RE: Complaint ID ***
Complaint Involves:Advertising Issues Customer’s Statement of the Problem:We live in a private community with a 'no solicitation' policyEmployee came to the door
alleging they had worked for a neighborI checked with the neighbor and they have denied using this company.Complaint Background:Product/Service: tree carePurchase Date: 8/30/2016Problem Occurred: 8/30/2016Model: Account Number: Order Number: Talked to Company: 8/30/1982Name of Salesperson: Purchase Price: $0.00Disputed Amount: $Desired Settlement: No further contact by the businessNo solicitation in the Crystal Lake, Woodinville community
Business Response:
Good afternoon:
We will put *** *** ** *** *** *** ***, Woodinville , WA on our “Do Not Approach List” and she will not be contacted again. If she would like to give us her phone numbers that reach them, they will also be put on the “Do Not Call List”
Our canvasser actually spoke to the husband about “meeting” with a neighbor named *** (9-1-@ 4:00PM), and we have “worked" with one of her neighbors (*** on Crystal Lake Rd)
Our canvasser said that there was a no soliciting sign in the front of the development, but this house did not have a sign
Our canvasser said that she spoke with the husband, who took extensive time discussing all the tree issues he had throughout his backyard.
Apparently, the husband went in to see if his wife wanted to meet with us; she became angry because she had just said no to one of our telemarketers. He came out and said no
Thank you,

Complaint Involves:Customer
Services Issues
Customer’s Statement of the Problem:Business contacted my 86-year old mother (hard of hearing, confused) several weeks ago, said that we had tree damage at our apartment building, and they wanted to do an estimateShe said they had to talk with me (property manager), but went ahead and scheduled an estimateShe gave me their contact information, but before I could call to cancel, they called my mother, and she canceledThey called again today, and she told me that they said said they would be out tomorrow to work on the treesWhen she asked if they had talked to me, they told her they had talked with me (I have never talked to them)I got their name from the phone CID, phone number is not even connected to voice mailI found them online, left messages at several numbers and said they are not to come out or do any work, and that we didn't want to do business with themThey did call back in response to one of my messages, and I repeated aboveThe person said my mother misunderstood the purpose of the visit tomorrow and that there is a note on the file saying they are to only deal with meWhen I said their caller lied and said they had contacted me, the person said it was because that caller was filling in for someoneI told them that I did not want them to come out for any reason, I never wanted to do business with them, these are not reputable business practices, and that I am going to report themI am on hold with the police to make sure that if for some reason they do come out, there is a report on record that they do not have any authorization to do an estimate or any workThere is online record that their telemarketing practices are unsolicited, repetitive, and unappreciatedI am concerned that they are also dishonest and taking advantage of an older adult with limited capacity
Desired Settlement: No further contact by the businessThat this company's questionable business practices continue to be on record with the Revdex.com for others who might look them up
Business Response:
It is evident that “CONFUSION” is the key word with this situation. This is the information in our data base: “Would possibly like some trees removed /cleaned up RESCH appt 3/@11:00.” Daughter is manager and is in charge of all maintenance hiring including trees“Daughter called irateTake Off List!!!!!!!!!”
This is the information that is available for the appointment setters for our company. This contact was strictly to set an appointment to have an Arborist meet with the owners of the property. No appointment was set to have a face to face meeting. Ms*** made it clear she did not want to hear from us and was taken off our call list.
There never was a signed contract!!! No work would ever be done without a face to face meeting with the owners of a parcel; a contract would be in place that was signed by all parties and a deposit made for the service.
The property owner would have a copy of that contract, it would state exactly what service would be performed and the terms of payment. No one from the appointment setting department would tell them that a crew was coming out to do any work because they have no idea when a job is scheduled
We have been in business since 1986. If we preyed on the elderly, as suggested, we would have been drum out of business years ago. We would not have an A+ rating with the Revdex.com
Does Ms*** have a contract in place? NO
Did she meet with an Arborist from Ever-Green Tree Care, Inc? NO
Ms*** has been taken off our “Call List”. SHE WILL NOT BE CONTACTED.
She contacted us to cancel; she made a Revdex.com complaint; she contacted the Attorney General and contacted the Police!!
This is a tempest in a tea pot, confusion of what actually occurred, or what we were attempting to do is exactly what this is all about. An appointment was trying to be set to have a meeting with the property owner. As Ms*** states “She does not want any contact, does not want work done.” We agree entirely and will not be conducting any business with her.

Complaint Background:Product/Service: trees were thinnedPurchase Date: 1/13/2016Problem Occurred: 2/2/2016Model: Account Number: ***Order Number: Talked to Company: 2/2/2016Name of Salesperson:Rick V*** Purchase Price: $1861.50Disputed Amount: $
Desired Settlement: RefundSince it is really impossible to tell what work was done these are older trees that may or may not have been thinned it hard to dispute if the job was completedThe desired outcome would be half of the bill refunded
Business Response
Good afternoon,
The work was done as stated in the contract. The issue we have is that the contract clearly states: “Upon Son’s Approval”. The approval was not forthcoming and the salesman was remiss for “Putting the work in the system”, without his signature. It was not a valid contract without both signatures The arborist in question now knows that he needed both signatures to have a valid sale
We will refund one half of the bill for this mistake. The clients received quality work for the value of the entire price of the contract. We acknowledge the paperwork mistake and are paying for that error
Thank you,
Kathy K***

Company Response:This is a statement from the ISA Certified Arborist that performed theservice at the home:I remember the job. The tree he is referring to is the first line of the contractmaple - light crown clean This is the neighbor’s tree. I did complete all tasks listed on the contract and collected a satisfaction sheet. I do remember the customer saying something about a verbal agreement to possibly top the tree down to the old cuts I assumed he meant to have us back out with a new contract, especially since there is no mention of it on the contractIt is company policy that only work written on a contract is performed. Verbal Agreements are never entered into for precisely the issue at hand. This tree is not owned by Mr*** The original work was sold to Mr*** by an ISA Certified ArboristThe pruning was done by an ISA Certified Arborist The original work was done to ISA StandardsThe client signed a customer satisfaction sheet upon completion of the work. After customers first call to Evergreen the ISA Certified Arborist who sold the work reviewed the work and found the work to be to ISA industry standards and advised owner of the tree and the client of the findings. The Certified Arborist who reviewed the work called the client on May 27th. However the client huon the ArboristThis was the right number because the gentleman who answered the phone answered as, “*** ***”. When the Arborist said hello he immediately hung up. The Arborist called back and the phone went straight to voicemailA message was left advising of the inspectionThe Evergreen Regional Director made several attempts to contact the client. One of those contact calls was on June 26th. At this time a voice message was leftThis call was made in the presence of the ISA Certified Arborist who sold the work to the client. On this same day the Certified Arborist also in the presence of the Regional Director called and left a messageThe tree has been reviewed by a third ISA Certified ArboristThree ISA Certified Arborist(s) are advising that the heavy and hard pruning requested by the client should not be done. This tree is of great sentimental value to the owner of the treeThe owner of thetree and his Father pruned this tree on their own up until the death of the Father in There are no guarantee(s) that the requested pruning will not harm this tree and create emotional distress to the owner of the tree; in the event the tree becomes diseased or dies from results of the pruning. The work performed was the work paid for. $to do additional work at a later date would have been noted in writing. I am willing to give a credit since there is an issue about a verbal agreement, this is not the way people do business. To bring resolution a check will be sent in regular mail on Friday 7/31/2015.Kathy K***

I am rejecting this response because:I received a very nice phone call from a representative of Evergreen, apologizing for the experience and informing me that they would be refunding my mom's moneyThe caller was professional and I let him know that I appreciated it.The reason I am rejecting the response is that when the refund check came, it was for Mom's first payment of around $470, but did not include the initial deposit that was also charged to her of $That charge also needs to be refunded to herAs soon as I hear that she has received that amount, I will be happy to accept the response. If Evergreen requires records of the deposit charge, they can let me know via my direct email, which they have on file.I'm pleased that this matter will soon be settled
Sincerely,

Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is sufficient I would note that this all happened because of an unsolicited call to my mother and pressured sales practices We never solicited their services -EVER- and my mother felt pressured -- even with that first call -- to schedule something, even though she told them at that time they would have to talk with me I would consider this issue "closed" I would not consider it "satisfactory"

Dear *** ***:
We certainly do apologize for any damages and upset to our customer’s neighbor, Mr*** ***.
Mr***
contacted our sales representative on 12/27/Tuesday; who in turn contacted the office to address Mr*** issues. ***, the arborist of record, offered to have the crew return to do any missed debris or pruning. Mr*** declined the offer.
Mr*** told our customer service department that he wanted $for a damaged fence topper. Mr*** declined to send photos showing the damages. The customer service department sent the information to our management group; they in turn authorized the check to be cut to Mr*** with our express apologies
Mr*** did not wait to hear if we would comply with his request but immediately started a Revdex.com Complaint, on the 27th.
Most businesses have a procedure that is followed in these instances; a check would have been cut on Friday the 30th when all checks are cut. We would have appreciated the opportunity to address this without his immediate contact to the Revdex.com. We have been in business since and strive to address issues in a timely professional manner
The check is being sent
