Fitness Evolution received a medical request to cancel Ms*** membership on 02/15/2018. As this request was granted on 02/15/2018, no further charges to Ms*** billing account had been made For other personal issues, personal texts, relationships etc. Fitness Evolution cannot respond to such issues of the heart, that are very personal. Any issues related to bullying are taken very seriously and had been addressed with Ms***. Fitness Evolution has closed Ms*** account and determined there is no refund due. Complaint: ***I am rejecting this response because: I will not pay for services not being used and based on a broken contractThe class that was offered by Fitness Evolution while I was a member was named 'Yoga'The classes, as they were changed after November 2015, were "Pi-Yo', a mixture of pilates and yoga, which were absolutely not the same class and further poorly attendedThe few classes I went to had total people in attendance including the instructor, whereas a typical Yoga class may have 10-people
At minimum, a half dozen people I've spoken to in town, mostly from my local banking institution, have personally complained or known others (other bank customers, friends, family, etc) who have complained about the poor business practices put in place by Fitness Evolution with respect to financesAn ex-girlfriend had this company pursue her via collections over a late fee of $after her card expired unknowinglyThere was no communication first - just sent to collectionsIt is obvious to an outsider that your business practices need revision, it's just a matter of doing so.
I will also note that in none of these responses have you addressed the specific safety concerns brought up in my original email, or mentioned any intent to make repair/replace to mismatched dumbbell sets, bent bars on the smith racks, etcI no longer have any personal investment in these concerns since I am no longer a member, but I imagine the current customers would appreciate steps taken to rectify these items.
I ended my membership with Fitness Evolution on Nov27th, with a day grace periodAs of December 27th, I was no longer a member and haven't been to the gym since mid DecemberI will not pay for the month of January per all the aboveThat - and the total cost of this whole discrepancy is $You are a giant gym with many membersThe fact that you've taken the time you have to respond to these messages alone may constitute a back office staff hourly pay equivalent of this amountSurely the money isn't a concern for you.
The bigger concern that I have voiced above and will voice again, and that has been danced around in his email chain - is a difference of two days from what I understand based on billing cycles and processingHad I approached staff on Nov25th, as opposed to Nov27th, all of this would never have had to come to passIf I had been offered any kind of leeway on this time frame, I would not have approach the Revdex.com with any of thisThis is customer service at its basest, and your company is failing at it currentlyYou have the potential to make right with customers and should, and I would encourage you to do so

Complaint: ***I am rejecting this response because:As you can see from the contract they have provided, there is no signature, no initials, and marked as a month contract agreementYou will also note that there is no signature on the credit card section agreeing to allowing them to continually charge my credit cardThe law firm I am working with also pointed out that the $fee they charged is marked as $on this contract, further proof of their illegal chargesMy credit card company denied their charges after a lengthy discovery period, stating that Fitness Evolution failed to provide any proof constituting their charges and all charges were then reversed in my favorThat is when Fitness Evolution determined they would then pass the suggested debt off because of their lack of evidence, in addition to adding other charges above the originally charged amount.I have also searched the Revdex.com database for claims against Fitness Evolution and have found hundreds of other similar claims of then illegally charging people's credit cardsAnd, when they these people point out that our memberships were canceled, Fitness Evolution denied the existence of those submissions of cancellation and flipped that to debt collectionsThis is a perfect option for a class-action lawsuit against a company that takes advantage of a service to collect debt when it is unconstitutedIt's unfortunate for a business to flex the power of turning unjustified debt over to a collection agency to then harass innocent individuals on these claimsAll the while Fitness Evolution wipes their hands free of any responsibilityA terrible business practice.In addition, the service fees they are suggesting is another claimThis is the amount the credit card company charged them for the reversal of their chargesThey are now trying to pass that amount to me when they failed to present necessary evidence to justify their chargesThis is not my responsibilityNone of their charges are my responsibility.Sincerely,*** ***

I filled out the paper work at the front desk. It was accepted. Funds ceased to be withdrawn. I followed protocol and this is a fraudulent claim from fitness Evolution. I have no control over their failure to adaquately administer their paper work. The service rep did not supply a copy to me and now it appears that is on purpose so Fitness Evolution and [redacted] can collude on their fraudulent claim. I have been patient and now require they reverse thir actions. Common sense would dictate that someone understood the membership was canceled as funds stopped withdrawing. How does this company continue to harass me with all the similar complaints reported about them? FTC needs to open an investigstion on their business practices.

I am rejecting this response because:Stating that there is no record of my ever coming in to cancel or calling to cancel is a lie. The only reason there's a history of a scan on my account in March of 2017 is because the girl at the front desk had asked me to scan my membership card to pull up my profile information on her computer, so that she could verify that my account was in good standing so that I could cancel. In fact I did it twice and this log is reflected in my online records account. If this is something you can access through the gyms computer network, then you know that your statement of "no record" is a bald faced lie. I hope Fitness Evolution gets shut down. Any company that conducts business in the way you do, Sue J[redacted], usually finds themselves in the defendants seat in a court room. I will never do business with the shady likes of you again.

Complaint: ***I am rejecting this response because they aren't attempting to resolve anything.  They take no responsibility for having a faulty system and simply blame the supposed "industry standard" for their irresponsibility.  This is the only gym I have been a member to so have no idea what other gyms do.  It does not matter if they want to be able to have any of their members be able to take a child in and use the child care, that is not my responsibility.  I did what I was supposed to do.  I went into the business and asked to cancel my membership and child care.  How was I supposed to know that it wasn't all on my account like any sensibly designed system ought to have linked them?  I turned in BOTH of my access cards and yet the front desk staff said nothing about not having cancelled the child care.  I did my part and now the business refuses to do theirs.  It is sad when a business refuses to do the right thing and spends more effort refuting a rightful claim rather than righting the wrong they have inflicted.Sincerely,

clarify Fitness Evolution has no account for [redacted], however, there is an account for an [redacted].   There are no informational notes or checks that Ms. [redacted], ever came into the facility to cancel.   There are no two-year contracts and no cancellations over the phone ever.   There is another gym in Bellingham that has 2-year contracts, they also do not cancel over the phone.  As far as every coming into Fitness Evolution to cancel, there is no record.  Also, your account was paid on time and you could have cancelled at any time! The front desk handles all cancellations on an hour and daily basis, it is unclear if you had come in prior to this month, why you could not have canceled.   As the agreement states, it is a month to month agreement until cancelled. Fitness Evolution did not receive a cancellation for an [redacted] in the past 12 months.  Nor has there been any past communication received regarding the membership account until this notice was received.    Attached is a copy of the agreement that was e-mailed when the account was started.  The complaint statement and the desired settlement statement appear contradictory. Complaint: [redacted]I am rejecting this response because:According to Fitness Evolution, my written documentation to cancel my membership was not sufficient because it was submitted "with no certified mail receipt showing it wasreceived at Fitness Evolution on or near the date of statement." If I am to understand this correct, members must also submit cancellation via a "certified mail receipt." Please confirm if this is correct. I assume it was written into the contract, but I have been unable to locate that specific verbiage.From my understanding, cancellation must be in writing and received at the facility. My cancellation was in writing and submitted and received by a representative at Fitness Evolution as was required. I provided proof of that communication in my previous email. I have also provided documentation showing other members who have also complained that they did submit a written cancellation, but were still charged after cancelling their account. According to Fitness Evolution, "Fitness Evolution has have been unable of find any written documentation from Mr. [redacted] that his cancellation was received by us in writing." This appears to be a pattern with Fitness Evolution Bellingham in not storing or updating their records appropriately. At Fitness Evolution there are no family plans, as with other gyms.  Each individual utilizing the gym must have their own account, which has a specialized fee for the type of service requested.   Each member signs an agreement to the payment and conditions of use.  In regards to our Kids Care program, the parent and/or guardian signs the agreement on behalf of the child. 
 
All agreements, have the same cancellation requirements.  There are no cancellations done over the phone, fax or e-mail.  All cancellations must be done in writing with a signature.  When cancellation is done at the facility, a cancellation form is done with a signed signature.  A copy of this completed form is e-mailed to the e-mail address on file immediately. 
 
The Kids Care program can be unitized for each child by a father, mother, grandmother, sister, brother etc. as long as they are all members.   It is up to the signer of the agreement to ensure the account is cancelled. 
 
As the agreement states, it is a month to month agreement until cancelled. Fitness Evolution did not receive a cancellation for [redacted] in the past 10 months.  Nor has there been any past communication received regarding the membership account.
 
The request for refund has been reviewed and determined there will be no refund due.  However, the account has been closed.
