In reference to the complaint identified by the abovementioned case number (the “Revdex.com Complaint”), Kroll Factual Data (“KFD”) provides the following response:
 
KFD sent the request to remove the inquiry to the credit reporting agencies on or around March 10, 2015.  This request included the letter from [redacted] and the letter from Mrs. [redacted] requesting the removal. KFD also sent a copy of the request to Mrs. [redacted] for her files.  Once the credit reporting agencies receive the request, the have 30 days to remove the inquiry.  KFD will not receive correspondence in regard to the completion of the request.

Re: Case # [redacted] – [redacted]To Whom It May Concern:In reference to the complaint identified by the abovementioned case number (the “Revdex.com Complaint”), Factual Data provides the following response:By way of background, Factual Data is a reseller of consumer reports and subject to the Fair Credit Reporting Act, 15 U.S.C. §1681 et seq.  The information included in each consumer report provided by Factual Data is obtained from one or more of the following sources: Experian, Trans Union, Equifax, as well as certain other information vendors.  The Revdex.com Complaint indicated that Factual Data’s client, [redacted] pulled a credit report without Mr. [redacted]’s authorization.  Factual Data’s initial response to Mr. [redacted]’s dispute is that the inquiry was authorized and would remain based on a letter provided by our client [redacted].  In light of the information from Mr. [redacted] in this complaint and a second letter we received from Mr. [redacted], we have requested the inquiry be removed from Mr. [redacted]’s credit report.  A copy of the removal request letter will be sent directly to Mr. [redacted].

To Whom It May Concern:
On behalf of Kroll Factual Data, Inc. (“KFD”), I write in response to the above-referenced complaint filed by Mr. [redacted] on May 12, 2014 (the “Complaint”). By way of background, KFD is a reseller of consumer reports and subject to the federal Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. (“FCRA”), which, among other things, sets forth the permissible purposes for which a reseller is permitted to furnish a consumer report. See 15 U.S.C. § 1681b. Certain of these permissible purposes do not require the consumer’s written authorization prior to the consumer reporting agency’s (or in this case, the reseller’s) furnishing of the consumer report. One such purpose states a consumer report may be provided to a person when the consumer reporting agency or reseller has reason to believe such person “intends to use the information in connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit to, or review or collection of an account of, the consumer.” See 15 U.S.C. § 1681b(a)(3)(A). In this particular instance, KFD, in its capacity as a reseller of consumer reports, was requested by its clients – [redacted] Mortgage Group, LLC and [redacted] Company – to furnish a copy of Mr. [redacted]’s consumer report to [redacted] Mortgage Group, LLC and [redacted] Company in connection with his effort to “seek[] the best mortgage rate [he] can.” See the Complaint. The inquiries posted on Mr. [redacted]’s credit file, which is maintained by the three major credit bureaus – Experian, Equifax and TransUnion – were posted in response to [redacted] Mortgage Group, LLC and [redacted] Company’s request that Mr. [redacted]’s consumer report be furnished. KFD does not have the independent ability to remove credit inquiries.
