The $you upgraded the shingles and to cover the re-flashing of her chimney that you said was not coveredAccording to the claims draft, you were paid $for chimney flashing which still needs repair, there is still small gaps in the caulking which can allow water entryYou say that all of these changes were explained to [redacted] and the adjuster in your reply, but in the beginning you said she has dementia or alzheimer'sIf you suspected this why didn't you get it in writing? That would be the ethical and professional way to handle this situationThe reason for the two years is that we tried to get insurance on the house and because of the shabby job that was done, we cannot insure the houseI live in Arizona and when I went to Kentucky to move my mother to Arizona is when I found out the terrible job that was done on her houseThe gutters leak, there are raised areas in the shingles, exposed nails, large voids which can allow water damage were the shingles were cut too tight to trim and siding causing buckling, step flashings were not visible and should be verified at rear against siding and shingles should be cut back 1/from siding preventing curlingThat's just part of the roof problemThe roof should be completely redone! You failed to mention the $that you were paid to replace the drywall in the living room which included to scrape and prep for painting, [redacted] blown in insulation, apply anti-microbial agent, texture the drywall ceiling and paint which was not done and still remains undoneThe garage: the roof was not repaired and as the result, most everything in the garage was ruined which included antique furniture, antique cash register, hundreds of movie posters that my mother purchased over the yrs that she worked part time at the theatre, antique accordian, prints from famous painters, inventory from my brothers business at [redacted] bike shop, which could total into the thousands of dollarsBut at this point we are not pursuing thatAll we want is the garage repaired so we can get insuranceI have a copy of all the charges that you were paid, your estimate and all I am asking for at this time is for you to fix the garage as you were paid for in the beginningIf you can show me the paperwork different than what I have, signed or initialed changes which should have been done when the changes were madeIf not, then I expect the garage fixed as agreed upon the signed contractIf something does happen to the house in the meantime, you could be held liable because we cannot get insurance until these issues are repaired.Yours truly, [redacted] Regards, [redacted]

It is unfortunate that Mr [redacted] has turned to name calling to distract from the real issues and avoid his responsibilities His actions have been very consistent, fain interest and concern but no follow thru to make sure his promises to the customer are fulfilled All issues could and should have been avoided if the job was completed professionally and accurately from the beginningContinuous shortcomings and problems have followed, with me, the customer, having to constantly point out these issues and ask for corrective action Mr [redacted] acts like he is put out by my requests and that it is my job to make sure the corrections are done by his crews I hired Mr [redacted] to manage the roofing project and his crews to full completion and satisfaction Unfortunately for me, this has not been the case I want to make sure that other potential roofing clients are aware of these practicesTo date there has been no resolution [redacted] ***

I am a sole proprietor and my name is [redacted] not [redacted] and I have no employees by that name that work for meSo I am certain there are other aspects of this complaint that are either invalid or misinformationI was contacted by the [redacted] 's on one occasion, not multiple, to go out and inspect shingles that they felt were lifted up from improper installationI went out to inspect the roof and the [redacted] 's were not present at that timeI made sure the shingles had ample number of nails in them (or more) and re-sealed any shingles I felt were possibly lifted by additional wind damage to the roof over the past two years Per the contract that the [redacted] 's signed before my company began the work, it states clearly the homeowner is responsible to schedule an annual inspection of their roof by me to address any issues with the roof since I offer a 30yr warranty against leaks and workmanship NOT related to some other weather related event such as hail or strong windsThe [redacted] 's failed to schedule this annual inspection for the past two years so there was no way for my company to stand behind the conditional warranty they were given I was never informed of the [redacted] 's not being satisfied with the inspection and subsequent repair I had made to their roofNeither was I informed they were going to seek another contractor to perform the alleged $worth of repairs that they are now requesting restitution of In summation, I did what the homeowner requested of me, I was never notified in any manner that they were not pleased and I was not notified of them choosing to pay another contractor to come out to make repairs to repairs that were already completedI regret this situation and the displeasure of this consumer but I do not see how I am financially responsible for these repairs when there was never any further communication from the [redacted] 's once I was at there home and made the repairs that were evident at that time [redacted] Falls City Roofing###-###-####

The insurance company in this settlement as in most other roof repair or replacement settlements will not pay to replace rotten wood as they deem this as routine neglect by the property ownerWhen her insurance company paid to have this roof replaced, the insured did not have the additional money it would take to replace the wood that was rotten on her garageThe shingles on her roof and garage were year year three tab shinglesThe insured wanted to upgrade her existing roof to architectural three dimensional shingles so she decided to utilize the money allocated to her to repair of the garage to cover the additional expense of the upgraded shinglesHer garage roof was not repaired as there was no way we could have nailed new shingles to the rotten wood that she did not have the means to replace at that timeIt has been three years since this roof was replaced and I have not once received a phone call or email or any other form of communication from the insured or her sonIt us only now, that her son, who is trying to have his daughter occupy this property that I have been made aware of any issuesIf the insured or her son had had any concerns at all regarding her garage roof over the past three years, why was I then not notified much sooner? I am happy to make the repairs to the garage roof so long as the insured or her son are willing to pay for the rotten wood to be replaced as well as the cost of the shingles [redacted] Falls City Roofing ###-###-####

My Response dated 6/26/2015: Once again Mr [redacted] blames someone else for his inaction and/or his failure to handle customer issues His reason for inaction is always someone else’s faultIt is his employees’ fault for not showing up to complete the repairs and letting him knowIt is the homeowner’s fault for not calling him again to let him know that no one showed up to complete the repairsThere is never proper follow up by Mr [redacted] himself to assure repairs are completed Thus, his continual use of the word “ASSUME” has becomes his themeThis has been a constant theme with Mr [redacted] during the installation and warranty repairs for my roof and gutter guards Mr [redacted] continually acts like the victim when in fact he is the sole person (as owner/president) responsible for completion of all work and the satisfaction of his customersMy apology to him is that I am sorry that I ever contracted with him and would recommend to other home owners to steer clear of Mr [redacted] and his company, Falls City RoofingThere has been no effort made by Falls City Roofing to handle my warranty complaint dated 4/17/ This complaint remains open [redacted] - Homeowner

So far as the plaintiffs accusation that we "took advantage of the elderly" please know that I informed the insurance company on a recorded line that I felt o was dealing with an insured whom I felt may have dementia or Alzheimer's and I did so to protect her as well as myselfWhen the adjuster arrived the day of the inspection we sat with [redacted] and he explained he settlement at a bare minimum of three times b/c she would forget what he had told herThe rotten wood on the garage was addressed with the insured by both me and the adjuster and Ms [redacted] 's decision at the time was that since insurance would not pay to replace it that she did not have the financial ability to pay for it either due to the fact that she was helping support her male relative living in her basement The referenced $to reroof the garage was utilized by the homeowner at the time to purchase upgraded dimensional shingles since her insurance only covered the cost to replace the three tab shingles she presently had on her roof and to re-flash her chimney that the insurance did not pay for because in their opinion it was not related to the wind damage on her roofAll of this was clearly explained to [redacted] and the adjuster explained it to her as well so there is not a chance that I or anyone else took advantage of this homeownerIn addition, it has been over two years since this roof was replaced and I have not once been contacted by the insured or her family regarding any issues they felt were not addressed or performed in a proper, professional mannerI am happy to address all of the insureds issues and concerns solely for the costs of materials should he elect to have me do soI am very very sorry the insureds family members feel I was not fair or forthright with [redacted] but if they are willing and able to speak with the adjuster or retrieve the recorded call from her insurance company, they will know I did everything in my power to protect their mother and complete her roof replacement ethically and professionally [redacted] Falls City Roofing [redacted]

Regarding the complaint by [redacted] ***, the plaintiffs aimed to mention in his report that when he called his tone was that of either one in a drunken stupor or a angry child throwing a temper tantrumWhen I told him since I had not heard back from him since I had last asked my roofing crew to go fix one piece of drip edge that had come loose from underneath his shingles, I "assumed" it has been taken care ofHis response to me, in a very condescending and angry tone was, "you know what? You really need to quit assuming"At that point I ended the conversation and have not heard back from the plaintiff since He has called me once before ranting like a madman over another issue that I promptly took care of so his tone and condescending remarks are completely unnecessary and inflammatoryI am happy to resolve this fir the plaintiff once I receive an apology for the manner in which he spoke to meThank you [redacted] Falls City Roofing ###-###-####

There were no shingles missing or otherwise but nailed down as the complaint alleges when I went to inspect the roof and address the nail popsI can only presume that whatever contractor(s) the plaintiff chose to have come out to her home created this damage in order to otherwise legitimize the necessity for the plaintiff to pay for repairs that were not present when I went out to the inspect the reported nail pops and lifted shinglesFrom the ground surrounding this single story ranch home it would be very easy to see if there were ever any shingles missing, much less the now only now being reported as being soAgain, per the contract the plaintiff signed, they have a warranty against and defects in workmanship "IF" the contact me once annually to perform a roof "check up" inspectionThe plaintiff has not contacted me in two years since her roof was installed so there is no present warranty and no way for me to ascertain if the shingles she is only now claiming were missing were from additional wind danGe over the past two years or from her having multiple contractors on her roof to do inspections in order to receive compensation or if indeed it was from an issue with the initial installationHad the plaintiff abided by their contract and had me out to inspect this roof annually, as do the majority of the homeowners I do work for, all of this could have been avoided or addressed with no expense to them what so everSo far as texting them that I was there I can not recallI nearly always leave a note stuck in the door letting the customer know I was there and so they have something in writing to confirm I have mad any necessary repairs *** *** Falls City Roofing###-###-####

There are several things in Mr*** reply that do not have to do with the issue at hand. The issue is that he received my kitchen cabinets from ** Roofing without my permission and has not returned them to me. As a result I have had to purchase new cabinetsI have been contacted several times by *** *** via text message*** *** has repeatedly contacted me about my cabinets. Initially, he wanted me to pay $1,for cabinets that I had paid for (receipts available)When I refused to pay he said that I could pick up the cabinets but refused to coordinate a mutually agreeable date/time; in addition, me receiving my cabinets was contingent on me removing my complaint with the Revdex.com

I have spoken with the customer and explained her window was ordered but was manufactured incorrectly and that the manufacturer failed to have the correct size remade and I was never made aware of this issue until last a couple of weeks ago when the homeowner contacted me to check on her windowAt
that time I have her the choice of permitting me to reorder the window or refunding her her moneyHer husband was the individual I spoke with so he a agreed to have the money refunded to which I agreedI mailed them a certified check for the amount and was contacted a week or so later that they had never received itI then contacted my bank to ensure the check had not been cashedThis took a few days and once my bank confirmed the check had not been cashed I agreed to have deliver her refundMy son then was admitted unexpectedly to the hospital for breathing issues and my focus was on his well being and not on my business affairsI spoke with the husband again on Sat and explained my son was to be released that day so I would be over to deliver their refundThe hospital failed to release my son till Mon this week so my intent was to try and get there this evening to refund their money for the windowThank you

I have contacted the plaintiff several times letting her know I would be happy to return her cabinets once her complaint with the Revdex.com was removedI requested this action be takePrior to returning her cabinets as the plaintiff has not complied with anything she has verbally or under contract agreed to doI have told her as soon as I see the complaint removed that her cabinets wound be returned that very same dayI have sent her pictures of the cabinets so are knees they are in he very same condition in which she purchased themAs this plaintiff has already not done as she said she would on numerous occasions, I did not feel it was in my best interest to return her cabinets only to have her not remove her complaint from the Revdex.comOnce her cabinets are returned she will have no reason to do what is right similarly to what she has done all along. *** *** ###-###-#### ###-###-####

She has further not paid [redacted] for all the work that was performed at her residence so he subsequently pulled off her job and has been unable to pay me as a result of her being in default of the contract she had with them. I am happy to deliver her cabinets as soon as she fulfills her part of the contract that she is presently in default of or when she compensates Mr [redacted] for the work already performed so he can in turn compensate me, as was initially agreed upon by all parties.   [redacted] Falls City Roofing. ###-###-####

1. If [redacted] had actually come out and "fixed" or "examined" the roof then he should have noticed that the "nail pop" was not a "nail pop" but a part of the shingle that had popped off since it was not nailed down.  Therefore we had 2 roofers come out and check the roof and both roofers noticed that an entire section or basically 50 shingles had not been nailed down, therefore costing us the $600.00.  2. He never contacted us as the texts that I would receive from him kept indicating that he was "sick" due to the weather conditions and had yet been out to the house.]
