Fischer Homes has been in correspondence with us and has offered what they see as a solution/way to meet in the middle.  We need more time to decide if this is what is in the best interest of our neighbor, as well as ourselves.  We appreciate Fischer taking our concerns seriously and this rejection is more in order to buy time until our neighbor decides what he would like to do, since the driveway is as much his as it is ours.  He has had two contractors out, both of which say the final coat has not been laid, we have had one who said the final coat was never laid.  The developer who laid the blacktop is no longer in business so we are unable to speak with them.  Our neighbor wants to see if what is specified on the land plot in regards to the layers of asphault needed to be laid, is what has actually been laid.  We need more time for us and our neighbor to dissect the situation.

Homes’ Divisional Vice-President recently reached out to our customer and let
them know that we're investigating their concern. He has corresponded with...

them and
visited the site to visually observe the private drive in question. He’s also requested
the professional opinion of a contractor that installs blacktop of all types.
At this time
we’re anticipating a response from the contractor that we contacted to review
the private drive. Our next plan of action will be formulated by both what we
observed as well as the opinion of the contractor.
The above information
has been communicated to our customer and they understand the process. They recently communicated that they've requested a professional to observe the driveway as
well.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
 It was Fischer Homes who damaged the lane, not the developer, therefore they need to fix it.  They had all of their heavy equipment parked on our lane daily, creating divots in the asphalt.  There are also gashes, gouges and cracking.  Again, I have photo documentation of the damage and vehicles trespassing on our lane .  One hundred and nineteen photos in all. The two homes that were built on either side of the lane, located on the cul de sac were built using our lane for access.  Fischer Homes never asked for permission to use the lane, and none was ever given.  Fischer Homes needs to fix this problem.As for the driveway fix mentioned in their response, that was the first I'd heard of it.  It happens to be my driveway and Fischer Homes never contacted me or offered these "fixes".  I would appreciate it if Fischer Homes actually contacted me regarding the driveway matter.

Fisher Homes response to my compliant is a false. I cannot park a mid to full size car on both sides of my garage and I never have. If a mid size vehicle is parked in the left side of my garage it blocks the steps used to enter the home. Futhermore no one from fishers has contacted me after filing this complaint with the Revdex.com.

of a Change Order once the Final Selections have processed. The policy is to protect the customer and the builder from mistakes and delays. Typically the Purchase Orders and Prints have been initiated and changes often create scheduling and product deferment. This particular contract was under a contingency clause so the processes had not yet commenced. Dear Revdex.com,We appreciate the opportunity to respond to Mr. [redacted]’s allegations. We are continually working to maintain our high percentage rating for customer satisfaction. We are extremely concerned with the matters that Mr. [redacted] brought to our attention and have made efforts...

to troubleshoot the root causes. We understand the seriousness of the two situations and were in no way diminishing or trying to justify them. We tried to contact the [redacted] representative that made the alleged comments that the gas lines were only hand tightened, but did not have success. We did have some concern with the alleged statement as [redacted] actually performs a very stringent round of high pressure pass/fail testing on the gas lines before a builder can move forward on the home. This home passed the tests so if there was an issue as described we feel as though we need to have a meeting with [redacted] to understand how this could happen.Mr. [redacted] made an unannounced visit to our corporate office very upset and demanded to talk to someone so Mr. [redacted] agreed to meet with him. Mr. [redacted] was in no way blamed for the matter, but when he demanded that Fischer Homes pay for a third party whole house inspection or he’d go to social media, news stations etc… Mr. [redacted] tried to calm him down and let him know we would send the plumbing contractor to his home, but the demand for the whole house inspection escalated. Due to similar situations he was asked if in the last 14 months is it possible that the children used the spout to pull themselves up from the tub. We have seen this and believe it to be a reasonable question in a home that we have not had ownership of for over a year. The plumber was requested to make a visit to the home and the tub spout was identified as not being set tight enough and made the necessary adjustments.We are very sorry that these two situations occurred and agreed to have the plumbing contractor go through the home and check all the visible connections. This was conveyed during a phone conversation in which Mr. [redacted] said he had to hang up due to being at the veterinarian’s office, but would contact us back to discuss. We had not heard anything from Mr. [redacted] until we received the Revdex.com’s request for this response. Dear Revdex.com,We have researched this complaint and found that Fischer Homes and the original homeowner closed on this home on February 21st, 2012. Our original customer was provided with a one year non-transferable warranty on the home. Fischer Homes has not had control of this home...

for just shyof five years.We did find that we inspected the matter of the mandatory safety tie-off eyebolt in the roof and removed it for the second homeowner. We are not sure if our original customer requested the safety eyebolt be left for future use or not, but we did remove it and repair the shingle area.Fischer Homes fully honors the contractual warranty obligations to our original customers, but we are not able to continue that obligation to a home that is four years past the warranty and owned by a subsequent buyer.Thank you for allowing Fischer Homes the opportunity to research and respond to this matter accordingly.Fischer Single Family Homes II, LLC

We took some time to thoroughly research the situation and now have our response in order. The trees that Mr. [redacted] is referring to were noted as healthy at the time of...

closing and he was instructed that it would now be his responsibility to water and maintain them. He did request the species at the Home Orientation and that was provided. It is our understanding that the customer did not move into the new home directly after closing and we were in a time period where there was very insignificant rain so the trees were not being maintained as instructed. The observation by the field associates was that the yard was dry and cracking. It is for this reason that Fischer cannot warrant landscape that is turned over in good health. We're not in a position to pick and choose who gets a replacement and who does not due to the maintenance and care it takes to keep newly planted landscape thriving. However, if a plant is put in and is dormant state and it does not  bloom or grow foliage then it is replaced, but this was not the case in this matter.We will contact our customer to discuss the situation further and try to reach an amicable resolution.Thank you again for this opportunity,[redacted]

There is a pending yard repair created by the area of exterior concrete being replaced.  The Warranty Manager and the Customer Relations team researched the warranty service emails and voicemails and found that there were service requests completed through our Homeowner’s website and services were issued to the field team to address. The Customer Relations Coordinator issues the request to the appropriate associate to contact the customer. We apologize if there was any miscommunication about how the request is processed through the website. We will strive to provide the type customer satisfaction the we are known for and plan to have our Corporate Warranty Manager contact our customer to work through any outstanding matters.Thank you,Fischer Homes

by Fischer Homes. Our service records do show that our flooring trade partner  addressed the flooring matter with  our customer in 2014. The warranty coverage for the floor would have been conveyed by the flooring trade partner. The notes on this matter would elude that the customer's dogs created the majority of the problems reported.We also do not not show anything in our service file that would indicate landscaping being affected by run-off water.The HVAC system has a 10 year parts warranty when registered and the customer can pay a small fee up front to cover labor for the same amount of time if they choose to. Mechanical systems have extended warranties, but are subject to proper use and care maintenance practices.Fischer Homes provides it's customers with detailed information in both the Home Owners Guide contract document as well as extensive warranty and maintenance information in the Home Owner Use and Care Guide. We are very concerned with customer satisfaction and offer as much information on use and care as possible during the purchase of a home. We appreciate the ability to respond to our customer’s
submission to your organization.
The
community in which our customer built their home was developed by an outside
company that Fischer Homes has no control over. In these situations they are
responsible for all of the streets and...

private lanes. When the homes on the
private lanes are constructed and purchased in a time frame within the
developers schedule they’ll complete the final asphalt overlay post construction,
but In this case they chose to do so prior to the homes being completed and we
have no control or responsibility in the matter.
In this
customer’s situation the concrete area that adjoins the asphalt was replaced
and the concrete subcontractor not knowing whether the final was complete or
not left the apron lip up an inch to receive a future asphalt coat.
We have
offered to blend the asphalt into the lip or we’re also willing to replace the
concrete again without the one inch lip. The private asphalt lane is in good
condition and has been final coated by the developer. We are not in a position
to overlay the entire private lane.
 
Again, we
appreciate your involvement in these matters and are very willing to complete
either of the above offers for our customer.

Thank you
for forwarding this matter and allowing us the opportunity to respond.
Our
customer’s rendition of the how the process took place isn’t how we saw it. The
pre-approval portion was very clear and they qualified to build the home they
desired. Not only...

did they qualify to build, but they had a strong enough
credit score to be approved for a bridge loan which means they could close and
move in their new home prior to their current home selling. It takes an
elevated level of credit and funds to be approved for a bridge loan today.
Our
Construction Purchase Agreement is very clear on this and once it’s been
executed and approved by the Vice-President the processes go into motion. Both
the builder and the customer have obligations to meet.
I have
attached two documents for the Revdex.com to review. The first is the pre-approval
status that is shows that they’re well qualified and can afford the home that they
signed the contract for and the second is the letter that was sent to the
customer for refusing to honor their obligations of the Agreement that we
entered into together.
We are
uncertain of the reason they’ve chosen to not fulfill their obligations of the
contract, but it clearly isn't affordability.
