I am rejecting this response because:In regards to complaint number *** yesterday afternoon I forward to find a grave what I had read their " contact and faqsand want to be reinstated ASAPI have gotten no reply.Well at the same time is it right for them to remove all the *** family from theWintergreen Gorge cemetery? I am surprise they did not remove my parents and grandparents too, other than theydid not know the last name.Also is it right to encourage people to invade other people families they do..ex My grandparents of my husband are buried in the Erie Cemetery , is it rightto take pictures of their graves with out first asking the family permission...a picture was submitted by a *** *** that we do not know who he is....This is invasion of the family privacy..Another example is my Great Great Aunt and Uncle who are also buried in theErie Cemetery has a picture taken by *** and ***This is disrespect to aunt*** and Uncle ***...They never contacted the family for permission to take a picture of this grave either..So if they want to complain about rules, what about laws in some statesarethey breaking them.*** ***@Aol.com

We apologize for any inconveniences that have occurred from this situation.   The memorials in Yonah Memorial Gardens were just one example of memorials being placed in cemeteries where the person is not buried.  Mr. [redacted] has added other memorials to incorrect cemeteries, even after being warned about this action.  Adding false information to Findagrave is a violation of our Community Rules or Terms of Service. We expect our members to treat each other with respect and kindness, as stated in our Community Rules.  The action of adding negative comments to his member biography is a violation of these rules. I am rejecting this response because: The grouping of memorials I put in the Yonah cemetery were changed to burial unknown. I made a simple mistake and have corrected it. The derogatory comment was that I called another Find a Grave member the worst Find a Graver because although I submitted proof of burial the member refused to correct the memorials, and although Find a Grave says it will correct discrepancies has still NOT corrected the memorials in question even though I submitted proof of disposition.Find a Grave accused me of submitting false memorials, which I did not, as evidenced by the fact they didn't mention it this time, an outright lie about me.

In regard to photographing headstones, laws vary from state to state. They even vary from cemetery to cemetery. We ask that our members obey all state and local laws as well as cemetery rules and regulations.

We will process the request for removal of memorials if requested by immediate family members.

We have carefully reviewed this request and have the following response. As a company, we strive to serve our customers’ best interests. We apologize for any inconveniences that have occurred from this situation and appreciate the opportunity for communicating this resolution. The member, [redacted], has violated our Terms of Service or Community rules.  This has happened on multiple occasions.  We have sent notification in each of these instances and the member has, each time, agreed to our Term of Service and Community Rules.  Here is a copy of the detailed email that explains the violations, sent to the member on November 6, 2017.   “In February, 2013 you backdated memorials.  Your account access was locked.  You responded stating that you would not do this again.  Your account was reinstated. In May, 2013 you were emailed about adding surviving spouses as pre-need memorials. In March, 2014 you were emailed and asked not to add burial unknown memorials, or pre-needs, and only adding a memorial after you have searched for the memorial first and it is not found.  In May, 2014 you backdated memorials again and your account access was locked.  You emailed back saying you wouldn't violate the rules.  Your account was reinstated. Throughout the last half of 2015, many memorials made to the living were removed.  These were pre-need memorials made to people who are alive. In December 2015, your account access was locked for violations of adding the living (even after the same memorials had been removed).  You received a detailed email regarding your violations.  You agreed to all of our Terms of Service, our FAQ, and also agree not to add living people or burial unknowns to Finda A Grave.  Your account was reinstated. In May, 2016 you added a memorial to a living person.  It was removed.  You added the same memorial an additional time after it was already removed.  Your account access was locked for this violation.  Your account was reinstated as you said you would no longer add memorials to the living. In October, 2017 you continually added multiple memorials again after they had been removed (even multiple times).  These were memorials to people who are alive, which you had agreed not to add to Findagrave.  Your account was permanently locked and you received an email stating that it would not be reinstated due to these recurrences and violations.   We hope that this helps you understand our decision not to reinstate your account.”   This member has been given ample opportunities, after she agreed to our Terms of Service and Community Rules, to have her account access restored.  This last violation was the fourth and final violation. We will not be reinstating [redacted]’s member account on Find A Grave. Find A Grave continues its mission to provide a collaborative community where members can contribute memorials and record burial dispositions. I am rejecting this response because:Merriam-Webster dictionary defines plagiarism as follows:"Definition of plagiarize, plagiarized, plagiarizing: transitive verb: to steal and pass off (the idea or words of another) as one's own: use (another's production) without crediting the source, intransitive verb: to commit literary theft: present as new and original an idea or product derived from an existing source."In my opinion, "VDR" plagiarized my uncle's family research when she created Find A Grave memorial for [redacted] and [redacted].  [redacted] and [redacted]'s Find A Grave memorials do not reference / credit their source of information.[redacted]'s name on his Find A Grave memorial is not consistent with his tombstone.  [redacted]'s name on her Find A Grave memorial is not consistent with her tombstone.Sincerely,

[redacted]  Find A Grave Rules are not used by other member on FG , But they single out one person when someone complains and keep giving reason you are violating rules. 1. My post dating was family ( Which I try to tell Find A Grave why I posted) The pre-needs was mostly  where I had walked cemeteries taking pictures. I added family members that said I could ( with the understanding that that was okay with FG.  Below is just a small list of members on FG that has pre-needs and unknown burial ( which unknown are all over FG. All I wanted was to complete cemetery info that I was working . I do not see how FG can keep my information and block me ? ( I can send a lot more members that are in violate) I do not feel that I was violating rules when over half of FG members are violating.   Thank you

We apologize for any inconveniences that have occurred from this situation and appreciate the opportunity for communicating this resolution.   The member, [redacted], has violated our Terms of Service or Community rules.  This has happened on multiple occasions.  The result of which was losing access to her member account.  This member has been given three opportunities, after she agreed to our Terms of Service and Community Rules, to have her account access restored.  This last violation was the fourth and final violation.  [redacted] has been sent an outline of her violations with explanation and details of why her account will not be restored.  That outline was sent on November 6, 2017. By accessing or using the Websites or the services that we provide via the Websites ("Service"), you are concluding a legally binding agreement with us, based on these Terms, including all terms, conditions and policies incorporated herein by reference. We have carefully reviewed this request and have the following response.   As a company, we strive to serve our customers’ best interests. We apologize for any inconveniences that have occurred from this situation and appreciate the opportunity for resolution.   In the original complaint [redacted] stated, “I requested them to either remove this obituary that does not reflect my mom's wishes, or remove all reference to me and my immediate family.”  We removed all reference to [redacted] are her immediate family.  We also locked the biography field so that the manager could not adjust the biography. We have apologized to [redacted] and explained that we are running behind on email at this time. Her emails were found and processed along with her first request.  There were other requests in her emails such as “I respectively request that all information about me and my immediate family ([redacted], [redacted], and [redacted]) be removed from this record and all other records on your site listed below:   Find a Grave Memorial # [redacted] - [redacted] Find A Grave Memorial #[redacted] - [redacted] Find A Grave Memorial #[redacted] - [redacted] Find A Grave Memorial #[redacted] - [redacted] Find A Grave Memorial #[redacted] - [redacted]   We removed all information about [redacted] and her family members from these memorials and prevented the member from adjusting the biography by locking that access.   [redacted] is now requesting that we remove this memorial from Find A Grave.  This memorial is managed by an immediate family member and cannot be removed. We can lock certain sections of the memorial if they are being abused.  When we are contact by the copyright holder of the photos that are located on the memorial page, then we can remove them.  We will need proof of ownership (such as the original photo) sent to us and then we will take action to remove the photograph.  These should be sent to [email protected].  If the photo section of the memorial is being abused, we can lock access to that as well.   We allow immediate family members to manage memorials on Find A Grave.  We understand that immediate family members may have differing opinions about adding information online.  We do our best to find a solution in compromise, by locking certain sections of the memorial. If the manager of this memorial page violates any of our Terms of Service or Community Rules or abuses this memorial in any manner, we will take the necessary action.
