I am rejecting this response because: According to Regulation Z of the Truth in Lending Act, any advertisement that contains a trigger term (i.ea monthly payment amount, or APR) must also include all finance terms within the advertisement This would include whether the rate is for a lease or purchase, the required down payment, and the length of the amortization schedule The Napoli Nissan ad I outlined in my original complaint did not contain any of those components, despite using a trigger term by advertising a monthly payment amount That is illegal and subject to both fines and/or jail time Napoli Nissan has continued to run the ad By not disclosing those terms, it allowed me as the consumer to be misled by the salesperson and waste my time and day in an effort to sell me a car that didn't align with their advertisement That is exactly the type of practice that TILA aims to prevent, and Napoli Nissan is in direct violation of this regulation

I am rejecting this response because:First of all the date was incorrectIt was September 25, Second of all I choose a Braselton home based on their reputation and qualityBraselton allowed a contractor to use untreated wood and now they need to correct mistakes caused by their employeesA home that is only years old should not have wood rotBraselton's home rating of AAA is deceptive as they do not stand by their workmanshipI understand it is past years, however at less than months past the years is unacceptable that they are unwilling to correct this deplorable situationI have never seen a new home in Corpus Christi, start falling apart in yearsThis has caused me unbelievable stressI now have to take this matter to the tax office as they have appraised my home as a quality Braselton home and it is notA home normally increases in value and should not be falling apart and losing value in a short years

After careful review of both the website and the signs posted in the neighborhoods, it does appear they need to be updated. In this neighborhood we do offer lots starting in the 120's, however at this time all of those lots have been sold. Lots in the newly developed area are larger lots therefore they do start in the 150's.

We checked the vehicle over for the customer. Their were very obvious signs that some thing impacted the exhaust (after) they purchased the vehicle. Because of the recent purchase we are willing to help the customer out and do the repair at cost.

base price for houses in that neighborhood (cottages at southlake) was in the 150's, when the sign right outside said starting in the 120's.  When asked about the sign he said it was just old.  On the Braselton homes website, under cottages at southlake, it has recently been changed in ONE place to say 150's where the bottom still says that the homes start at $120,000.  So even disregarding the third party websites, Braselton Homes is still advertising prices that they don't honor.

Trulia, Zillow, and Realtor.com are all third party listing sites. We do not have control of the prices on these sites. Signs posted throughout the neighborhoods indicate base prices for the homes in that neighborhood.

Napoli Nissan is trying to accommodate the customer's situation to the best of our ability.  The delay in registration occurred due the mailing address of the customer.  Napoli sent the proper, original paperwork to the address that appeared on the drivers license.  The delay happened...

because we had to backtrack and duplicate the process.  While the delay was taking place, Napoli sent the customer a dealer plate so they could drive the vehicle.Napoli used all resources to accommodate the customer.  We did our best to correct the errors that happened with the miscommunication on the mailing address..

satisfactory to me. I did receive a call from the warranty department to schedule an appointment for July 2nd for the flooring issue. Will the sinkhole and grading issue be addressed at this time also?

After reviewing the plans and several representatives of Braselton Homes speaking to [redacted], we found that Braselton Homes built the home according to the signed (by [redacted]) and completed contract and any corresponding work orders that were on file. As a courtesy, Braselton...

Homes was able to better accommodate the customer, for any inconvenience experienced, or misunderstanding that occurred. Fortunately we were able to provide another home that was available within the customers desired time frame and price range. I believe the matter has been satisfied, and we look forward to continuing to assist and work with the customer.

I am rejecting this response because:The responds from the Braselton warranty department is the same as that was provided to me by the repairman to give to me rather than confronting me personally.  As I mention in my original complaint there were several issues with the tile work in the house that were deemed as unacceptable dew to poor workmanship and the builder is refusing to satisfy his end of the bargain and repair construction deficiencies that are covered pursuant to Sections VI.5; VI.17.b.(3); II.C.1; and III.A.4.28 of the home warranty guide.  My home is under a VA Loan and falls under this section of the home warranty guide.  These HUD guidelines require the builder to correct these deficiencies in workmanship.Thanks You[redacted]

We are currently working with homeowner on getting these issues resolved. It has been a little complicated since the homeowner has missed several service calls, with no notification and as a result have had several subcontractors at the residence ready to begin work and have had to be sent to their...

Now it seems that we are trying to accommodate the homeowner with a hotel room so more in depth repairs can be done, however the homeowner has guests in the home that are not covered to be part of the hotel accommodations. We will be in contact with the homeowner by Tuesday 10/6/15 in an effort to find out how they would like to work this out. Braselton Homes will cover the homeowners stay in a hotel while repairs are being troubleshot and completed however can not do the same for roommates [woman with the baby; the homeowner has no children at the home].

Per the contract each homeowner signs when closing, we offer a One Year Limited Builders Warranty on each home. Each home also has a Ten Year Structural Warranty through a third party warranty company. Per our records the home has a closing date of 7/27/2005. Due to this the home does fall outside...

of the warranty time frame for both the One Year Builders Warranty and also the Ten Year Structural Warranty. Unfortunately, due to this we are unable to process the homeowners claim.

We sent the car to [redacted] to diagnose the problem, they said to replace the hydraulic pump for the convertible top. The part was ordered and should arrive March 5th at the dealership.

Per the contract each homeowner signs when closing on their home, each home comes with a 1-Year Limited Builders Warranty and a 10-Year Structural Warranty through a third party company. Each homeowner also receives a Homeowner's Manual that outlines the Warranty Guidelines along with Homeowner Maintenance Guidelines. Homeowner Maintenance is very important. Unfortunately, because this home falls outside of the 1-Year Limited Builders Warranty and also the 10- Year Structural Warranty, we are unable to process the Homeowner's claim.

sizable payoff.  There was no cash being offered by the customer and the vehicle he chose had numerous options.  The advertisement, which is being referenced, doesn't fit the criteria that the customer presented.  [redacted] was in our dealership over a month ago.  If he would like, Napoli can revisit his situation and try to accommodate him to the best of our abilities.

We are currently in contact with the purchaser to resolve this issue.
