[Again, their story has changed as to why they feel they paid me what I was due.  I have now lost count as to how many differing excuses as to why they believe their own narrative.  This is less about the money and more about their inept customer service agents and process as a whole.  The fact that they are now saying that interest accrued at the close of business on 12/4 and they did not reach my payment until 12/5 makes no logical sense.  If my due date was the 8th of every month, that would indicate to most consumers that interest is accrued again after the close of the day that payment is due not before.They continue to send me letters stating that they have been trying to reach me via the phone, FALSE.  They had the audacity to waste time and resources by sending me 27 pages of my original loan documents which prove nothing and I am still in possession of my original copies and now have another set of irrelevant papers.  This is not resolved as far as I am concerned however, I wish to NOT receive any more asinine correspondence from this joke of a business.  There is a reason that they are now out of business and only exist to provide customer service to those consumers with outstanding loans.]

This is not a fix all there is still the matter of late fees and any other fees also there is a issue of my credit rating and the three payments that are behind I would like them to be moved to the end of my contract and a real statement so I can see the payment reflect the actions of any payments maid.
I did not agree to a paperless plan and need a new statement each month if not the bike will be returned to Harley Davidson 1334 W.Centerville road Garland Road Garland Tx 75041 I have been in contact with [redacted] he is the Business Manager at Harley Davidson he has also been in contact with one of the head members of Thunder Road I have been Financed by this company once befor on a 2013 bike it needs to be removed from my account records

Please read and understand what is being requested before assuming that your agency acted accordingly. Your response says that the letter has been sent to me but I have yet to receive it and neither has my fiancé. (No emailed form was sent to his email address on file). I also haven't received it in post mail. The form is not made available on your website or on his account when logged in. (The reviewed calls pertaining to this complaint should have confirmed this.)

I am not accepting the business response, because it shows in the system when the last time I have called. And first Loan Associates have a log of who I speak with and what the conversation is about. Because if not, then why would the rep that I have talked too in Decmeber, would state to me that it showed in the system that I have called in Novemeber about the conversation of the current amount, so why do I need to provide the information to them, The company is only making it harder for me to to resolved this issue.  I was looking for a supervisor to call me, not the questions forward to me to answer like, Who did I talk to, what's is their name, and when did the incident happen. I have been misinformed, I am requesting the phone record from my company, to see when did I actually spoke with the rep. But First loan has all of this.

Not only is it a matter of the privacy policy practiced by
First Associates but we are also prohibited by law per: § 805 of the
FDCPA Paragraph (b) COMMUNICATION WITH THIRD PARTIES.Third party authorization forms are provided to the consumer
to be completed by the consumer and returned to our office for approval.
However, considering the current circumstances of the consumer as explained by
the complainant; we provided the Third Party Authorization Form directly to the

like to explain our...

involvement with respect to the customers Private Student
Loan. We (First Associates) are the current third party loan servicer; we are
not the holder nor do we own the loan. We had no involvement in the origination
of the loan or the education that was received at [redacted]. We
cannot address complaints against the [redacted] campus that was
attended. We recommend the customer contact the school directly regarding any
complaints about education or loan origination.
 
Upon
review of the account we can confirm that the customer did submit a request for
In School Forbearance on 02/02/2015. Unfortunately per the terms of the loan
contract; In School forbearances can only be granted upon the following
qualifying terms:
 
1.     
The loan
has not passed the
date that is 48 months after the first disbursement of the first PEAKS Private Student Loan.
2.     
The
customer is enrolled at [redacted] or [redacted] on at
least a half time basis.
3.     
The loan
is not in a Default status.
 
The In School Forbearance
form that was subm[redacted]ed by the customer did not meet the above qualifications;
specifically because the school being attended is not [redacted]
or [redacted].
 
As loan servicer our
administrative authority is limited to the terms of the customer’s student loan
contract. We cannot make changes to or otherwise modify the loan terms.
 
If the customer still wishes
to speak with a supervisor we can arrange a telephone call at the customer’s
earliest convenience. Please have the customer provide the date and time that
she would like to be called.

We understand that you may have some confusion as to your private student loan from Student Credit Union Connect for your tuition at ITT Technical Institute Liverpool Campus (235 Greenfield Parkway Liverpool, NY 13088-6651). We have contacted the financial aid department of the campus listed above and have obtained your financial aid history report. Highlighted on the history report are the abbreviations ELFCU PVTLN which stand for [redacted] Federal Credit Union Private Student Loan. [redacted] Federal Credit Union is the original lender of your Student Credit Union Connect loan. The amount listed of $7,595.00 on the financial aid history report matches the amount on the promissory note that was emailed to you per your request on 01/13/2014. We have included the following documents for your review: ITT Tech Financial Aid History Report, Promissory Note, Truth in Lending Disclosure and Loan Approval Letter from the previous servicer (ACS).
We have verified that this account is being reported on your credit report, specifically to Equifax and Experian . We do not have a reporting relationship with TransUnion, if you have pulled your credit report using their services you would have not seen this account.

Upon review of our records it appears that we have been released of our servicing responsibilities to [redacted]'s Private Education Loan. Her loan was transferred...

to [redacted] CREDIT, LLC in October 2014. [redacted] CREDIT, LCC can be reached at [redacted]. We are no longer servicing this loan and have no further information.

complaint.
 Upon review of Ms. [redacted] account history we can confirm that
she did contact our office via telephone on 02/24/2015. Ms. [redacted] advised the
representative that she has been attending school since Fall 2013 and...

would
like her student loan to be placed into an In School Deferment. At this time
Ms. [redacted] loan was already more than 6 months past due.
 
Per the terms of Ms. [redacted]’s Promissory Note; she must be
attending [redacted] at least half time for her loan to remain in
or be re-placed into an In School Deferment Status.
 
The payment history shows that Ms. [redacted] continued making
her loan payments until August 2014. At anytime Ms. [redacted] could have
contacted our office to go over the In School Deferment qualifications that are
outlined in her promissory note. We have always kept Ms. [redacted] aware of the
delinquency by mailing monthly billing statements and mailing her a demand
letter notifying her of the risk of default. The demand letter was mailed to
her on 1/12/2015.
 
Coincidentally, on the same date that Ms. [redacted] contacted
our office; her loan was moved into a permanent default status as her loan was
in a prolonged state of delinquency.  
 
According to the details in Ms. [redacted] complaint she is
currently attending “University of Maryland University College”, unfortunately
even if we had received her request for an In School Deferment in time to
process the form before the default; she would not have qualified.
 
We encourage Ms. [redacted] to contact our office if she would
like to discuss a payment arrangement that fits her financial needs.

I had attained a loan with [redacted] **, a online learning institution and had received a loan from First Associates Loan Servicing LLC.
First, I never received the materials to do the course, but the main problem is that First Associates Loan Servicing LLC has me both in collections, and as an active student. They are still charging me a monthly fee, interest, and late fees, but they also have me in active collections with no option to try to make the account current so I can pay the monthly payment. They will not work with me, they constantly transfer me to other departments, back to the school, or hang up, or 15 plus minute hold times when no one answers the call.
There is absolutely no way to resolve this unfair debt practice that serves me in any way. By keeping me in the active student status and continuing to charge late fees and interest, and keeping me in debt collection which I can not get out of without paying the balance in full, they have effectively bypassed the 7 year reporting. In essence, they can keep reporting negatively to my credit report for life. No outcome serves me and the destruction they have done to my credit report. This may very well be the worst experience I have ever had with any company in my 44 years of life. Subsequently, since they service the online school [redacted], I would advise anyone to stay away from this school because of who they choose as a lender for your loan.
I had not got the education, and then I had to file for SSDI leaving me with an income of 700 dollars a month. I was not able to pay for the schooling, but they never stopped treating me as an active student, while also cutting me off from bringing my account current and reporting it as such. Whether I pay the principle, late fees, and interests, or pay the monthly payment, they will continue to report and ruin my credit. This is a no win situation, and I never even got the product they are charging me for.
Stay very far away from these companies, their practices are shady at best, and they have found a way to bypass the 7 year negative account reporting.
