Customer’s Statement of the Problem:Business contacted my 86-year old mother (hard of hearing, confused) several weeks ago, said that we had tree damage at our apartment building, and they wanted to do an estimateShe said they had to talk with me (property manager), but went ahead and scheduled an estimateShe gave me their contact information, but before I could call to cancel, they called my mother, and she canceledThey called again today, and she told me that they said said they would be out tomorrow to work on the treesWhen she asked if they had talked to me, they told her they had talked with me (I have never talked to them)I got their name from the phone CID, phone number is not even connected to voice mailI found them online, left messages at several numbers and said they are not to come out or do any work, and that we didn't want to do business with themThey did call back in response to one of my messages, and I repeated aboveThe person said my mother misunderstood the purpose of the visit tomorrow and that there is a note on the file saying they are to only deal with meWhen I said their caller lied and said they had contacted me, the person said it was because that caller was filling in for someoneI told them that I did not want them to come out for any reason, I never wanted to do business with them, these are not reputable business practices, and that I am going to report themI am on hold with the police to make sure that if for some reason they do come out, there is a report on record that they do not have any authorization to do an estimate or any workThere is online record that their telemarketing practices are unsolicited, repetitive, and unappreciatedI am concerned that they are also dishonest and taking advantage of an older adult with limited capacity

Business Response:
It is evident that “CONFUSION” is the key word with this situation. This is the information in our data base: “Would possibly like some trees removed /cleaned up RESCH appt 3/@11:00.” Daughter is manager and is in charge of all maintenance hiring including trees“Daughter called irateTake Off List!!!!!!!!!”
This is the information that is available for the appointment setters for our company. This contact was strictly to set an appointment to have an Arborist meet with the owners of the property. No appointment was set to have a face to face meeting. Ms*** made it clear she did not want to hear from us and was taken off our call list.
There never was a signed contract!!! No work would ever be done without a face to face meeting with the owners of a parcel; a contract would be in place that was signed by all parties and a deposit made for the service.
The property owner would have a copy of that contract, it would state exactly what service would be performed and the terms of payment. No one from the appointment setting department would tell them that a crew was coming out to do any work because they have no idea when a job is scheduled
We have been in business since 1986. If we preyed on the elderly, as suggested, we would have been drum out of business years ago. We would not have an A+ rating with the Revdex.com
Does Ms*** have a contract in place? NO
Did she meet with an Arborist from Ever-Green Tree Care, Inc? NO
Ms*** has been taken off our “Call List”. SHE WILL NOT BE CONTACTED.
She contacted us to cancel; she made a Revdex.com complaint; she contacted the Attorney General and contacted the Police!!
This is a tempest in a tea pot, confusion of what actually occurred, or what we were attempting to do is exactly what this is all about. An appointment was trying to be set to have a meeting with the property owner. As Ms*** states “She does not want any contact, does not want work done.” We agree entirely and will not be conducting any business with her.

Ms*** *** signed a contract that clearly stated the work that was to be performed.? We were to “Crown Clean One Fir Tree”
for $500.00.? She did not, nor did her salesman state on the contract “She wanted only branches removed.”

The crew performed the service as they stated below:
“We went through the canopy of the tree removing the broken, dead and dangerous branches and thinned? the tree appropriately so the wind can pass through more effectively.”? When we were done Ms*** was wondering why I hadn't taken a significant portion of the large structural branches off the treeShe was concerned that they would fall off the tree.? I explained to her that these limbs were all individually checked for integrity and left because they? are the strongest limbs on the tree and provide the structure of the treeIf you start taking out a lot of large branches in a tree like this there's too much space in between the remaining branches and then in a load such as ice or snow or heavy rain they tend to snap off because there's nothing there to support themIt would not be my recommendation remove these limbs because it would actually end up making the tree more dangerousI explained all these things to her; before I left she signed a satisfaction sheet and gave me a check in full for the balance.”

This crew performed services for the tree on Ms*** property; Ms*** derived benefit from the services provided.? We did not call the 10% discount of $and a $Starbucks card with our apologies -restitution.? This was in compensation for her misunderstanding the scope of work that was done.? Had we done what she wanted it would affect the structural integrity of the tree.? We offered her that compensation as a sign of good will.?

She expects the crew and salesman to go without compensation for work that was performed that she derived benefit for… making her tree a safer tree…..? ????

We will refund the balance of the money for all the work done that she refuses to pay for.? She will be taken off all of our lists so she will not be contacted again.? Another company can perform what she wants whether it is in her best interest or not

I would note that this all happened because of an unsolicited call to my mother and pressured sales practices? We never solicited their services -EVER- and my mother felt pressured -- even with that first call -- to schedule something, even though she told them at that time they would have to talk with me? I would consider this issue "closed"? I would not consider it "satisfactory"?

I am rejecting this response because:I received a very nice phone call from a representative of Evergreen, apologizing for the experience and informing me that they would be refunding my mom's money. The caller was professional and I let him know that I appreciated it.The reason I am rejecting the response is that when the refund check came, it was for Mom's first payment of around $470, but did not include the initial deposit that was also charged to her of $140. That charge also needs to be refunded to her. As soon as I hear that she has received that amount, I will be happy to accept the response.If Evergreen requires records of the deposit charge, they can let me know via my direct email, which they have on file.I'm pleased that this matter will soon be settled.

They expressed the desire for removal of a Poplar and Douglas Fir? They decided to have the Fir and Poplar removed; approved; signed the contract and gave a 10% deposit
Prior to the scheduled date to do the work, they had someone else trim some of the limbs over the house on the Fir tree(The other company trimmed foliage, not long limbs.)
I met *** at 8:am the next day to go over the work to be done with the remaining poplar ??" the contract was adjusted ??" (since they had breached the original contract and used a company to do work on the Fir).?

We removed the Poplar as contracted.? The cost for the service was bid correctly and completely in line with the fees we charge all our clients.? No refund will be forth coming for removal of a 110’ tree that took more than one day to remove.? ?

Safety wise, I instructed them that the Fir tree was about as clean as could be (Evergreen tree had previously trimmed the tree for the old owner 2-years prior) they wanted it removed and then changed their minds.? How is this unfair business practices, they had someone else in to do the pruning on this tree that they decided to do

I advised them that we use outside vendors that come pick up the larger trunk wood at a charge of $per cord.? They stated they didn’t want to pay any more money.? I spoke to them about trying to give the wood away.? We agreed that if they couldn’t give the wood away they could contact our vendor for an exact price of removing the remaining wood.? (I actually saw someone with a truck picking up some of the wood the next day, so I thought all was good.)? ?

I also advised them that Evergreen does not stump grind that we also use vendors that do that work.? I had guestimated a price of appx$450.00.? I told *** that the grinder companies would give them an exact price up front before doing the work.? They would pay the grinder directly

Our canvasser said that there was a no soliciting sign in the front of the development, but this house did not have a sign
Our canvasser said that she spoke with the husband, who took extensive time discussing all the tree issues he had throughout his backyard.?
Apparently, the husband went in to see if his wife wanted to meet with us; she became angry because she had just said no to one of our telemarketers.? He came out and said no

They expressed the desire for removal of a Poplar and Douglas Fir.  They decided to have the Fir and Poplar removed; approved; signed the contract and gave a 10% deposit.

We removed the Poplar as contracted.  The cost for the service was bid correctly and completely in line with the fees we charge all our clients.  No refund will be forth coming for removal of a 110’ tree that took more than one day to remove.  
 
Safety wise, I instructed them that the Fir tree was about as clean as could be (Evergreen tree had previously trimmed the tree for the old owner 2-3 years prior) they wanted it removed and then changed their minds.  How is this unfair business practices, they had someone else in to do the pruning on this tree that they decided to do.
 
I advised them that we use outside vendors that come pick up the larger trunk wood at a charge of $100 per cord.  They stated they didn’t want to pay any more money.  I spoke to them about trying to give the wood away.  We agreed that if they couldn’t give the wood away they could contact our vendor for an exact price of removing the remaining wood.  (I actually saw someone with a truck picking up some of the wood the next day, so I thought all was good.)
