Once project was in progress, customer noticed the sunroom had not been built to accommodate an existing hot tub. After review of the signed Scope of Work, it was determined that inclusion of hot tub was never included. In good faith, Four Seasons offered to make revisions to project in...

order to accommodate the town requirements for hot tub at NO ADDITIONAL COST to the homeowner, in lieu of a signed change order and release. Specs of the hot tub were also to be provided to Four Seasons by homeowner in order to update engineering. This was expressed via phone communication with homeowner, along with multiple letters sent dated October *, October **, & November **, 2015. Although the customer originally agreed to move forward, none of the required documentation was given to Four Seasons to progress the project. Four Seasons believes it is still entitled to the balance of the funds to be received under the original contract and scope of work signed by the homeowner. Again, we are happy to make necessary changes to project in order to accommodate the town requirements at NO ADDITIONAL COST to the homeowner.  We look forward to response.

Four Seasons sent a Release to be signed, In this release (Not a New Contract)  several specific information was left out.  Such as the fact that Four Seasons had there own contractor, I never hired my own contractor.  Needless to say the important info here is that How am I suppose to sign a release for a project that was never completed.  They also made it clear that without this signature on the said RELEASE AGREEMENT nothing would be done on my property.  That would be intimidating of a consumer on a whole new level.  I would also add the fact that  Four Seasons sent me a letter from an Attorneys firm indicating that they would not be completing the project and expect to be paid in full.  Hence the reason I do not trust this company.  If they had intensions on making any corrections they should have done it when the problems first arouse but NO there contractor and Four Seasons as a company avoided doing a good job.  Also the bad weather that long island has recently sustained has made me very concerned about the structure.  One last thing if Four Seasons is  implying that the HOT TUB was not in the SCOPE of Work, why is it sitting in the structure as we speak.

Review: Inferior work addressed months later with more inferior work but not before being addressed with unanswered phone calls and complacency. Contract and sales issues which leave me with additional unexpected expenditures ie told many times that room will be so well insulated there will be no change in temperature in living room after removal of sliding doors to sunroom.Desired Settlement: siding removed and properly replaced (not nailed to sheetrock in exterior), with weaved corners (as stated in contract), painted (as I have already paid someone to do not knowing siding still problematic), soffet properly winterized, all holes sealed (draft), unattached trimwork attached, space between ceiling and wall addressed, and constant popping noise addressed. I would also like heating issue to be addressed with a compromise that is acceptable to both parties. and glue scraped off of roof

Dear Revdex.com. A step was taken in the right direction but I do not consider the matter resolved at this time. [redacted]

Review: The windows on our Four Seasons sunroom failed and were improperly installed. All the roof windows are cloudy and leaking. The wall windows drain between the walls. They are still covered under the 20 year warranty. We had new siding installed and found that the walls were rotten all the way through including the studs. Two other contractors told us that is because the windows were improperly installed. [redacted] is the local rep for Four Seasons. He viewed the damage December [redacted] and took pictures. After numerous calls I finally reached him on January [redacted]. He said Four Seasons would replace the windows. I agreed to replace the walls. Then he told me that meant they would supply me with a stack of windows but not install them. I said that wouldn't provide me with an guarantee since they would just claim the windows were improperly installed anytime there was a problem. He said he would check back with the company. He has not returned any calls since then. I have left messages on his work and cell phones, spoken to two different associates and left notes on the office door. No return calls of any kind. I have left repeated messages on the Consumer Affairs line of the Corporate office. No return calls. My sunroom is being held up by the drywall only. It is a serious safety hazard.Desired Settlement: I want the windows replaced including the installation. I have agreed to replace the walls that were damaged by the window failure.

[Your Answer Here]I provided the photos of the damage to my room and the failed windows on March [redacted]. I received a reply that the information had been received and was being reviewed. I sent a followup email on March [redacted] asking about any progress and was told it was being reviewed. The company filed this reply to the Revdex.com complaint on the [redacted] advising that they were reviewing the photos. I have heard nothing from them since. I am required to reply within 6 days to keep this complaint open. The Four Seasons Representative in Iowa has never returned any calls. This room is a serious safety hazard. All agree the windows failed. All agree they are under a 20 year warranty and it is within this time frame. I am not expecting to have my entire room redone as I understand the warranty is for the windows only. Extensive damage caused by the failure of the windows include the walls, flooring and deck which I will have to repair myself. I just want replacement windows installed on my room. WARRANTIES ARE ONLY AS GOOD AS THE COMPANY BEHIND THEM.

We have been in communication with the [redacted]s following their supply of requested information and photos. Based on the information that was provided we were able to confirm that the [redacted]s were not the original purchasers of the room. The room was orignially purchased in 1995 by the then owner of the home in which the [redacted]s currently reside. The Four Seasons Sunrooms 20 Year Limited Warranty in effect in 1995 was for the benefit of the original purchaser only and could not be transferred to any subsequent owner.

Four Seasons does recognize and appreciate the fact that the sunroom does need extensive glass replacement. As a result, we have proposed a special offer on the glass and glazing materials required for the room. We have asked them to contact us if they are interested in pursuing this proposal.

Contract indicated that the down payment would be returned without penalty within 10 days. To date we have not received the down payment. This company has no legal right to retain our down payment. In August 2015 original release was sent to homeowner for signature. Homeowner wanted to make revisions. October *, 2015 revised release sent to homeowner. Homeowner did not want to sign. As mentioned, hot tub was not in contracted scope of work. Four Seasons asked for release to be signed in lieu of completing additional scope at NO CHARGE to the homeowner. Home owner would not sign. Four Seasons is still entitled to receive balance of contract due regardless of consumers decision to not move forward with additional work quoted at no charge because this work was not included in the contract scope of work. Again, Four Seasons is happy to move forward with completing additional work requested at NO CHARGE. With this said we will need a change order signed from the homeowner before work begins. This is to acknowledge additional work to be performed at no charge although there is a balance due of $8,500 from original contract. Payment would not be due until work completed. In addition, homeowner has not yet provided updated dimensions for hot tub in order to update engineering accordingly. Please advise.

Review: Four Seasons Sunroom, LLC., is the manufacturer and parent company of Four Season Sunrooms. They license authorized sales and service centers throughout the country and one such authorized sales and service center is [redacted] S. US-1, Port St. Lucie, Florida. [redacted] acknowledges they installed a sun room in my home, and they acknowledge they most likely still have the blueprints from the job. [redacted] refuses to come and repair a broken panel in the ceiling of my sun room. Originally, in August 2014, I spoke with "[redacted]", who stated he was the [redacted] and he agreed to place me on his list of scheduled work. After many weeks of not hearing from [redacted], I called again ... many times leaving a message, and finally an "[redacted]" answered and initially said he'd put me on the list for work. Several months went by and each time [redacted] said, "You are on my list.", but eventually the last time I spoke with [redacted], he admitted his boss will not come to fix my glass -- they are too busy! So I started calling the parent company in [redacted] I have left 6 - 10 very detailed messages on they answering system explaining all of the above, but they do not call me back. Once, I received a phone call from the Orlando Four Season Sunroom Dealer, and a "[redacted]" from there sympathized with me, but said there is nothing they could do from Orlando, it was too far away. I have left messages for [redacted], the customer service representative of the parent company. I have also attempted to contact [redacted], and [redacted]. Nobody answers their phone and nobody calls back.Desired Settlement: All I expect is someone to repair my broken/shattered pane of safety glass in the ceiling of this Four Seasons Sunroom.d I expect to pay for the repair.

12/**/14 Complaint # [redacted] After searching our accounts and our warranty database, there is no information to suggest Four Seasons is associated with [redacted]. We have also had no correspondence with the consumer in question. Upon receipt of the complaint from Revdex.com on Wednesday December **, 2014, I left a message for [redacted] to call me to provide more information about the sunroom so we can further investigate his concerns. On Thursday December **, 2014 I received a message from [redacted] containing no requested information, just a phone number for contact. That same day I returned [redacted]’s phone call but received no response. I followed up again today Monday December **, 2014, and left another message for [redacted]. His wife [redacted] returned my call today Monday December **, 2014 at approximately 3:35pm to further state, the room was not purchased by them but the previous [redacted] of the home, [redacted]son. She then stated she did not wish to be involved in any correspondence regarding the sunroom in question that I must speak with her husband who will call me the next business day. I then proceeded to search for a [redacted]son at this address also with no luck. I will be awaiting the response from [redacted] to hopefully receive some more information to further assist with his needs properly. I have requested to provide additional information and a copy of the original contract. Revdex.com I.D. - [redacted]This window and total sunroom was purchased by [redacted] and [redacted] approximately June 2001. [redacted]son is deceased. I purchased the home from [redacted] August *, 2013. I was provided with only an "Engineering Calculations" drawing of standard components for the proposed sunroom. That drawing specifies: "Standard System 4 modular sunroom, Model SWM-17DH with 5CB5 heavy roof rafters with channel insert with 5 - 36" bays and no gable ends for the [redacted]son residence located in [redacted]. Dated February [redacted] 2001" The drawing has an engineer's stamp of review and compliance from [redacted], [redacted], dated April *, 2001.I have no other paperwork or contracts of the installation by [redacted].As I indicated in my original Revdex.com complaint, I am most interested in getting my shattered glass ceiling panel repaired. The price and if warranty is involved is not at issue!I do note however that the Four Season Sunrooms web site clearly states their product carries a 20 YEAR FULL WARRANTY, GLASS BREAKAGE INCLUDED for as long as you own your home, which is FULLY TRANSFERABLE.But again, payment or warranty is NOT AT ISSUE. I am requesting that Four Season Sunrooms stand behind their product for repair purposes.If I am not legally covered by a warranty that's fine .... I just want someone to fix the shattered ceiling glass properly so it does not leak.

As of 3:55pm on January *, 2015, an agreement was made by [redacted] and Four Seasons Sunrooms via written consent that the new window will be ordered an installed by his local independently owned and operated dealer. An invoice was sent to [redacted] by the dealer which was signed off on stating the window will be installed by mid March at a charge to him as it is a custom order glass window that must be produced (warranty is non-transferable as discussed and provided in documentation as requested by [redacted]). Review: The sun room leaks water when there is outdoor rain or melting snow. This issue has been active for a couple of years directly after the room was completed. The sunroom contract listed a start date of 10/**/2011 however there were several issues retrieving permits and just inefficient construction of materials therefore the completion date was near November 2012. We noticed the leak issue once the sun room was "completed", we then reported the leaks to the local reseller of the four seasons product. They said the problem was due to the work of the contractors building the sun room. The contractors said the issue was due to the product. Both the reseller and building contractor pointed fingers hence no resolution. The reseller office closed sometime in middle 2013, and the building contractor said the product is bad. This should not be happening. We asked about a claim and the reseller office said we could not make a claim, it's the fault of the building contractor.Desired Settlement: Trained engineers from the sun room business to research the issue. Find the leaks. Show my wife and I exactly the issue and explain the resolution and timing. Rip apart the sun room walls/windows to verify there is or is not water damage. Redo the sun room with whatever needs to be redone. Test the leaks after fixed, and write up with pen and paper exactly was has been done since day 1 minute 1 until the resolution and job is complete, include all technical terms and notate every person and action. Have a person be available in the future to address future leaks. No charge to make the correction should even be considered. This has not been a valued purchase.

We have researched [redacted]'s complaint, and determined that he ordered his room through [redacted] Home Improvements, Inc and independently owned and operated company authorized to resell the Four Seasons product line. While Four Seasons has quality oversight of the product, we do not supervise or control their operations or installations. During our investigation of this matter, we regret to learn that [redacted] has discontinued business.

We will contact [redacted] directly to put him in contact with a qualified installer of Four Seasons products in his area. Any materials supplied by Four Seasons found to be defective will be covered by the Four Seasons product warranty however any costs related to installation defects fall outside of this coverage.

I received an email from [redacted] on 6/**/14 @ 7:58 am. The email stated I have a message from the Revdex.com, and click the link to view the message from Four Seasons Sunroom of NY LLC. I have to respond within 6 days or the case will be dropped.

The reason for my message is to respond within 6 days, and state that I don't accept the response from Four Seasons Sunroom of NY LLC.

The reason is because:

1) My wife and I agree that Four Seasons Sunroom of NY LLC be responsible for not only replacing defective product plus labor but any and additional cost to resolve the issue. Four Seasons Sunroom of NY LLC should hold responsibility for the action of their resellers and the resellers decisions to build Four Seasons Sunrooms, including the representation and actions for all building contractors, building equipment, and all warranties associated to the creation of the Four Seasons Sunroom building . From experience with the building contractor, there will be a cost to us if the issue is not product related. The building contractor has said this in the past given they only cover one year warranty. Within the first year they told us this is a product issue. After one year we assume a charge. One year labor warranty is unexceptable given the product and labor of the Four Seasons Sunroom building are related to weather patterns. Weather patterns are cyclical and are not identical during the following year. This does warrant a longer time frame for a labor warranty. Hence if the builder doesn't supply extra warranty time, the extra warranty time greater than a year should be considered an added mandatory labor warranty by Four Seasons Sunroom of NY LLC.

2) The building contractor that built the sunroom a few years ago, and already determined that the issue is not a labor issue but a product issue -is now the same company that will be evaluating the issue hear today in June 2014. I mention this because Incredible Builders built the sunroom and agreed that the leaks were due to the product and not the labor. Hands down, case closed. The debate of this issue with us, [redacted] and Incredible Builders occurred for too several years once the sunroom was built and leaks immediately identified. The resolution was that we, the home owner, will accept the leaks because [redacted] hired by Four Seasons Sunroom LLC said it was a labor issue, and Incredible Builders said it was a product issue. The leaks and misery continue.

3) The evaluation of this issue at hand will occur on the sixth day since receiving the email from Revdex.com. Given we had to respond within 6 days to the Revdex.com request sent via email on 6/**/14, therefore we assume the resolution will not occur on the sixth day. This appears correct because the issue pertains to varying weather patterns and labor using sealant caulk that may not dry in a few hours. If caulk is applied then this doesn't imply that they're is resolution. As it happened in the pay few years, there are no leaks if there is no reason and/or melting snow. Therefore to determine leaks will be during the next rainy/ice melting season. Until there is significant evidence over a significant amount of time then we don't accept the initial resolution. However we expect a short and long term resolution and structured follow up plan to decipher the strength of the resolution. This is very serious especially because we added boarding to the sunroom and partial is ruined by water damaged. Who will fix the post construction floor boarding? Can we find the same floor boarding that we originally installed? If there is water damage due to product and labor incompetence, does every implemented post construction be covered, both labor and supplies? Or is this a home warranty claim?

4) We did receive a phone call near 11:00 on 6/**/14 from the Customer Affairs department at Four Seasons Sunroom of NY LLC, [redacted]. I asked her to call me back and leave a phone message because I was driving. I received the phone message and then identified the company to do the evaluation was Incredible Builders. I then called [redacted] back at 12:30 on 6/**/14, no answer, then I left a message about the issue to call me back. No return call from [redacted] yet. I then called Incredible Builders near 12:50 on 6/**/14 and talked with [redacted]. [redacted] had no clue of what I was calling for. [redacted] was in the field so he had to go back to the office and investigate our files. [redacted] then called back and scheduled a meeting at our house for 6/**/14 at 10 am cst.

Incredible builders and [redacted] are in the process of planning and scheduling a time to go out and address the existing issues with the French Doors, window locks and bent bolt. The most recent work on the gutters by Incredible Builders has not been evaluated by us because the extreme weather affects an evaluation. Standing on a ladder up to the roof is dangerous for us during weather with rain, snow and windy conditions with temperatures near 30 degrees. Given the various mistakes while building the room several years ago, we don't accept Incredible Builders judgement about their work quality. We have several pictures to prove. As mentioned in my prior message, a list of items that Incredible Builders worked on has not been presented to us. Incredible Builders refuses to provide this information. They say it's complete. This informs me that they are not willing to further help or they are incompetent. At least we know of one issue not fixed; the decoration on the peak of the room is not fully installed. Incredible Builders denied that it was on the list they received. I worked with [redacted] a few months back, and created a list. [redacted] mentioned he would present to corporate, and corporate would present to Incredible Builders.We look forward to see [redacted]. Review: Telephone harassment. Repeated calls, apx 20 to 30 a day, before 6am and up to midnite.

All I did was request a catalog and I have been getting calls from this business day and night including Sat and Sun from early morning till late at nite. I have emailed this company 4 times to stop. I am taking in a cease and desist letter to them today. [redacted] stated in her email to me on Friday, June [redacted] that she would contact corporate office to have phone calls halted. They have increased. This is illegal by Okla law, and if not stopped I will contact the police, file charges and forward the case to the District Attorney's office to prosecute the caller. The number they are calling from is ###-###-####.Desired Settlement: Cease and Disist all phone calls to me, stop this telephone harassment at once.

I would like to take the opportunity to acknowledge [redacted]’s complaint and the obvious frustration she has expressed. I apologize for any aggravation we may have caused her. We take [redacted]'s complaint very seriously and her opinion is very important to us. Our goal is to provide consumers with an outstanding Four Seasons experience from initial contact and throughout the process concluding with years of benefit from their Four Seasons Sunroom or Windows. Immediately upon receipt of this compalint, I confirmed that we placed [redacted] on our Do Not Call list.

I do want to state that our records show that we placed 10 calls to [redacted]’s phone number over the course of 5 days, and these calls were made from 10 AM to 9 PM. While we do not believe this to be excessive or intrusive, we do acknowledge that [redacted] found this to be excessive.

Review: I signed a contract in May 2013 with local Four Seasons Sunrooms franchisee Creative Concepts Home Improvements for a four seasons room for $40,000. I put $20,000 down. Prior to beginning the project, I asked to change the scope of the project from a four seasons room to a bi-fold door system, to which I told told it would not be a problem. After agreeing to this change, the company told me that my $20,000 deposit was forfeit and a bi-fold door system would constitute an entirely separate contract that requires an entirely separate charge and deposit. I disputed this, as they initially said they would change the contract to accommodate the change of scope.

After a lengthy dispute that spanned the summer, fall and winter, we came to an agreement in December 2013 to simply return to the original scope of the project - $40,000 for the four season room, exactly as stated in the contract. Company said that because they would have to open up the back of my house, it would be better for us if they waited until the spring, when the weather was warm and they could begin the project. I agreed to this and did not contact them again until April 2014.

As of June *, 2014 I have never been able to successfully get in touch with Creative Concepts Home Improvements. I sent an email to Four Seasons Sunrooms the week of May **, 2014 asking what what is going on, and they have not returned my email, either.Desired Settlement: I have reason to believe Creative Concepts has gone out of business, as they no longer answer their office phone nor return email. If this is the case, then I believe the fairest outcome is for Four Seasons Sunrooms, as the parent company, to complete the project as originally intended in the contract through another local franchise, with a credit for the $20,000 I already spent. Otherwise, I insist on a refund of the $20,000 for failure to execute the contract.

Creative Concepts is an indenpently and operated company that has been authorized to sell and install Four Seasons products. Four Seasons has investigated [redacted]'s complaint with [redacted], [redacted], and [redacted] has advised us that he has discontinued business.

As of this date, Creative Concepts has not submitted an order for material to satisfy [redacted]'s requirement.

Four Seasons will contact [redacted] separately to review the details of this incident and put him in contact with another company in his area to work with him directly on this matter.

Four Seasons requested a copy of the contracts and receipts, which I have provided. They said they will contact a local affiliate to come to my house to review the scope of the project, and from there to determine what they can do to resolve the dispute. I told them that I would be happy with either a credit in the amount of the down payment that was lost, or the provision of the bi-fold door that was previously negotiated by Four Seasons and CCHI.
