This business contacted me to sell me services of contacting people on my behalf. The salesperson called and texted over twenty times to get me to sign a contract and submit, by overnight mail, their fee of $5,000.00. The salesperson was relentless, and once my $5,fee was received and cashed, I never heard from this company again. Although there is a claim that they got in touch with me, I did not receive anything from them. No phone calls, no e-mails, no post mailIf their service sold to me was how good they are at contacting people, it seems like they would have called me to let me know they had not heard anything from me after collecting my money. Instead, it appears to be just a scamI did send two certified letters to this company letting them know I had not heard anything from them and wanted my money returned, both went unanswered. Once, I spoke briefly with the salesperson, who said someone would get back with me. Again, no response. Several voicemails left on the main company phone number also went unreturned. Since the first brief contact with the salesperson, all phone calls are only met with voicemailThe contract I signed with the company said that if I was not satisfied with their services after months, I would be eligible for a refund. Obviously, since I have not heard from this company after more than months and paying them a large sum of money, I am unhappy with their services and would like my full fee refunded. This is nothing more than a scam, and I will next look into postal fraud since the postal service handled sending the money by overnight mail and the business has committed mail fraud to take advantage of me for of this sum

Please see attached copy of agreement and additional terms at the bottom. They have taken my $10,and not given me any leads that have bought or sold with any Realtor. I would be happy to take listings but The Fitzgerald Group has not been able to generate qualified leads of any kind in the last couple years and I believe time is up and they need to stop with the diversion tactics! I have been a top agent in my area for over years and in the business for years. Here's some bullet points to show that I'm not some incompetent agent as they would argue in their ridiculous form letter- *** *** has proven to be one of the *** ***'s top resources for real estate.In the Real Estate business full time for over yearsTop Producer in the *** *** for over years*** works with the # producing company in California, *** ***. Consistenly ranks in the top1-2% of *** *** agents nationally. Blame the client for not being competent is certainly not going to work with my record and past client satisfaction & referral record! Not only have I not received any leads that have done real estate business with me or anyone but most interesting is that some of the "leads" that came my way said they only wanted to know their homes value and have no intention of selling. It appears to me that The Fitzgerald Group has no only mislead me but also people that just wanted a market evaluation that have no desire to moveI'm happy to stand in front of any judge and jury and go through each lead in court and have all hear my calls on speaker phone with the so called "leads" they have sent me to complete their obligation to me. It would be clear to any sane person that they have taken my money, not provided value, mischaracterized me in their letter and emails, sent leads, told me to contact Bob Fitzgerald (whom has never responded to my emails/calls) and simply refuses to do the right thing which is to admit they could not fulfill their side of the contract and reimburse meRegards, *** *** *** *** Presidents Elite and Broker Associate

This is the first contact I have had from this company! I have called, emailed, and sent letters (certified and return receipt)The problem is that I have received nothingI have received zero leads - this has nothing to do with the quality of leadsI haven't gotten ANY!? I am not alone hereI have reached out and spoken to dozens of other agents that have been totally scammedWE WANT OUR MONEY BACK! The fact that this company is completely unresponsive is what is most irritatingThey ignore any negative feedback, and simply to not respondI am NOT satisfied with this generic disclaimerThis company needs to start OWNING up this major issueThis is total fraudIn addition, this company has you pay with a check only to insure you can't get your money backHad I paid with a credit card, I could have reported fraud and had my money recoveredThe defect is with the company itself and it's ethics (and lack thereof) - I know nothing about the quality of their productsThis isn't about my performance as a Broker, this is about asking for a refund of $5,for services never renderedMrFitzgerald can expect a lawsuitSo many people have fallen victim - the complaints are astounding.

We have reviewed the complaint submitted by one of our partners. We would like to respond to this complaint and all others made regarding our organization. We partner with real estate professionals whereas we set up listing appointments with home-owners that are actively trying to sell their home...

and our partners agree to secure listing agreements by making presentations to and being hired by those home-owners. The complaints that you are receiving are only are one side of the story. We have set over 20,000 appointments for our partners and they have made millions of dollars listing and selling homes for a home seller that we connect them with. The bottom line is that the partners that do their part and take listings are happy. If they don't take listings, they blame us, not themselves, for not doing their job which is getting the home seller to hire them. If they say the appointments aren't any good, they don’t tell you that 70% of the home sellers actually listed with other agents which is a breach of our agreement on their end. Those that file a complaint have not take ANY listings and in most cases don’t even attend the appointment that we set with the home owner. If they say they didn't get enough leads - they didn't say that they didn't send us their call list by the schedule deadline. (This call list ensures that we call only sellers in areas and price ranges that our partners want appointments.) If they won't give us feedback or send us referral agreements on listings that they take – they are not upholding their side of the partnership. We have sent the [redacted]'s 18 opportunities.  Out of the 18 - 5 of them have been listed and sold with other agents in their market and another 2 are currently listed - all activity which happened after they received the lead.  Our program is a partnership.  We can refer the seller...

to the agent to follow up with but it is still up to the agent to get the listing and get it sold.  A typical agent can convert one in every 3 - 4 opportunities when working with FSBO and EXP.  The [redacted]'s then stopped supplying lists to call limiting what we were working for them.  This was against our recommendation.  There is no refund available but we would be happy to resume our effort for them.

First, this seems like a generated response from this company as many people have and will continue to turn them in for fraudulent or shady business practices. (a quick search on on the internet is all that is needed) After, I had turned my money over to them, they then informed me about a third party payment system which I would have to use which costs a monthly subscription fee. I did not agree to that, and no where in the contract did it say anything about it. therefore it was a deceitful tactic and after turning my money over to them I immediately asked for it back before they had done any work for me. To this point they have done absolutely no work and wont refund my money. They also keep telling me to email ([redacted].com)   for the refund which I have several times and gotten absolutely no response. I have asked for a phone number for the owner or someone to talk with me about my money and am informed every time that all I can do is email. They then keep sending me emails trying to get me to get started in the program which I do not want to do. I have  contacted the Real Estate Commission Board here in the State of Washington and New York  as well as the Attorney Generals office which will now start looking into interstate fraud. This company has set up no listings for me as I have never had them do any work what-so-ever, therefore I am not complaining about they're performance which Cheri eludes to in her email, I am asking my money to be returned to me before they did any work. I asked for a refund before they had even cashed the check. Its not $5 its $5,000. Let me know what else you will need.

Yes they have sent me leads, but I signed up for listing appointments.  The appointments that they have set up for me were not realistic sellers ([redacted] st, [redacted] st.,) , already had a real estate agent they were going to list with so I had zero chance ([redacted] dr., [redacted] st., [redacted] cir., [redacted] st.)  , would work with me only if I brought them a buyer ([redacted] st., [redacted] ter) , changed their mind to not list ([redacted] st., [redacted] ave.)  sold their house for sale by owner ([redacted] dr. , [redacted] st.), didn't show up for the appointment and listed with another agent ([redacted] cir.), listed with a discount broker ([redacted] ave.).I've gone on 4 appointments that they set up for me.  [redacted] cir ended up listing with an agent that had a kid that went to the same school as their kids.  They actually fired that agent and listed with another agent and that listing has expired too.  They started at $375k and have recently expired again at $329k.  Mr. [redacted] had his head buried in his hands the whole appointment and was very disinterested, plus his wife didn't even join us.  He didn't like the price I suggested and went with the other agent that had a kid in the same school as they did.  That agent bought the listing.[redacted] st. - I met with them and the husband wasn't thrilled about paying a commission.  I told them the price their home needed to be listed at to sell.  By the time I got home I received a notification from [redacted] and they reduced their house to the price I told them and it sold a couple days later.  They used me for pricing.[redacted] cir. - They never showed up to our appointment and didn't answer any of my several calls.  They listed with another agent a couple days later. [redacted] st. - I met them on at 9am.  When I showed up she said that I needed to hurry through my presentation because they had a showing at 9:30 am.  That 9:30 am showing ended up buying the house.  For them to say since I have taken zero listings from them is my fault is 100% wrong.  I've followed up on every single lead they have sent me, and still following up on the ones that have a longer timeframe to sell.  Because 70% of sellers list their home with another agent isn't a breach of contract, it isn't in the contract I signed.  Yes some of the leads they sent me have listed and sold with another agent.  How is it my fault when I call the lead and they give me no chance for an appointment when they have already decided to list with another agent.  I send them leads every 1st and 15th and provide feedback on every lead which is apart of the contract.  I also have an email of them stating that I have provided everything on my end so that the contract is valid for me to get my full refund after 6 months if I'm not satisfied.  I have been asking for a refund for over a month.  They tell me to email the owner because he deals with the refund.  I have sent the owner at least 10 emails asking for a refund and haven't heard back from him once which I have records of.   Attached is a copy of the contract they had me sign.  Let me know if you need anything else from me. [redacted] and [redacted] signed up with us in May 2016.  They had to do a split payment to get involved as they did not have the funds initially, which we agreed to.  We got started with them after the deposit of the 2nd check on 5/28.  They did not want to provide phone...

numbers to call initially so we offered to do the research to call For Sale By Owners in their market.  We did explain this would not generate as many appointments but were happy to start this way.  They did sign up for the source after a few weeks.  They only stayed in the schedule by sending numbers 10 weeks.  In that period of time we sent 7 appointments.  As we progressed they didn't answer feedback requests so we could keep track of where they were with their order.  They complain about the quality of the appointments yet other agents in the market were listing and selling them after we sent them to [redacted] and [redacted], which of course means they were viable listing opportunities.  They simply were not following up as they needed to in order to get these referrals listed and sold.  They had a great appointment with one For Sale by Owner that stated they would list in July.  They did list in July with another agent and sold on 8/9.  Another For Sale By Owner we never received feedback on was listed by another agent in the market 2 months after the appointment was sent to [redacted] and [redacted].  That same agent sold it a few months later.  Another Expired that was sent in June is still listed with another agent in the market.  Another FSBO that was sent in August is still listed with another agent in the market.  As you can see, there are plenty of opportunities here that could have worked for them.  We did our part and will continue to send them appointments should they want to get back in the schedule, with the understanding that they will be fully engaged by sending lists consistently and will provide feedback on each opportunity that we send.

I requested a refund when I declined to modify contract agreement with bob Fitzgerald company. It states in their contract that both parties must agree, I did not agree & did not want to alter what I originally agreed upon. They Also had not signed or sent me a copy of signed contract until...

after they cashed my check & I requested full refund. I did not received any services. After I filed a complaint to sue them for refund, nj court also took my check & never did anything. I figured it was a list cause & to try n go back n get some leads to at least cover the 5k I am obviously out. So I called bob Fitzgerald company back to set up lead service. Paid for service called land voice st their instruction to send them people to call to hopefully become my client sell their home. I have spent approx $100/mo on leads for them to call & have not received one lead appointment...  I see all other complaints dealing with same thing but I just wanted to at least try to make a positive out of this but, they of course fo not like me do how will they convince a lead that they should sell their home with me? They are still in breach of original contract. I want out

We did reach out to Ms. [redacted] directly.  We sent Ms [redacted] a check to cover Landvoice expense as she misunderstood how the list process worked.  She then only sent leads for deadline on 3 occasions.  The agreement was that she would commit to sending us numbers and feedback for at least a 6 month period.  That did not happen.  We are awaiting lists to get her back in the call schedule.

We are a company that converts internet leads at a rate well above the national average. Internet leads from companies like [redacted] where the lead is no more than an email inquiry. The Fitzgerald service was sold as leads who would be waiting for our response at an appointment time set by Fitzgerald. We were only able to make phone contact on a few of the so called pre-set follow ups they gave us. If Fitzgerald would like to clarify and itemize the statistic that they quoted I will respond to each alleged lead and circumstance. After a year of getting nowhere with the Fitzgerald leads we discontinued using the info service that they required us to purchase in order to supply them with numbers to call and set appointments for us. That was only adding on to our financial loss from the association with Fitzgerald. We continued to provide them with additional prospects that we research in house. Never got any response on any of those. And then there was the issue of Cheri W. not responding to calls and emails. Really? Amazing service from someone we spent $5000. with. I reject their response. Judging by the response I've received from other realtors throughout the country about their experience with these folks there seems ample evidence that they are running a scam.

[redacted] did sign up for our services in April of 2016.  We then sent a welcome email explaining the bio information needed to start getting him set up.  He never responded to first request 4/29.  Another request was sent on 5/16.  To date we have not completed step one...

of the set up process and await the return of the requested information so we can start calling. We also have never been provided the lists to call which would be step 2 in the set up.  Once the bio information and the lists to call are received we are happy to begin the prospecting.

We are happy to resume our calling effort.  No new leads have been sent since 2015.  We would need updated numbers to be sent consistently on the 1st and the 15th of each month and in return we would continue to send opportunities until client has listed and sold 10 referrals.

I participated in the program as agreed upon for the 6 months and did not receive ONE qualified lead. I sent feedback on the ones I did receive, when I received them... I received 7 leads during that time and all but one were fsbo listings where the seller was told that I simply wanted to preview the listing; hardly a qualified listing appointment. Also I was promised an average of 2 appointments per week. So basically I was promised 48 and got 7 and 6 of them were total garbage. I have attached a copy of my performance guarantee signed by myself and Bob Fitzgerald. It clearly states that if unsatisfied after working the system for 6 months I would be entitled to a refund. Bob Fitzgerald's company has a track record of deceit and unfulfilled promises. I no longer wish to receive services from them and per our agreement I demand a full return of the money I paid them ($5000). Anything short of a full refund is unacceptable.
