Fisher Homes response to my compliant is a falseI cannot park a mid to full size car on both sides of my garage and I never haveIf a mid size vehicle is parked in the left side of my garage it blocks the steps used to enter the homeFuthermore no one from fishers has contacted me after filing this complaint with the Revdex.com

Dear RevDex.com, Thank you for forwarding this matter and allowing us the opportunity to respond Our customer’s rendition of the how the process took place isn’t how we saw itThe pre-approval portion was very clear and they qualified to build the home they desiredNot only did they qualify to build, but they had a strong enough credit score to be approved for a bridge loan which means they could close and move in their new home prior to their current home sellingIt takes an elevated level of credit and funds to be approved for a bridge loan today Our Construction Purchase Agreement is very clear on this and once it’s been executed and approved by the Vice-President the processes go into motionBoth the builder and the customer have obligations to meet I have attached two documents for the Revdex.com to reviewThe first is the pre-approval status that is shows that they’re well qualified and can afford the home that they signed the contract for and the second is the letter that was sent to the customer for refusing to honor their obligations of the Agreement that we entered into together We are uncertain of the reason they’ve chosen to not fulfill their obligations of the contract, but it clearly isn't affordability Thank you again for allowing Fischer Homes to respond to this matter Fischer Single Family Homes III, Ltd

Dear Revdex.com,In response to the above reference complaint, Fischer Homes appreciates the involvement of the Revdex.com as a neutral third party to help reach a reasonable solutionThe home closed on 11/30/and is now three years past the one year warranty provided by Fischer HomesOur service records do show that our flooring trade partner addressed the flooring matter with our customer in The warranty coverage for the floor would have been conveyed by the flooring trade partnerThe notes on this matter would elude that the customer's dogs created the majority of the problems reported.We also do not not show anything in our service file that would indicate landscaping being affected by run-off water.The HVAC system has a year parts warranty when registered and the customer can pay a small fee up front to cover labor for the same amount of time if they choose toMechanical systems have extended warranties, but are subject to proper use and care maintenance practices.Fischer Homes provides it's customers with detailed information in both the Home Owners Guide contract document as well as extensive warranty and maintenance information in the Home Owner Use and Care GuideWe are very concerned with customer satisfaction and offer as much information on use and care as possible during the purchase of a homeWE fully understand that there are hundreds of components that make up a home and we want our customers to have the knowledge to maintain them responsibly.Thank you for the opportunity to respond to this matter.Fischer Single Family Homes II, LLC

Fischer Homes has done nothing at all to resolve this complaint. They claim that it is because I have chosen litigation, however, to date I have simply had an attorney send a letter summarizing my damages (see attached). I personally spoke to a representative from Fischer Homes prior to having my lawyer send this letter and I was told that they had decided to do nothing. Therefore, I decided to commit my damages in writing

We’d like to thank the Revdex.com for allowing us to respond to the
garage floor allegations you recently received from *** ***
Fischer Homes originally closed this home in August of with an individual other than ***
***We were unable to locate any record of a garage floor issue for the
last
twenty seven years (27)
We did review the pictures that were sent by *** *** and
saw the proper installation and the reason for itThe slab is reinforced and
designed for possible settlement so that it can bridge the area without an
issueI have attached pictures that he sent that prove our pointThe slab is
resting on a keyway lip around the perimeter along with a grid pattern of rebar
and a structural center support beam
We’re confident that the garage floor was installed
correctly by way of the pictures sent in by *** ***We noted that the
contractor tearing out the floor has his bobcat equipment on the floor during
the removal process and it appears stableIn the attached photos you can see
the rebar clearly running through the concrete and sitting on the keyway as
designedIt’s obvious that the thickness of the concrete is more than four
inches in most areas and as in all concrete pours it is designated to be an
average of the number of inches required
We do not believe there was any danger to *** *** family
and the garage floor was still performing after twenty seven yearsTheir contractor
can voice an opinion as he’s doing the job he bid on, but we respectfully
disagree

Fischer Homes offered a mere $5,for damages I submitted that were close to $30,000. I do not consider this a reasonable effort to resolve the issue.

Dear Revdex.com,The home that our customer purchased does in fact have a two car garage and is being used as suchThe foundation on the home is poured as designed, but the garage slab was lowered by 2inches to lessen the driveway gradeHowever, the 2’’ drop did not change the
entry steps from two steps to three steps they were always designated to be threeThe homeowner actually does park both mid-size vehicles in the garage at this timeWe understand the access is close-fitting, but the plans for this lot and this home dictated three stepsWe respectfully disagree that we offered to re-pour the garage floor as it does not warrant re-pouringThank you for allowing us to respond to this matterFischer Homes

For your reference, details of the offer I reviewed appear below.First, regarding our closing dateWe closed on 4/28/16, Fischer Homes asked us to close on 4/22/16, merely days prior to our taking possessionWhen the trees were planted they were bare and evidently youngUpon taking possession of the home we immediately began watering as instructed by the gentleman that did our walk-through with us, the assistant to our landscaper and another landscaper who worked at a community across Frogtown from usIn my initial complaint I suggested that we were never given healthy trees in the first place, this may or may not be true, however, I dug approx9" deep around the base of one of my trees and was unable to reach the top of the root-ballThe earth that I dug through was solid, damp clay, the likes of which a child might play with and is impermeable (photos attached).My suggestion is that the only water these trees ever received was the first water they receivedWhen I watered my trees to the volume and frequency I was instructed, the water just sat on top of the ground and took hours to absorb, suggesting to me the ground was already saturated by the ample rain we get and my wateringFinally regarding the dry cracked ground being indicative of not wateringMy lawn, with the exception of a few patches, is flourishing and in those patches the ground (clay) is indeed cracked when it isn't wetI would encourage all interested parties to observe the ground at *** *** *** *** *** where they will find equally patchy and cracked ground and flourishing green trees.At the time of my writing this 21:on 7/11/I've not yet received any communication from Fischer Homes regarding my complaint with Revdex.com.I find Fischer Homes' response to my complaint both dishonest and evasive, consistent with my dealings with them thus far

Dear Revdex.com,Ms*** addition to her initial complaint is not an accurate representation as to what has occurred between the parties to date. Ms*** statement that “to date I have simply had an attorney send a letter summarizing my damages” is not true as this was not the first letter sent by her legal counsel. In fact, the first letter sent by her legal counsel was dated May 4, and claimed damages related to the view issue(See Exhibit 1) Once a party is represented by legal counsel it is Fischer’s corporate policy to refer the matter to our counsel at *** *** *** for further handling with opposing counsel. This is in fact what occurred with our legal counsel contacting Ms*** legal counsel on May 11, to discuss the allegations in the letter of May and the future handling of the claim. During that call Ms*** legal counsel agreed to provide our legal counsel an itemization of her claimed damages. Per this agreement, our legal counsel received a letter from the Ms*** counsel on May 23, summarizing her damages. Ms*** counsel requested a response from our counsel within days of this letter. Our legal counsel is currently drafting Fischer’s response to the letter of May 23, 2016. Based on the advice of our legal counsel and legal ethics once Ms*** sent the letters by her legal counsel, Fischer Homes is obligated to direct all future communications through her chosen counsel. The record is clear that Fischer Homes has not “done nothing” to resolve this complaint but has done exactly what Ms*** has required Fischer Homes to do which is communicate and work with her legal counsel to try to resolve this complaint. Until the process with legal counsel plays out Fischer Homes will be relying on its legal counsel to provide all responses to Ms*** complaints directly to Ms*** legal counsel. Thank you,

Dear Revdex.com,We are again very sorry that the incident happened and hope his daughter's cheek has healedThe issues that Mr*** describes are both plumbing related and our offer to have the plumbing contractor inspect every connection and fitting accessible still standsA third party whole house inspection is not warrantedWe stand by our products and understand the need to have the plumbing contractor go through the home, but we do not agree that a whole inspection is necessary.We will contact Mr*** to see if he agrees to the plumbing contractor's offer and discuss reimbursing him for a reasonable medical invoice for his daughter's cheek laceration. We have thoroughly reviewed
the entire process with each Fischer Homes and *** *** associate that touched
the process with *** *** and have come up with the following.
*** *** came to our
Model home to meet with our Sales Counselor and with what seemed to be a clear mission to
purchase a new homeHe actually came in three different days with his family and spent
up to three hours each time working hard to secure the best possible price for
the home he intended to purchase.Our Sales Counselor conveyed
that *** *** represented to him from day one that he knew he needed to sell
his home to acquire the home loan he was prequalified forThe bridge loan that
he refers to was only going to be an option to secure financing if he did not
sell his home prior to the time of closing on the new homeAt no time was the
bridge loan being forced on him, but was being offered as a backup plan if his
home did not sell in a timely fashion.He was prequalified
for a year fixed mortgage for $300,with 5% down with a loan amount of
$285,and the bridge loan as an option if his home did not sell
He added a finished
basement and other options prior to signing the contract which took it to
$325,He knew he would have to submit new loan application documents to
secure approvalHe refuses to do this after signing the contract knowing full
well his obligationsHe now wants something completely different than what he originally negotiated for three days and signed a contract to forHe now says he does not
want the inconvenience of moving twice in the event that his home sells prior
to the new home being ready
Good Faith Efforts to make himself a qualified buyer included listing and
selling his home, prior to the completion of his new Fischer HomeHe now
refuses to list itWe shared with him that if that is indeed how he feels,
then the best route to go is the bridge loan that *** *** discussed with
him prior to signing the contractWe reiterate that the bridge loan was always
represented as the 'back up' plan that would allow him to secure financing on
the off chance that his home did not sell in a timely fashion.Throughout the home
purchase discussions leading up to the contract agreement, each
conversation included ***i representing that he would sell his home
*** *** is making
the representation that Fischer Homes is unscrupulous in requesting that he secure
a bridge loan, when in fact the bridge loan would only be in play if his home
does not sellFischer Homes and *** *** associates have discussed this with *** From the start of the process it was our understanding that he
intended to list his home, and perhaps negotiate a delayed close with his
buyer that would allow him to avoid the double move, but he refuses to
consider this suggestionThis option would allow him to easily comply with the
Purchase Agreement that he freely signed
We're still confused on why *** *** refused to submit the requested
application documents for the home loan on the new dollar amount as *** ***
can’t approve or deny the loan without them
Fischer Homes is not sure
why *** *** made such a reversal in the plan that he agreed and signed a
contract for, but our policy in this situation is to move forward with what our
Sales Counselor and Sales Manager spent a portion of three days working with
him onHe knew the terms of the loan and was made aware that the HELOC for 15% of the purchase price was not
available

negotiations and the signing of the Construction Purchase Agreement contract
We are comfortable that we are being fair and that *** *** should complied with the good faith effort that he agreed to
