[redacted] and was told this was a wrong number for Ms. [redacted]. The number was immediately removed and we have not had any contact after that conversation. Esser, James & Associates did not disclose any information to this female. This was the only person we spoke to on this file. We have not had any contact with Ms. [redacted] or her children. Therefore we are disputing that Esser, James & Associates told her children that she would go to jail if she didn’t settle her debt and that we refused to send anything copies of the debt or that there is a warrant for her arrest. The sales person listed on the complaint was Chris James. Esser, James & Associates does not have any employees with that name. In no way, was Esser, James & Associates' efforts to collect this debt meant to intentionally annoy or harass Ms. [redacted]. We do apologize for any inconvenience Ms. [redacted] may have suffered. Associates called the provided phone number in the complaint and was told Mr. [redacted] could not be
reached at that phone number, and that we had the wrong number. We were unaware of a correct phone
number for Mr. [redacted]. Esser, James & Associates did not receive an email with contact information for Mr.
[redacted]. In no way, was Esser, James & Associates' efforts to collect this debt meant to intentionally annoy or
harass Mr. [redacted]. We do apologize for any inconvenience Mr. [redacted] may have suffered. This matter is
closed and Mr. [redacted] can rest assured that he will not be contacted by Esser, James and Associates again.

Associates reached out to Ms. [redacted]’s relatives to try and get location information only. Of course, it is
against company policy to threaten any consumer with criminal or civil charges....

The notes do not indicate
that this occurred and the persons involved in his account vehemently deny that anyone threatened Ms. [redacted]. In no way, was Esser, James & Associates' efforts to collect this debt meant to intentionally annoy or
harass Ms. [redacted]. We do apologize for any inconvenience Ms. [redacted] may have suffered. This matter will be
closed and Ms. [redacted] can rest assured that she will not be contacted by Esser, James and Associates again.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. I agree that after re-examining the recording of the call between [redacted]: he stated that he was calling from their pre-legal department not their paralegal department. However, this does not negate the fact that he contacted me with the intent to attempt to collect on a debt for his client, [redacted] with the threat of litigation and reporting to the credit bureaus with the insinuation of recommending his client to proceed with legal action for forcible recovery without a law license. In fact, no mention was made of my right to dispute under FDCPA regardless of whether said debt was valid or not: or regardless of whether they had all my identifying information correct.

the paralegal department. We do not have any paralegals nor do we have a department for paralegals. Our client does litigate and we do make recommendations to our client to proceed. As for the desired settlement, Esser, James & Associates does not have the authority to mark anything as “paid in full” if the account is not paid. when it was placed in our office. We were
unaware of a correct phone number for Ms. [redacted]. Esser, James & Associates left a message for Ms. [redacted]
at the provided phone number in the complaint. The voicemail did not identify Ms. [redacted] and we were
unaware that it was a good contact number for her. Per FDCPA we are allowed to contact any person other
than the consumer for the purpose of acquiring location information only. No personal information was
disclosed. Ms. [redacted] contacted our office 9/24/15 first saying do not contact her mother in law anymore.
The number was removed immediately, while she was still on the phone. She then stated she was unable to
pay the account. The representative was professional and understanding during the call and the account was
closed same day since Ms. [redacted] said she was unable to pay. No more phone calls were made after 9/24/15.
We then received a Web Complaint Form Submission we provide on our website from Ms. [redacted] on 9/25/15
using vulgar language towards our company. In no way, was Esser, James & Associates' efforts to collect this
debt meant to intentionally annoy or harass Ms. [redacted]. We do apologize for any inconvenience Ms. [redacted]
may have suffered. This matter is closed and Ms. [redacted] can rest assured that she will not be contacted by
