take/finance the Route 66 Warranty coverage, but we do offer it as a completely optional service that can be added on to the loan.  it is entirely up to the customer if they want it or not.  The customer is told at the time of closing that they have 60 days to cancel the warranty for full refund credit (minus $25 cancel fee), that way they have time prior to the required miles or days to filing claim with the warranty to ensure if the car is driving properly or not and what all is covered with the warranty.  Also, as the lender, we have no control over what the warranty company will cover as that is between the warranty company, the mechanic, and the customer.  If there was a known problem with the auto there should have been a call to the warranty company to determine if that specific item was covered or not (or a call to the dealership who sold them the car originally if it always had an issue).  The Complainant  (customer's wife) contacted the branch on 3/28/17 (almost a year after they closed on their renewal loan with the warranty) asking what was covered on the warranty.  Prior to all of this, in August of 2016, the customer notified us that he was having a hard time making pmts since he wasn't working due to a work injury as he is in construction/roofing.  We worked with customer to set up 3 mths of temporary modified lower payments to help out the customer during this time, however after loan returned to regular payments in November 2016 the customer began not paying us on time or only partial payments due to him not working because of the weather (roofer/construction).  On 3/31/17 (3 days after complainant contacted us inquiring about the warranty coverage), the customer contacted the branch and said the warranty would not cover the mechanical issue and that he couldn't afford the truck anyway, and wanted us to come pick up the car as a voluntary repossession.  We notified customer at that time that he is still responsible for making the payments and would be responsible for any remaining balance after the vehicle is sold and funds applied to his account.  The file note on 3/31 indicated that the branch employee said would contact the customer "next week" to set up a pick up time.  On 4/7, file notes indicated customer contact and that we were notified at that time that they were moving that day and we needed to get the truck.   Repo company went out on 4/8, and vehicle is currently waiting to be sold.  Since the repo, we have attempted to contact the customer SEVERAL times with no answer or return calls, as his account is showing past due and as of today (5/10/17) is in fact due for the 2/13/17 payment.  We will proceed with the sale of the voluntary repossession and will post any net sales funds towards current balance and then per contract the customer will be responsible for any deficiency balance.

Customer opened her account 5/23/16 with a $7,485 opening balance (consisting of $6,001 original disbursement, plus $784.70 in optional Life Ins & GAP, plus $700.10 in loan fees), not $6,485, so the opening balance is incorrect by $1,000 right there.  Per notes in file she was...

quoted a net payoff on 5/10/17 of $7,846, so only $361 higher than opening balance not $1,300 more (and this is due to unpaid interest).   A loan account balance, per contract, will only reduce if the customer makes at least the minimum payment due (which per original loan agreement is $269.33/mth) and also makes this minimum payment on time.  Starting with the very first pmt due 7/1/16, customer had not made a full payment nor paid on time per original agreement until customer made a pmt on 3/30/17 (and even that one was made late, as was due 3/15/17).   Customer has also made full pmts on 4/24/17 (late, since due 4/15) and just yesterday on 5/11/17 (due 5/15) which a year after her account opening was the first full pmt ever made technically on time.  So hopefully this is the beginning of customer paying full pmts on time per original agreement, but for the first year of the loan, because of all of the late and partial payments which created late fees, legal fees, and unpaid past due interest, the customer’s original loan balance has not decreased.  A file note from the branch today (5/12/17) indicates that they tried to call this customer to further explain in detail the balance, but the phone number we have on record for customer was disconnected, so an email was sent.    NOTE that Due to customer stating they had hardships, we were willing to work with her to provide Temporary Modified pmt options for her, which allowed us to keep moving her account forward for her (as she is not showing past due currently even with all of those late or partial pmts), but of course since were only partial pmts of original loan agreement it would not reduce her balance.

Our Regional Manager in Idaho (Robert M[redacted]) was able to reach out to Miss [redacted] over the phone yesterday and discussed the issues.  He indicated to me that Miss [redacted] now understands the situation and feels that the issue is resolved.  In fact, Robert said that she is also coming into the branch on 1/6/17 to sign another loan with us.

I have 2 other loan applications for this car that both got rejected. Due to I was only working a seasonal job. both of those companies did contacted my employer, to find out the position I had was a seasonal position that ended. Also kurt and toshia had me lie about my employment, history. that I worked at waste management for 3 yrs. I have not worked for waste mangement since 2012 and I only worked for them for 4 months.  I've been unemployed for 3 yrs prior at the time I purchased this car. I have email correspondence with toshia 3 days after the sale of the car, informing her my job has ended, and I was going home in washington where I've been since. I have a print out of equitable finance on the 2004 hyundai car which shows they have the car listed at 77,503 miles. Again I talked to Gabriel with the first week to report fraud, and again with Robert in january. Which I have that phone call recorded, and robert admitting he knew kurt committed fraud on there bank. Robert at that time did say he would have someone fix the car, at that time I also informed him in the phone call, I did not live in Idaho, that me and the car has been in washington state since june 11th. I reported the mileage issue since 3 days after the sale of the car, PBT listing had a picture of the car with 178,xxx. After checking with DMV and doing a carfax shows this car went threw a auto auction a month or so prior to me purchasing the car. Which they reported the car having 177,503 miles on in it in the auction. The car insurance is not in my name, but in my dads name, due to I had to license the car in idaho and use a idaho address cause this location was not licensed to sale in the state of washington at the time of purchase. they also have my monthly income down as 2,000 a month. I never made anywhere near that. my ytd income was barely 1658.77. Prior to this I lived in washington state my entire life, which I have numerous neighbors who can verify that, and that I'm still currently live in washington.  On equitable finance kelly blue book summary, they have a ton of options that this car does not even have. ( they have the mileage at 77,503) Which at the time of the sale this car had 178,xxx miles on it, which we have a time dated picture of the odometer in june showing the car turned over to 179,xxx just a week after the sale. Toshia and Kurt had more than a professional relationship, which I can prove via facebook comments and tags.  Which they both knew I was already denied by two other finance companies due to not having enough work history in the last 3 yrs to lying about my down payment on the car. I have witnesses, and supporting documents. I should have never been approved for this auto loan. The GPS device - I was given a appointment by Toshia P[redacted], which occurred AT THE INSTALLER PERSONAL RESIDENCE. NOT A BUSINESS! I also have 2 other witnesses that can support and can get address. I have robert [redacted] telling me in the phone conversation that he would have someone look at the car, I waited for a reply. 2 weeks later I called him and have 3 recorded calls of him hanging up on me, soon as he figured out who I was. Otherwise this company, knows that Kurt of PBT Auto Sales committed fraud againist there bank, and instead of doing anything have been covering up any and all illegal activities done by him and there finance officer. Which I have the emails, phone recordings, and other types of contact. along with work history, and supporting documents that I would be glad to share with any law enforcement or Revdex.com personal. Also during the time I purchased the car, I was not able to take the car into Equitable finance during the time of the sale, due to it was not running. I have ebay receipts of parts for this car, I purchased on the day of the sale to get the car running again. I also have in the email, to Toshia, that I asked to bring the car in to be checked that KURT of PBT Auto Sales, reported incorrect mileage and options on the car, just 3 days after. Which I have been trying to prove and equitable finance has only offered to fix the car and get running and charge and addon to my bill the repair cost or allow me to sell the car or trade it in to get another car. Have been my only options, otherwise, they have NEVER contacted me to resolve any of these issues, since I first reported them. Which during the time, I went in person my wife was with me. The only reason I was in Idaho or working was due to my mom needed help due to hip surgery, and I did not have the funds or transportation to return to washington at the time. Which I got the job at [redacted] in Jerome, which when I applied for there seasonal position it was only transporting plants from one greenhouse location to there main facility.  The day I was hired on, they told me it would only last until the first of june and end. Which I was honest on my other two applications, and was honest to Toshia. Which she told me, I would never get approved for a auto loan. My first correspondence to Toshia P[redacted] and to the manager of the boise branch. I notified them of bare wires showing from there gps device. They could of at anytime ask to have it looked at and fixed. They refused to acknowledge any issues with the GPS Device. It later shorted out, and burnt the wiring. Which I also have pictures, and would be more than happy to take the car to a dealer, which I do not have to funds to do, I have only been able to find 2 seasonal jobs since.

I am rejecting this response because: I have a mesa He stating that the only way I could receive the paperwork was by going to the office and picking it up. Was also told that there was a law that it was illegal to send the paperwork.

The President of our company has contacted the customer directly and this complaint has been resolved to both side's satisfaction.

Here is the response from our Branch Manager in the Garrity/Nampa location that this customer has been working with:  I spoke with this customer the next morning, as the same day he spoke with our office, I did not receive the message to return his call.   However, when I did get the...

message, I called him back immediately. I explained to him it was a misunderstanding that I was not disregarding the review of his account. We reviewed his payment ledger together, including each and every single payment individually made over the course of his 28 received payments. We found he had been on a temp reduced payment for 13 months. Because of this it was satisfying interest yet the balance was not being reduced he was aware that he could make full payments or more than his required payment at any given time so that he would be able to see a reduction. I did offer him solutions to be able to reduce his principle owing balance or pay in full with settlement or refinance option. I informed him I would call him back on Monday 19th for the amount of the settlement I could offer after reviewing with RM. Upon getting an amount I could offer him for settlement I called him on Monday (2/19/18) and left a VM.  I have not received a return call as of end of the day Tuesday (2/20/18).
