March 4, San Diego Revdex.com Ref: Complaint ID [redacted] Gentlemen: When I purchased this $special offer from the Fun Bike Center on 07/29/for ten boat tune ups for the life of the time I owned my boat, I requested a copy of the special offer and was told they did not have a hard copy, but that the purchase and all records were maintained on their computerI was, therefore, surprised and intrigued that as a result of my claim with the Revdex.com; the Fun Bike Center has now provided a copy of this special offer which they state was signed by meAlthough a copy of my signature appears on this scanned ‘Agreement,’ this document was never presented to me nor did I ever sign it I was told by the employee who offered and sold the tune up special to me that each of the ten tune ups was available as long as I owned my boatI never paid any money (i.e$to renew as indicated on the copy of the Agreement) after I paid the $on 07/29/and yet received tune ups on 07/29/2010, 05/02/2011, and 06/07/(see attached receipts)I do not have the original 07/29/receipt because I was told they could not print a receipt after I signed the credit card approval and it was all in their computer!! I only use the boat two or three times a year for a few hours each time and would only get a tune up once a year!! I would never have agreed to pay $for a single tune up worth about $This special was offered when the Fun Bike Center was having financial problems and needed cashNow that they have weathered the financial storm they do not want to provide the services I prepaid to them I am sure other customers have also been denied prepaid tune upsThe Revdex.com should not represent unethical businesses Sincerely, [redacted] **

HORRIBLE SERVICE DEPARTMENT ! DO NO BUY FROM HERE ! When I purchase a motorcycle from a dealership, I expect a quality repair facility & good customer service to come along with itIf or when you take a bike in to them for service you can bet on being strung along, lied to & overall completely dissatisfiedThe name of this dealership should be (The No Service Bike Center) The major manufacturer's need to check in on this sham of a business, for they would not let them put their names on the building ! [redacted] and [redacted] are the most friendly and helpful sales people to work with! I bought a motorcycle from them and they helped me ship it to HawaiiI didn't have to go the dealership, they handled all the paper work, I just coordinated the shippingEasy sale and transfer of payment and titleI would highly recommend them if you are looking for any type of motorcycle

We were sorry to hear that *** *** was not completely satisfied
with his purchase of the used Yamaha WaverunnerThere several opinions in his
complaint that we do not agree with but do understand that it how he viewed the
transactionPlease allow me to state some facts:
Many
brands like Sea-Doo and Yamaha have specific financing
for their own productsFor example if you buy a Yamaha Waverunner, Yamaha can
provide the financingIf you buy a Sea-Doo, it is most likely that the bank
Sea-Doo partners with will provide the financingIn Mr***s specific case
he states that he was trying to purchase a $5,jet skiIt was a Sea-Doo
SparkWe tried and failed to secure financing from the company that provides
the financing for Sea-DooYamaha however did provide an offer on the used
WaverunnerYou cannot purchase the $5,Sea-Doo with Yamaha’s financing
Fun Bike Center did not get paid a penny or receive any
other incentive from Yamaha (Capital One) for the loan that *** ***s agreed
toIn fact the opposite is trueFun Bike Center was charged $by
Capital One, Yamaha’s finance partner, to complete the loan*** was approved
on their tier program which is set by Capital One and Yamaha and cannot be
adjusted by the dealerFun Bike Center did not pass this charge on to ***
***sFun Bike Center absorbed the costAny statement from anyone that implies
Fun Bike Center could have provided any other APR other than the one he received
for the purchase of the used Waverunner on Tier Yamaha financing is simply
not true

This statement is obviously inaccurateIt is proven
inaccurate because FBC does retain the original signed document that was
presented to Mr*** at the time of saleThis original is a two part
documentFBC has one copy and the other copy was torn off and given to Mr *** after it was executed by both a representative
of FBC and Mr***To further collaborate our documentation, it appears that
Mr*** has a unique signatureThere would be no way to guess how he signs
his name Both the way the “*” in ***
is written and the extremely unique “***” show that this would be impossible
to guess. (This copy was already
provided to the Revdex.com on ***’s request)
After checking our records Mr*** is correctWe have no
record of him renewing his agreement after the first yearThis means that FBC
rendered services to him over and above what that required under his agreement
Even though it is our position that his claims have no base,
FBC is still committed to finding a fair resolution to this complaint *** ***General ManagerFun Bike Center***

*** ***,
I do show that you have an outstanding GAP cancellation due
to you that FBC has
processedIt looks like the cancellation was rejected by
the administratorIt should not have been rejected and you are due Typically
FBC does not complete the refund until we receive the refund from the
administratorBecause it has been so long we will issue the refund to your
lien holder within two business daysI apologize for the delay

Revdex.com:
I have spoke in detail with FBC management regarding my complaintAlthough the incident itself is inexcusable, the steps taken by management have convinced me that every effort is being taken to ensure this will not happen againI will continue to do business with FBC and would like to put this behind me.
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution would be satisfactory to me. I consider this complaint resolved

Gentlemen:
When I purchased this $999 special offer from the Fun Bike Center on 07/29/2010 for ten boat tune ups for the life of the time I owned my boat, I requested a copy of the special offer and was told they did not have a hard copy, but that the purchase and all records were maintained on their computer. I was, therefore, surprised and intrigued that as a result of my claim with the Revdex.com; the Fun Bike Center has now provided a copy of this special offer which they state was signed by me. Although a copy of my signature appears on this scanned ‘Agreement,’ this document was never presented to me nor did I ever sign it.
I was told by the employee who offered and sold the tune up special to me that each of the ten tune ups was available as long as I owned my boat. I never paid any money (i.e. $1.00 to renew as indicated on the copy of the Agreement) after I paid the $999 on 07/29/2010 and yet received tune ups on 07/29/2010, 05/02/2011, and 06/07/2012 (see attached receipts). I do not have the original 07/29/2010 receipt because I was told they could not print a receipt after I signed the credit card approval and it was all in their computer!!
I only use the boat two or three times a year for a few hours each time and would only get a tune up once a year!! I would never have agreed to pay $999 for a single tune up worth about $200. This special was offered when the Fun Bike Center was having financial problems and needed cash. Now that they have weathered the financial storm they do not want to provide the services I prepaid to them.
I am sure other customers have also been denied prepaid tune ups. The Revdex.com should not represent unethical businesses.
Sincerely,
[redacted].

Fun Bike Center has honored all terms on the agreement that was
presented to and signed by Mr [redacted]. The agreement clearly has an
expatriation date. Fun Bike Center has never offered a maintenance
agreement that was valid for the "life of the time" someone owns their
product. What type of concession would you like me to make you to put this complaint to bed? [redacted]General ManagerFun Bike Center[redacted]

I purchased a new motorcycle from the fun bike center, for 16,668.00, I rode the bike 3 time putting 53 miles on it. I didn't like the way it handled so I returned it and they bought the bike back for $9,500.this was such a ripoff. The bike was in excellent condition.

We are completely puzzled by the email we received yesterday
from you. There are many inaccurate statements that don’t make any sense at
all. We did not ask for or receive any deposit “toward the bike to cover
potential titling fees”. Fun Bike Center did not keep or loose the title to
your motorcycle. You did not pay any additional cost for the purchase of your
new motorcycle.
Please allow me to explain the facts of your motorcycle
purchase.
You completed the purchase of your new motorcycle and paid
the sale price we offered and not a penny more for any reason. The total sale
price paid was 12,996.22. This price did not include any deposit. You did
however ask Fun Bike Center to accept a trade-in toward the purchase. Fun Bike
Center was forced to decline because you could not produce the required titling
documentation for your trade. Fun Bike Center did agree that if you produced
the required documentation we would, at a later date, purchase your motorcycle
from you but it would be a completely separate transaction. Fun Bike Center
gave you this promise in writing on a document labeled “DUE BILL”. (See
attachment) You signed this document and a copy was provided to you. It makes
absolutely no sense that Fun Bike Center would keep any documentation for a
trade-in that we could not take. We both know you would have needed this
documentation to take legal ownership of your proposed trade-in.
If you cannot produce the required documentation to legally
allow us to transfer the Buell XB12s to us we would like it removed from or
property as soon as possible. If you provide us with the proper documentation
Fun Bike Center will still honor our original agreement.
DMV’s typically have a way to handle lost titles. I am not
sure how it works in Arizona but in California if a title is lost a new one can
be acquired using a document called “Duplicate Title Request”. If the vehicle
is not in your name then it will require the help of the current registered
owner.

The response back from [redacted] on the same day was:Mr. [redacted],
My apologies for any miscommunications in explaining the
title issue of the bike. The manager explained to me that the $1,000 was to
cover the potential price of having to go through the titling procedures for
the motorcycle themselves. It wasn't clearly explained to me that the $1,000
was in place of the trade-in.
However, the sales manager DID keep the original
un-notarized title that I had provided. He told me that he would be keeping the
title in the event that I could not complete the titling process through AZMVD.
I'm not quite sure how the title that I brought was lost between then and now,
but I most certainly did not leave Fun Bike with it.
If the bike is still on site, I would like to come pick it
up. That's probably the simplest resolution.
Best regards,
[redacted]
FUN BIKE CENTER response the same day:Hi [redacted],
 Thank you for your fast
response. You can pick up the Buell any time during business hours. Do you have
an idea when you will visit for the pickup?
 [redacted]
Fun Bike Center's position is that [redacted] can choose to pick up his motorcycle or produce proper documentation so that we can transfer it in our name and we will pay him the agreed upon price of $1000.
