Fitness Evolution has reviewed Mr. [redacted] complaint and responses. 
 
Mr. [redacted] has agreed to or signed an acceptance of all complaints responded to. The additional information below is submitted to Mr. [redacted]. 
 
All upgraded memberships have a minimum requirement of 120 days, as Mr. [redacted] correctly stated.    As for class schedule changes, please refer to Mr. [redacted] signed agreement (attached) which states in the General section, the following.   “Fitness Evolution expressly reserves the right to add, eliminate or alter any program, equipment, furniture or fixture when deemed necessary or desirable in its sole discretion”.   It should be noted the classes Mr. [redacted] has referred to, have not changed, however; different instructor’s may have been scheduled due to availability.
 
It is appreciated when members bring any issues to management, as this assist in responding to any unknown problems right away.   Fitness Evolution always take immediate action to have any equipment repaired or replaced.  When equipment is not working properly, Fitness Evolution stops the use of that equipment until it has been repaired.  The timing to repair or replace is solely based on how long it takes for a part or equipment to be shipped from our vendors and/or installed.   
 
As Mr. [redacted] agreed with the 30- day notice and one- month billing period, currently Mr. [redacted] has not paid this amount due for the month of December only.  Mr. [redacted] account transactions dated 1/05/2016 is attached.

Mr. [redacted]’s agreement and membership change form.   Mr. [redacted] signed a membership agreement on January 8, 2013. Mr. [redacted] than cancelled his membership on June 9, 2014.   Mr. [redacted] agreed to pay monthly fees of 10.86 and one annual fee per year of 42.39 until canceled.  Mr. [redacted] also agreed to a 30 day – one month billing period from date of cancellation.  The annual fee is due 3 months following enrollment, than annual thereafter.  Mr. [redacted] has contacted Fitness Evolution several times and each time Fitness Evolution has responded to Mr. [redacted].  Fitness Evolution has not received any correspondence from an attorney regarding this matter.Fitness Evolution has reviewed your account and found there is no refund due.  All charges had been agreed to by Mr. [redacted].  Mr. [redacted] membership has been closed since August 9, 2014.Should there be any further questions or problems, please do not hesitate to contact me.Sincerely,Sue J., Office Manager, Fitness EvolutionCc:       Tamara M., President
