I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[The Aztec would not start unless you were pressing the gas for a long while, and when you would release the gas it would die. I have video of [redacted] as well as others trying to start the vehicle and it would not start, I also have video of everything discussed as well as [redacted] on the phone and documents stated that he would return the money for the Aztec. I also have video of me starting the vehicle, the ignition switch missing after they replaced it. They not only drove my car they took the car home with them, [redacted] actually did not know that Scott took the car home with him, because he was on vacation. I would love to send documentation pictures video etc.  ]

The seller is complete oblivious to the initial request of a full refund. He has ignored any and all factual information surrounding this purchase. This is not going to be a negotiation, the seller has already committed to a resolve of repairs and reneged on that option and stating fairy tale estimates and more lies. His offer of $330 is completely insulting, and anybody reading the complaint could clearly see that a repair of this type would cost well over $1000.00. The part alone at wholesale was nearly $600 and the labor to replace that part was 4+ hours. Nonetheless, I am tired of the lies, I am tired of the constant insults and unacceptable behavior of the seller. Better Business is not intended for the seller, but Kevin Kendall believes what ever is best for himself is the best business regardless of the long list of complaints throughout the internet. At this point the seller refuses to accept a full refund, and I believe that the only matter now is to file court documents and proceed with contacting other people that have been taken by this total liar and scam artist, con-man. I hope after this is all completed the Revdex.com will take another look at Kevin Kendall's business practices as well as local and government authorities, and the Arizona Attorney General in the findings of this and many other complaints levied and filed against Kevin Kendall and Fearless Motorsports. I will be posting open reviews about Kevin Kendall and his business practices and pursuit of all monies spent and loss of wages including attorney fee's and costs.

We have been in communication with this customer to get the issue resolved. The original purchase included two vehicles and we made a package deal with discounts that were part of the original agreement.   We informed the customer that there was several small repairs that needed to be...

completed as they looked at it before we had it completed.  they agreed and left a deposit and only left with the reciept...they did not complete the finance contract as they were ina hurry and needed to get the son to practice...they also brought the vehicle back so that we could install a gps and complete the neccesary repairs the nxt day.   however the customer that was on the paperwork was not with them and the paperwork could not be signed.    we informed them that we had completed a level 3 inspection on the vehicle to bring it to a restored status. they left and agreed to come back to finish the contract. 3-4 days later I was informed that tamesishe wanted to cancel the contract as she didnt feel it was a good car, I asked her for time to complete the previously listed repairs. she disagreed and the deal was unwound however it changed the overall deal as a package as the purchase only included one car instead of two, we also charge a restocking fee that covers re advertising the vehicle, inspection cleaning etc that must be performed afeter a car is returned.    The owner's name is jeffery...not kevin. the vehicle is not a salvage but does have a restored level 3 title meaning it passed inspection, they were given a check that had a brief hold placed as is standard practice bank to bank. we have been working with the customer snce to find a resolution that makes her happy that includes free brakes and oil changes on their vehicles..however we are not able to refund money as that is a real cost that was incurred on the unwound deal.

This customer came in with the original complaint of having a dead battery at times, we checked her alternator and it was fine, the battery was tested and found to be weak so we recommend replacing it, the starter being bad was a recent case, and it was also replaced, they were no way related. the way they did her sound system is absolutely a problem as it creates a constant  draw, its tied directly into the positive battery cable. we have helped every time she has asked, our position on this matter is not changed, her vehicle has been in her possession for a almost nine months. the repairs she is requesting are simply maintenance than any person would have to take care of.

[redacted] of Fearless Motor sports already has my wife's email considering he asked for it when we bought the car from him so I don't know why he would also need my email. I also make it a habit not to give out my email to people I do not trust, so I did not feel comfortable providing him with our email address again. However, he has had no problem text rude and profane text messages (see attachment) which he could easily send me the tracking number for the part via text as he has told my wife he would contact the providing company about since the beginning of this whole ordeal. The text message that I have attached was sent to my personal cell phone the morning after I filed my first complaint with the Revdex.com. I was honestly shocked, because under no circumstance can I see a reason for using profanity or for being so rude to a costumer, and this is how my entire experience with Fearless Motor Sports has been. The car we purchased from Fearless Motor Sports has now been at their shop for over two weeks getting the A/C fixed and I have not received any update from [redacted] since the rude text he sent me on June 30th. No auto shop would ever take this long and especially not follow up.As [redacted] stated in his response I did ask about how the four different tire treads and if it would effect the ride of the car and he told me no it would not effect anything. However, what he should have said was it won't effect the safety of the car but the car with still vibrate and make a humming noise at high speeds. This was very much a deceptive sales technique, a game of semantics. Again had I known that this would be the case with the tires I would have walked away immediately. Now for the airbags. Even if what [redacted] says is true that the this supposed broken senor would not stop the air bags from deploying in a crash, this still makes the airbag light be on so if something else were to happen that would prevent my airbags from deploying I would have no idea that there was a problem. [redacted] has never been willing to try and make things right with us instead he rudely laughs every time I bring up a resolution.  Regards,

On 1-15-16 a vehicle was purchased by jessica and boyfriend  that was a 2006 elantra vin number [redacted]. the vehicle did not...

over heat at the time and drove fine with no dtcs, we have our inspection reports. approximately two weeks later the vehicle the vehicle was brought back by Joshua and he stated to our Scott A[redacted] that he had hit a large dip in the road ad possible debree at a fast rate of speed that he estimated to be around 35 miles per hour, immediately after he noticed that his instrument cluster was not working correclty. he asked us to diagnose. we went through his electrcal as related  to the problem for a little over an hour and he was charged accordingly. It was deemed that possible damage may have accured to the cluster and possibly some sensors related to the tachometer. we asked him to bring the vehicle back as we had previously scheduled appointments, so we could further verify that problem and order the parts accordingly. The vehicle was not brought back. on march first I was contacted by mrs. barrus asking if she could recieve a new warranty form. I informed her that we do not re issue new warranties on a sold vehicle but it it would be typical for a vehicle as new as hers and with the mileage that her vehicle  had to have a 3 month or  three thousand mile warranty on the engine and transmission, any additional warranties such as those given on new parts would be also typical. she never mentioned any problem with her car. approximately a week later I was contacted again and she informed me that her car had possibly overheated and blown a head gasket, I asked her to bring the vehicle in for inspection by our staff to which she refused. I also informed her that if the vehicle was driven to the point of overheating it would void the warranty. Our warranty does not cover abuse by customers but instead covers mechanical failure.

The Keys were left in mr. [redacted] car which was moved outside the gate directly as a result of him not paying for his tow...it had nothing to due with him making complaints or reports. also we never had contact direct contact  with any [redacted].  This car was bought private party from a customer of ours, we have that customers name and phone number if you guys would like...please just email us to request it and it is yours. mr[redacted] called us a week after buying the vehicle stating that he planned on reselling it but had lost the title....he also requested our help tracking down the seller to get a duplicate...which we did. It was only after this that he overheated the vehicle...Mr[redacted] knows who he bought the car from...and even though it was on our property when he paid for it..we did not gain financially from the sale in any way. He can continue to complain or threaten us as he has continually done but he will be recieving no help in any way from this shop. It was never our vehicle...therefore we ever had an obligation to help him in the first place. we did only because we try to help in general anyone around us. We are more than willing to go to court and as stated we can provide the sellers name address and phone number... we will not give it again to mr[redacted] because of his harassing nature and at the request of the seller. Mr. [redacted] drove this vehicle overheated for a great distance to cause the damage that he did....We have no interest in offering any help of any kind to this gentleman because he already stiffed us on the tow bill even though we inspected his car for free. Again...its not our vehicle and we will gladly see this man in court to prove that he not only knew it but that he is has also mislead and directly lied to many different agents in regards to this situation. We have already contacted the [redacted] in regards to this gentle man and a restraining order is in process Thank you

I made a payment for the starter of 180 owing 50 that he did not add to

my loan but said to pay with next payment, also the only other repair

done was fog lights that they had on there but not hooked up so they did that and added that to the loan, if I come in every month saying something...

is wrong it is their job to figure out what it is, not go off of what I believe could be the issue, I am not a mechanic. To come in every month saying there is a problem and them never figuring out what the issue is is ridiculous. Not to mention that we had issues sine day one of getting the car. Also the tire already had a gash in the tire which I had mentioned to his manager at one point and they said it would be alright, the tire being hit on the side of the driveway did not damage the tire or the rim, and it was the back tire not the front which had the gash, I spoke to at least 4 or 5 different people at his establishment, so Kevin who is responding does not have all the accurate information. This car has been a dud since we got it and he is making my stereo to be the issue which it was not. The battery was fine it was the starter that was the issue and if they did their job they would of figured that out months ago instead of just changing the battery which we did not jump several times only twice till we figured out it was not the battery that was the issue it was the starting of the ignition.

Mr.[redacted] bought this vehicle from another customer who frequents this shop, a mr [redacted], although the vehicle was at our shop being inspected when mr.[redacted] bought this vehicle. He bought the vehicle as is and fearless motorsports was never in possession of said vehicle and we never benifited...

monetarily from the sale. We informed mr.[redacted] that it was running hot and we did replace the thermostat for mr [redacted] for which he was charged. The issue of the car is between the two owners.  further more mr. [redacted] lost the title after his purchase and contacted us and we reached out to mr [redacted] to request a duplicate for mr [redacted]. mr [redacted] called us and said that his vehicle had died and asked us to tow it our shop at our cost but that we would be reimbursed for the tow later. after inspection it was found that the water pump had failed and that the vehicle was overheated to the extreme. Mr. [redacted] admitted that it was dark and he wasnt watching the tempeture gauge when the incident happened and it was possible that he drove it hot for quite some time. the repair would be more than what the car was worth and we informed mr [redacted] of this but offered to help in any way we could, and we also mentioned that we could possibly find a shop in the area that had a motor laying around who might want to buy it so at least he could recoup some of his money. We did have some interest from a couple partys in the vehicle but were unable to gett ahold of mr [redacted] by phone, text or email.  at the end of the day mr [redacted] bought the car as is. we have a copy of the as is paperwork from mr [redacted].  The very next time we heard from mr [redacted] he threatened to file a complaint with the Revdex.com and [redacted] if we did not reimburse him.....however its not our car and never was. again not our responsibility...and again he bought the car as is from a private party.  as of last night mr [redacted] offered to drop complaints if we find a buyer for his car today.........I dont mind helping people but we dont work for free. mr [redacted] has picked up his vehicle for which he never paid for the tow and has possesion of the vehicle now. ...he bought the car as is....he overheated it......and then has tried to bully and threaten us into giving him money for a car that was never ours.  I will let him now when the duplicate is dropped off and if we hear from a buyer we will forward the info to mr [redacted]. I believe that concludes our business...he has somewhat abused our goodwill.

in response to the complaint....we sold the sante fe to him with a 3000 mile 3 month warranty on the engine and the transmission. we had also replaced the ac compressor before the purchase and I informed the customer of this. after this purchase the compressor ended up going out a day later, they...

contacted us and I told them to bring it in and we would replace it. we are currently waiting for the new compressor to come in which was ordered6-25-15 from high quality ac. we have asked them multiple times to send us a tracking number to send to the customer but have not recieved one. however they did tel us the have alrady sent the replacement.  I informed the customer of this and even offered to forward the emals from the ac company if he provided his email address. This customer has been stand offish and threatened to right a complaint if we did not return his money. I told hm the car would have to have a seriuos issue for us to simply return the car after its been sold for a week. the compressor issue is a easy fix, we recieved a faulty one and are waiting for the replacemnt for install. they do have four different tires on the vehicle of similiar tread, I informed the customer that it was safe to drive and would not be a safety concern, as far as the airbag light being on it has a sensor in the seat, I told him I would provide him with the information on it and that it does not stop the airbag from going off in the event of a crash.    in short we are simply waiting on the replacement part so that we can send them down the road with  cold ac. we have informed them of this multiple times and the husband has continually been hostile and accused us of giving them the run around...however he wont prvide his email so that we can forward him the correspondence between us and the ac company. we are simply waiting as they are for the replacement. we dont need a car taking up space anymore then they need the car in the shop.

we have contacted the customer...we were unaware of any issues with the motorcycle until recieving the complaint. we have let the customer know that if he has any questions or is in needof any help to bring the bike in and we would be happy to go through any issues that we were unaware of. This bike...

was ridden every day and was taken on a test drive by the customer... its an older bike.. a 1995 and we were under the immpression that he planned on doing some work or a bit of restoration on it...A project bike I believe is what was stated.    We informed him of all the work that we had completed on the bike.   We are more than happy to clean the tank again if there is any residue inside it or go over any thing else the customer has concerns about. we made sure the bike ran well and was road safe before his drive. Im not sure how a exhaust pipe would "fall off" but again we are more than happy to address any concerns with it. We have contatced the customer to make sure he knows that we are available if he requires us in any way and I hope that we can resolve this with him being happy.

In the reopens, frearless motorsports claims they were never in possession of said vehicle?? I bought it from his business in Adobe dr. in Phoenix from his sales person, [redacted]. I was given a bill of sale from fearless motor sprouts, (which I have attached a copy ) singed by the owner, [redacted], certifying he was the lawful owner of the car. which is requied by law. I did not know at the time of negeotiatiting that he never transferred tital, which he is required to do by law, are-[redacted].

I called the owner back the day I bought it and told him the car overheated on my way home from the shop after I purchased it. He refused to help me in any way. I even offeed to pay for a new radiator, if he would install it for free, he would not. I asked him for his e-mail address and proof of purchase for the thermostat he claimed he put in. he would not return my calls on this request. the car broke down on me on the way to work 2 days after I purchased it, I had it towed back to fearless motor sports and asked kevin to look at it. he said the head gasket was blown and he would not fix it. I informed him per the arizona lemon law, he was required to fix a major problem withinn two weeks or 500 miles from time of purchase. He flat out refused to do any thing for me. when I informed him I filed complaints with the b.b.b, and the [redacted], he "flipped out on me, thretened me, and told me the car was pushed into the street I'm front of his shop. I asked him if the keys were in it and he said he would not give them to me he was so angry. I has to have the phoenix police go to the business with me just to get the keys. 

Please help me, I have a broken down car that I spent my last 1600.00 on and I have to depend on co-workers just to get back and forth from work

Bought a vehicle from the owner who said I wouldn't have any problems with it since his brother owned it before and took real good care of it, put a couple new parts on it, yada-yada, I end up having to replace the starter, ignition and get all the wires under the dash re-wired and re-programmed because they were burnt. $1600.00 out of my pocket that I wasn't expecting for a while since I'd "have no problems with this vehicle" I asked for a duplicate title and I'm sure these as double charged me, the owner also told me the car would pass emissions and when I take it through, it doesn't pass! When I tell him he gets defensive and says I can't trust the place I went to, ummm a certified DMV place? Really? So he takes it to go through emission wherever he went and it magically passes, he charges me for the testing when I still had 2 chances to go through with my emissions testing place, I somehow have a small hole on the right side of my vehicle passenger door that definitely was NOT there after he fixed whatever made my car not pass emissions the first time, then I go to get a plate for my car and wowwwwww the title somehow goes from 115k miles to 221k miles! Which goes back to the burnt wires under my dash board because they did a dash swap, doesn't go by his warranty cause he charged me to fix the problem that was causing the car to not pass emissions when he told me it would pass in the first place! All the tires were different sizes, found that out when I got a flat and needed a new tire. Apparently he plans to make it a business to have a car lot, damn I feel sorry for anyone that goes there. I tell everyone I know and meet about this place and my situation.

charge. we drove the vehicle because the intermittent problem that she was having we could not find, we drove it until it finally had the symptoms she was describing, typically shops will charge for fuel when you have to test drive the vehicles with intermittent problems, however we did not need to put fuel in the tank, after repairs were completed she was contacted.   she pointed out that they had paid over what she thought was fair for the vehicle because of the [redacted] value. it was explained that [redacted] is a refernce and not always entirely accurate. she expressed her desire to return the vehicle.     after the repairs were completed the vehicle never had any dtcs or trouble codes, it also went through emmisions fine. at times you would have to give it a little gas to help it start but in know way does it affect the functionality of the car, per our warranty everything has been taken care of over and beyond what was originally agreed to. there warranty covered the engine and transmission for 3 months or 3000 miles. we covered the ignition and sensor on us even though it was out of warranty. the car was running fine when it left here. we had multiple mechanics inspect it due to the nature of the customer and us wanting to protect ourselves.

Review: I purchased a 2003 Pontiac Aztec. On 5/12/15 the car had wiring issues and then the car would not start. I brought the care back to [redacted] at fearless motorsports to be repaired. 1st attempt to fix the car was when they capped a spark plug as well as a vacuum hose. Said it was perfect. Drove 3 blocks to a gas station. Turned the car off and back on and it would not start. After trying multiple times we get it back to fearless. Where their kept it for 1 week. And during that week my car was taken home by an employee. Without my permission. As well as oil in the foot of my car and ignition switch broken. I found all of this out when I picked the car up on 5/27/15 I also find my gas tank is below a half a tank when I brought it in at a full tank and [redacted] would not reimburse my gas. We are told it is fixed there is a guarantee. We get something in writing that says we get our money back if it was not fixed on the 27th signed by management. The morning of the 28th. . . The car will not start no matter what! Finally get it started for it to die again. Call [redacted] He proceeds to say there is nothing I can do for you if you bring it back and it starts then nothing I can do. I bring it back and the car does not start for him! He still after trying 2 times already will not refund our money. So we decided to let him try and fix the problem again. Fuel filter tried and still had the same issues. Fuel regulator put in and still have through same issues this is now 4 attempts to solve the problem. The car has spend more time in their possession then in mine! I fear my safety as well as my daughter whom is barely over 1 years old.Desired Settlement: I just want the 3,400 in exchange He take the vehicle back. Because we have that agreement as well as by law I have given him over the proper amount to fix it!

I also have video of me starting the vehicle, the ignition switch missing after they replaced it. They not only drove my car they took the car home with them, [redacted] actually did not know that Scott took the car home with him, because he was on vacation. I would love to send documentation pictures video etc. ]
