Going back to the original service, if Everdry had dug all the way down, all the way around, like they are supposed to, perhaps they would've seen the cracks that were missed the first time or twoIf it was imperative that the drywall and/or framing be removed, it should've been requested thenI would say that after paying [redacted] + several un-paid days off of work, and making sure someone was at the house each time Everdry came out, any additional costs should be covered by EverdryThat includes the time and money it takes to remove and replace any drywall and/or framing, re-landscaping the yard and hooking up the a/c unit againSince our house was built in the 60's, I doubt there is a cistern next to itAt this point, I would expect any further issues, including that, to be covered by EverdryEverdry's system has failed time and time again, for over a year's timeI want a full refund, or, if service is to be done, it needs to be done in full, with no more cost to my familyI don't want us to have to spend any more of our time or hard earned money on thisWe suffer from allergies, and without our a/c hooked up, (it can't be hooked back up until Everdry finally waterproofs our basement, so the ground doesn't have to be dug up again), we have been miserable, needing to open the windows to try to keep the house coolConcessions need to be made by EverdryBottom-lineIf they want to fix it right, beginning on the 15th, that's fineThey will need to come out and prep it, and then put things back where they belong, or pay to have them put backAgain, using the car analogy, if you purchased a new car that would not stop leaking after a year, you would expect a replacement car, or your money backWe expected to get what we paid for...a dry basement...a year ago, and it's still leakingEveryone should agree that this is unacceptable! Initial Business Response / [redacted] (1000, 5, 2016/02/10) */ Everdry contacted Mr [redacted] on 1/27/to set up a time for the owner and production manager to come to his house and address any issues he was havingThe inspection was set up for 2/3/16, which happened to be a great day to inspect his system because this area just had a heavy rain the previous day/night on 2/2/When the owner and production manager arrived at Mr***'s house they found his basement to be dry, the previous days rain had no effect on his house, which was proving that the system had workedA few things they found was that the digital display was not working on Mr***'s BBU, but was still functioningEverdry is willing to replace the whole unitAlso the cracks that Mr [redacted] was referring to are called stinging cracks, which are superficial cracks that just cosmetically need to be readjusted, due to the thickness of the concrete, the owner told Mr [redacted] that we can cut out and repour the concrete in this area so it looks cosmetically betterThose were the findings of the inspection that took place, other than that the system seems to be functioning properlyAfter Everdry initially installed their system, one of the discharge pipes blew apart due to the amount of water that was flowing thru it, which caused Mr [redacted] to get water in his basement, this was not due to faulty workEverdry turned the information over to their insurance company, so Mr [redacted] would be compensated for this incidentEverdry has spoke with Mr [redacted] several times after this incident, and has followed up with their insurance company regarding this claimEverdry's insurance has paid out an amount of money to Mr [redacted] for the remediation and damages of this incidentEverdry's insurance company in no way, shape, or form asked Mr [redacted] to pay a deducible to themEverdry spoke to Mr [redacted] on 2/9/to schedule these repairs and Mr [redacted] said he does not want us to do the workTo this date Everdry is willing and able to perform this service work for Mr*** OFFER: Initial Consumer Rebuttal / [redacted] (3000, 7, 2016/02/10) */ (The consumer indicated he/she DID NOT accept the response from the business.) Everdry of Northern Indiana completed work at Mr***'s home in November After completing the work, we received an email
from *** *** regarding a water line that was damaged during our installation and that she was less than dissatisfiedShe requested that Everdry reimburse her the money for the repairs to the water line in the amount of $Everdry did indeed reimburse Robyn *** $on 12/4/13, to satisfy the amount of the water lineEverdry also gave the ***'s an extra year of warranty free of charge ($value), for any inconviences this may have causedEverdry has not heard from the ***'s since the email in November In their complaint they state that they have tried to contact Everdry several times in the past couple years, however our records show that no attempt has been made until they were recently mailed a warranty invoiceThe ***'s are not obligated to renew their warranty through Everdry yearly, it is an option to all of our customersThe ***'s have also stated that they have had 4-different contractors who have looked under their house, also there were other contractors that were working at the ***'s house during our installationEverdry has spoke with Mr*** and set up an inspection for the service manager to look at the ***'s residence on 1/14/16, to *** the area

Everdry can not comment on any of the damages that the ***'s describe until an inspection of the area takes place on 1/14/16, which Everdry and Mr*** has agreed toEverdry has reimbursed the ***'s for the only damage that the ***'s have reported and made known to EverdryEverdry is not aware of any water faucet that was damaged during our installationHowever, with other contractors working on the ***'s residence, it is hard to say when the damage was done and who damaged their faucetOnce again we have not heard from the ***'s since immediately after their installation in November The ***'s did sign off on completion of the work and satisfactory walk thru inspection, following their installation in Nov Everdry did resolve the complaint the ***'s had regarding their waterline in Nov 2013, and we are just now hearing of other issues years after installationOnce again, the extended warranty is optional to all Everdry customers, and they are not obligated to renew...Everdry does send out reminder invoices, not any demand letters

Everdry performs basement waterproofing services and supports a warranty and service agreement on work performedEverdry waterproofed the basement for Mr***, although, by the nature of water, the basement is not impermeable to water
This is the reason for warranty and the service agreementEverdry has been in situations in the past, where basement waterproofing was performed and payment was not rendered, therefore, Everdry created policy many years ago in which a cash customer (as is Mr***) is required a third of the contract price as a down payment, a third on the start of the job, and final third upon completionAt completion, the warranty and service agreement take over to support the system installedIn the case of Mr***, this policy was modified in support of Mr*** purchasing this homeIt was made known to Everdry from Mr*** that the sale of the home could not close unless the work was performedThe closing of the home was to create the funds for the waterproofingEverdry tried to have Mr*** follow the policy of a cash customer, but couldn't, due to funds coming from the closingThis put Everdry in a unique placeEverdry tried to support Mr*** by agreeing to perform waterproofing as long as proof of stipulations and fund distribution was sent to the Everdry officeAlso, it was made clear by Mr*** that the project had to be done by a specific date so he could closeEverdry accommodated by moving the planned schedule aroundAs the waterproofing was finished, closing was not for a couple of days and Everdry would have a check cut out of closingThis did not happenAt this point, there are many storiesMr*** is saying he has a cashiers check, the seller of the home says she has the check from closing, and other stories as wellEverdry is being cautious and has all conversations with all parties documented and timelinedAs Mr*** is cautious about paying and not getting work performed, although, Everdry is in a contractual obligation to support the warranty, both parties are worried about the same, lack of commitmentTo make all parties comfortable, Everdry would like Mr*** to follow the policy of Everdry's cash customerMr*** can pay Everdry the first two thirds of the contract price and keep the last third until the end of the service performedEverdry is willing to service the work, but since this project has modified practice and Mr*** and *** *** (seller) both claim to be paying Everdry under two different situations, it has caused caution relating to whether Everdry will be compensated or not

Initially, Everdry's attempts to waterproof the basement have failedWaterproofing not finishedEverdry feels they have completed a repair when ,in fact, they have notOur basement leaksOur agreement was for Everdry to waterproof the basementThis ongoing repair job has set the payment timeline into somewhat of a lapseLet it be known , funds are readily available, as mentioned, the funds for the repair were made to us upon closing the homeThe home closing did change in venue, but the funds are here to spendWe had appreciated the way Everdry began to work with us regarding timelines and payment in the pastWe feel fortunate that it rained the night they attempted their repair and we noticed water still coming in the basement walls, the repair not completeEverdry has not been here to finish the job in over thirty daysWe look at the dirt piles along the home only to know that it needs dug up again and repaired correctlyWhen I asked Everdry to accept partial payment and continue to try and waterproof the basement, they refused, wanting payment in full before they would consider returning to the property to finish the jobThis is what Everdry refers to as "warranty"What Everdy is missing is the fact that they have not provided the service statedOur basement continues to leak and it is not repairedPayment, will not fix the basementThis has been an ongoing concern of oursEverdry, asking for complete payment when services have not been renderedEverdry was here, dug holes and installed drainageThe basement continues to leakWe are willing to give Everdry half of the payment when they return to waterproof the basementCheck in hand when they get hereA photocopy of the check can be faxed to the office beforehand to relieve any idea of cautionWaterproof the basement and we will gladly pay the remaining half to complete our contractual agreement when the repairs can be verifiedIf Everdry wants paidThey will waterproof the basementThis is not difficult

After our service manager assessed the area that Mrs*** was concerned with, he found that there was no leakage in this areaMrs*** would like Everdry of Northern Indiana to replace her wallHowever we do not replace walls, nor would this fall under the guidelines of our service agreement coverage of "subsoil masonry seepage." The wall replacement is outside the scope of any work performed by Everdry of Northern IndianaHowever Everdry could recommend a local rebuild companyWe have set up an appointment for Thursday, December 17, with Mrs*** to explain this
