[redacted] I believe the facility was closed closer to 2 months,beginning shortly after Veteran's day.Also,even now,it is not fully open,with several features,including the track and the pool,among others,still unavailable.Therefore full price should not be charged.It is still in disarray and there is only 1 bicycle functioning.In addition,the communication throughout the entire process has been and continues to be very poor.

The issue is I was never refunded..the gym was never fully open and they had no right to give my membership to [redacted] without any writen or venal notice and then for [redacted] to start taking money out of my bank acvount.I never approved that and [redacted] has no signed agreement with me. I want Dec, Jan, Feb at least refunded by w fitness 20.99/ month..I will make a new complaint against [redacted]..w fitness had no right to transfer my information without my knowledge or consent.

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted].  Please see the attached email thread in response to the last communication.  If I was not afforded 30 days notice of the club location's closing, I do not believe I should be held to that same standard for notifying the Club of canceling my membership.  There were rumors circulating on social media and among the member's about the Club closing, but as last as of the last week of January, Club staff still would not confirm this.  The email I've attached indicates that Club staff did not know until February, and yet another communication in this complaint states that the Club posted notices on January 20, which was NOT TRUE, I was there and I asked staff.  The only notices posted were that child care was suspended.  I'm surprised I'm still having to argue this, as it seems rather clear.  Please afford me the respect of being truthful here and don't make us continue this argument.Regards,

W Fitness has never run television or radio advertising. Attached is a copy of the signed membership agreement that was emailed to [redacted] on 3/27/2015. The date that she joined the health club. As stated in the membership agreement [redacted] had 3 days to review the...

agreement and cancel for a full refund if she did not agree with any of the terms. On 2/10/16 [redacted] called our billing company [redacted] financial to cancel her membership. A copy of the recorded phone call with [redacted] Financial and Ms. [redacted] is attached. During the call [redacted] informed her of our cancellation policy which is also stated in her membership agreement, and that her account would not be cancelled until she completed the cancellation form and sent to [redacted]. Ms. [redacted] then acknowledged on the phone that she would be into the club to pick up her 30 day cancellation notice. Ms. [redacted] has a past due balance is listed at $93.99. This amount includes four monthly payments of $11 for March, April, May, and June of 2016, as well as the annual rate lock fee of $49.99. Ms. [redacted] has been fully informed of the cancellation process numerous times and fails to comply so her account remains active.

Unfortunately our location in worcester was flooded due to a burst sprinkler pipe upstairs. Our facility was shut down for one month December 17th, 2016 until January 17th, 2017. We are working with the insurance company now to reimburse everyone one month worth of membership dues while the facility...

As stated in [redacted]'s membership agreement " An annual membership rate guarantee fee of $49.99  will be drafted once per year for the life of the membership. The first draft will incur 02/15/2012 and reoccur once per year on the same date until the membership is cancelled. In order to cancel the billing of this annual fee, the club requires written notice and cancellation of your membership on or before the 25th of the previous month."  Written notice of [redacted]'s decision to cancel was not received until 02/07/2017, therefor she is responsible for the annual fee.

Hello, [redacted]'s agreement was emailed to the address that she provided on the date that she signed up for the membership, copies are also available at the facility at any time. I have also attached a copy of the membership agreement.   Please provide any proof that you have (ie certified mail receipt or time stamped email and we will have [redacted] investigate). However, as I stated in the original email even if [redacted] had received your cancellation form on 4/6/17 you would have still been responsible for your annual fee as stated in the terms of your agreement. As of today 5/24/17 [redacted] has not received your cancellation form.  Also, Our equipment is well maintained and serviced once per week.

Signage stating that the facility was closing on 2/28/17 was posted on our website, [redacted] page and in the facility on 1/20/2017. The letter also stated that any remaining memberships would be transferred to our [redacted] location.

 Getting worse and worse.They had the only bike available removed and the person who said she was the "Manager"had no idea why.Still no use of the track or the pool,but the same fee continues to be deducted each month($11.)No working phone to contact anybody.Shortened hours.Are they planning to close?Please help.

The health club is currently rebuilding the facility after significant water damage which has forced us to move some equipment so that we can complete repairs. We have also froze all billing for the month of February to make up for the time that we were closed, December 17th - January 17th.
