settlement: PAY ME THE AMOUNT I WOULD HAVE RECEIVED HAD YOU TAKEN THE TIME TO DO WHAT YOU SAID YOU WERE GOING TO DO, OR REPLACE THE ITEMS IN THE SAME CONDITION YOU RECEIVED THEM.

Response:

We listed several items for the customer, and spent considerable time with those listings. The customers items were listed, per our agreement. We have pictures of the items, and the items were sold by bid to the higest bidder, representing the value of the items. The box of items was in very rough shape, missing parts, dirty and had many broken incomplete items. The custmer called us several times and we had several discussions. Never mentioned any other requests, specifically the one stated in this complaint. In accordance with our terms the customer was paid, the customer has signed his check and the money was removed from our account. We have a copy of the signed final payment check. We listed several items for the customer, and spent considerable time with those listings.

We have thousands of satisfied customers. The customer was upset before we started becaue we refused to take some of his items due to value issues. We regret that this customer was not satisfied. Per the customer, we delisted three of his other items and gave them back to him at no charge, as a courtesy to the customer. At no time did the customer ask for anything else. We do not gurantee the selling price any item, and our contract limits any and all damages to $100.00 , or the price that the item was sold for, in any event.

We are seeking legal opinions about this request. We believe the complaint is not accurate. We would be happy to try to appease this customer, but we find it strange that this "solution" was never mentioned prior to this complaint, including the day he pick-up his items and signed for them. He could simply call us to resolve this situation. Our phone number is 440-250-8774.
