Review: I have requested on two separate occasions that our merchant account with this company be closed down. When I call they tell me I must speak to the actual processor, and not them. When I call the processor they tell me I have to cancel with Merchant services. Last month we spoke to Everest for the second time and explained to them that our business has closed and isn't processing cards and we want to close our merchant account with them. They informed us after an hour of jumping through hoops that we were all set and the charges would be reversed and the account closed. This months bill shows they refunded the prior amount of 123.89 and now a new charge of 93.32 has shown up which tells me the account has not been closed. I figured I would try this route before terminating/blocking them from having access to my account but am in need of help in handling this matter. This company tries anyway possible to keep you on there monthly billing list including telling lies to get you off of the phone thinking your issue is resolved.Desired Settlement: I would like the current 93.32 refunded and the account permanently closed. This is a nightmare company to work with.

Everest Merchant Services has tried to contact the merchant in regards to this latest issue and we were unable to get a hold of anyone. we have went ahead and closed out the account and refunded the total amount taken out of the account since the previous refund. we will continue to get in contact with the merchant this way we can specify what has been done on the account. the Merchant should see the refund within seven to ten business days.

Review: I signed on with this company at the end of march 2014. when I initially received a call from this company they did a comparison of one of my current merchant statements and showed me how much they could save me by lowering my interchange rates, and my transaction fees. My interchange rates were to be 0.12% and my transaction fees were to be 0.05. When I Looked over my first two statements I saw I was being charged 0.25% for my transaction fees. I didn't know how to figure out what interchange rate I was being charged so I called the number on the statement which is actually a different company called [redacted]. they informed me I was being charged 0.18% interchange rates. I also questioned what the $50.00 minimum discount due, fee was for. they said because I didn't process $50.00 or more for the month. I informed them that I most certainly did process more than $50.00 for the month then they couldn't explain why I received that charge and was told I would have to contact Everest Merchant for the discrepancies. I tried contacting Everest Merchant many times and no one would ever return my call. I finally did get to speak to someone and I expressed my concerns about the above issues as well as the fact that they were supposed to pay off my previous merchant company and leasing company which they still hadn't done as of June [redacted] 2014. The lady promised me she would check into these issues and see how we could resolve the issues. Meanwhile I am still being billed monthly charges from my previous companies for early termination fees. It is now June [redacted] 2014 and I still have not received a call back from her nor have I been able to get through to a real person. I have tried calling the company several times a day several times a week. I even left messages stating if someone didn't return my call that I would have no choice but to contact the Revdex.com still no response. I am at my wits end with this company.Desired Settlement: I want them to pay off my early termination fees for my previous merchant company and leasing company which is $1068.25 for [redacted]. and $450.00 for [redacted] systems. I would also like to terminate my contract with this company with no early termination fees because it is my belief they already breached our contract by not paying these fees and by charging me more in rates and fees than agreed upon.

Review: Everest promised to buy out a existing contract, they did not buy it out. Everest coded my business, but refused to fix the coding problems. ( Corporate Credit card were being declined because of how they coded my business, when I ask them to recode I was told sure , I emailed several time about this issue and called. Emails and calls were not returned.) I have changed processors and no longer have coding issues. I have ask Everest to cancel my account but now they want to charge me $495 to do so. My contract says I have a $25 dollar minimum but they are charging me $42 per month. Everest want to hold me to the contract but they are not following the same contract.7-*-13 my account was charge $173.95 and today is was charged $42. I have not used this company since April 2013.Desired Settlement: I would like a refund of the current charges and cancellation of my account without penilty

We can refund the merchant for the months that they did not process. They did not process for April through July and were charged $332.75 (April: $46.95, May: $46.95, June: $173.95, July: $64.90). Given that we did not reimburse them for their previous processor since they did not process with us long enough, we can waive our Early Termination Fee and refund them the $495 that they were charged. In total, they will receive a refund of $827.75 in one to two weeks.

Review: After over 5 months of not resolving issues with equipment sent, our company searched for another company that provided merchant services that we could actually work with. All equipment was return in good working order as instructed by their tech department. The sales rep as well as several in the tech dept. acknowledged that equipment was being returned due to not being able to make it work. Not terminated by us, rather that communication issues with the credit card terminals could not be resolved by them. Verbal agreement was made that since we did not terminate because we did not want to work with Everest but rather because a solution to problem was not found, no early termination fee of $495.00 would be charged. About a month later a direct withdrawal from our bank account was made for that amount, $495.00.Desired Settlement: Refund fee charged of $495.00 as per the verbal agreement made prior to returning all equipment.

This merchant has processed with us for four months successfully running transactions of $10,000 per month so the merchant

was obviously able to use our equipment. We resent her terminals multiple times (tracking number: [redacted], [redacted], [redacted]) to try to accommodate.her but she still decided to cancel with us. The merchant signed a contract stating that she would be charged an Early Termination Fee of $495 if she cancelled early which I have attached. Since she only processed with us for four months, we had to charge her an Early Termination Fee given that she cancelled with us early.

Review: Everest Merchant Services (EMS) received my business because in the contract they agreed to paying any early termination fees that our business incurred from switching credit card processing company. After providing proof and going through what seemed to be a very evasive tactic of telling me that my previous rep was no longer employed for over a year, I finally had contact with the third highest ranking person their, [redacted]. The communication started in March of 2012 and I received a handwritten check July *, 2013 from them for $175 of the $350 that I sent proof to them twice over the past year and a half. Ironically, prior to the check coming, they withdrew $185 for a PCI compliant charge. The PCI charge was not to be charged if I filled out a form which I had proven to them that I completed. So now I am still out the rest of the $350, $175 plus the $185 PCI compliant charge. [redacted] said they were sending the $350 in 2 checks, which he copied in [redacted] & [redacted] at EMS stating that I should receive it and was looking into the PCI charge. Since then the only communication I had with the company was an email I sent to [redacted] stating that I had had enough and was going to file this complaint. If needed I also kept a log of most of the calls and email with EMS.Desired Settlement: I would like the balance due on the early termination cost which is $175 and a refund for the PCI compliance charge of $185.00 which was charged twice, once last year and once this year even though I filled out the questionnaire both years.

Review: December 2012 Best-Way was contacted by Everest Merchant Services to do a cost comparison on credit card processing fees. I was asked and did send a monthly credit card processing statement for comparison. On 12/**/2012, after conversations with [redacted] ([redacted])stating that Everest could save Best-Way on processing fees, I faxed the application containing my company’s information, voided check and confirmation in the fax of a conversation we had about fees to be charged which all were addressed in the application. The fax and the application both stated: no statement fees or compliance fees and a minimum fee of $50.00 would be charged only if the total fee collected wasn’t over $50.00. Interchange rates with zero basis points, three cent swipe fee and twenty five cent batch fee.

February 2013 Best-Way started processing credit cards with Everest and in March 2013 received my first statement of charges from Everest. March **, 2013 I sent an email to [redacted] stating I wasn’t being charged interchange plus zero basis points as promised, also that I had been charged a $10.00 Compliance Fee. Since I didn’t hear anything back from [redacted], on March [redacted]2013 I called customer service and was connected to the voice mail of [redacted] ([redacted]) leaving him a message to contact me. [redacted] contacted me later the same day and stated he would remove the $10.00 compliance fee and check into the rates I was being charged. [redacted] also asked me to forward the email I sent to [redacted], which I did on March **, 2013. March [redacted] I sent an email to [redacted] and [redacted] about not hearing anything back. March [redacted] received an email from “[redacted]” stating he wasn’t the “[redacted]” I was looking for. Talked with [redacted] in customer service about the problems, forwarded all previous emails I had sent to [redacted] and [redacted].

May **, 2013 I contacted [redacted] again stating I hadn’t heard back from anybody, he again asked me to forward all previous emails and he would start deducting the overages as of 3/**. The overages now included $10.00 PCI Compliance, $9.95 Statement and $50.00 minimum fee to be charged only if I was over the minimum amount (every month Best-Way was over $50.00 in fees collected). May **I sent another email to [redacted] stating I hadn’t heard anything back. No response.

October **, 2013 I sent out the following email to [redacted], [redacted], [redacted], [redacted] and “[redacted]”.

To Whom it may concern:

Hopefully somebody can answer my questions! As you can see from the previous emails we have worked through some of the issues but some still exist.

1. Fees charged – If you look at my application (PDF – EMS Documents) I addressed and confirm a conversation I had with [redacted]. He specifically told me I wouldn’t have any PCI Compliance, Statement or CC Association Fees. Even the application sent by EMS, filled out by my company and sent back to EMS addresses some of these fees. Your company filled in the amounts for each of the items. Your company put the large “X” through the right side of the application negating anything in that section as being applicable.

a. Statement Fees – shouldn’t be one, wasn’t charged one in March (our first month with your company), April through present $9.95 per month

b. Monthly Minimum Fee $50.00 – Only to be charged if our total fees don’t exceeded $50.00, we have exceeded this amount every month but have still been charged the additional $50.00

c. Additional Fees - If you look at the bot[redacted] of (PDF) EMS Credit Card Processing some fees I am charged ever month, some I am not. Several of the fees per our agreement I shouldn’t be charged!

d. Compliance Fees - Why a “monthly” fee of $10.00 plus an “annual” fee of $129.00. Plus a “Non-Compliance” fee of $19.95 per month, according to the information I have I am in compliance until the end of October.

2. Credit Card Fees vs. actual amount deducted from my bank statement – Why would there be $47.44 more deducted from my bank account than the statement says should have been deducted?

3. Why do the total amounts deducted continue to climb ever month even if the amount of transactions and the deposits made don’t increase.

I called yesterday because I hadn’t been receiving statements, after being transferred four different times I talked to [redacted] and she told me I would have received a letter back in February stating they were going “green” and she would send me an email on how I can get them on line. What’s the chances I didn’t receive that letter since I started with your company in the middle of February?

I thought we had most of our earlier problems stated in the emails below worked out but obviously I was wrong. Since I hadn’t been receiving the statements I dropped the ball and trusted what I was being charged was correct.

Now that I have access and have received my statements, the truth is in front of me and I can only assume one of two things:

1. I was misled by your represents in the fees that I would be charged OR

2. I have been charged some fees by accident and those fees will be reimbursed and corrected!

I have attached my original application that I signed and sent back to your company, a previous bank statement from my prior credit card processing company you said I was being overcharged by and you used for comparison and a sheet of comparisons that are addressed above.

I am still looking forward to the savings your company promised and someone responding to my email with answers to my questions. Please respond by email.

November **, 2013 I received a letter from Argus Merchant Services stating they will be overseeing my account for technical support. I called the technical support number on the letter and talked with “[redacted]”, she asked me to forward all previous emails sent and she would refund the $50.00 minimum fees, $9.95 statement fees, $129.00 annual compliance fee, $19.95 non-compliance fees and the $10.00 monthly compliance fees. She also stated she would get back to me with other answers by November [redacted]. On November **I sent an email to [redacted] stating:

On [redacted]at 10:00 a.m. central time you and I talked on the phone about some problems I had been having since we signed on with Everest. You had me send the below email so you could address my concerns along with agreeing to remove some of the fees that I was being charged. Before the conversation ended you told me you would look into my concerns I have listed below and would get back to me on Friday, November [redacted]with some answers. It is now November [redacted]and I haven’t heard from you or anyone in your company!

I have been trying to get this corrected since becoming a merchant of Everest Merchant Services, now your company is overseeing the account. I am just asking to be charged according to our agreement. It looks like last month alone I was over charged more than $280.00. Some of the overages are on “legally regulated” charges.

I see your company was issued a “B” by the Revdex.com, this typically means your company doesn’t get many complaints filed against them and when they do the complaints are resolved. If we can’t resolve these issues my only other options are the Revdex.com and/or contacting an attorney to file a lawsuit to be reimbursed for over charges and fees associated with a lawsuit. Please work with me to try to get these resolved!

I haven’t received any refund on the fees as promised and haven’t received any response by phone or email from anyone within the Argus or Everest Merchant Services company. In December the contract wasn’t being lived up to by Everest Merchant Services I switched to another processing company. I feel I should be refunded the following amounts:

Review: Everest contacted me to offer merchant processing I thought it sounded like a good deal so I signed up at first with in 24 hours I found out more info about the company and chose to not move forward sending over 15 Faxes and 25 unanswered phone calls requesting them to cancel my account. They Proceeded to start charging my bank account without even sending Equipment and not ever Processing a single card for me. They then had the Processing company send the monthly Statements to a Fake Email Address so as not to tip me off the phone number they have listed with the Processor is ###-###-#### When I called the number to find out why they where Stealing my money all you get is an Answering Machine at someones home again a Fraudulent number This company will not Return Calls let alone Answer the Phone they have then Proceeded to Steal Almost $1500 out of my account all un authorized!!Desired Settlement: Re fund All Stolen FEES for the Zero Services I have Received!!!!!!

Review: I spoke with a sales rep who told me to send statements for a quote. The sales rep told me that he was goign to try to qualify me for "wholesale pricing" and for that he wanted to me to fill out some paperwork and send over a voided check. Before completing this step, I made it extremely clear to the rep that I did not want a contract, nor did I have a desire to sign up just yet, that I was just shopping around. the sales rep reassured me that I was not signing up for anything. To my surprise, I received a merchant terminal; I immediately spoke with the rep and told him I did not want it nor did I authorize it, and that I wanted everything reversed; the response I received was that if I did not use it I would be charged close to $1000. I want this illegal and fraudulent situation resolved immediately with a personal appology from the sales rep and an immediate cancellation and reversal of the entire transaction.Desired Settlement: cancel the service

Review: I was promised a rate of $.10 a transaction, I was charged $.25 a transaction. When I called my sales rep. he said he would take care of it. I don't know for sure what he did, but I have 4 statements that show $.25 a transaction. I called to cancel my account, and got a answering machine. I have left a min. of 2 calls a day for the last 16 days and have received no call back. How am I supposed to cancel my acc. if I cant get in contact with them. My sales rep. works for [redacted], and he says I have to call Everest to cancel. I just want to end this problem. On top of this I am going to be charged a cancellation fee of $495.00 that I was not told about till today. I tried to find this fee somewhere in my contract, but it was faxed to me and is very faded. It might be in there, I just cant see it.Desired Settlement: I would like to cancel my contract with Everset, and not be charged a cancellation fee. I have documents showing what I was promised, and I have statements showing that I was not given the rate I was promised. I don't feel that I should be charged because they [[redacted],Everest?] did not honor there part of the contract.
