To Whom It May Concern:
In response to your correspondence dated February 27, 2014, Kroll Factual Data is a credit-reporting agency acting as a reseller. We provide a merged credit report to banks and lending institutions that use our services to access credit for lending
purposes.
The correspondence we received from you on behalf of Ms*** indicates that there was an inquiry into her credit report on February 25, that was unauthorizedUpon receiving your request we searched our system by name for the inquiry Ms*** mentions in her correspondence. We located the report in our system that was accessed by our client Cumberland Valley National Bank.
We contacted our client and requested proof the authorization for the credit pull. Our client stated that this inquiry that accessed MsMcelwee’s Trans Union credit report was a result of a technical error and their intent was not to pull the credit report. They have indicated that the inquiry should be removed from the consumer’s report
Kroll Factual Data has requested that the inquiry dated February 25, be removed from Ms***’s Trans Union credit report

Verbal agreements are generally inadmissible in court. Written approval to search my credit history is proof positive that I gave permission. Without such written proof, I reject Kroll's argument and I ask that Kroll's inquiries be stricken

In response to your correspondence dated July 27, 2014, Kroll Factual Data (KFD) is a credit-reporting agency acting as a reseller as defined in the Fair Credit Reporting Act (FCRA). The information in our reports comes from the national credit reporting agencies Experian, Trans Union, Equifax and other information vendors
The correspondence we received from you on behalf of Mr*** indicated that there was inquiry on his credit report that had been secured without authorization. Upon receiving your request we searched our system by name for the inquiry Mr*** mentions in his correspondence and we were unsuccessful in locating it. We did however locate the letter we received from Mr*** on May 5, and our response letter mailed on May 6, requesting additional information. As we were unable to locate the report that generated the inquiry, we reached out to Mr*** directly. Mr*** supplied the inquiry date of November 2, 2012. This information allowed us to locate the report in our system that was accessed by our client Network Funding. We provided this information over the telephone to Mr*** and he confirmed this was an authorized inquiry for his mortgage loan

They sold my name to other companies at the time of a mortgage credit check These other companies ran credit checks without my knowledge delaying the final approval of my mortgage

I received a notice about this company pulling my credit report, in turn creating a hard inquiry which dropped my credit score significantlyI did not authorize this to happenI know nothing about this company and why they have pulled my credit reportI have no clue who or what this company is

Kroll Factual Data, Incdoes, among other things, pull credit reports on people for different entities, including financial institutions like my own bankThese are "hard" hits on your credit & negatively affect one's credit scoreWhen, on a weekend, I saw Kroll had asked for my credit report from the big credit bureaus, I was upset and left a negative reviewThe very next business day I received a very pleasant phone call from a real live personShe told me who had asked for my credit report (my bank) and why (request coded as being for an extension of credit or a mortgage)I never applied for any credit with my bank & there was absolutely no reason my bank should have done thisThe woman from Kroll clearly explained how to dispute the hit on my credit, which I didI tried to call the bank branch/person who had originated the request but she was conveniently out of the office & I'm still waiting to hear from my own bank as to why it did what it didKroll however was right on top of the situation from the very startNo computer voice, options to chooseSo while I may not like the fact my own bank is pulling my credit report w/o my authorization and using a third party to do it, in this case the third party, Kroll Factual Data, treated me with concern, respect and intelligence

The correspondence we received from you on behalf of Mr[redacted] indicated that there were two inquiries on his credit report that had been secured without authorization. Upon receiving your request we searched our system by name for the inquiries Mr[redacted] mentions in his correspondence. As Mr[redacted] mentioned we had investigated these disputes prior and our client, Watson Mortgage, responded that they had verbal permission. In light of the discrepancy we contacted our client a second time and asked if they could provide additional detail. The loan originator was able to provide that she was working with the spouse of Mr[redacted]. At this point we contacted Mr[redacted] directly to see if he was aware of this request. Mr[redacted] stated he was not involved with this request
As Mr[redacted] was not involved in the request [redacted] will be requesting that the inquiries of February 4, and February 13, be removed from his credit report. We will provide a copy of the removal request directly to Mr[redacted]

FactualData provides the following response:By way of background, Factual Data is a reseller of consumer reports.  The information included in each consumerreport provided by Factual Data is obtained from one or more of the following sources: Experian, Trans Union, Equifax, as well as certain other informationvendors.  The Revdex.com Complaint indicated that Factual Data pulled a credit report on March 22, 2014 without Ms. [redacted]’authorization.  In response to this complaint, Factual Data contacted its client – [redacted] (who accessedthe report through our services) – to obtain information on the permissible purpose of this credit pull. The correspondence we received from you on behalf of Mr. [redacted] indicates that he has concerns regarding credit scores and how Factual Data handles them.
 
Mr. [redacted] states that the scores that are on the Factual Data report are different than the scores he has obtained directly from the national credit reporting agencies. Factual Data does not calculate credit scores; we purchase the credit score along with the credit file directly from the credit reporting agency and the score is then put in the consumers report. There are many different scoring models and brands of scores.  The scores that Factual Data purchases are as follows:

[redacted] - Fair Isaac V2 FICO
[redacted] – Beacon 5 FICO  
 
These score models are most commonly used by mortgage lenders.  However these are not necessarily the scores the national credit reporting agencies offer to consumers for direct purchase.   For example, some of the scores sold to consumers are the Vantage Score or another version of the FICO score such as the Plus Score.
 
Factual Data believes the difference in the scores Mr. [redacted] purchased from [redacted], [redacted] and [redacted] are due to the difference in scoring models.

The correspondence we received from you on behalf of Mr. [redacted] indicates that there were two inquiries into his credit report that were unauthorized. Upon receiving your request we searched our system by name for the inquiries Mr. [redacted] mentions in his correspondence. We located the reports in our system that was accessed by our clients [redacted] Mortgage Group, LLC on February 18, 2014 and [redacted] Company on December 26, 2013.
We contacted each of these clients and requested proof the authorization for the credit pull. [redacted] Company stated that Mr. [redacted] provided verbal authorization to Madeline Burns over the telephone in regard to a refinance. [redacted] Mortgage Group, LLC responded that Mr. [redacted] provided verbal authorization to [redacted] in regard to a refinance. Factual Data Flood did a Flood Determination on a loan we are getting. They are showing the property is in a flood zone AND there is no way! It would have to flood the city of Corbin first and get up another 50-75 feet to flood this property. They had done a Determination 2 1/2 years ago and it was determined NOT TO BE in the flood zone. I have contacted them, as has our loan officer and insurance agent and they are saying their Determination is not changing. They are FLAT OUT wrong, anyone with eyes and common sense could plainly see, there is no possible way for this property to get flooded.

It does but if I accept I cannot comment. In the [redacted] acct I had power of atty for my mother because I was helping her since she had alzheimers, maybe that is how I got connected to her acct. But it was her acct and she had a stroke and that's why we stopped the acct. We would like to settle this for her but it is her acct.
