Thank you for notification of the above reference complaintMr***'s home was built in Upon notification by Mr [redacted] in of his concern over his master shower seat leaking we immediately asked our tile installer to evaluate the situationOur installer determined the current shower seat had been rebuilt by the homeownerIn discussions with Mr [redacted] he stated he had torn out the existing seat after a leak in which was denied due to lack of maintenance by M/I HomesHe then reframed and retiled the areaThe current active leak is not occurring in a product constructed by M/I HomesM/I Homes respectfully ask you to close this complaint

At the time of closing Mr [redacted] was provided with a copy of the Customer Care Manual This manual provides information and suggestions on how to care for his new home Page and of this manual address the exterior components (driveways, walks, patios and steps) Under the care tips it states that the home owner should refrain from using de-icing chemicals and to help prevent scaling after days of air drying a concrete sealer be applied Because concrete scaling is cosmetic in nature it does not fall under the structural warranty M/I Homes respectfully declines Mr***’s request to repair his concrete Mark N [redacted]

The original close date of this home is April 27, In September of the home owner contacted M/I homes with concerns about their exterior trim After it was inspected by Customer Care the home owner was called and advised that the trim was in good shape all around the home The home owner was called with an update of findings and was advised that it looked like the original paint and caulking It was highly recommended they have the trim caulked and painted every 3-years as recommended in the Customer Care ManualIt was noted that there were two windows at the bottom corners might have slight water intrusionAgain it was highly recommended they take care of this soon rather than wait a couple more years when many more boards would need replaced from lack of maintenance In August of M/I Homes was again contacted and a request was made to inspect the trim as they felt it was failing After this inspection as a customer courtesy M/I Homes offered to replace the corner boards and the home owner was reminded that he had been instructed to paint and caulk the prior year Exterior trim is not a structural item and does not fall under the structural warranty that is still in existence M/I Homes respectfully declines Mr***’s request to replace his exterior trim Mark N [redacted] |

I am rejecting this response because: This complaint is specifically about the improper installation of moisture barrier, which is still in place today and exists in the home as delivered by MI Homes. The bench itself is immaterial to this complaint. It's plainly clear today, as it was in when the original warranty claim was denied, that the installation is faulty and caused significant damage. We've had multiple repair companies come and look at the issue to quote repairs. Every one has stated that it was improperly built by MI Homes. Our request is that MI Homes repair, replace, or otherwise compensate us for this defect

M/I Homes has and will continue to uphold its warranty obligations to the homeowner.  With that said, based on our physical inspection on September 20, 2017 there was no evidence of a septic smell and we confirmed the stair squeaking had been repaired.  Several...

unrelated repairs are scheduled to take place in this home over the next few weeks.   We will continue to work with the homeowner as any additional concerns arise.

I am rejecting this response because:  Parts were received.  Supposed to get times/dates for installation and paint of the garage door on Monday the 11th but have not heard back.  Followed up today with Jerry B[redacted] and Joe L[redacted] via email this morning and waiting to hear back as of 1600.

This letter is in response to the response rejection from this customer on 6/23/2016.After receiving this response today, I took some time to go back by the customer’s home and reassess the concern. I did not notify the customer as I wanted to do so open minded. My conclusion is that since we did in fact, and to my correction, rework the drainage ditch all the way up to the culvert pipe as the customer has mentioned, we will perform a repair that we feel will resolve the standing water concern.We will install a French Drain beginning at the right side of the culvert pipe, if viewing from the street, and extend this drain all the way off the customers property. Although surface water from rain will continue to flow over the grass as expected, the moisture within the soils afterwards will be evacuated by this drain addition allowing for a useable and maintainable yard.I have contacted our landscape company to provide a recommendation of a final repair plan. Once this information is received, I will then set up a meeting with the home owner to review this plan and expectation, upon completion.My apology regarding this matter and we look forward to providing a better resolution for the drainage ditch. Unfortunately the culvert pipe repair was a homeowner maintenance related concern and was not covered by a warranty. This pipe was 6 ½ years old or older and we assure everyone this material was not previously used and was installed new at time of construction. Although now repaired, this will help us provide the best repair possible for the drainage.Lastly, I ask that with these letters being public knowledge, my name be removed as requested by the Revdex.com when filing a complaint or rebuttal.

MI on 4/4. He went over my list of concerns with our home. He said he would go over these at his office and get back with me. That is the last I heard from him. I have tried to call and text him and I also emailed his assistant. I have not received any response. I would like for him or someone with MI to call me and arrange to fix the items which Greg and others at MI promised to fix in the past before they stopped responding to me. Thank you,[redacted]

The issue the homeowner is experiencing is known as  “thermal distortion “ and it is a natural occurrence like a hail storm, tornado, or lighting, etc…  We understand this distortion is worse in the early spring or late fall when the sun is low in the sky and the sun’s rays...

reflect off the low-e glass and effect the vinyl siding on a home close by.   We, as the builder, have no responsibility or warranty to cover thermal distortion. We recommend the homeowner work with their homeowner insurer for a resolve.  Thanks.

Our division personnel have been in contact with the homeowner several times, as late as this morning.  Parts just arrived and we are awaiting a response from the garage door company for an install time.   Once a time is established the work will commence.   The homeowner is aware and should continue to work direct with the division until completion.   Thanks.

M/I Homes has addressed each and every item on the list with the homeowner's representative and had contractors on site to repair all warranted items along with some courtesy items on 10/9-10/10/17.

The Raleigh Division has confirmed they are working directly with Mr. [redacted] to resolve his warranty claim.  Mr. [redacted] indicated that he was withdrawing his Revdex.com complaint accordingly.  Thanks.

Mr. [redacted]’s home was built in
accordance with applicable building code and subsequently passed numerous
required county code enforcement inspections.  Original damage to the
shower was caused due to a lack of maintenance. The original area of complaint
was removed and rebuilt by Mr. [redacted]. The existing leak and improper
construction currently creating an issue was built by Mr. [redacted] and/or Mr.
 [redacted]’s subcontractors.
The M/I Home’s Homeowner Manual
(9/03 Edition pg. 9) states “Recaulking Ceramic Tile Grouting” is a homeowner
maintenance item.  Under “Interior Components” of this manual it states
(pg. 13) “After closing, you are responsible for re-grouting cracks. Use
flexible high-quality tub and tile caulking material”.
The M/I Home’s Homeowner Manual
(9/03 Edition pg. 4) states “Under our warranty policy, we warranty against
problems resulting from defective materials and workmanship during the first year
of ownership of your newly constructed home”  Mr. [redacted]’s homes was built
in 2007.  This manual further states (pg 8.) under “Exclusions from
Warranty” ; “Damage caused or made worse by: (#13) Negligence or improper
maintenance or operation by anyone other than M/I Homes its employees, agents
or subcontractors”  . The warranty manual further excludes, in the same
section, “Materials or work supplied by anyone other than M/I Homes, its
employees, agents or subcontractors”.

I reviewed the response made by the business in reference to complaint ID [redacted], and find the resolution is satisfactory to me so long as all of the items are resolved on July 11th.
