I attempted to reach out and provide extra clarity and my calls were not returnedI reached out two or three times by email and twice calling the store during regular business hours with no returned contact of any kindI have those calls recorded which I disclosed to the employees who picked up the phone on those attempted contactsAt this point I've done all I'm willing to do to help you make sense of your internal filing issue Why would I save the proof of my termination of contract for over two years when I followed your protocol exactly as asked and after that the payments stopped coming out of my accountHow am I to assume that there was never a resolution when there were no payments charged and no requests for them until two years later? Your own records will show I have not attended the location in more than two years in accordance with my statement

Member joined our gym on 12/26/Her dues were at $per month and an annual fee of $We get numerous calls inquiring how to terminate membershipsPer Fitness contract, there is no cancellation fee; however, we must receive days written notice and your account balance must be at zero for the cancellation to fully processIt is very possible that this member came in to cancel and walked away still a memberSwindling? No, often times members cancel, but don't necessarily want toWe try to understand that life gets in the wayIf we can help you, why not!? Sometimes that means we will offer to lower your dues, give you personal training sessions on us, or put your membership on a holdIn this situation, the member took our offer and she chose not to cancel, thus continuing payments and membershipOur policy states that in the instance of a missed payment, you may be subject to a $late feeThat late fee is typically added weeks after the missed paymentPrior to adding that late fee we do our best to contact the member to update billing and settle the balanceThis member's account went a couple of months without responding to our point of contact regarding her balanceAround September, we were able to contact her and I told her that she would need to come into the facility to fill out our short cancellation form, but that we would not be able to fully process it until the account balance was at zeroShe owed for her July, August, August Annual fee, and late feesI was able to waive the most recent late fee and she agreed to set up a payment planShe came in on 09/06/and filled out the cancellation form making her last billing date 09/15/After signing the form, we were unable to contact her again and she never paid on her balanceFor that reason, she was sent to our local collections agency on 10/13/for a total of $for July, August, August AF, September, and late feeApproximately weeks ago, this member came into our facility to workoutI tried to discuss the account with her and she told me she would come in at a later time to setup another payment plan; a situation we have offered numerous times, she has agreed to, and after many failed attempts to contact her, she fails to provide us an amount, schedule, or even begin date of the paymentsWe are all human and realize financial hardships do occur; we have a standing policy accepting payment plans and do our best to work with members who are willing to work with us

As noted in the attached documentation, Fitness required me to return the membership card with my request for termination effectively ending my opportunities to use the facilities costing me initially $ I complied with your instructions to send a termination request in writing by certified mail at a cost of $ Since the termination request was required to be sent by certified mail only, I expect to be reimbursed for that cost as wellI submitted the request for immediate termination on May yet you still deducted $from my account on May 26th bringing the total that you owe me to $ I'm sure you agree that these are reasonable reimbursements and will consider this matter closed only when I have been recompensed

Per the notes in this account, the member called today and the account was cancelled and is in research for the refund The letter for the cancellation is scanned into one of the accounts so I'm sure this was strictly a human error in overlooking the second account listed in the letter.We have been in business in the area for years and are locally owned and operated, if the member had contacted us directly we could have easily resolved this issue The management will authorize the refund today of months X $20.74=$ The cancellation letter was dated 3/21, the billing date on the account was the 22nd of every month, 3/22/dues would have run prior to receipt of the letter Therefore the months in question are April-Nov 2015, or months.ABC Financial is one of the largest fitness billing companies in the US and handles thousands of gyms and accounts, there was no malice in this oversight.A refund may take up to 3-business days to see back on the account

We have cancelled him for tanning from here on out, however we had no documentation to support his statement, and therefore are unable to refund himWe are offering monthly dues credit for five months and two personal training sessions

Fitness prides it's self on providing a high level of customer service, we do everything we can to ensure each and every member understands our membership agreement.Our membership requires a 30-day written notice in order to cancel; this notice is required in writingWe encourage members cancel in person so they can receive a copy of the signed cancellation form Monday through Friday 8am to 8pmIf those times are not accommodating, members also have the option to mail us a letterManagement is available Monday through Friday 8am to 8pm and more that willing to discuss any issue that may ariseDue to the content of this complaint multiple attempts have been made to contact the member in order to remedy the issueIf any misunderstandings occurred throughout the process of enrollment or afterward we are unable to resolve them due to an inability to contact the membersWe would be more than willing to correct any mistake made on our part, please do not hesitate to contact us to resolve this issueThank You, Fitness llc Management [redacted]

This is the first time I have seen this complaint as apparently it went to my spam box directly, so I apologize for not responding sooner I went thru my emails and I have from the manager, Jeff, asking for a freeze for this member The first was dated 2/17/and the month freeze was set up and as you will see from the transactions, it ran from March to May The second email was received on 6/requesting a second freeze for months and it was set up from July to Sept.Normally we have a month max per year but we gave this member an additional months in for the surgery The complaint states the surgery was in June, I do not know why the March-May request was made, I can only assume the surgery was rescheduled perhaps? But regardless, we did provide the full month freeze that was requested as you can see by the transactions attached
