Complaint: [redacted]
I am rejecting this response because:The business tries to
play a game. I have never stated that I do not have points, I stated that I can
not use points and special prices from $99 to max $209 per week for hotel
reservation in Europe as [redacted] promised me. Also when I asked to show me
locations of the hotels in Europe (I was interested in hotel reservation in big
cities like Paris, London ,Roma, he told me that MCI has them everywhere and I
will receive the list of the hotels with MCI cards) He promised me everything
with words, but on contract he put different things.  It was fraud.  Here is my original complains:
“I would like to
dispute these charges because of fraud of sales representative [redacted]
phone [redacted] ext [redacted]. I bought this membership with my girlfriend
[redacted]. She is the witness of this fraud. I explained to [redacted]
that I am not interesting in resorts reservations because I have vacation home
in [redacted]. I need only points and discount hotel reservations in Europe with
RCI. He told me I can do both hotel and resort reservations. I signed the deal.
According to the contract I should receive RCI card and package in 90 days. I
asked for expediting RCI cards because I would like to go to Europe in May. He
promised me these cards in one month. I call him a lot of times because I have
not received cards until May 16. It was too late to make my May reservation. After
I have received RCI membership cards with RCI Points Entry Program package I
call RCI to make a reservation. RCI representative explained me that Hotel
reservation is without any discount and I cannot book hotel rooms with membership
points. I call my salesperson [redacted] on May 27/2014 at 12 20 PM and
explain him that I cannot book Hotel rooms with points and special price as he
promised when I bought this membership. He told me that I used wrong phone
number and gave me another one [redacted]. I call RCI one more time, no
booking as promised. Representative deceived me and I bought product which I
cannot use. I call to FantaSee resort [redacted] and talked with [redacted]
[redacted] and explained her my problem, that I cannot use this membership because
of salesperson fraud. I asked for full refund $2600, she reconnected me to
another person and this person refused me because it is too late. I explained
her that I call to make a hotel reservation right after I have received the package
and cards from RCI and found out that it does not work for me. She suggested me
make reservation with resorts.”

Complaint: [redacted]
I am rejecting this response because: I am not interesting in resorts reservations because I have
vacation home in [redacted]. I stated this from the beginning. I need only points
and discount hotel reservations in Europe with RCI. [redacted]
promised me that I can do both hotel and resort reservations. He promised
to expedite RCI membership cards delivered to me in 30 days to make reservation
for my May vacation. I contacted Fanta See resort regarding this meter
four, five times, but received these cards too late. Everything [redacted] promised me was
a lie. He only wanted to sell me the product I do not need and made money. I
have received my RCI cards too late and find out that I can’t use this product
at all. The company on purpose gives you membership RCI cards in three months,
than it is too late to cancel membership. I did not use Fanta See resort product
and is not going to use it. I would like full refund. Best regards, [redacted]

The consumer does not have a valid complaint. The consumer has 50,000 points with RCI as a result of his purchase.  He claims he does not. This is not true. The consumer can receive information on discounted hotel stays via RCI Travel. He claims he cannot. This is also not true. The consumer was sent his RCI cards within the prescribed period of time indicated on WRITTEN contract terms. He stated someone made a verbal commitment. We can only agree on what is written and the consumer currently possess his cards so this is a dead issue. The consumer owning a vacation home in [redacted] has no bearing on this transaction now nor at the time of purchase. We have offered to waive the remaining payments in an effort to ensure the consumer felt that a satisfactory resolution was reached. FantaSea Resorts had to pay for the points the consumer now has available in his RCI Points account and a full refund is not warranted as we have demonstrated that we have meet the terms of the commitment. Additionally, we offered to reduce the price by the remaining balance in effort to resolve this matter in an amicable manner. Please confirm if the consumer is willing to accept our offer.

Response:

I have read the consumer's complaint. The package purchased was for discounted resort stays at the Flagship Resort and points to utilize at RCI with any available inventory that was equal or less than the points purchased. The consumer stated we advise the RCI memebership card was to be received within 90 days and states to have received it on may 16 which is a 63 days from date of purchase. The consumer had no reasonable right to travel with RCI in May when being advised in writing that the membership process would take 90 days to finalize when purchasing on March 12. This time line was agreed to in advance in writing and we exceeded the contract terms in expediting the membership by nearly 30 days. The consumer states he is requesting a refund of $2600. The purchase price paid to date appears to be $1,299. The consumer has bee3n offered assistance to utilize his points to enjoy what was purchased and he has refused. We are requesting that consumer allow us to provide him with vacation assistance to remedy his concerns. Additionally, as an act of good faith, we suggest that the consumer enjoy a night's stay at our Flagship Location to enjoy his membership. He can book that stay directly with myself or our customer card department. During that stay, he maybe find time to meet with our representative to assist his with his vacation planning.

I have read the consumer's rebuttal. The consumer has points to utilize and therefore a dispute doe snot exist. We cannot commit not should the consumer expect service beyond the contract terms in the example of his membership cards. In a final effort to resolve this matter and ensure an act of good faith on behalf of the company, I will cancel the remaining payment on this contact and consider this matter final. The consumer can enjoy the points for the purchase price paid to date and the future payment will be cancelled. I beleive this is more than a fair and satisfactory resolution. Please confirm prior to the next payment due date.

I am rejecting this response because:I would like full refund. This business did fraud. I can not use points for hotel reservations and there is no discount to book hotels in Europe. They promised me maximum $409 for one week hotel reservation (not resorts) in Europe, or use points for hotel reservation in Europe. I have not use my membership and not going to use it because it does not work for me. I paid money for nothing. Company deceived me.

Response:

I have read the consumer complaint and cannot track the fraud they claim. Please provide a specific example of fraud for me to address. They claimed they didnt have points, they do. I offered to stop future payments essentially providing the product as significant cost reduction, they refused. If the consumer expects his claims to be heard, it must be factual. The consumer had points in his account. What other issue exists in this matter? In a final effort to resolve this complaint with the consumer, we will refund the half of the monies paid to date and allow the consumer to retain the points in his name.

Response:

As the business I dispute the allegation that we are playing games. Our documents and sales information does NOT represent that points can be used for hotel stays. we are not a hotel we are a resort and our working relationship with RCI is also for Resorts. Information on discounted hotel stays can be obtained but not have points used as a method of payment in the transaction. We offered to waive the future payments due, we offered an overnight stay and we offered to refund half the amount paid. These offers are beyond what we feel as fair and are only in a matter of goodwill to the consumer as there was no wrong doing on our behalf.

I am rejecting this response because:Representatives promised us that introduction of the product

takes 2 hours, instead it took 5 terrified ours. A lot of representatives talk

to us for long time to persuade to buy the product. They promised us that this

is very good product and I may use points and special prices for resorts and

hotels reservation in Europe. I stated that I need only hotel reservations in

Europe. In reality this is useless product for us. It was real Interrogation

and fraud. My girlfriend [redacted] and I were real tired and would like to get

out as soon as possible. We did not read contract and signed it. I do not need

this service, I did not use it and is not going to use. I would like my money

back. The business tries to get money from me for nothing. I am 67 years old

retired and it was very hard to me to withstand that interrogation.

Response:

Dear [redacted],

I have read the consumers rebuttal. The length of time for the consumer is generally scheduled minimally 120 minutes. If the consumer requires more time to make an informed purchase, it is granted. Such was the case in this scenario. I am not sure why the consumer would fault us for permitting the time needed by them to ensure they fully understood the product they were purchasing. We do not promise Hotel stay in Europe as this is not part of our service. We are a time Share or Vacation Ownership Company. The consumer purchased a trial period for travel to timeshares. The consumer was granted a recessionary period and did not exercise their option. We have offered the consumer the following options in an effort to resolve this complaint despite no wrong doing on our behalf:

1) We offered to waive ALL future payments due

2) We offered to refund half of the monies paid.

3) We offered personalized vacation assistance to assist the consumer in enjoying what they purchased.

All of the above offers have been rejected. These are more than fair and satisfactory resolutions to this matter. These are our final offers.

Thanks,

Consumer

My complaint with Flagship Condominium Association was resolved on 09/15/2014. I accepted they offer to return half money I paid them and no more payments. I paid them first payment $1299, and two more payments $72.22. Total $1443.44 Flagship Condominium associating paid me nothing back and has never contacted me.

Business

Response:

The last notation I have is that the consumer did not find our solution satisfactory. I just checked the

Revdex.com system to confirm and it appears that the consumer actually did agree to close the matter but I was not certain base don the content if

he accepted our offer. The amount of money paid by the consumer in total was $1443.44. We offered and agreed to a refund of half. The refund will be for $721.72. Please have the consumer accept this offer and we will refund the $721.72 back to his credit card.
