Please accept this letter in response to the complaint that you filed with the Revdex.com on January 6, 2017. Your complaint is in regard to the automatic payment withdrawals from your checking account for your loan at Regency Finance Company ("RFC") on your account ending in [redacted]....

During a review of your account, we did not locate prior written or oral notifications from you requesting that RFC not process phone payments from your checking account. RFC will respectfully adhere to your request. Enclosed is a copy of the payment history regarding this account for your reference. In speaking with the manager of the office, he confirmed he spoke to you and conveyed the same information to you. RFC will no longer process funds from the checking account per your request. The bank claims I did not have available funds until 10 November 2015 which is why they charged me overdraft fee's totaling in 481.00 dollars. However, according to my account statement from the bank, all deposited funds were available on 09 November 2015. I was not charged any fees until after on the 10th. I have numerous copies of my statement proving this to be true which I can provide.

I do not accept their response. They have created it that they can charge NSF at anytime. Again in April I was told the policy was to charge as fees come in and then in September that they deduct from highest to lowest, which is contrary to April’s conversation with the new policy.   My last conversation with [redacted] in October was that checks would be returned! The check in October for $500 drafted to another FNB account, at the same branch, should NOT have been honored. In October, the house payment draft from FNB was a human error, otherwise there would have been sufficient funds for the check. But instead the check was put through knowing that putting through a $500 check would cause substantial fees. In addition, if the bank would have placed the $500 withdrawal on my account immediately, I could have made a deposit before the close of the Uniontown branch office. I did not know it was negative until the following day on both occasions. Checks should be processed immediately, and posted as pending. I still stand by the correct customer service thing to do is HONOR the expenses AS PRESENTED, as I was told in April. The fees in September would have been $37 versus $111. The check in October should NOT have been processed or only a $37 fee versus $185. I am a human being, who makes errors. In every instance of overdraft, funds were immediately placed to correct them. However, I work very hard for my money to help keep a roof over my head and pay for the extra needs of my Autistic son. I believe, this bank has a choice to do what is right for the customer and see that their policies are very costly. It is not appropriate to be told in April the new policy, then be told in October when the savings account was closed that checks would be returned and a check presented to the same branch as my account was still processed. I do not feel their discretion was used in the best interest of the client; but, in the best interest of the bank.

The returned item fee charged to your account on June 7, 2017, of$37.00 was caused by the following transaction amounts: $20.00. The returned item fee was incurredper the deposit account agreement and personal fee schedule, provided to you at account opening andenclosed for reference.On June 6,2017, your ending balance was $3.25. Ms. [redacted] explained that you had received acourtesy refund and no further refunds would be given unless there was a bank error or fraud onaccount ending 0011. You indicated your dissatisfaction with the conversation and requested a call fromMs. [redacted]'s manager.On June 19, 2 0 1 7 ,1 spoke with you via telephone. We discussed FNB's refund policy and how thetransactions listed above caused returned items and returned item fees. I reiterated that you hadreceived a previous courtesy refund and would not receive another. Although we understand Mrs. [redacted]’s concern about the amount of overdraft fees she has
incurred, we have reviewed the activity on her account and have found that all charges are
legitimate. First National Bank encourages every customer to balance their account to the bank
statement and...

never make purchases or write checks prior to having the funds available in their
account.
The bank’s policy was explained to Mrs. [redacted] in April.  She was told that when she swipes her
debit card for purchases, those funds are immediately removed from her available funds.    
Then again in September, when the account had additional overdrafts, we explained the bank’s
policy of paying the highest dollar value items first, because the higher amounts generally carry
more importance for customers.
In October, we called Mrs. [redacted] as a courtesy to reminder her that because she had closed her
savings account that she would no longer have overdraft protection transfers available from her
savings.  At this time we also offered other solutions for overdraft protection, such as a line of
credit attached to her checking.  It is the policy of First National Bank to provide our overdraft
honor program to our established customers, which honors checks and purchases that they
make up to $800.
Throughout this entire process, it was explained to Mrs. [redacted] that the only way we could
refund any fees would be if the bank had made an error on her account.   
After another careful audit of Mrs. [redacted]’s account, we still conclude that the bank has made
no error and all of the banks procedures have been followed to the approved policies
guidelines.

This transaction overdrew your account,which caused the $37.00 overdraft fee (OD Fee) on October 4, 2016, and the $12.00 ContinuousOD Fee on October 5, 2016. The agent advised that you could dispute the transaction, if you feltthe transaction was unauthorized, but your response was that you authorized the transaction andthere was nothing to dispute. In your complaint, you indicated that the $7.56 PayPal transactionwas unauthorized, action was taken, and our Uniontown Branch has been trying to reach you togather additional information.Our records indicate that your account does have overdraft services but is opted out of RegulationE, which does not authorize FNB to pay overdrafts on ATM transactions and everyday debit cardtransactions. Upon receipt, a check was cut to you for the payment by FirstNational Bank. On May 4, we were notified that the authorization was revoked at [redacted] and thepayment was returned back to [redacted]. Please check your [redacted] records as they would have beenobligated to credit your account back $236.79. The credit should have occurred on or aroundMay 4. The result o f these actions provided you two credits, one via check from FNB and theother via ACH from [redacted]. overdrafts, such as an unsecured line of credit and/or establishing a savings account with automatic transfers to cover overdrafts.  The customer declined these services and recently incurred another overdraft, for which a refund has been requested.   Due to the repetitive nature of these overdrafts, the customer was informed that no further refunds would be granted.

We have received a copy o f your communication from the Revdex.com regarding the status of your accountsending in 1381 and 5580. After reviewing your accounts, we have found the following:On 08/24/2015, you filed disputes on 16 items from [redacted] with dates ranging from...

07/19/2015 through08/23/2015. Because you had prior relationships with this merchant you chose which items to dispute and which items werelegitimate. Temporary provisional credit totaling $604.00 was provided on 08/31/2015 for all of the disputed items. TheBank is still conducting its investigation which is due to expire in 90 days (11/17/2015) from your initial notification. Asecond checking account was opened for you at your request on 10/14/2015 as a courtesy so you would have access to fundsthat were being deposited.On 11/02/2015, the initial disputed account had been overdrawn for 49 days. Regardless of situation, the Bank’s policy is to“charge off ’ an account that has been continuously overdrawn for 49 days. At the time of the charge off, the bank reservesthe right to “use the money from any other account in which you hold an interest to pay the debt” . This is found in theDeposit Account Agreement. When the original, disputed account was charged off, funds were collected from the newaccount that was opened to off-set the amount owed to the bank. The charge off was not sent to Collections and will not besent until the disputes that were filed are resolved.The case will be resolved on 11/17/2015, at which time the action taken will depend on the outcome o f the disputes. If thedisputes are valid, the temporary provisional credit will become permanent and any fees assessed as a result o f the disputeditems will be refunded. If the disputes are not found to be valid, the temporary provisional credit will be reversed and theamount owed to the bank will be sent to Collections.

To all they have not told the truth and honesty. The first problem was when First National Bank took over Metro they sent out a payment through the bill pay dated not to go out on April 1,2016 and they sent it out  on February 1,2016 and charge me 35.00 overdraft fee and it was their fault and dud not  fix it, then being they sent the bill pay out to early and charge me fee  of 35.00 and then being the account was overdraw they then charge me a 111.00 fee. This bank know my Military check does not go into the bank tiil the 1st and I never scehdule any payment till the forst or after.By thime it was over and done with all the fees my accout was negative $1200.00 for all their fees and which is outrages. They sent me emails through their site that they sent out  letter and their booklet oabout them and all the fees.And as we stanfd now with all their fees they have my account at negative $1000.00. I need someone to go in and check out things cause I refuse to to apy these outrages fees. And when I called to talk to te manager the excuse was that she was not there and she was the only mamager trying to run three banks till they get new managers.I get $3068.00 amonth in my pension and I have money to pay everything but the way they did anddiong things with all their outrages fees no one can afford.And when I called and ask to stop payments on theingsor for them to close my account they claim they cannot do either.So with all this I hoping someone investigate this and a;ll the outrages fees they are charging.I have never in my life had trouble with a bank till now.The first National Bank here in Harrisbyrg, Pa is the worst bank in with all their putrages fees.I legelly do not know how they are allow to charge fees like 111.00 overdrafts in one draw and and  115.00 in another draw.I am apply to this being I haoping someone is out there to help the customer or citizen instead allowing these banks and company to proceed in charging out rages fees!Sincerely and Thankyou

Revdex.com,I completed and uploaded the privacy form you requested to this response.I also uploaded 2 of my personal documents as well.  One I believe is a copy of the signed release you are looking for and the other is the bill from July which lists past due as older then 6/3/16 and current up to 7/5/16.  My purchase was made on 6/9/14 and according to their own bill's current and past due date range this would be the current month for the 2 year pay off.  On the bottom it has the expiration date of 6/9/16 which would occur during this month's billing period.  How cant they say I didn't pay the balance off in time if their own bill says that date is still current and in the billing cycle 2 year window of the purchase date?  Something doesn't seem right as this is deceiving towards myself and any costumer that is paying a bill monthly.  Are the dates purposely set up to confuse the customer?Thank you,[redacted]
