Regarding: *** *** To whom this may concern, This letter is in response to a complaint filed against FORUM Credit Union and forwarded to us by your office on July 18, A FORUM representative spoke with Mr*** via telephone on July 18th after receiving notice of his
complaint and reached a mutually acceptable resolution The resolution of the complaint was overnighting a refund check to Mr*** and FORUM agreeing to refund any fees that may have occurred from the situation At the time of loan inception, Mr***’s signed contract states the he will provide proof of insurance to the creditor and maintain insurance for the life of the loan to ensure protection of the propertyIf the borrower fails to provide or maintain insurance, FORUM may obtain insurance to protect their interest of the property On March 27th, *** ***, FORUM’s third party insurance tracking company, received a cancellation notice from *** Insurance for Mr***’s auto loanTwo notices were mailed to the Mr*** on April 25th and May 23rd requesting he provide proof of insurance or FORUM would purchase Collateral Protection Insurance (CPI)In addition to the letters, eleven telephone calls were made to Mr*** during the insurance lapse in attempts to resolve the issue. On June 8th, Mr*** contacted *** *** to provide insurance coverageThere was a six day delay between the time of Mr*** providing insurance coverage and the loan being updated to show acceptable insurance During the delay, a CPI policy was added to the loan and the monthly payment was adjusted to cover the cost of the CPI FORUM was made aware of the acceptable insurance on June 15th and a refund was issued for the policyDue to oversight, Mr***’s monthly payment was not readjusted to reflect the policy refund Once this error was brought to our attention, we promptly issued a refund and adjusted the payment One of the options we offer all members for refunds is to deposit funds to their savings account We thank Mr*** for his feedback, and apologize for the error Please let me know if there are further questions or additional information requiredI can be reached at 317.558.6023. Member charges are related to a transaction that is not covered by the opt out the member is referencing. On June 3rd the member received reversal of fees and the situation was discussed with the member. The member needs to cancel the recurring charge in question to avoid the
fees. The situation will be addressed with the member again but his charges are accurately being charged based on his account agreement and requires an action on his part with the vendor that is submitting the charge. The laws governing this transaction do not allow us to take any action on the members behalf in this situation

The member was presented with information in May detailing information that they did indeed have an account with FORUM. It was an auto loan and a share account.  There has been no contact from the member since June regarding their review of the materials. The information will be sent to...

Dear Ms. [redacted], I am responding on behalf of FORUM Credit Union on the complaint from [redacted] on April 12, 2016.  Mr. [redacted] obtained an auto loan for a 2011 Chevrolet Malibu on June 23, 2014.  In the contract for the auto loan it states that the member will provide insurance on...

the property protecting against loss and physical damage and subject to a maximum deductible amount indicated in the insurance disclosures.  FORUM will need to be listed as the loss payee on any such policy.  If the individual on the contract fails to obtain or maintain insurance, or name FORUM as the loss payee, FORUM may obtain insurance to protect our interest in the property.  This insurance may be written by a company other than the one you would choose and may be written at a rate higher than the rate you could obtain if you purchased the insurance required by the contract. FORUM’s insurance tracking company, [redacted] received a cancellation notice from [redacted] Insurance Company on 12/16/2015. A written notice was sent to Mr. [redacted] on 1/12/2016 and 2/9/2016 asking Mr. [redacted] to provide insurance documentation.  No documentation was received. Collateral Protection Insurance (CPI) was added in the amount of $1,956.00 to cover the time period of 12/29/2015 to 12/29/2016.  Telephone calls were made to Mr. [redacted] on 2/9/2016, 2/29/2016 to try and get the insurance resolved prior to adding the policy on 3/2/2016. On 3/15/16 a binder from [redacted] Insurance was received showing an effective date of 3/15/16 and no loss payee was listed.  On 3/29/16 an impairment notice was sent to Mr. [redacted] asking him to list FORUM as the loss payee.  On 4/1/2016 telephone calls were made to Mr. [redacted], and [redacted] Insurance.  [redacted] verified the effective date of 3/15/16 and confirmed the loss payee of FORUM Credit Union.  They verified a lapse in insurance coverage from 12/29/2015 to 3/15/2016.  A partial refund was issued in the amount of $1,544.00 leaving a lapse amount of $412.00 owed for the lapse timeframe 12/29/2015 to 3/15/2016. I am not satisfied because my account would not have been put into the negative if Forum hadn't tacked on a bunch of hidden miscellaneous share fees onto my account. If you look at the date of each debit transactions you can clearly see the funds were there. Had they not been my card should have been declined because in the previous month my overdraft priveleges had been revoked. These share fees intentionally posted before my transactions to put me back into the negative and charge all these overdraft fees, which I am supposedly not allowed anymore. In numerous different months I have been charged for various miscellaneous share fees with no explanation and that I have paid. This however is unacceptable to charge the fees while my other transactions are taking place and causing overdrafts on my account. I am no longer authorized overdraft protection, so theses share fees should have taken place after my purchases or the bank should reverse the resulting overdraft fees. I have numerous bank statements from the past showing this has never happened before. My share fees always take place after my transactions resulting in no more overdraft fees than I have already acquired myself. This is going to happen this way because my bank would have stayed in good standing, So the bank reversed the share fees to post first, so I would acquire overdraft penalties. Please look at my back bank history to see that the share fees have always come out at a time when it would not endanger my account, like now. All I ask is that all overdraft fees be reversed and for a detailed explanation of what these share fees are for and why they post at such random times. Please explain. Thank you.

FORUM Credit Union responded to Mr. [redacted] on December 14, 2015. The balance owing is from a negative balance on a savings account. FORUM Credit Union has sent Mr. [redacted] the statements

Dave A[redacted] (Collections Supervisor), spoke with the member on 3/29/17 and explained what happened on his account.  FORUM Credit Union performed a “right of offset” due to the monies owed. Member did request a paid in full letter, which had been ordered and sent to the member prior to the call...

On 1/27/16 a FORUM Credit Union debit card dispute representative assisted Mr. [redacted] when he called to dispute charges debited from his checking account made through the use of his FORUM Credit Union debit MasterCard. The debits in question included charges from the following merchants:...

iMarketsLive, Lowes, Doterra, Forever 21, and Amazon. All charges Mr. [redacted] was disputing were in access of three months from the date they were debited from his checking account.   This is beyond the period MasterCard allows for charges to be disputed. As a result, Mr. [redacted] was advised to directly inquire with the merchants in question to conduct further research.

They mention an  auto loan,without any detailes about dealership, amount of loan, did I borrow money from Forum? They show withdrawal without specifyng by whom ? I never deposit any money on this acc. I never took any money from this acc. I never had any thing to do with Forum. It is all a fabrication of their internal system and a desired to get something for nothing.They mention that the negative balance resulted from an AD&D withdrawal for $135.00. Withdrawal by whom? They need to show  evidence tat I did this. What did I buy from Forum that I failed to pay for?.
